P./255-2009.-Puntarenas,\na los catorce días del mes de agosto del 2009.\n\n \n\nConsiderando:\n\n \n\n            I.-Que de conformidad con\nla Ley Nº 7384, Ley de Creación\ndel INCOPESCA y la Ley Nº\nLey de Pesca y Acuicultura, es atribución y competencia del INCOPESCA\nestablecer conforme a criterios técnicos, científicos, económicos y sociales,\nlas zonas o épocas de veda, sea por área especies determinadas, a fin de\nproteger y aprovechar los recursos hidrobiológicos de manera sostenible.\n\n \n\nII.-Que los programas de asistencia\nsocioeconómica diseñados con tal propósito, a favor pescadores que se vean\nafectados en los períodos de veda, implicarán necesariamente servicios de\ntrabajo comunal por parte de los beneficiarios; razón por la cual es necesario\ndefinir las formas o alternativas que resulten razonables, oportunas y\nconvenientes para la realización de dicho trabajo comunal y su verificación y\nsupervisión por parte del INCOPESCA para los fines correspondientes.\n\n \n\n            III.-Que\nde conformidad con el artículo 36 de\nla Ley Nº 8436, Ley de Pesca y Acuicultura, el\nEjecutivo podrá autorizar el destino de fondos del Presupuesto Nacional a favor\ndel Instituto de Ayuda Social (IMAS), con el propósito de desarrollar programas\nde asistencia socioeconómico diseñados especialmente con tal propósito, a favor\nde los pescadores que se vean afectados períodos de veda, siempre que se\ncompruebe que no tienen otras fuentes de ingresos y se encuentre en condición\nde pobreza coyuntural. Por tanto,\n\n \n\nLA JUNTA DIRECTIVA DEL INCOPESCA\n\n \n\nACUERDA:\n\n \n\nAprobar las:\n\n \n\n\"Regulaciones generales para la\nrealización del Servicio de Trabajo\n\n \n\nComunal, por parte los\npescadores afectados durante\n\n \n\nlos períodos de veda acordados\n\n \n\npor el INCOPESCA\"\n\n \n\n            Artículo 1º-Todo aquel pescador que\nse vea afectado durante las vedas acordadas por INCOPESCA, para recibir\ncualquier tipo de asistencia económica sea a través del IMAS, de cualquier otra\nInstitución Estatal u Organización No Gubernamental, estará en la obligación\ncumplir con la realización del Servicio de Trabajo Comunal, en adelante\ndenominado STC y el cual será coordinado y supervisado por el INCOPESCA en\nconjunto con la entidad que provea los recursos económicos para ese fin\n\n            Artículo\n2º-Para los efectos de lo indicado en el artículo anterior, los pescadores de\nlas localidades comprendidas en las áreas definidas en la veda, deberán de\ncumplir con alguno de los siguientes mecanismos o alternativas como STC:\n\n \n\na) Limpieza y recolección de basura, desechos o cualquier otro material\ncontaminan playas, esteros y desembocaduras de los ríos.\n\n \n\nb) Reforestación de manglares u otras áreas públicas.\n\n \n\nc) Realización de obras de construcción, mantenimiento y reparación de\ncaminos, infraestructuras diversas, cementerios, acueductos, salones comunales,\nescuelas, etcétera, en cuyo caso las Organizaciones Pesqueras debidamente\ninscritas y legalizadas ante el INCOPESCA y que deseen realizar este tipo de\ntrabajo comunal, deberá previo comunicarlo al INCOPESCA.\n\n \n\nd) Participación en talleres, cursos, seminarios y otras actividades de\ncapacitación, divulgación e información afines con la actividad pesquera o de\nevidente interés público, impartidos por el INCOPESCA o por cualquier otra\nInstitución Pública u Organización No Gubernamental, en este último caso\nsiempre y cuando haya sido debidamente coordinada con el INCOPESCA.\n\n \n\ne) Cualquier tipo de actividad de bien social o comunal en\ninstituciones de carácter benéfico como asilos de adultos mayores, hogares y\ncomedores infantiles, así como entidades públicas, centros educativos,\nreligiosos, culturales, Organizaciones Gubernamentales y sociales.\n\n \n\nf)  Participar en cualquier tipo de programa que tenga establecido el\nMinisterio de Salud para la erradicación de una epidemia como por ejemplo el\ndengue u otras, en cualesquiera de estas comunidades pesqueras comprendidas\ndentro del área establecida por el decreto de veda.\n\n            Artículo 3º-Para la realización del\nSTC de conformidad con las actividades y alterna anteriormente definidas, los\nbeneficiarios de las ayudas económicas, deberán cumplir un mínimo de 30 horas\nmensuales, para lo cual las Organizaciones o diferentes entes que se\nbeneficiadas con el STC, deberán aportar los bienes, recursos, materiales,\nequipos y cual otro apoyo logístico necesario para el cumplimiento del mismo.\nEl INCOPESCA podrá facilitar la coordinación con los entes el logro de los\nobjetivos del STC.\n\n            Artículo\n4º-Corresponderá a la\n Jefatura del Departamento de Extensión y Capacitación,\nJefaturas de las Oficinas Regionales del INCOPESCA, en forma conjunta con las\nautoridades correspondientes, la coordinación y supervisión de la realización\ndel STC por parte de pescadores beneficiados, para lo cual determinarán con las\nInstancias Públicas, Organizaciones, Grupos de\nla Sociedad Civil,\nCentros Educativos, Religiosos, Culturales y otros de carácter similar, la\nforma y ejecución del STC por parte de cada uno de los pescadores beneficiados\ntravés de las Organizaciones Pesqueras inscritas ante el INCOPESCA y que los\nrepresenten.\n\n            Artículo\n5º-Para efectos de lo anterior, una vez definido por las Jefaturas del\nDepartamento Extensión y Capacitación y de las Oficinas Regionales del\nINCOPESCA la realización programación del STC por parte de los pescadores\nbeneficiarios, deberán proceder por los me idóneos a informar a los pescadores\nu Organizaciones correspondientes, el (los) lugar (es) forma de realización y\ncumplimiento del STC.\n\n \n\n            La\nobligatoriedad definida anteriormente no libera a los pescadores beneficiarios,\nni les exime su responsabilidad de informarse ante el Departamento de Extensión\ny Capacitación Oficinas Regionales del INCOPESCA, del cumplimiento y de la\nforma de realización de su STC.\n\n            Artículo\n6º-En el caso de que el INCOPESCA a través del Departamento de Extensión\nCapacitación y de sus Oficinas Regionales, determine el incumplimiento del STC\npor parí cualquiera de los pescadores, remitirá la información correspondiente\nmediante el informe respectivo a\nla Presidencia Ejecutiva\ndel INCOPESCA, con la finalidad de que dicha informa sea remitida de forma\ninmediata, a la\n Institución Pública u J. D. I. P./255-2009.-Puntarenas,\non the fourteenth day of the month of August of 2009.\n\n \n\nConsidering:\n\n \n\n            I.-That in accordance with\nLaw No. 7384, Law Creating\nINCOPESCA and Law No.\nFisheries and Aquaculture Law, it is the authority and competence of INCOPESCA\nto establish, based on technical, scientific, economic, and social criteria,\nclosed zones or seasons, whether by area or specific species, in order to\nprotect and sustainably utilize hydrobiological resources.\n\n \n\nII.-That the socioeconomic assistance\nprograms designed for this purpose, in favor of fishers affected during closed seasons,\nwill necessarily involve community work services (servicios de trabajo comunal) on the part of the beneficiaries;\nwhich is why it is necessary to define the forms or alternatives that are\nreasonable, timely, and suitable for carrying out said community work service (trabajo comunal) and its verification and\nsupervision by INCOPESCA for the corresponding purposes.\n\n \n\n            III.-That\nin accordance with Article 36 of\nLaw No. 8436, Fisheries and Aquaculture Law, the\nExecutive Branch may authorize the allocation of National Budget funds in favor\nof the Social Aid Institute (IMAS), for the purpose of developing socioeconomic\nassistance programs specially designed for this purpose, in favor\nof fishers affected during closed seasons, provided it is\nproven that they have no other sources of income and are in a condition\nof circumstantial poverty. Therefore,\n\n \n\nTHE BOARD OF DIRECTORS OF INCOPESCA\n\n \n\nAGREES:\n\n \n\nTo approve the:\n\n \n\n\"General regulations for\ncarrying out the Community Work\n\n \n\nService, by affected\nfishers during\n\n \n\nthe closed seasons agreed upon\n\n \n\nby INCOPESCA\"\n\n \n\n            Article 1.-Any fisher\naffected during the closed seasons agreed upon by INCOPESCA, in order to receive\nany type of economic assistance whether through IMAS, any other\nState Institution, or Non-Governmental Organization, shall be obligated to\ncomplete the Community Work Service, hereinafter\nreferred to as STC, which will be coordinated and supervised by INCOPESCA in\nconjunction with the entity providing the economic resources for that purpose.\n\n            Article\n2.-For the purposes of the foregoing article, the fishers from\nthe localities included in the areas defined in the closed season must\ncomplete one of the following mechanisms or alternatives as STC:\n\n \n\na) Cleaning and collection of trash, waste, or any other material\nthat pollutes beaches, estuaries (esteros), and river mouths.\n\n \n\nb) Reforestation of mangroves or other public areas.\n\n \n\nc) Carrying out construction, maintenance, and repair works on\nroads, various infrastructures, cemeteries, aqueducts, community halls,\nschools, etcetera, in which case the Fisheries Organizations duly\nregistered and legalized before INCOPESCA that wish to carry out this type of\ncommunity work (trabajo comunal) must first notify INCOPESCA.\n\n \n\nd) Participation in workshops, courses, seminars, and other training,\noutreach, and information activities related to the fishing activity or of\nevident public interest, given by INCOPESCA or by any other\nPublic Institution or Non-Governmental Organization, in this latter case\nprovided that it has been duly coordinated with INCOPESCA.\n\n \n\ne) Any type of activity of social or community benefit in\ncharitable institutions such as senior citizens' homes, children's\nhomes and soup kitchens, as well as public entities, educational,\nreligious, cultural centers, Governmental and social Organizations.\n\n \n\nf) Participating in any type of program established by the\nMinistry of Health for the eradication of an epidemic such as\ndengue or others, in any of these fishing communities\nincluded within the area established by the closed season decree.\n\n            Article 3.-To carry out the\nSTC in accordance with the activities and alternatives previously defined, the\nbeneficiaries of the economic aid must complete a minimum of 30 hours\nper month, for which the Organizations or different entities that are\nbenefited by the STC must provide the goods, resources, materials,\nequipment, and any other logistical support necessary for its fulfillment.\nINCOPESCA may facilitate coordination with the entities to achieve the\nobjectives of the STC.\n\n            Article\n4.-The\n Head of the Extension and Training Department and the\nHeads of the Regional Offices of INCOPESCA, jointly with\nthe corresponding authorities, shall be responsible for the coordination and supervision of the completion\nof the STC by the benefited fishers, for which purpose they shall determine, with the\nPublic Entities, Organizations, Civil Society\nGroups,\nEducational, Religious, Cultural Centers, and other similar entities, the\nform and execution of the STC by each of the benefited fishers\nthrough the Fisheries Organizations registered with INCOPESCA that\nrepresent them.\n\n            Article\n5.-For the purposes of the foregoing, once the Heads of the Extension and Training\nDepartment and the Regional Offices of\nINCOPESCA have defined the completion and scheduling of the STC by the beneficiary\nfishers, they must proceed by the most suitable means to inform the fishers\nor corresponding Organizations of the place(s) and\nform of completion and fulfillment of the STC.\n\n \n\n            The\nobligation defined above does not release the beneficiary fishers,\nnor does it exempt them from their responsibility to inform themselves, at the Department of Extension\nand Training or Regional Offices of INCOPESCA, of the fulfillment and\nthe form of carrying out their STC.\n\n            Article\n6.-In the event that INCOPESCA, through the Department of Extension\nand Training and its Regional Offices, determines non-compliance with the STC\non the part of any of the fishers, it shall forward the corresponding information\nby means of the respective report to the\nExecutive Presidency\nof INCOPESCA, in order that said information be forwarded immediately\nto the\n Public Institution or Non-Governmental Organization that has\nprovided the economic resources for this purpose, so that it may proceed\naccordingly.\n\n            Article\n7.-Effective upon its publication.
