  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 35426\n\n                        Crea Refugio Nacional de Vida Silvestre Conchal, categoría mixto y crea\nComité de Manejo Compartido del Refugio Nacional de Vida Silvestre Mixto Conchal\n\nTexto Completo acta: 114655\n\nNº 35426-MINAE (*)\n\n(*)(Así modificada su denominación por el\nartículo 11 de la Ley \"Traslado del sector Telecomunicaciones del\nMinisterio de Ambiente, Energía y Telecomunicaciones al Ministerio de Ciencia y\nTecnología, N° 9046 del 25 de junio de 2012)\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE AMBIENTE Y ENERGÍA\n(*)\n\n(*)(Así\nmodificada su denominación por el artículo 11 de la Ley \"Traslado del\nsector Telecomunicaciones del Ministerio de Ambiente, Energía y\nTelecomunicaciones al Ministerio de Ciencia y Tecnología, N° 9046 del 25 de\njunio de 2012)\n\n            Con fundamento en las facultades que\nles confieren los incisos 3) y 18) de los artículos 140 y 146 de\nla Constitución Política;\nlos artículos 1, 32, 35 y 36 de\nla Ley Orgánica del Ambiente Nº 7554 del 04 de\noctubre de 1995; artículos 82, 83 y 87 de\nla Ley de Conservación de\nla Vida Silvestre Nº\n7317, del 30 de octubre de 1992; artículos 1 y 5 de\nla Ley Forestal Nº 7575\ndel 13 de febrero de 1996, y con fundamento en lo dispuesto en los artículos\n6º, 11 y 27 de la Ley\n General de\nla Administración Pública\nNº 6627 del 02 de mayo de 1978, artículo 21 del Reglamento a\nla Ley de Biodiversidad, Decreto\nEjecutivo Nº 34433-MINAE del 11 de marzo del 2008.\n\n \n\nConsiderando:\n\n \n\n            1º-Que en distrito 08 Cabo Velas,\ndel cantón tercero Santa Cruz de la provincia de Guanacaste, se encuentran\nterrenos del Estado, con una extensión de 11,46 hectáreas,\nque incluyen, áreas de manglar y estero.\n\n            2º-Que\ncontiguo al manglar, se encuentra ubicado un área de bosque perteneciente a\nReserva Conchal Sociedad Anónima, 3-101- 124933, representada por Carlos\nHernández Herrero, mayor, casado una vez, Ingeniero Civil, portador de la\ncédula de identidad Nº  9-0015-0594,\nDirector de Operaciones con facultades de Apoderado Generalísimo sin límite de\nsuma. La propiedad se encuentra inscrita bajo la matrícula de Folio Real\n5033737-000, situada en el distrito 08 Cabo Velas, cantón 03 Santa Cruz de la\nprovincia de Guanacaste, cuyos límites son al norte, con faja inalienable y\nManuel Sequeiro; al sur, con calle pública Matapalo;\nal este, con José Joaquín Chaves y al oeste, con calle pública.\n\n            3º-Que\nen agosto del 2007, Reserva Conchal Sociedad Anónima, manifestó su voluntad de\nincorporar la finca de su propiedad, descrita anteriormente, bajo el régimen de\nprotección de vida silvestre por un periodo de diez años; comprometiéndose\ndentro de este plazo de tiempo, a no desarrollar ninguna actividad que afecte\nla fragilidad de los diferentes ecosistemas existentes en dicha área, sin\ncontar con la correspondiente autorización del Área de Conservación Tempisque\ndel Sistema Nacional de Áreas de Conservación (SINAC). Así mismo, dará toda la\ncolaboración necesaria para que los investigadores, inspectores de recursos\nnaturales y otros funcionarios del SINAC, visiten dicha área en cumplimiento de\nsus funciones.\n\n            4º-Que\nla finca corresponde a un área de 28,29 hectáreas\nque se ubican aproximadamente en la coordenada 337573 E / 264745 N, hoja\ncartográfica Matapalo Nº 3047 III.\n\n            5º-Que\nel área de interés es considerada de gran importancia para la protección de la\nbiodiversidad de la zona costera, pues presenta características especiales para\nla conservación de significativas especies de flora y fauna asociada a\nhumedales, entre ellas: mangle rojo (Rhizophora\nmangle), mangle mariquita (Laguncularia recemosa), palo de sal (Avicennia\ngerminans) y mangle botón (Conocarpus\nerecta) y reptiles como el cocodrilo (Crocodylus acutus). En los ecosistemas albergan temporal o\npermanentemente especies de aves acuáticas entre las que sobresalen el galán\nsin ventura (Jabiru mycteria),\nel piche común (Dendrocygna autumnalis)\ny la espátula rosada (Ajai ajaja),\nentre otras. Mientras que los crustáceos están representados por gran variedad\nde especies de cangrejos como el cangrejo violinista (Uca\nsp), el cangrejo terrestre (Cardisoma\ncrassun) y el cangrejo azul (Gecarcinus\nsp). Entre los mamíferos presentes sobresalen los\nmonos congo (Alouatta palliata), Venado cola blanca (Odocoileus\nvirginianus) y pizote (Nasua\nnarica).\n\n            6º-Que el área de interés a proteger forma parte del Corredor Biológico Diriá,\npermitiendo la protección y el intercambio de especies entre dichos lugares. Además de que consolida\nla conectividad ecológica y la viabilidad de la biodiversidad.\n\n            7º-Que\nel área de Playa Conchal, el estero, Manglar de Puerto Viejo y el bosque que se\nsometerá a protección se encuentran dentro de la microcuenca El Capulín. Esta\nmicrocuenca abastece de agua al manglar ya que la boca del estero está separada\ndel manglar por una sección de playa y una duna que actúa como una barrera o\ntapón de sus aguas. Durante la época lluviosa, dependiendo de la intensidad de\nla precipitación, la barrera puede romperse y se restablece comunicación con el\nmar, de lo contrario la microcuenca sería la única que abastece de agua dulce\nal manglar.\n\n            8º-Que\nparte de los deberes y funciones del Estado es procurar y asegurar la\nprotección ambiental, siendo Costa Rica uno de los países más destacados en\neste ámbito de acción, estableciendo un sistema de áreas protegidas en todo su\nterritorio, poniendo en práctica el mandato constitucional establecido en el\nartículo 50.\n\n            9º-Que\nla administración de la vida silvestre y la recomendación de medidas que\naseguren la perpetuidad de las especies, son funciones del Sistema Nacional de\nÁreas de Conservación (SINAC), de conformidad con el artículo 22 de La Ley de\nBiodiversidad, Nº 7788, a\ntravés del Área de Conservación Tempisque (ACT), Área que forma parte del\nSistema de conformidad con el artículo 21 del Reglamento a la Ley de\nBiodiversidad, Decreto Ejecutivo Nº 34433-MINAE publicado en La Gaceta\nNº 68 del 08 de abril de 2008.\n\n            10.-Que\nla Ley Forestal dispone que la administración del recurso forestal será competencia\ndel Ministerio de Ambiente y Energía (*), debiendo velar en consecuencia por su\nconservación en áreas que comprenden el Patrimonio Natural del Estado.\n\n(*)(Así\nmodificada su denominación por el artículo 11 de la Ley \"Traslado del\nsector Telecomunicaciones del Ministerio de Ambiente, Energía y\nTelecomunicaciones al Ministerio de Ciencia y Tecnología, N° 9046 del 25 de\njunio de 2012)\n\n            11.-Que\nexiste un Plan de Manejo autorizado por el Comité Técnico y el Consejo Regional\ndel Área de Conservación Tempisque desde el 20 de diciembre del 2006, dicho\nplan fue aprobado de manera definitiva y formal, mediante resolución\nACT-OR-034-2007 del 15 de noviembre del 2007 emitida por Comité Técnico del\nACT.\n\n            12.-Que\nde conformidad al artículo 12 inciso d) del Reglamento a la Ley de\nBiodiversidad, Decreto Ejecutivo Nº 34433-MINAE publicado en La Gaceta Nº 68\ndel 08 de abril de 2008, el Consejo Nacional de Áreas de Conservación (CONAC),\nen Sesión Extraordinaria Nº 003-2008 celebrada el día 16 de junio del 2008,\nmediante Acuerdo Nº 15 aprobó el Plan de Manejo y la creación del Refugio\nNacional de Vida Silvestre Conchal, categoría Mixta.\n\n            13.-Que\nanalizados los objetivos que persigue la declaratoria del Refugio Nacional de\nVida Silvestre Conchal, en\nla Categoría Mixto, se ha determinado que los mismos\nson acordes con los requisitos para crear nuevas áreas silvestres de\nconformidad con lo dispuesto en los artículos 35 y 36 de\nla Ley Orgánica del\nAmbiente. Por tanto,\n\n \n\nDECRETAN:\n\nCRÉASE EL REFUGIO NACIONAL DE\nVIDA SILVESTRE\n\nCONCHAL, CATEGORÍA MIXTO\n\n \n\n            Artículo 1º-Declárese el \"Refugio\nNacional de Vida Silvestre Conchal\" en la categoría mixto, el cual estará\nubicado en el distrito de Cabo Velas del cantón tercero Santa Cruz, de la\nprovincia de Guanacaste con un área total de 39,75 hectáreas\nque incluyen:\n\n \n\na.    \nUn sector de 11,46 hectáreas de terrenos de manglar que\nconstituyen Patrimonio Natural del Estado, en un área estatal ubicada en la\nhoja cartográfica Matapalo Nº 3047 III, The property is registered under the Real Folio number\n5033737-000, located in district 08 Cabo Velas, canton 03 Santa Cruz of the\nprovince of Guanacaste, whose boundaries are to the north, with the inalienable zone and\nManuel Sequeiro; to the south, with public road Matapalo;\nto the east, with José Joaquín Chaves and to the west, with public road.\n\n            3rd-That\nin August 2007, Reserva Conchal Sociedad Anónima, expressed its willingness to\nincorporate its property, described above, under the\nwildlife protection regime for a period of ten years; committing\nwithin this period of time, not to develop any activity that affects\nthe fragility of the different ecosystems existing in said area, without\nhaving the corresponding authorization from the Tempisque Conservation Area\nof the National System of Conservation Areas (SINAC). Likewise, it will provide all\nnecessary collaboration so that researchers, natural resource inspectors\nand other SINAC officials, may visit said area in performance of\ntheir duties.\n\n            4th-That\nthe property corresponds to an area of 28.29 hectares\nthat are located approximately at coordinate 337573 E / 264745 N, cartographic sheet\nMatapalo Nº 3047 III.\n\n            5th-That\nthe area of interest is considered of great importance for the protection of\nbiodiversity of the coastal zone, as it presents special characteristics for\nthe conservation of significant species of flora and fauna associated with\nwetlands, among them: red mangrove (Rhizophora\nmangle), white mangrove (Laguncularia racemosa), black mangrove (Avicennia\ngerminans) and buttonwood mangrove (Conocarpus\nerecta) and reptiles such as the crocodile (Crocodylus acutus). The ecosystems temporarily or\npermanently shelter species of aquatic birds among which stand out the\njabiru (Jabiru mycteria),\nthe black-bellied whistling duck (Dendrocygna autumnalis)\nand the roseate spoonbill (Ajai ajaja),\namong others. While crustaceans are represented by a great variety\nof species of crabs such as the fiddler crab (Uca\nsp), the land crab (Cardisoma\ncrassun) and the blue crab (Gecarcinus\nsp). Among the mammals present, notable are the\nmantled howler monkeys (Alouatta palliata), white-tailed deer (Odocoileus\nvirginianus) and white-nosed coati (Nasua\nnarica).\n\n            6th-That the area of interest to be protected forms part of the Diriá Biological Corridor,\nallowing the protection and exchange of species between said places. Furthermore, it consolidates\necological connectivity and the viability of biodiversity.\n\n            7th-That\nthe area of Playa Conchal, the estuary, the Puerto Viejo Mangrove and the forest that will be\nsubjected to protection are within the El Capulín micro-watershed. This\nmicro-watershed supplies water to the mangrove since the mouth of the estuary is separated\nfrom the mangrove by a section of beach and a dune that acts as a barrier or\nplug for its waters. During the rainy season, depending on the intensity of\nthe precipitation, the barrier can break and communication with the\nsea is re-established, otherwise the micro-watershed would be the only source of freshwater\nto the mangrove.\n\n            8th-That\npart of the duties and functions of the State is to ensure and guarantee\nenvironmental protection, Costa Rica being one of the most prominent countries\nin this sphere of action, establishing a system of protected areas throughout its\nterritory, putting into practice the constitutional mandate established in\narticle 50.\n\n            9th-That\nthe administration of wildlife and the recommendation of measures that\nensure the perpetuity of species, are functions of the National System of\nConservation Areas (SINAC), in accordance with article 22 of the Biodiversity Law,\nNº 7788, through the Tempisque Conservation Area (ACT), an Area that forms part of the\nSystem in accordance with article 21 of the Regulation to the Biodiversity Law,\nExecutive Decree Nº 34433-MINAE published in La Gaceta\nNº 68 of April 8, 2008.\n\n            10.-That\nthe Forest Law (Ley Forestal) provides that the administration of the forest resource shall be the competence\nof the Ministry of Environment and Energy (*), and must therefore ensure its\nconservation in areas that comprise the Natural Heritage of the State.\n\n(*)(Thus\nmodified its denomination by article 11 of the Law \"Transfer of the\nTelecommunications sector from the Ministry of Environment, Energy and\nTelecommunications to the Ministry of Science and Technology, N° 9046 of June\n25, 2012)\n\n            11.-That\nthere is a Management Plan authorized by the Technical Committee and the Regional Council\nof the Tempisque Conservation Area since December 20, 2006, said\nplan was approved definitively and formally, by resolution\nACT-OR-034-2007 of November 15, 2007 issued by the Technical Committee of the\nACT.\n\n            12.-That\nin accordance with article 12 subsection d) of the Regulation to the Biodiversity Law,\nExecutive Decree Nº 34433-MINAE published in La Gaceta Nº 68\nof April 8, 2008, the National Council of Conservation Areas (CONAC),\nin Extraordinary Session Nº 003-2008 held on June 16, 2008,\nby Agreement Nº 15 approved the Management Plan and the creation of the Conchal National\nWildlife Refuge, Mixed category.\n\n            13.-That\nhaving analyzed the objectives pursued by the declaration of the Conchal National\nWildlife Refuge, in the Mixed Category, it has been determined that they\nare consistent with the requirements for creating new wild areas in\naccordance with the provisions of articles 35 and 36 of\nthe Organic Environmental Law. Therefore,\n\n \n\nDECREE:\n\nCREATION OF THE CONCHAL NATIONAL\nWILDLIFE REFUGE, MIXED CATEGORY\n\n \n\n            Article 1-Declare the \"Conchal National\nWildlife Refuge\" in the mixed category, which shall be\nlocated in the Cabo Velas district of the third canton Santa Cruz, of the\nprovince of Guanacaste with a total area of 39.75 hectares\nthat include:\n\n \n\na.    \nA sector of 11.46
