I.\nP./270-2009.-Puntarenas, a los veintiún días del mes de agosto del 2009.\n\n \n\nConsiderando:\n\n \n\nI.-Que de conformidad con la Ley Nº 7384, Ley\nde Creación del INCOPESCA y la Ley Nº 8436, Ley de Pesca y Acuicultura, es\natribución y competencia del INCOPESCA, dictar sobre la base de criterios\neconómicos, sociales, ambientales, técnicos y científicos; la conservación, el\naprovechamiento y el uso sostenible de los recursos hidrobiológicos.\n\n \n\nII.-Que de conformidad con el\nartículo 66 de la Ley Nº\n8436, Ley de Pesca y Acuicultura, el INCOPESCA podrá autorizar la pesca de\nsardina únicamente para ser utilizada pan el consumo humano o como carnada, por\nlo cual se considera pertinente establecer con fundamento en las estadísticas\nde los desembarques de dicho recurso hidrobiológico, que porcentaje de éstos\ndebería corresponder a materia prima para la elaboración de productos\ndestinados al consumo humano y que porcentaje, a carnada para la flota pesquera\nnacional y/o extranjera.\n\n \n\nIII.-Que de acuerdo con estudios\ncientíficos realizados sobre dicho recurso, se logró establecer que las\ndiferentes especies que conforman la pesquería de la sardina que se explota en\nel litoral pacífico costarricense, alcanzan su talla de primera madurez a los 11 centímetros\nen razón de ello, se estableció como medida precautoria mediante el acuerdo Nº\nAJDIP/215-98, publicado en el Diario Oficial\nLa Gaceta Nº\n172 del 3 de setiembre de 1998, prohibición sobre la captura, descarga y\ncomercialización de aquellos especímenes con longitud total inferior a los 15 centímetros,\nconsiderada ésta como la longitud comprendida desde el extremo anterior de la\nnariz hasta la parte distal de la aleta caudal y en porcentaje, igual o\nsuperior al 10% del desembarque total de la flota sardinera con red bolichera.\n\n \n\nIV.-Que a raíz de la variación\nmundial en los precios del petróleo, el sector pesquero nacional ha venido\nexperimentando un aumento progresivo en sus costos de operación\nfundamentalmente por el combustible que representa cerca de un 80% de esos\ncostos; situación que desde hace varios años ha venido generando la práctica\ndel trasbordo de productos pesqueros entre una embarcación y otra, como medio\npara permitir su mayor permanencia en los caladeros de pesca. Por tanto,\n\n \n\nACUERDAN:\n\n \n\n1º-Establecer el destino de un porcentaje\nigual o mayor a un 90% de los desembarques de sardina como materia prima para\nla elaboración de productos destinados al consumo humano y de porcentaje igual\no menor a un 10% como carnada para la flota pesquera nacional.\n\n2º-Permitir a la flota pesquera\nsemi-industrial sardinera, el trasbordo de los productos pesqueros capturados\nbajo el amparo de sus respectivas licencias de pesca comercial, a través\nembarcaciones tipo \"barcazas\", acondicionadas para este propósito y para lo\ncual, éstas deberán estar en el registro de embarcaciones que obra en el\nINCOPESCA.\n\n3º-Para efecto de verificar lo\nindicado en los dos puntos anteriores, cuando se desembarque sardina u otros\nproductos pesqueros, por parte de las embarcaciones pertenecientes a la flota\npesqueras semi-industrial sardinera o embarcaciones trasbordadoras, los\ninteresados quedarán sujeto registro de datos por parte de funcionarios del\nINCOPESCA.\n\n4º-Para ello el armador, el\nrepresentante legal de la empresa o el propietario, deberán notificar el Tiempo\nEstimado de Arribo (TEA) y las cantidades aproximadas de sardina otros\nproductos pesqueros a desembarcar y presentarán o enviarán a la oficina del\nINCOPESCA más cercana al lugar del desembarque del producto, el formulario de\nSolicitud de Inspección previsto para este efecto, indicando el lugar donde se\ndeberá realizar la inspección, la fecha y la hora de inicio del desembarque y\ndemás información solicitada.\n\n5º-La notificación deberá\nhacerse por escrito en forma personal o vía fax al INCOPESCA, con al menos 3\nhoras hábiles de antelación a la fecha de arribo de la embarcación muelle de\ndesembarque, en el horario de lunes a viernes de las 8:00 a. m. a las 4:00 p.\nm. Aquellos desembarques que deban iniciar en días no hábiles, días feriados o\nde asueto y deberá hacerse de notificación el día hábil anterior al\ndesembarque.\n\n6º-Dichas embarcaciones serán\ninspeccionadas por el INCOPESCA, de manera aleatoria; conformidad con sus\nfacultades y potestades otorgadas por Ley, específicamente par recolección,\nanálisis y proceso de datos e información relacionada al recurso sardina, en\ncuyo su costo será asumido por el interesado.\n\n7º-Los dueños o representantes\nlegales de las embarcaciones sardineras estarán obligados durante los primeros\nocho días de cada mes a entregar al INCOPESCA un informe de las descargas del\ninmediato anterior que detalle fechas de descarga, kilos descargados de sardina\npor descarga y kilos vendidos a la industria nacional para consumo humano, cada\ninforme debe de ser firmado calidad de declaración jurada.\n\n8º-La industria procesadora de\nsardina para consumo humano deberá de entregar al INCOPESCA un informe\ntrimestral que debe contener el detalle mensual del volumen de kilos de\nsardinas comprados a cada barco sardinero, así como, el porcentaje promedio del\ntotal de la captura recibida de cada barco que no superó la talla de 15 cm.\n\n9º-Con base en los informes de\nsupervisión de descarga y de la información contenida en informes referidas en\nlos puntos 7 y 8 anteriores,\nla Dirección Técnica elaborará los informes\nperiódicos de evaluación de recurso sardina, que servirán de base técnica a\nla Junta Directiva\npara toma de decisiones y acuerdos que garanticen una adecuada explotación del\nrecurso.\n\n10.-Deróguese el acuerdo Nº A.\nJ. D. I.\nP./270-2009.-Puntarenas, on the twenty-first day of the month of August, 2009.\n\n \n\nConsidering:\n\n \n\nI.-That in accordance with Law No. 7384, Law Creating INCOPESCA, and Law No. 8436, Fisheries and Aquaculture Law, it is the authority and responsibility of INCOPESCA to issue, based on economic, social, environmental, technical, and scientific criteria, provisions for the conservation, exploitation, and sustainable use of hydrobiological resources.\n\n \n\nII.-That in accordance with Article 66 of Law No. 8436, Fisheries and Aquaculture Law, INCOPESCA may authorize sardine fishing solely for use for human consumption or as bait; therefore, it is deemed pertinent to establish, based on the landing statistics for said hydrobiological resource, what percentage of these landings should be destined as raw material for the production of products for human consumption and what percentage as bait for the national and/or foreign fishing fleet.\n\n \n\nIII.-That according to scientific studies conducted on said resource, it was established that the different species comprising the sardine fishery exploited on the Costa Rican Pacific coast reach their size at first maturity at 11 centimeters; accordingly, as a precautionary measure through agreement No. AJDIP/215-98, published in Official Gazette La Gaceta No. 172 of September 3, 1998, a prohibition was established on the capture, landing, and commercialization of specimens with a total length of less than 15 centimeters, this being understood as the length from the anterior tip of the snout to the distal part of the caudal fin, and representing a percentage equal to or greater than 10% of the total landing of the sardine fleet using purse seine nets (red bolichera).\n\n \n\nIV.-That as a result of global variations in oil prices, the national fishing sector has been experiencing a progressive increase in its operating costs, primarily due to fuel, which represents approximately 80% of those costs; a situation that for several years has led to the practice of transshipment (trasbordo) of fishery products between one vessel and another, as a means of allowing them to remain longer on the fishing grounds. Therefore,\n\n \n\nAGREES:\n\n \n\n1.-To establish that a percentage equal to or greater than 90% of sardine landings be destined as raw material for the production of products for human consumption and a percentage equal to or less than 10% as bait for the national fishing fleet.\n\n2.-To allow the semi-industrial sardine fishing fleet the transshipment (trasbordo) of fishery products caught under the authority of their respective commercial fishing licenses, by means of \"barge\"-type vessels (barcazas), equipped for this purpose, for which these vessels must be listed in the vessel registry held by INCOPESCA.\n\n3.-For the purpose of verifying the provisions of the two preceding points, when sardines or other fishery products are landed by vessels belonging to the semi-industrial sardine fishing fleet or transshipment vessels, the interested parties shall be subject to data recording by INCOPESCA officials.\n\n4.-For this purpose, the vessel owner (armador), the legal representative of the company, or the owner must notify the Estimated Time of Arrival (Tiempo Estimado de Arribo, TEA) and the approximate quantities of sardines and other fishery products to be landed, and shall submit or send to the INCOPESCA office nearest the product landing site, the Inspection Request form provided for this purpose, indicating the location where the inspection is to be carried out, the date and time of the start of landing, and other requested information.\n\n5.-Such notification must be made in writing, in person or via fax to INCOPESCA, at least 3 business hours prior to the date of arrival of the vessel at the landing dock, during business hours from Monday to Friday, 8:00 a.m. to 4:00 p.m. For landings that must begin on non-business days, holidays, or days of rest, notification must be made on the business day prior to the landing.\n\n6.-Said vessels shall be inspected by INCOPESCA on a random basis, in accordance with the powers and authorities granted by Law, specifically for the collection, analysis, and processing of data and information related to the sardine resource, the cost of which shall be borne by the interested party.\n\n7.-The owners or legal representatives of sardine vessels shall be obligated, during the first eight days of each month, to submit to INCOPESCA a report on the landings of the immediately preceding month, detailing landing dates, kilograms of sardines landed per landing, and kilograms sold to the national industry for human consumption; each report must be signed as a sworn statement (declaración jurada).\n\n8.-The sardine processing industry for human consumption shall submit to INCOPESCA a quarterly report containing the monthly breakdown of the volume in kilograms of sardines purchased from each sardine vessel, as well as the average percentage of the total catch received from each vessel that did not exceed the 15 cm size limit.\n\n9.-Based on the landing supervision reports and the information contained in the reports referred to in points 7 and 8 above, the Technical Directorate (Dirección Técnica) shall prepare periodic evaluation reports on the sardine resource, which shall serve as the technical basis for the Board of Directors (Junta Directiva) for decision-making and agreements that guarantee the proper exploitation of the resource.\n\n10.-Repeal agreement No. A.
