ACUICULTURA\n\nINSTITUTO COSTARRICENSE DE PESCA Y\nACUICULTURA\n\n \n\nAJDIP/251-2009.-Puntarenas a los siete días del\nmes de agosto del 2009\n\n \n\nConsiderando:\n\n \n\n1º-Que de\nconformidad con la Ley Nº 7384 y la Ley Nº 8436, son funciones del INCOPESCA,\ncoordinar al sector pesquero, promover y ordenar el desarrollo de la pesca, la\ncaza marítima y la investigación, así mismo, fomentar, sobre la base de\ncriterios técnicos y científicos, la conservación, el aprovechamiento y el uso\nsostenible de los recursos biológicos del mar.\n\n2º-Que\ndentro de las atribuciones del INCOPESCA están las de controlar la pesca y la\ncaza de especies marinas en aguas jurisdiccionales, determinar las especies de\norganismos marinos que podrían explotarse comercialmente, establecer el número\nde licencias y sus regulaciones, así como, las limitaciones técnicas que se han\nde incorporar a estas, determinar los períodos y áreas de veda, así como, las\nespecies y tamaños cuya captura está restringida o prohibida.\n\n3º-Que\nel Golfo Dulce es un cuerpo de agua semi-cerrado de origen tectónico de\naproximadamente 50 Km de largo por 10 a 15 Km de\nancho y que rodeado de cientos de hectáreas de bosque primario es la zona\nmarino costera más pristina y mejor conservada de\nnuestro país, cuya belleza e importancia ambiental es reconocida a nivel\nmundial.\n\n4º-Que\nsu condición de fiordo tropical justifica su importancia biológico-pesquera y\npor lo tanto no es conveniente la utilización de métodos de pesca no\nsostenibles que pongan en peligro su biodiversidad marina.\n\n5º-Que\nestas condiciones especiales convierten al Golfo Dulce en un sitio adecuado\npara ser declarado y manejado bajo el concepto de Área Marina de Pesca\nResponsable, reglamentado por el INCOPESCA mediante Acuerdo AJDIP/138-2007, en\nla cual únicamente se permita el uso de artes de pesca sostenibles que\ngaranticen la recuperación de los \nrecursos pesqueros.\n\n6º-Que\nuno de los objetivos primordiales de las Áreas Marinas de Pesca responsable es\nla gestión para el uso sostenible a largo plazo de los recursos pesqueros.\n\n7º-Que\nmediante solicitud expresa dirigida a la Junta Directiva del INCOPESCA, de seis\norganizaciones de pescadores artesanales y una organización de pesca turística\nque faenan dentro del Golfo Dulce, propusieron formalmente un proceso de tres\netapas para la conformación del Área Marina de Pesca Responsable Golfo Dulce en\nla cual no se permita la pesca industrial ni semi-industrial, ni el uso de\nningún otro tipo de redes de arrastre para realizar las faenas de pesca.\n\n8º-Que\ncada región del litoral pacífico requiere medidas de ordenación particulares.\n\n9º-Que\nla ordenación de la pesca debe fomentar el mantenimiento de la calidad, la\ndiversidad y disponibilidad de los recursos pesqueros en cantidad suficiente\npara las generaciones presentes y futuras, en el contexto de la seguridad\nalimentaria, el alivio de la pobreza, y el desarrollo sostenible. Las medidas\nde ordenación deben asegurar la conservación no sólo de las especies objetivo,\nsino también de aquellas especies pertenecientes al mismo ecosistema o dependientes\nde ellas o que están asociadas con ellas.\n\n10.-Que\nel INCOPESCA en uso de sus facultades permitidas por la ley y los reglamentos\nnacionales, contando con la colaboración de otras instancias, desarrolló un\nproceso de consulta para la toma de decisiones de forma transparente, con la\nefectiva participación de la industria y el sector artesanal que vino a\nproporcionar soluciones oportunas a cuestiones urgentes en el Golfo Dulce y\nadicional se cuenta con un criterio técnico positivo respecto a las medidas a\nimplementar en dicha aérea, emitida por la subdirección general técnica del\nINCOPESCA mediante oficio SDGT 091-07-2009.\n\n11.-Que reconociendo en quienes ejecutan la pesca artesanal en\npequeña escala su importante contribución al empleo, los ingresos y la\nseguridad alimentaria; se debe proteger apropiadamente el derecho de estas\npersonas, a un sustento seguro y justo, proporcionando acceso preferencial,\ncuando proceda, a los recursos pesqueros que explotan tradicionalmente, así\ncomo a las zonas tradicionales de pesca en las aguas de nuestra jurisdicción\nnacional.\n\n \n\nPor tanto, se\nacuerda:\n\n \n\nArtículo 1º-Acoger\nla petición que seis organizaciones de pescadores artesanales y declare the establishment of Golfo Dulce as the Golfo Dulce Marine Area of Responsible Fishing**\n\n**Complete Text of Minutes: C8126**\n\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\nCOSTA RICAN INSTITUTE OF FISHERIES AND\nAQUACULTURE\n\nAJDIP/251-2009.-Puntarenas on the seventh day of\nAugust 2009\n\nConsidering:\n\n1º-That in accordance with Ley Nº 7384 and Ley Nº 8436, the functions of INCOPESCA are to coordinate the fishing sector, promote and regulate the development of fishing, marine hunting, and research, as well as to promote, on the basis of technical and scientific criteria, the conservation, exploitation, and sustainable use of the biological resources of the sea.\n\n2º-That among the powers of INCOPESCA are those of controlling fishing and the hunting of marine species in jurisdictional waters, determining the species of marine organisms that may be commercially exploited, establishing the number of licenses and their regulations, as well as the technical limitations to be incorporated into them, and determining the periods and areas of closure (veda), as well as the species and sizes whose capture is restricted or prohibited.\n\n3º-That Golfo Dulce is a semi-enclosed body of water of tectonic origin, approximately 50 Km long by 10 to 15 Km wide, and that, surrounded by hundreds of hectares of primary forest, it is the most pristine and best-conserved marine-coastal zone in our country, whose beauty and environmental importance is recognized worldwide.\n\n4º-That its condition as a tropical fjord justifies its biological-fishery importance, and therefore the use of non-sustainable fishing methods that endanger its marine biodiversity is not advisable.\n\n5º-That these special conditions make Golfo Dulce an appropriate site to be declared and managed under the concept of a Marine Area of Responsible Fishing (Área Marina de Pesca Responsable), regulated by INCOPESCA through Acuerdo AJDIP/138-2007, in which only the use of sustainable fishing arts (artes de pesca) that guarantee the recovery of fishery resources is permitted.\n\n6º-That one of the primary objectives of Marine Areas of Responsible Fishing is the management for the long-term sustainable use of fishery resources.\n\n7º-That through an express request addressed to the Board of Directors of INCOPESCA, six artisanal fishing organizations and one tourism fishing organization that operate within Golfo Dulce formally proposed a three-stage process for the establishment of the Golfo Dulce Marine Area of Responsible Fishing, in which industrial and semi-industrial fishing would not be permitted, nor the use of any other type of trawl nets (redes de arrastre) to carry out fishing activities.\n\n8º-That each region of the Pacific coastline requires particular management measures.\n\n9º-That fishery management must promote the maintenance of the quality, diversity, and availability of fishery resources in sufficient quantities for present and future generations, in the context of food security, poverty alleviation, and sustainable development. Management measures must ensure the conservation not only of target species, but also of those species belonging to the same ecosystem or dependent on them or that are associated with them.\n\n10.-That INCOPESCA, in use of its powers permitted by law and national regulations, with the collaboration of other entities, developed a consultation process for transparent decision-making, with the effective participation of industry and the artisanal sector, which provided timely solutions to urgent issues in Golfo Dulce, and additionally, there is a positive technical opinion regarding the measures to be implemented in said area, issued by the subdirección general técnica of INCOPESCA through official letter SDGT 091-07-2009.\n\n11.-That recognizing in those who carry out small-scale artisanal fishing their important contribution to employment, income, and food security, the right of these persons to a secure and just livelihood must be appropriately protected, providing preferential access, where appropriate, to the fishery resources they traditionally exploit, as well as to traditional fishing zones in the waters under our national jurisdiction.\n\nTherefore, it is agreed:\n\nArticle 1º-To accept the petition that six artisanal fishing organizations and one tourism fishing organization that operate within Golfo Dulce made to the Board of Directors of INCOPESCA, by virtue of which they formally proposed a three-stage process for the declaration of the establishment of Golfo Dulce as the Golfo Dulce Marine Area of Responsible Fishing, in which industrial and semi-industrial fishing would not be permanently permitted, nor the use of any other type of trawl nets to carry out fishing activities, and to order that the procedures and actions be carried out that allow, upon fulfillment of the respective requirements, the official declaration of said area as a Marine Area of Responsible Fishing.\n\nArticle 2º-To prohibit trawling with industrial and semi-industrial vessels, and the use of any other type of trawl nets to carry out fishing activities, in Golfo Dulce, from an imaginary line established at its mouth or entrance from Cabo Matapalo (GPS coordinates 08º 22' 20\"60 N and 083º17'16\" W) to Punta Banco (GPS coordinates 08º22'19\" N and 083º09'08\"60 W), and from this imaginary line inland in a north-northwest direction, encompassing its interior zone in its totality, so that it immediately becomes a zone in which its resources are used exclusively for artisanal fishing, tourism-sport fishing, permanently prohibiting the industrial and semi-industrial fishing fleet from any fishing modality, and any other that intends to use trawl nets.\n\nArticle 3º-To entrust the Executive Presidency of INCOPESCA to immediately carry out the pertinent steps before the President of the Republic and the Minister of Agriculture and Livestock so that the Decreto Ejecutivo No. 17933-MAG dated December 21, 1987, is modified so that it conforms to the new provisions approved by INCOPESCA.\n\nFirm agreement." }
