y de conformidad con\nlo dispuesto por la Ley\nde Creación del Ministerio de Obras Públicas y Transportes, Ley Nº 4786 del 5\nde julio de 1971 y sus reformas; la\n Ley de Administración Vial, Ley Nº 6324 del 24 de mayo de\n1979; el artículo 101 de la Ley\nde Tránsito por Vías Públicas Terrestres, Nº 7331 del 13 de abril de 1993; y\nsus reformas la\n Ley Orgánica del Ministerio de Economía, Industria y\nComercio, Ley Nº 6054 del 14 de junio de 1977;\nla Ley Orgánica\ndel Ministerio de Salud, Ley Nº 5412 del 8 de noviembre de 1973, y\nla Ley General de Salud,\nLey Nº 5395 del 30 de octubre de 1973.\n\n \n\nConsiderando:\n\n \n\n            1º-Que ha sido notable el\nintercambio comercial y el uso de las vías públicas para el transporte de toda\nclase de bienes y productos, desde y hacia cualquier punto del territorio\nnacional e internacional.\n\n            2º-Que\nha podido comprobarse, que existen una serie de productos y materias que dada\nsu naturaleza intrínseca y sus propiedades fundamentales, requieren una\nregulación específica a efecto de que puedan ser trasladados y transportados\npor las vías públicas terrestres, en observancia de las normas técnicas y\njurídicas que posibiliten la protección al medio ambiente y la seguridad de\nquienes se desplazan por estas vías.\n\n            3º-Que\nes competencia del Ministerio de Obras Públicas y Transportes, regular todo lo\nconcerniente al tránsito de vehículos y al transporte de personas y bienes por\nlas vías públicas del territorio nacional, la seguridad vial y la prevención en\nla contaminación causada por los vehículos automotores.\n\n            4º-Que\nla Ley de Tránsito por Vías Públicas Terrestres dispuso, por medio de su\nartículo 102, que todo vehículo que transporte materiales o sustancias\npeligrosas o explosivas, deberá portar un permiso especial otorgado por la\nDirección General de Transporte Público, así como someterse a las regulaciones\nque al efecto se establezcan para su circulación, dentro de los límites de\nseguridad que al efecto se precisan.\n\n            5º-Que\ncorresponde al Ministerio de Salud definir cuales son\nsustancias o productos tóxicos, así como sustancias, productos u objetos\npeligrosos de carácter radiactivo, comburente, inflamable, corrosivo,\nirritante, explosivo u otros, así como autorizar su importación, almacenamiento,\nventa, transporte, distribución o suministro.\n\n            6º-Que\nel Ministerio de Salud tiene la obligación de velar porque toda persona natural\no jurídica que se ocupe de la importación, fabricación, manipulación,\nalmacenamiento, venta, distribución, transporte y suministro de sustancias o\nproductos tóxicos, o sustancias peligrosas o así declaradas, realice dichas\noperaciones en condiciones tales, que permitan eliminar o minimizar el riesgo\npara la salud y la seguridad de las personas y animales que pudieren quedar\nexpuestos con ocasión de su trabajo, tenencia, uso o consumo, según\ncorresponda.\n\n            7º-Que\nes función del Ministerio de Salud, dictar las disposiciones reglamentarias\npertinentes en relación con el registro obligatorio, el contenido de la\nrotulación del producto, sus envases y empaques, la simbología pertinente, la\nnaturaleza del producto, sus riesgos y contraindicaciones, los antídotos que\ncorrespondieren, entre otros, todo lo cual resulta de especial importancia\ntratándose de sustancias o productos tóxicos o de sustancias peligrosas o así\ndeclaradas.\n\n            8º-Que\nel Ministerio de Economía, Industria y Comercio, por medio del Órgano de\nReglamentación Técnica, es el órgano competente en lo relacionado con la confección\nde las normas técnicas relacionadas con dicha materia.\n\n            9º-Que\nen el artículo 5 de la Ley Nº 7593 publicada el 5 de setiembre de 1996,\nestablece el suministro de combustible derivado de hidrocarburos como un\nservicio público y dispone que sea el Ministerio del Ambiente y Energía (*),\nquien otorgue la autorización para prestar el servicio público de\nalmacenamiento y venta de combustibles derivados de hidrocarburos a\nconsumidores finales.\n\n(*)(Así\nmodificada su denominación por el artículo 11 de la Ley \"Traslado del\nsector Telecomunicaciones del Ministerio de Ambiente, Energía y\nTelecomunicaciones al Ministerio de Ciencia y Tecnología, N° 9046 del 25 de\njunio de 2012)\n\n            10.-Que\nen virtud de lo expuesto, se requiere reglamentar las condiciones técnicas y\njurídicas bajo las cuales es posible el transporte terrestre de productos o\nsustancias tóxicas y peligrosas. Article 101 of the Law on Traffic on Public Land Routes, Nº 7331 of April 13, 1993; and its amendments, the Organic Law of the Ministry of Economy, Industry and Trade, Law Nº 6054 of June 14, 1977; the Organic Law of the Ministry of Health, Law Nº 5412 of November 8, 1973, and the General Health Law, Law Nº 5395 of October 30, 1973.\n\n \n\nConsidering:\n\n \n\n            1º-That the commercial exchange and the use of public roads for the transport of all kinds of goods and products, to and from any point of the national and international territory, has been notable.\n\n            2º-That it has been verified that there are a series of products and materials which, given their intrinsic nature and fundamental properties, require specific regulation so that they can be moved and transported on public land routes, in observance of the technical and legal standards that enable the protection of the environment and the safety of those who travel on these routes.\n\n            3º-That it is the competence of the Ministry of Public Works and Transport to regulate everything concerning the traffic of vehicles and the transport of persons and goods on the public roads of the national territory, road safety, and the prevention of pollution caused by motor vehicles.\n\n            4º-That the Law on Traffic on Public Land Routes provided, through its Article 102, that any vehicle transporting hazardous or explosive materials or substances must carry a special permit granted by the Dirección General de Transporte Público, as well as submit to the regulations established for that purpose for its circulation, within the safety limits specified for that purpose.\n\n            5º-That it is the responsibility of the Ministry of Health to define which are toxic substances or products, as well as hazardous substances, products, or objects of a radioactive, oxidizing, flammable, corrosive, irritant, explosive, or other nature, as well as to authorize their import, storage, sale, transport, distribution, or supply.\n\n            6º-That the Ministry of Health has the obligation to ensure that any natural or legal person engaged in the import, manufacture, handling, storage, sale, distribution, transport, and supply of toxic substances or products, or hazardous substances or those declared as such, carries out said operations under conditions that allow for the elimination or minimization of risk to the health and safety of persons and animals that could be exposed on the occasion of their work, possession, use, or consumption, as applicable.\n\n            7º-That it is the function of the Ministry of Health to issue the pertinent regulatory provisions regarding mandatory registration, the content of product labeling, its containers and packaging, the pertinent symbols, the nature of the product, its risks and contraindications, the corresponding antidotes, among others, all of which is of special importance in the case of toxic substances or products or hazardous substances or those declared as such.\n\n            8º-That the Ministry of Economy, Industry and Trade, through the Technical Regulation Body (Órgano de Reglamentación Técnica), is the competent body in matters related to the preparation of technical standards related to this matter.\n\n            9º-That Article 5 of Law Nº 7593, published on September 5, 1996, establishes the supply of fuel derived from hydrocarbons as a public service and provides that it is the Ministry of Environment and Energy (*), who grants the authorization to provide the public service of storage and sale of fuels derived from hydrocarbons to end consumers.\n\n(*)(Its designation thus amended by Article 11 of Law \"Transfer of the Telecommunications sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology,\" N° 9046 of June 25, 2012)\n\n            10.-That by virtue of the foregoing, it is necessary to regulate the technical and legal conditions under which the land transport of toxic and hazardous products or substances is possible. Therefore,\n\n \n\nDecree:\n\n \n\n\"OFFICIAL ADOPTION OF THE EMERGENCY RESPONSE\n\nGUIDEBOOK FOR THE TRANSPORT OF\n\nHAZARDOUS MATERIALS 2008\"\n\n \n\n    Article 1º- For purposes of mandatory application for the preparation of the Emergency Sheet for the Transport of Hazardous Products (Ficha de Emergencias para el Transporte de Productos Peligrosos), the \"Emergency Response Guidebook\" (Guía de Respuesta en Caso de Emergencia), the latest version in force internationally, is officially adopted, which shall be published and available at the following web addresses: http://www.mopt.go.cr/; http://www.ministeriodesalud.go.cr; http://www.reglatec.go.cr/ and http://www.minae.go.cr/\".\n\n    (Thus amended by Article 1 of Executive Decree N° 35861 of February 4, 2010)\n\n \n\n (Sinalevi Note: Due to the extensive nature of the norm and its format, the content of the \"2008 Emergency Response Guidebook for the Transport of Hazardous Materials\" can be accessed at the following link: Guía de Respuesta.archivo pdf )\n\n            Article 2º-The Ministries of Public Works and Transport, of Health, of Economy, Industry and Trade, and of Environment, Energy and Telecommunications, shall ensure, within the framework of their competence, the correct application of this guidebook.\n\nArticle 3°.- Amend the text of the Regulation for the Land Transport of Hazardous Products, Executive Decree Nº 24715, published in La Gaceta Nº 207 of November 1, 1995, and of the Regulation for the Management of Hazardous Industrial Waste, Executive Decree Nº 27001, published in La Gaceta Nº 101 of May 27, 1998, so that where it reads \"Emergency Response Guidebook\" (Guía de Respuesta en Caso de Emergencia), it shall read \"Emergency Sheet for the Transport of Hazardous Products\" (Ficha de Emergencia para el Transporte de Productos Peligrosos).\n\n    In the rest of the national regulations where compliance with the \"Emergency Response Guidebook\" (Guía de Respuesta en Caso de Emergencia) is stipulated, proceed to substitute said name with that of \"Emergency Sheet for the Transport of Hazardous Products\" (Ficha de Emergencia para el Transporte de Productos Peligrosos).\n\n \n(Thus amended by Article 2 of Executive Decree N° 35861 of February 4, 2010)\n\n            Article 4º-Amend Executive Decree Nº 24715-MOPT-MEIC-S, published in the Official Gazette La Gaceta Nº 207 of November 1, 1995, Article 68, so that it reads as follows:\n\n\"Article 68.-In the event that a spill or some other incident occurs during transport, the person in charge of the hazardous material must notify or cause to be notified:\n\nThe Emergency System 9-1-1.\n\n(Thus amended the preceding paragraph by Article 3 of Executive Decree N° 35861 of February 4, 2010)\n\nTheir contractor (boss).\n\nThe owner, lessee, or charterer of the vehicle.\n\nThe shipper or owner of the hazardous material.\"\n\n            Article 5º-It shall be effective upon its publication in the Official Gazette La Gaceta.\n\n \n\n            Done at the Presidency of the Republic.-San José, on the twenty-fourth day of April of two thousand nine."
