Asimismo, está obligado a propiciar un\ndesarrollo económico y ambientalmente sostenible, entendido como el desarrollo\nque satisface las necesidades humanas básicas, sin comprometer las opciones de\nlas generaciones futuras.\n\n \n\n2º-Que\nel Fondo Forestal creado mediante la\n Ley Nº 7575, publicada en el Alcance Nº 21 a\nLa Gaceta Nº 72 de 16\nde abril de 1996 y sus reformas, está administrado por el Sistema Nacional de\nÁreas de Conservación, según lo establecido en\nla Ley Nº 7788, publicada en\nLa Gaceta Nº 101 de\n27 de mayo de 1998 y sus reformas.\n\n \n\n3º-Que\npor medio del oficio DM-602-2009 de 21 de abril de 2009, el Ministro de\nAmbiente, Energía y Telecomunicaciones, solicita ampliar el gasto\npresupuestario máximo del Fondo Forestal en ¢70.570.024,00 (setenta millones\nquinientos setenta mil veinticuatro colones exactos), con el fin de atender\ngastos inherentes a las necesidades del área forestal y cubrir gastos de\nhospedaje y alimentación de los funcionarios que laboran en las actividades de\ncontrol y protección forestal.\n\n \n\n4º-Que\ndicho monto se financiará con superávit libre institucional y servirá para\natender erogaciones relacionadas con gastos de hospedaje y alimentación de los\nfuncionarios que laboran en actividades de control y protección forestal;\nadquisición de equipo de trabajo como cintas diamétricas; clinómetros;\nbrújulas, entre otros, destinados a Áreas de Conservación; equipo de\ntransportes para actividades de supervisión y control forestal; y adquisición\nde equipos de posicionamiento global.\n\n \n\n5º-Que\nmediante el Decreto Ejecutivo Nº 32452-H, publicado en\nLa Gaceta Nº 130 de 6\nde julio de 2005 y sus reformas, se emite el \"Lineamiento para la aplicación\ndel Artículo 6 de la Ley Nº\n8131 de la\n Administración Financiera de\nla República y Presupuestos\nPúblicos y la regulación de la clase de ingresos del Sector Público denominada\nFinanciamiento\".\n\n \n\n6º-Que\nel artículo 7 del decreto citado en el considerando anterior, dispone que los\nrecursos de financiamiento que provienen de vigencias anteriores -superávit\nlibre- son parte del patrimonio de los órganos y las entidades y pueden\nutilizarlo en períodos subsiguientes para financiar gastos que se refieran a la\nactividad ordinaria de éstas, con los cuales se atienda el interés de la\ncolectividad, el servicio público y los fines institucionales, siempre que\n-como en el presente caso- no tengan el carácter permanente o generen una\nobligación que requiera financiarse a través del tiempo, como la creación de\nplazas para cargos fijos, o cualquier otro compromiso de la misma naturaleza.\n\n \n\n7º-Que\nmediante el Decreto Ejecutivo Nº 34404-H, publicado en\nLa Gaceta Nº 56 de 19\nde marzo de 2008 y sus reformas, se emitieron las Directrices Generales de\nPolítica Presupuestaria para el año 2009, estableciéndose en el artículo 1º del\ncitado Decreto, el gasto presupuestario del año 2009 para las entidades\ncubiertas por el ámbito de\nla Autoridad Presupuestaria.\n\n \n\n8º-Que\ncon el Decreto Ejecutivo Nº 35047-H, publicado en\nLa Gaceta Nº 79 de 24\nde abril de 2009, se amplió el gasto presupuestario máximo autorizado al Fondo\nForestal para el año 2009, el cual se fijó en ¢427.587.227,00 (cuatrocientos\nveintisiete millones quinientos ochenta y siete mil doscientos veintisiete\ncolones exactos), cifra que no contempla los gastos indicados en el\nconsiderando 4 de este decreto.\n\n \n\n9º-Que\npor lo anterior, resulta necesario modificar el gasto presupuestario máximo\nfijado al Fondo Forestal para el año 2009, incrementándolo en la suma de\n¢70.570.024,00 (setenta millones quinientos setenta mil veinticuatro colones\nexactos). Likewise, it is obligated to foster economically and environmentally sustainable development, understood as development that satisfies basic human needs, without compromising the options of future generations.\n\n \n\n2º-That the Forestry Fund (Fondo Forestal) created by Law Nº 7575, published in Alcance Nº 21 to La Gaceta Nº 72 of April 16, 1996 and its amendments, is administered by the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), as established in Law Nº 7788, published in La Gaceta Nº 101 of May 27, 1998 and its amendments.\n\n \n\n3º-That through official communication DM-602-2009 of April 21, 2009, the Minister of Environment, Energy, and Telecommunications requests to increase the maximum budget expenditure of the Forestry Fund (Fondo Forestal) by ¢70,570,024.00 (seventy million five hundred seventy thousand twenty-four colones exact), in order to meet expenses inherent to the needs of the forestry area and cover lodging and meal expenses for officials working in forestry control and protection activities.\n\n \n\n4º-That said amount will be financed with institutional free surplus (superávit libre) and will serve to meet outlays related to lodging and meal expenses for officials working in forestry control and protection activities; acquisition of work equipment such as diameter tapes; clinometers; compasses, among others, destined for Conservation Areas; transportation equipment for forestry supervision and control activities; and acquisition of global positioning equipment.\n\n \n\n5º-That by means of Decreto Ejecutivo Nº 32452-H, published in La Gaceta Nº 130 of July 6, 2005 and its amendments, the \"Guideline for the application of Article 6 of Law Nº 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the class of public sector income called Financing\" is issued.\n\n \n\n6º-That Article 7 of the decree cited in the preceding considering states that financing resources coming from prior periods—free surplus (superávit libre)—are part of the equity of the organs and entities and can be used in subsequent periods to finance expenditures related to the ordinary activity thereof, which serve the interest of the community, the public service, and institutional purposes, provided that—as in the present case—they are not permanent in nature or generate an obligation that requires financing over time, such as the creation of positions for fixed posts, or any other commitment of the same nature.\n\n \n\n7º-That by means of Decreto Ejecutivo Nº 34404-H, published in La Gaceta Nº 56 of March 19, 2008 and its amendments, the General Budget Policy Guidelines for the year 2009 were issued, establishing in Article 1 of said Decree the budget expenditure for the year 2009 for the entities covered by the scope of the Budgetary Authority (Autoridad Presupuestaria).\n\n \n\n8º-That with Decreto Ejecutivo Nº 35047-H, published in La Gaceta Nº 79 of April 24, 2009, the maximum budget expenditure authorized for the Forestry Fund (Fondo Forestal) for the year 2009 was increased, which was set at ¢427,587,227.00 (four hundred twenty-seven million five hundred eighty-seven thousand two hundred twenty-seven colones exact), a figure that does not contemplate the expenditures indicated in considering 4 of this decree.\n\n \n\n9º-That due to the foregoing, it is necessary to modify the maximum budget expenditure set for the Forestry Fund (Fondo Forestal) for the year 2009, increasing it by the sum of ¢70,570,024.00 (seventy million five hundred seventy thousand twenty-four colones exact). Therefore;\n\n \n\nDecree:\n\n \n\nArticle 1º-The maximum budget expenditure for the Forestry Fund (Fondo Forestal) for 2009, established in Decreto Ejecutivo Nº 35047-H, published in La Gaceta Nº 79 of April 24, 2009, is hereby modified, leaving the maximum budget expenditure limit at the sum of ¢498,157,251.00 (four hundred ninety-eight million one hundred fifty-seven thousand two hundred fifty-one colones exact), for that period.\n\nArticle 2º-It is the responsibility of the active administration (administración activa) of the Forestry Fund (Fondo Forestal) to comply with the provisions of Article 6 of Law Nº 8131, Law of the Financial Administration of the Republic and Public Budgets, published in La Gaceta Nº 198 of October 16, 2001 and its amendments, as well as in Decreto Ejecutivo Nº 32452-H, published in La Gaceta Nº 130 of July 6, 2005 and its amendments.\n\nArticle 3º-This Decree shall be effective as of its publication.\n\n \n\nGiven at the Presidency of the Republic, on the eighteenth day of June of the year two thousand nine." }
