acuerdo, cumplan con los siguientes requisitos:\n\n(*)(Nota de Sinalevi: Mediante el acuerdo N°\nA.J.D.L.P./016-2010 del 15 de enero de 2010, se establece como plazo último,\ndefinitivo e improrrogable en la presentación de requisitos para la obtención\nde licencias de pesca por primera vez, el día 28 de febrero de 2010)\n\na) Fórmula de solicitud\ndebidamente completada.\n\nb) Presentar cédula de identidad\nvigente en original y aportar fotocopia por ambos lados o cédula de residencia\nvigente, y aportar fotocopia completa.\n\nc) Aportar una certificación de\npropiedad de la embarcación a su nombre, del Registro Nacional de Buques\nvigente, con no más de dos meses calendario de haber sido emitida.\n\nd) Presentar Certificado de\nNavegabilidad vigente, en original y aportar fotocopia.\n\ne) Cancelar el canon\ncorrespondiente por Carné de Pesca Comercial o presentar dicho carné vigente.\n\nf)  Fotografía de la embarcación\npor ambos lados, rotulada debidamente con el nombre, número de matrícula y\nbandera.\n\ng) Presentar documento emitido\npor la CCSS de que está al día con sus obligaciones de la seguridad social.\n\nh) Certificación emitida por la\nCCSS, de que no se encuentra inscrito como trabajador asalariado con algún\npatrono.\n\ni)  Cancelar y acreditar la\ndebida inspección de la embarcación, realizada por funcionarios del INCOPESCA.\n\nj)  Cancelar el canon\ncorrespondiente por derecho a la Licencia de Pesca Comercial.\n\nk) Presentar documentación idónea\nque demuestre que tiene al menos tres años de ejercer la actividad de pesca en\nforma continua.\n\nPara los efectos anteriores el INCOPESCA se apoyará\nen las recomendaciones y demás documentación remitida al INCOPESCA por las\nComisiones Asesoras Regionales.\n\nExcepcionalmente\naquellas personas físicas que por alguna razón no aparecieren en los listados\ncorrespondientes del registro realizado por el INCOPESCA y que cumplan con los\nrequisitos señalados anteriormente, podrán presentar la documentación\ncorrespondiente dentro del mismo plazo citado.\n\nArtículo 2º-La sola\npresentación de la documentación requerida por parte de los interesados, no\ndará lugar a la obtención de la licencia, la cual estará condicionada a la\nverificación y valoración que realice el INCOPESCA a través de las instancias y\nmecanismos correspondientes.\n\nArtículo 3º-La\npresentación de documentos por parte del interesado será de manera personal y\npara ello, deberán presentarse a la oficina regional o subregional del\nINCOPESCA más cercana a su base de operación, sin embargo se autoriza a los\ndirectores o jefes regionales o subregionales, el desplazamiento de\nfuncionarios a las comunidades pesqueras de manera previamente programada y\ncomunicada a través del Departamento de Extensión y Capacitación, para lograr\nuna mayor cobertura y efectividad en la aplicación del presente acuerdo.\n\nArtículo 4º-El\nINCOPESCA rechazará de manera inmediata, todas aquellas solicitudes en las que\nse logre determinar de conformidad con los registros que obran en la\nInstitución, de aquellos interesados que obtuvieron en el pasado una Licencia\nde Pesca Comercial y decidieron traspasarla en los últimos 5 años calendario\nanteriores a la vigencia del presente acuerdo o bien que mantengan deudas con\nla Institución.\n\nArtículo 5º-Para\nlos efectos pertinentes el INCOPESCA ha dividido el Golfo de Nicoya en 3 zonas, a saber:\n\n \n\nZona A (Golfo\nInterior): Es el área comprendida entre una línea recta\nimaginaria que va desde el Muelle de Cruceros de Puntarenas (9º58'26\" Latitud Norte,\n84º49'51\" Longitud Oeste), hasta el Faro ubicado en la parte más oriental de\nlas Islas Negritos (09º49'14\" Latitud Norte, 84º49'35\" Longitud Oeste) y de\nesta línea bordeando la costa hacia el interior del Golfo hasta llegar a una\nlínea recta imaginaria entre Puerto Níspero (10º12'7\" Latitud Norte, 85º13'9\"\nLongitud Oeste) y Puerto Moreno (10º12'4\" Latitud Norte, 85º14'75\" Longitud\nOeste) en la desembocadura del Río Tempisque.\n\n \n\nZona B (Golfo\nMedio): Es el área comprendida entre una línea recta\nimaginaria que va desde Punta Agujas en la desembocadura del Río Agujas\n(9º43'54\" Latitud Norte, 84º57'00\" Longitud Oeste), hasta el Faro ubicado en la\nparte más oriental de las Islas Negritos (9º48'18\" Latitud Norte 84º49'48\"\nLongitud Oeste) y de esta línea al límite con la zona anterior.\n\n \n\nZona C (Golfo\nExterior): Es el área comprendida entre una línea recta\nimaginaria que va desde la Isla Herradura (9º37'48\" Latitud Norte, 84º39'54\"\nLongitud Oeste), hasta la Punta de Cabo Blanco (9º33'24\" Latitud Norte,\n85º06'47\" Longitud Oeste) y de esta línea hasta el límite con la zona anterior.\n\nArtículo 6º-Los\nmétodos y artes de pesca que el INCOPESCA autorizará en estas licencias,\nresponderán a\n\nArtículo 7º-No se\nautoriza a nivel nacional la captura y descarga por parte de los\npermisionarios, así como la compra, transporte, industrialización y venta por\nparte de los centros de acopio o puestos de recibo, pescaderías, supermercados\ny plantas procesadoras, de las siguientes especies provenientes del litoral\npacífico costarricense y de embarcaciones pertenecientes a la Flota Artesanal\nen Pequeña Escala:\n\n \n\n \n\n| Especie | por\nparte de los permisionarios, así como la compra, transporte, industrialización\ny venta por parte de los centros de acopio o puestos de recibo, pescaderías,\nsupermercados y plantas procesadoras, de producto provenientes del litoral\npacífico costarricense y de embarcaciones pertenecientes a la Flota\nSemi-Industrial Camaronera, para lo cual el INCOPESCA procederá a certificar su\norigen.\n\nArtículo 9º-Artes\nde pesca autorizados en las presentes licencias:\n\n \n\nA. Pesca de Escama y\n\n500\n metros medida de punta a punta y un máximo de 200\nanzuelos circulares.\n\n.  Nasas para captura de peces y\n\n3000\n metros medida de punta a punta y un máximo de 1200\nanzuelos circulares.\n\n.  Línea de superficie con una\nlongitud máxima de 3000\n metros medida de punta a punta y un máximo de 1200\nanzuelos circulares.\n\n.  Nasas para captura de peces y\n\n3000\n metros medida de punta a punta y un máximo de 1200\nanzuelos circulares.\n\n.  Línea de superficie con una\nlongitud máxima de 5000\n metros medida de punta a punta y un máximo de 1500\nanzuelos circulares.\n\n \n\nD. Pesca de Escama y\ncrustáceos en el Litoral Caribe costarricense:\n\na) Se permitirá como artes de\npesca las siguientes:\n\n.  Cuerdas de mano con anzuelos\ncirculares.\n\n.  Nazas para captura de peces y\ncrustáceos (Langosta y Camarón).\n\n.  Línea planera (de fondo) con\nuna longitud máxima de 3000\n metros medida de punta a punta y un máximo de 1200\nanzuelos circulares en la totalidad de esa longitud.\n\n.  Línea de superficie con una\nlongitud máxima de 5000\n metros medida de punta a punta, y un máximo de 1500\nanzuelos circulares.\n\n \n\nE. Pesca\nde Grandes Pelágicos en el Litoral Pacífico costarricense y fuera de sus aguas\njurisdiccionales: Para otras embarcaciones distintas a las\nartesanales en pequeña escala, se aplicarán los métodos y artes de pesca\nestablecidos en la normativa vigente.\n\nDisposiciones\nGenerales\n\n \n\nArtículo 10.-El INCOPESCA\ncoordinará con las autoridades competentes, a efectos de prohibir la\nimportación de redes agalleras con luz de malla inferiores o mayores a las\npermitidas en la normativa vigente.\n\nArtículo 11.-El\nINCOPESCA coordinará con el Ministerio de Obras Públicas y Transportes y el\nMinisterio de Justicia, a fin de que de previo a la inspección técnica e ins\n\nArtículo 12.- El INCOPESCA\nno autorizará el traspaso de licencias de primera vez otorgadas al amparo de la\npresente regulación, hasta tanto no se cumpla el plazo de vigencia inicial de\nlas mismas, sea de 6 años, salvo las siguientes situaciones: muerte o\nincapacidad física permanente del permisionario debidamenacreditada, o tratándose\nde traspaso por donación entre familiares hasta segundo grado de consanguinidad\ndebidamente demostrado, sin que medie ánimo de lucro.\n\n (Así\n reformado mediante acuerdo N° AJDIP/307 del 9 de agosto del 2013)\n\nArtículo 13.-La inobservancia a lo establecido en la presente\nregulación será sancionada de conformidad con lo dispuesto en la Ley Nº 8436,\nLey de Pesca y Acuicultura y cualquier otra disposición pesquera vigente.\n\nArtículo 14.-Corresponderá al Departamento de Extensión y Capacitación\ndel INCOPESCA, la debida divulgación de los términos y alcances del presente\nacuerdo.\n\nArtículo 15.-Deróguese toda aquella normativa pesquera anterior que se\noponga a las disposiciones establecidas en el presente acuerdo.\n\nArtículo 16.-Rige a partir de su publicación en el Diario Oficial La\nGaceta.\n\nTransitorio\nI.-El INCOPESCA deberá según corresponda para las diferentes pesquerías y\nlicencias, estandarizar el uso de los métodos y artes de pesca establecidas en\nel presente Acuerdo, para todas las licencias de pesca comercial, pertenecientes\na la flota pesquera nacional al plazo de vencimiento de la licencia, excepto\npara la pesca turística.\n\nTransitorio\nII.-A partir del vencimiento del plazo de vigencia de cada licencia todas las\nartes deberán haber sido modificadas y ajustadas o en su defecto, deberán ser\ndestruidas no sin antes aprovechar cualquier tipo de material (mecates, boyas,\nplomos u otros) y el INCOPESCA coordinará con las autoridades policiales\ncompetentes, así como con pescadores que se sometan a la responsabilidad de\nconservar para las futuras generaciones las especies que estén dentro del Golfo\nde Nicoya, para el decomiso y destrucción de aquellas artes que no Present a document issued by the CCSS showing they are up to date with their social security obligations.\n\nh) Certification issued by the CCSS, stating that they are not registered as a salaried worker under any employer.\n\ni) Pay for and accredit the due inspection of the vessel, carried out by officials of INCOPESCA.\n\nj) Pay the corresponding fee for the right to the Commercial Fishing License.\n\nk) Present suitable documentation proving that they have engaged in fishing activity continuously for at least three years.\n\nFor the above purposes, INCOPESCA will rely on the recommendations and other documentation sent to INCOPESCA by the Regional Advisory Commissions.\n\nExceptionally, those natural persons who, for some reason, do not appear in the corresponding lists of the registry carried out by INCOPESCA and who meet the requirements indicated above, may submit the corresponding documentation within the same period cited.\n\nArticle 2-The mere presentation of the required documentation by the interested parties will not give rise to the granting of the license, which will be conditional upon the verification and assessment carried out by INCOPESCA through the corresponding instances and mechanisms.\n\nArticle 3-The presentation of documents by the interested party shall be in person and, for this purpose, they must appear at the regional or subregional office of INCOPESCA closest to their operational base; however, regional or subregional directors or chiefs are authorized to deploy officials to fishing communities in a previously scheduled manner, communicated through the Extension and Training Department, to achieve greater coverage and effectiveness in the application of this agreement.\n\nArticle 4-INCOPESCA will immediately reject all those applications in which it is determined, in accordance with the records held by the Institution, that the interested parties obtained a Commercial Fishing License in the past and decided to transfer it in the last 5 calendar years prior to the effectiveness of this agreement, or who maintain debts with the Institution.\n\nArticle 5-For the pertinent purposes, INCOPESCA has divided the Gulf of Nicoya into 3 zones, namely:\n\n \n\nZone A (Inner Gulf): Is the area between an imaginary straight line running from the Puntarenas Cruise Ship Pier (9º58'26\" North Latitude, 84º49'51\" West Longitude), to the Lighthouse located on the easternmost part of Islas Negritos (09º49'14\" North Latitude, 84º49'35\" West Longitude), and from this line along the coast towards the interior of the Gulf up to an imaginary straight line between Puerto Níspero (10º12'7\" North Latitude, 85º13'9\" West Longitude) and Puerto Moreno (10º12'4\" North Latitude, 85º14'75\" West Longitude) at the mouth of the Tempisque River.\n\n \n\nZone B (Middle Gulf): Is the area between an imaginary straight line running from Punta Agujas at the mouth of the Agujas River (9º43'54\" North Latitude, 84º57'00\" West Longitude), to the Lighthouse located on the easternmost part of Islas Negritos (9º48'18\" North Latitude 84º49'48\" West Longitude), and from this line to the boundary with the previous zone.\n\n \n\nZone C (Outer Gulf): Is the area between an imaginary straight line running from Isla Herradura (9º37'48\" North Latitude, 84º39'54\" West Longitude), to Punta de Cabo Blanco (9º33'24\" North Latitude, 85º06'47\" West Longitude), and from this line to the boundary with the previous zone.\n\nArticle 6-The fishing methods and gear that INCOPESCA will authorize in these licenses shall respond to\n\nArticle 7-The capture and landing by permit holders is not authorized nationally, nor is the purchase, transport, industrialization, and sale by collection centers or receiving posts, fish markets, supermarkets, and processing plants, of the following species from the Costa Rican Pacific littoral and from vessels belonging to the Small-Scale Artisanal Fleet:\n\n \n\n \n\n| Species | nationally, as well as the purchase, transport, industrialization, and sale by collection centers or receiving posts, fish markets, supermarkets, and processing plants, of product originating from the Costa Rican Pacific littoral and from vessels belonging to the Semi-Industrial Shrimp Fleet, for which purpose INCOPESCA will proceed to certify its origin.\n\nArticle 9-Fishing gear authorized in these licenses:\n\n \n\nA. Scale Fishing and\n\n500\n meters measured from tip to tip and a maximum of 200\ncircle hooks.\n\n. Traps for the capture of fish and\n\n3000\n meters measured from tip to tip and a maximum of 1200\ncircle hooks.\n\n. Surface longline with a maximum length of 3000\n meters measured from tip to tip and a maximum of 1200\ncircle hooks.\n\n. Traps for the capture of fish and\n\n3000\n meters measured from tip to tip and a maximum of 1200\ncircle hooks.\n\n. Surface longline with a maximum length of 5000\n meters measured from tip to tip and a maximum of 1500\ncircle hooks.\n\n \n\nD. Fishing for Scale Fish and Crustaceans on the Costa Rican Caribbean Littoral:\n\na) The following fishing gear will be permitted:\n\n. Hand lines with circle hooks.\n\n. Traps for the capture of fish and crustaceans (Lobster and Shrimp).\n\n. Bottom longline with a maximum length of 3000\n meters measured from tip to tip and a maximum of 1200\ncircle hooks along the entirety of that length.\n\n. Surface longline with a maximum length of 5000\n meters measured from tip to tip, and a maximum of 1500\ncircle hooks.\n\n \n\nE. Fishing for Large Pelagics on the Costa Rican Pacific Littoral and outside its jurisdictional waters: For vessels other than small-scale artisanal vessels, the fishing methods and gear established in the current regulations shall apply.\n\nGeneral Provisions\n\n \n\nArticle 10.-INCOPESCA will coordinate with the competent authorities to prohibit the importation of gillnets with a mesh size smaller or larger than those permitted in the current regulations.\n\nArticle 11.-INCOPESCA will coordinate with the Ministry of Public Works and Transport and the Ministry of Justice, so that prior to the technical inspection and ins\n\nArticle 12.- INCOPESCA will not authorize the transfer of first-time licenses granted under this regulation, until the initial term of validity of the same has been completed, that is, 6 years, except in the following situations: death or permanent physical incapacity of the permit holder, duly accredited, or in the case of transfer by donation between relatives up to the second degree of consanguinity, duly demonstrated, without any profit motive involved.\n\n (Thus amended by agreement No. AJDIP/307 of August 9, 2013)\n\nArticle 13.-Failure to comply with the provisions established in this regulation shall be sanctioned in accordance with the provisions of Law No. 8436, the Fisheries and Aquaculture Law, and any other current fisheries provision.\n\nArticle 14.-The Extension and Training Department of INCOPESCA shall be responsible for the proper dissemination of the terms and scope of this agreement.\n\nArticle 15.-Any prior fisheries regulations that conflict with the provisions established in this agreement are hereby repealed.\n\nArticle 16.-It shall be effective upon its publication in the Official Gazette La Gaceta.\n\nTransitory Provision I.-INCOPESCA must, as applicable for the different fisheries and licenses, standardize the use of the fishing methods and gear established in this Agreement for all commercial fishing licenses belonging to the national fishing fleet upon the expiration date of the license, except for sport fishing.\n\nTransitory Provision II.-Upon the expiration of the validity period of each license, all gear must have been modified and adjusted, or failing that, it must be destroyed, but not before utilizing any type of material (ropes, buoys, weights, or others), and INCOPESCA will coordinate with the competent police authorities, as well as with fishers who accept the responsibility of conserving for future generations the species that are within the Gulf of Nicoya, for the seizure and destruction of those gear items that do not meet the regulatory characteristics, when they are found on board vessels, whether at sea or on land." }
