la\n Ley General del Servicio Nacional de Salud Animal, Nº 8495\ndel 6 de abril del 2006; la Ley\nde Presupuesto Extraordinario, Nº 7138 del 16 de noviembre de 1989, artículo\n46, inciso 22), que autoriza la apertura de Cuentas Especiales para recursos\nprovenientes de venta de servicios de Mercadeo, Salud y Producción Pecuaria e\nInvestigación Agrícola; el Acuerdo de Medidas Sanitarias y Fitosanitarias\naprobado mediante Ley de Ejecución de los Acuerdos de\nla Ronda Uruguay de\nNegociaciones Comerciales Multilaterales, Nº 7473 del 20 de diciembre del 1994;\nLey de la Promoción\nde la Competencia\ny Defensa Efectiva al Consumidor, Nº 7472 del 20 de diciembre de 1994.\n\n \n\nConsiderando:\n\n \n\n            1º-Que es función esencial del\nEstado proteger la salud de las personas, sistemas de producción primarios, los\nanimales y el medio ambiente, así como garantizar la protección de los cultivos\nde las plagas y enfermedades que puedan poner en riesgo o causar daños a la\nproducción agropecuaria.\n\n \n\n            2º-Que\npara la economía nacional y la seguridad alimentaria, la protección sanitaria\nde los productos de origen animal resulta fundamental, en especial en aquellos\nque son esenciales en la dieta de los costarricenses, lo que obliga al Estado a\nadoptar todas las medidas de prevención, vigilancia y control necesarias para\nevitar el ingreso y diseminación de plagas y enfermedades que pongan en peligro\no puedan causar daño a las personas o al patrimonio pecuario nacional.\n\n \n\n            3º-Que\nigualmente es una función esencial del Estado, establecer los mecanismos y\ncontroles necesarios para garantizar la inocuidad de los alimentos de consumo\nhumano y animal, protegiéndose con ello\nla Salud Pública.\n\n \n\n            4º-Que\nes un derecho fundamental del Estado, en el marco del Acuerdo para la\naplicación de las Medidas Sanitarias y Fitosanitarias, adoptar aquellas que\nresulten necesarias para proteger la salud y la vida de las personas, de los\nanimales y vegetales, basando esas medidas en una evaluación adecuada a las\ncircunstancias y los riesgos eventuales que ello conlleve.\n\n \n\n            5º-Que\nmediante Ley Nº 8495 del 6 de abril del 2006, se creó el Servicio Nacional de\nSalud Animal, (SENASA), como un órgano de desconcentración y personería\njurídica instrumental del Ministerio de Agricultura y Ganadería, derogándose\nla Ley Nº 6343 del 2 de mayo de\n1978, Ley sobre Salud Animal y sustituyendo por ello para todo efecto legal a\nla Dirección de Salud\nAnimal del Ministerio de Agricultura y Ganadería.\n\n \n\n            6º-Que\na través del Servicio Nacional de Salud Animal (SENASA) se brindan una serie de\nservicios a los productores y establecimientos agropecuarios y con cuya venta\nse generan los recursos necesarios para la sostenibilidad del Servicio,\npermitiéndose con ello cubrir gastos relativos a salarios y cargas sociales, la\nreposición y compra de equipos, materiales, reactivos y otros insumos\nnecesarios para la buena marcha y la atención oportuna de los requerimientos\nque se le formulan al SENASA.\n\n \n\n            7º-Que\nconforme al mandato establecido en el artículo 8 bis del Decreto Nº 27763-MAG\ndel 10 de marzo de 1999 y sus reformas, se establece que los montos de las\ntarifas por los servicios estipulados en ese Decreto están sujetas a un\nincremento anual que rige a partir del 1º de febrero de cada año, que se\ncalculará automáticamente con base en el valor del índice de precios al\nconsumidor del año anterior.\n\n \n\n            8º-Que\nes menester introducir algunas nuevas tarifas que se derivan directamente de\nla Ley Nº 8495 antes citada y\npublicitar el precio actual de las tarifas que cobra este Servicio, dado que su\núltima publicación general se realizó en el año 2005.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Regulation 35504\n\n                        Amends Executive Decree No. 27763 \"Setting of tariffs for the services\nof the Ministry of Agriculture and Livestock\", and its amendments\n\nComplete Text record: CB9AC\nNo. 35504\n\nNo. 35504-MAG\n  \n\n \n\n \n\n(This decree\nwas Repealed by article 3 of Executive Decree No. 35604 of October 28,\n2009)\n\n \n\n \n\n \n\n(Sinalevi Note: By means of directive No. 007 of September 25, 2009, a moratorium is established on the\napplication of the tariffs established in this decree, for a term of\nsixty days, a period within which a new provision on the matter must be issued)\n\n \n\nTHE\nPRESIDENT OF\nTHE REPUBLIC\n\nAND THE MINISTER OF AGRICULTURE AND LIVESTOCK\n\n \n\n  \n\n            In exercise of the powers\nconferred upon them by articles 140, subsections 3), 8) and 18), and 146 of\nthe Political Constitution;\nthe General Law of\nPublic Administration, No. 6227 of May 2, 1978;\nthe Law for the Promotion of\nAgricultural and Livestock Production,\nwhich incorporates the Organic Law\n of the Ministry of Agriculture and Livestock, No. 7064\nof April 29, 1987; the\n General Law of the National Animal Health Service, No. 8495\nof April 6, 2006; the Extraordinary\nBudget Law, No. 7138 of November 16, 1989, article\n46, subsection 22), which authorizes the opening of Special Accounts for\nresources from the sale of Marketing, Health and Livestock Production, and\nAgricultural Research services; the Agreement on Sanitary and Phytosanitary Measures\napproved by the Law for the Implementation of the\nUruguay Round Agreements of\nMultilateral Trade Negotiations, No. 7473 of December 20, 1994;\nthe Law for the Promotion\nof Competition\nand Effective Consumer Defense, No. 7472 of December 20, 1994.\n\n \n\nConsidering (Considerando):\n\n \n\n            1º-That it is an essential function of the\nState to protect the health of people, primary production systems,\nanimals, and the environment, as well as to guarantee the protection of crops\nfrom pests and diseases that may endanger or cause damage to\nagricultural and livestock production.\n\n \n\n            2º-That\nfor the national economy and food security, the sanitary protection\nof products of animal origin is fundamental, especially for those\nthat are essential in the diet of Costa Ricans, which obliges the State to\nadopt all necessary prevention, surveillance, and control measures to\nprevent the entry and spread of pests and diseases that endanger\nor may cause harm to people or the national livestock patrimony.\n\n \n\n            3º-That\nit is likewise an essential function of the State to establish the necessary mechanisms and\ncontrols to guarantee the safety (inocuidad) of food for human\nand animal consumption, thereby protecting\nPublic Health.\n\n \n\n            4º-That\nit is a fundamental right of the State, within the framework of the Agreement on the\nApplication of Sanitary and Phytosanitary Measures, to adopt those that are\nnecessary to protect the health and life of people,\nanimals, and plants, basing those measures on an assessment appropriate to the\ncircumstances and the potential risks that this entails.\n\n \n\n            5º-That\nby means of Law No. 8495 of April 6, 2006, the National Animal Health Service\n(Servicio Nacional de Salud Animal, SENASA), was created as a deconcentrated body with instrumental\nlegal personality of the Ministry of Agriculture and Livestock, repealing\nLaw No. 6343 of May 2,\n1978, the Animal Health Law, and thereby substituting for all legal purposes\nthe Directorate of Animal\nHealth of the Ministry of Agriculture and Livestock.\n\n \n\n            6º-That\nthrough the National Animal Health Service (SENASA) a series of\nservices are provided to agricultural and livestock producers and establishments, and the sale of these\ngenerates the necessary resources for the sustainability of the Service,\nthereby allowing it to cover expenses related to salaries and social charges, the\nreplacement and purchase of equipment, materials, reagents, and other supplies\nnecessary for the proper functioning and timely attention to the requirements\nmade to SENASA.\n\n \n\n            7º-That\nin accordance with the mandate established in article 8 bis of Decree No. 27763-MAG\nof March 10, 1999, and its amendments, it is established that the amounts of the\ntariffs for the services stipulated in that Decree are subject to an\nannual increase effective as of February 1 of each year, which will be\ncalculated automatically based on the value of the consumer price\nindex of the previous year.\n\n \n\n            8º-That\nit is necessary to introduce some new tariffs derived directly from\nthe aforementioned Law No. 8495 and\npublicize the current price of the tariffs charged by this Service, given that its\nlast general publication was in 2005.
