  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 35543\n\n                        Declara situación de pobreza coyuntural la condición de los pescadores\nsujetos a las restricciones y condiciones de veda para el Golfo de Nicoya, según el acuerdo\nA.J.D.I.P./200-2009 y acuerdo N° A.J.D.I.P 227 del 2009\n\nTexto Completo acta: CA0B3\n\nNº\n35543-MP-S-MAG\n\n \n\nEl PRESIDENTE DE LA REPÚBLICA\n\nY LOS MINISTROS DE LA\nPRESIDENCIA,\n\nDE SALUD Y DE AGRICULTURA Y\nGANADERÍA\n\n \n\n            En uso de las facultades y\natribuciones que les confieren los artículos 140 incisos 3), 8) 18), 20) y artículo\n146 de la Constitución Política, los numerales 25, 27 párrafo primero, 28\npárrafo segundo inciso b) y 103 párrafo primero de la Ley Nº 6227 \"Ley General\nde la Administración Pública\", la Ley Nº 7064 del 29 de abril de 1987 \"Ley de\nFomento a la Producción Agropecuaria, que incorpora la Ley Orgánica del\nMinisterio de Agricultura y Ganadería\", artículos 2 y 4 de la Ley Nº 4760 del 4\nde mayo de 1971 \"Ley de Creación del Instituto Mixto de Ayuda Social\", el\nartículo 4º del Reglamento para la Prestación de Servicios y el Otorgamiento de\nBeneficios del Instituto Mixto de Ayuda Social, publicado en La Gaceta\nNº 102 del 29 de mayo del 2000; artículos 34 y 36 de la Ley Nº 8436 \"Ley de\nPesca y Acuicultura\" publicada en el Diario Oficial La Gaceta Nº 78 del\n25 de abril de 2005 y el Decreto Ejecutivo 34741 \"Reforma Reglamento Orgánico\ndel Poder Ejecutivo\" del 10 de setiembre del 2008;\n\n \n\nConsiderando:\n\n \n\n            1º-Que conforme el Decreto Ejecutivo\n34741 \"Reforma Reglamento Orgánico del Poder Ejecutivo\" del 10 de setiembre del\n2008, el Ministerio de Salud en cabeza de su jerarca ejerce el rol de rectoría\ntanto del Sector Salud como del Sector Social y Lucha contra la Pobreza.\n\n            2º-Que\nde conformidad con la Ley Nº 8436, publicada en el Diario Oficial La Gaceta\nNº 78 de fecha 25 de abril de 2005 es atribución del Instituto de Pesca y\nAcuicultura (INCOPESCA) proteger y conservar los recursos hidrobiológicos, en\naras de garantizar a las generaciones venideras, los recursos vivos del mar,\npromoviendo, una explotación sostenible de los recursos mediante el\nestablecimiento de periodos y áreas de veda, para lo cual se emite el acuerdo\nNº A.J.D.I.P./ 200-2009 y acuerdo Nº A.J.D.I.P 227 del 2009, publicado en el\nDiario Oficial La Gaceta Nº 135 del 14 de julio del 2009 y en La\nGaceta Nº 147 del 30 de julio del 2009, respectivamente.\n\n            3º-Que\nel acuerdo citado y con base en el artículo 34 de la Ley 8436, Ley de Pesca y\nAcuicultura, prohíbe totalmente pescar en el área comprendida entre una línea\nrecta imaginaria que va desde Punta Torres, conocida como Peñón (84º43'52''\nLongitud Oeste, 09º53'31'' Latitud Norte) hasta el Faro de las Islas Negritos\nAfuera (84º49'35'' Longitud Oeste, 09º49'14'' Latitud Norte) y de esa línea,\naguas adentro hasta la desembocadura del Río Tempisque, a los pescadores\nartesanales de las comunidades del Golfo de Nicoya, que se encuentran en las\nprovincias de Puntarenas y Guanacaste, en el período comprendido en el 01 de\noctubre y el 15 de noviembre de 2009.\n\n            4º-Que\neste acuerdo citado impide a los pescadores desempañar su actividad remunerada\ny por ende percibir ingresos por este concepto, afectando la satisfacción de\nsus necesidades básicas.\n\n            5º-Que\nen el artículo 36 de la Ley 8436, Ley de Pesca y Acuicultura, se expresa:\n\"...El Poder Ejecutivo podrá autorizar el destino de fondos del Presupuesto\nNacional a favor de INCOPESCA para la realización de los estudios sobre vedas,\ny a favor del Instituto Mixto de Ayuda Social (IMAS), con el propósito de\ndesarrollar programas de asistencia socioeconómica diseñados especialmente con\ntal propósito, a favor de los pescadores que se vean afectados en los períodos\nde veda, siempre que se compruebe que no tienen otras fuentes de ingresos y se\nencuentran en condición de pobreza. Estos programas implicarán necesariamente\nservicios de trabajo comunal por parte de los beneficiarios, conforme al\nreglamento correspondiente o para la realización de estudios sobre la materia.\n\n            6º-Que\nel acuerdo de veda aprobado por la Junta Directiva del INCOPESCA al\ncorresponder a una veda total implica que para los pescadores sujetos de la\nmisma no se les realizará ni tramitará o autorizará el combustible a precio\npreferencial, con el consecuente impacto para el erario público.\n\n            7º-Que\nla Ley de Creación del Instituto Mixto de Ayuda Social, Nº 4760 del 4 de mayo\nde 1971, establece en su artículo 2º la finalidad de resolver el problema de la\npobreza extrema en el país y en su artículo 4º dentro de sus fines de creación,\nse señala \"atender las necesidades de los grupos sociales o de las personas que\ndeban ser provistas de medios de subsistencia cuando carezcan de ellos\".\n\n            8º-Que\nel artículo 4º del Reglamento para la Prestación de Servicios y el Otorgamiento\nde Beneficios del Instituto Mixto de Ayuda Social, publicado en La Gaceta\nNº 102 del 29 de mayo del 2000, define el concepto de pobreza como: \"Fenómeno o\nsituación compleja de índole coyuntural o estructural multifacético y\nheterogéneo, que afecta a las personas y que se caracteriza por sus precarias\ncondiciones de vivienda y sanitarias, bajos niveles educacionales, inserción\ninestable en el sistema productivo, condiciones de riesgo social, con poca o\nninguna incorporación en mecanismos de participación social, recursos\ninsuficientes para satisfacer necesidades básicas nutricionales, salud,\neducación y vivienda y en algunos casos ausencia o insuficiencia de destrezas,\naptitudes, herramientas y oportunidades para generar y acumular ingresos\".\n\n            9º-Que\nen el artículo 21 inciso h) del citado Reglamento, se señala en cuanto a los\nsujetos de los servicios institucionales, lo siguiente: \"En casos de excepción\ndebidamente documentados y con el correspondiente informe técnico social\nautorizados por quien ejerza la Gerencia Regional respectiva, se podrá otorgar\nbeneficios a personas o familias que presenten una situación de pobreza\ncoyuntural no necesariamente registrada como tal en el SIPO, o que mediante\nalgún decreto o ley específica, se considere beneficiarios de la acción\ninstitucional\".\n\n            10.-Que no se cuenta con un fondo compensatorio para brindar\nun subsidio económico a los pescadores afectados por la veda.\n\n            11.-Que el período de veda, provoca una situación de pobreza\ncoyuntural en los pescadores por la carencia de ingresos por este concepto, la\ncual, persiste un fin e interés público dirigido a la protección, conservación\ny sostenibilidad de los recursos hidrológicos, por lo cual resulta necesario\nasegurar el cumplimiento efectivo de la misma, mediante la definición de un\nsubsidio temporal a dichos pescadores que cubra en forma adecuada sus\nnecesidades básicas, nutricionales, de salud y vivienda. Por tanto,\n\n \n\nDecretan:\n\n \n\nDECLÁRESE EN SITUACIÓN DE\nPOBREZA COYUNTURAL\n\nLA CONDICIÓN DE LOS PESCADORES\nSUJETOS A LAS\n\nRESTRICCIONES Y CONDICIONES DE\nVEDA PARA\n\nEL GOLFO DE NICOYA\n\n \n\n            Artículo 1º-Declárese en situación\nde pobreza coyuntural la condición de los pescadores sujetos a las\nrestricciones y condiciones de veda para el Golfo de Nicoya, según Acuerdo\nA.J.D.I.P./ 200-2009 y acuerdo Nº A.J.D.I.P 227 del\n2009, publicados en el Diario Oficial La Gaceta Nº 135 del 14 de julio\ndel 2009 y en La Gaceta Nº 147 del 30 de julio del 2009,\nrespectivamente.\n\n            Artículo\n2º-Autorízase al Instituto Mixto de Ayuda Social a otorgar beneficios\neconómicos en calidad de subsidio a las personas indicadas en el artículo\nanterior, en apego a las condiciones que se establecen en el presente decreto.\n\n            Artículo\n3º-Serán beneficiarias de los recursos del IMAS, únicamente aquellas personas\nque se encuentren expresamente comprendidas dentro de la lista de pescadores\npropietarios y sus ayudantes de embarcaciones artesanales con licencia de pesca\ncomercial vigente, remitida por el Departamento de Extensión y Capacitación del\nINCOPESCA a más tardar el 4 de setiembre del 2009, siempre que se compruebe que\nno tiene otras fuentes de ingresos y que hayan cumplido con los servicios de\ntrabajo comunal, conforme lo establezca el INCOPESCA.\n\n \n\n            Dicha\nlista contendrá los siguientes requisitos mínimos:\n\n \n\na) Nombre completo del beneficiario.\n\n \n\nb) Número de cédula de identidad del beneficiario.\n\n \n\nc) Lugar de residencia del beneficiario.\n\n \n\nd) Número de licencia.\n\n            Artículo 4º-La incorporación de los\nposibles beneficiarios en los listados remitidos por el INCOPESCA al IMAS, no\ngenerará por sí misma derecho a recibir el beneficio del presente decreto, el\ncual estará condicionado a la valoración, verificación y efectiva comprobación\nde los requisitos correspondientes de conformidad con las competencias del\nIMAS.\n\n            Artículo\n5º-El IMAS, procederá a la atención de estas personas con base en la resolución\ndebidamente fundamentada y aprobada por la Gerente Regional que determine el\ncumplimiento de los requisitos establecidos en este decreto, de conformidad con\nel listado remitido al IMAS por el Departamento de Extensión y Capacitación del\nINCOPESCA y con los siguientes requisitos:\n\n \n\na) Fotocopia de la licencia de pesca comercial vigente, extendida por\nINCOPESCA.\n\n \n\nb) Fotocopia de la cédula de identidad vigente\n\n \n\nc) Declaración jurada de cada beneficiario indicando que no cuenta con\nmás fuentes de ingresos en su núcleo familiar que la actividad de pesca; antes\ny durante la veda.\n\n \n\nd) Certificación de la C.C.S.S., en donde conste que no es asalariado\npor alguna empresa o institución.\n\n            Artículo 6º-El IMAS otorgará un\nsubsidio a los beneficiarios que cumplan con las condiciones estipuladas en el\nartículo anterior. Dicho subsidio será emitido en dos eventos o tractos, de la\nsiguiente manera:\n\n \n\na) El primer tracto se entregará a más tardar el día 15 de octubre de\n2009 y que corresponderá al mes de octubre de 2009 por un monto de ciento\nveinticinco mil colones exactos (¢125.000,00) por beneficiario.\n\n \n\nb) El segundo tracto se entregará a más tardar el 20 de noviembre de\n2009 y será por la suma de cincuenta mil colones (¢50.000,00) por beneficiario.\n\n            Artículo 7º-Los subsidios serán\ntramitados por las Gerencias Regionales del IMAS de las zonas de Puntarenas y\nGuanacaste, previo aporte por parte de INCOPESCA de los requisitos estipulados\nen el artículo tercero del presente decreto y no requerirán que las familias se\nencuentren registrados en el Sistema de Información de la Población objetivo\n(SIPO).\n\n \n\n            No\nobstante, si de la información contenida en dicho sistema o de otros medios se\ndesprende que los potenciales beneficiarios o sus familias cuentan con otros\ningresos, proveniente de salarios, actividades remuneradas, renta u otros el\nIMAS podrá denegar el otorgamiento del beneficio lo cual debe ser comunicado de\ninmediato a INCOPESCA para lo que corresponda.\n\n            Artículo\n8º-Corresponderá al INCOPESCA, la supervisión y control del Servicio de Trabajo\nComunal que realizarán los pescadores en el período de veda, de conformidad con\nel respectivo reglamento que regule dicha actividad.\n\n            Artículo\n9º-El INCOPESCA comunicará a la Gerencia Regional respectiva del IMAS, en un\nplazo no mayor de ocho días hábiles que se tengan conocimiento de los hechos ,\nel nombre de aquellas personas que incumplan con el programa de Servicio de\nTrabajo Comunal, así como aquellos que ejecuten acciones que contravengan la\ndeclaratoria de veda o que posea ingresos complementarios. En estos casos el\nIMAS procederá a la revocatoria del beneficio autorizado, previo cumplimiento\ndel debido proceso, sin demerito de la posibilidad de las acciones de\nrecuperación de los montos del subsidio otorgado, así como la posibilidad de\nsuspensión por parte de INCOPESCA, del otorgamiento del combustible a precio\npreferencial, en forma proporcional al monto otorgado.\n\n            Artículo\n10.-Rige a partir de esta fecha.\n\n \n\n            Dado en la Presidencia de la\nRepública, San José, a los veintiocho días del mes de agosto del dos mil nueve.",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 35543\n\n                        Declares the condition of fishermen subject to the restrictions and conditions of the closed season for the Gulf of Nicoya to be a situation of circumstantial poverty, according to agreement A.J.D.I.P./200-2009 and agreement No. A.J.D.I.P 227 of 2009\n\nFull Text of record: CA0B3\n\nNo.\n35543-MP-S-MAG\n\n \n\nThe PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTERS OF THE PRESIDENCY,\n\nOF HEALTH AND OF AGRICULTURE AND LIVESTOCK\n\n \n\n            In use of the powers and attributions conferred upon them by articles 140 subsections 3), 8) 18), 20) and article 146 of the Political Constitution, numerals 25, 27 first paragraph, 28 second paragraph subsection b) and 103 first paragraph of Law No. 6227 \"Ley General de la Administración Pública\", Law No. 7064 of April 29, 1987 \"Ley de Fomento a la Producción Agropecuaria, which incorporates the Ley Orgánica del Ministerio de Agricultura y Ganadería\", articles 2 and 4 of Law No. 4760 of May 4, 1971 \"Ley de Creación del Instituto Mixto de Ayuda Social\", article 4 of the Reglamento para la Prestación de Servicios y el Otorgamiento de Beneficios del Instituto Mixto de Ayuda Social, published in La Gaceta No. 102 of May 29, 2000; articles 34 and 36 of Law No. 8436 \"Ley de Pesca y Acuicultura\" published in the Official Gazette La Gaceta No. 78 of April 25, 2005 and Executive Decree 34741 \"Reforma Reglamento Orgánico del Poder Ejecutivo\" of September 10, 2008;\n\n \n\nConsidering:\n\n \n\n            1º-That pursuant to Executive Decree 34741 \"Reforma Reglamento Orgánico del Poder Ejecutivo\" of September 10, 2008, the Ministry of Health, headed by its chief officer, exercises the stewardship role of both the Health Sector and the Social and Fight against Poverty Sector.\n\n            2º-That in accordance with Law No. 8436, published in the Official Gazette La Gaceta No. 78 dated April 25, 2005, it is an attribution of the Instituto de Pesca y Acuicultura (INCOPESCA) to protect and conserve hydrobiological resources, in order to guarantee for future generations the living resources of the sea, promoting a sustainable exploitation of resources through the establishment of closed season periods and areas, for which agreement No. A.J.D.I.P./ 200-2009 and agreement No. A.J.D.I.P 227 of 2009 are issued, published in the Official Gazette La Gaceta No. 135 of July 14, 2009 and in La Gaceta No. 147 of July 30, 2009, respectively.\n\n            3º-That the cited agreement, based on article 34 of Law 8436, Ley de Pesca y Acuicultura, totally prohibits fishing in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52'' West Longitude, 09º53'31'' North Latitude) to the Lighthouse of Islas Negritos Afuera (84º49'35'' West Longitude, 09º49'14'' North Latitude) and from that line, out to sea to the mouth of the Tempisque River, for artisanal fishermen of the communities of the Gulf of Nicoya, located in the provinces of Puntarenas and Guanacaste, during the period from October 1 to November 15, 2009.\n\n            4º-That this cited agreement prevents fishermen from carrying out their remunerated activity and therefore from receiving income from this source, affecting the satisfaction of their basic needs.\n\n            5º-That article 36 of Law 8436, Ley de Pesca y Acuicultura, states: \"...The Executive Branch may authorize the allocation of National Budget funds in favor of INCOPESCA for conducting studies on closed seasons, and in favor of the Instituto Mixto de Ayuda Social (IMAS), for the purpose of developing socioeconomic assistance programs, specially designed for that purpose, in favor of fishermen affected during closed season periods, provided it is proven they have no other sources of income and are in a condition of poverty. These programs will necessarily involve community work services (servicios de trabajo comunal) by the beneficiaries, in accordance with the corresponding regulations or for conducting studies on the matter.\n\n            6º-That the closed season agreement approved by the Board of Directors of INCOPESCA, corresponding to a total closed season, implies that for fishermen subject to it, preferential-price fuel will not be processed or authorized, with the consequent impact on the public treasury.\n\n            7º-That the Ley de Creación del Instituto Mixto de Ayuda Social, No. 4760 of May 4, 1971, establishes in its article 2 the purpose of solving the problem of extreme poverty in the country, and in its article 4, among its creation goals, it is stated \"to attend to the needs of social groups or persons who must be provided with means of subsistence when they lack them.\"\n\n            8º-That article 4 of the Reglamento para la Prestación de Servicios y el Otorgamiento de Beneficios del Instituto Mixto de Ayuda Social, published in La Gaceta No. 102 of May 29, 2000, defines the concept of poverty as: \"A complex phenomenon or situation of a circumstantial or structural nature, multifaceted and heterogeneous, which affects persons and is characterized by their precarious housing and sanitary conditions, low educational levels, unstable insertion in the productive system, conditions of social risk, with little or no incorporation into mechanisms of social participation, insufficient resources to meet basic nutritional, health, education, and housing needs, and in some cases absence or insufficiency of skills, aptitudes, tools, and opportunities to generate and accumulate income.\"\n\n            9º-That in article 21 subsection h) of the cited Regulation, regarding the subjects of institutional services, the following is indicated: \"In duly documented exception cases and with the corresponding technical social report authorized by the respective Regional Management, benefits may be granted to persons or families presenting a situation of circumstantial poverty not necessarily registered as such in the SIPO, or who by means of a specific decree or law are considered beneficiaries of institutional action.\"\n\n            10.-That there is no compensatory fund to provide an economic subsidy to fishermen affected by the closed season.\n\n            11.-That the closed season period causes a situation of circumstantial poverty among fishermen due to the lack of income from this source, a situation which persists alongside a public purpose and interest aimed at the protection, conservation, and sustainability of hydrological resources. Therefore, it is necessary to ensure the effective compliance with it, by defining a temporary subsidy to said fishermen that adequately covers their basic, nutritional, health, and housing needs. Therefore,\n\n \n\nDecree:\n\n \n\nDECLARED IN A SITUATION OF CIRCUMSTANTIAL POVERTY\n\nTHE CONDITION OF FISHERMEN SUBJECT TO THE\n\nRESTRICTIONS AND CONDITIONS OF THE CLOSED SEASON FOR\n\nTHE GULF OF NICOYA\n\n \n\n            Article 1º-The condition of fishermen subject to the restrictions and conditions of the closed season for the Gulf of Nicoya is declared in a situation of circumstantial poverty, according to Agreement A.J.D.I.P./ 200-2009 and agreement No. A.J.D.I.P 227 of 2009, published in the Official Gazette La Gaceta No. 135 of July 14, 2009 and in La Gaceta No. 147 of July 30, 2009, respectively.\n\n            Article 2º-The Instituto Mixto de Ayuda Social is authorized to grant economic benefits as a subsidy to the persons indicated in the previous article, in accordance with the conditions established in this decree.\n\n            Article 3º-Beneficiaries of the IMAS resources shall only be those persons expressly included within the list of owner fishermen and their helpers of artisanal vessels with a valid commercial fishing license, remitted by the Department of Extension and Training of INCOPESCA no later than September 4, 2009, provided it is proven that they have no other sources of income and that they have completed the community work services, as established by INCOPESCA.\n\n \n\n            Said list shall contain the following minimum requirements:\n\n \n\na) Full name of the beneficiary.\n\n \n\nb) Identity card number of the beneficiary.\n\n \n\nc) Place of residence of the beneficiary.\n\n \n\nd) License number.\n\n            Article 4º-The incorporation of potential beneficiaries in the lists sent by INCOPESCA to IMAS shall not in itself generate the right to receive the benefit of this decree, which will be conditional upon the assessment, verification, and effective confirmation of the corresponding requirements in accordance with the competencies of IMAS.\n\n            Article 5º-IMAS shall attend to these persons based on a duly reasoned and approved resolution by the Regional Manager that determines compliance with the requirements established in this decree, in accordance with the list sent to IMAS by the Department of Extension and Training of INCOPESCA and with the following requirements:\n\n \n\na) Photocopy of the valid commercial fishing license, issued by INCOPESCA.\n\n \n\nb) Photocopy of the valid identity card\n\n \n\nc) Sworn statement from each beneficiary indicating that their family unit has no other sources of income besides fishing activity; before and during the closed season.\n\n \n\nd) Certification from the C.C.S.S., stating that they are not a salaried employee of any company or institution.\n\n            Article 6º-IMAS shall grant a subsidy to beneficiaries who meet the conditions stipulated in the previous article. Said subsidy shall be issued in two events or installments, as follows:\n\n \n\na) The first installment shall be delivered no later than October 15, 2009, corresponding to the month of October 2009, for an amount of one hundred twenty-five thousand exact colones (¢125,000.00) per beneficiary.\n\n \n\nb) The second installment shall be delivered no later than November 20, 2009, and shall be for the sum of fifty thousand colones (¢50,000.00) per beneficiary.\n\n            Article 7º-The subsidies shall be processed by the Regional Managements of IMAS in the zones of Puntarenas and Guanacaste, upon prior provision by INCOPESCA of the requirements stipulated in article three of this decree and shall not require that the families be registered in the Target Population Information System (Sistema de Información de la Población Objetivo, SIPO).\n\n \n\n            However, if from the information contained in said system or from other means it is evident that potential beneficiaries or their families have other income, coming from salaries, remunerated activities, rent, or others, IMAS may deny the granting of the benefit, which must be communicated immediately to INCOPESCA for the corresponding actions.\n\n            Article 8º-It shall be the responsibility of INCOPESCA to supervise and control the Community Work Service that the fishermen shall perform during the closed season period, in accordance with the respective regulation governing said activity.\n\n            Article 9º-INCOPESCA shall inform the respective Regional Management of IMAS, within a term not exceeding eight business days from becoming aware of the facts, of the name of those persons who fail to comply with the Community Work Service program, as well as those who carry out actions that contravene the closed season declaration or who have complementary income. In these cases, IMAS shall proceed with the revocation of the authorized benefit, upon prior compliance with due process, without prejudice to the possibility of actions to recover the amounts of the granted subsidy, as well as the possibility of suspension by INCOPESCA of the granting of preferential-price fuel, in proportion to the amount granted.\n\n            Article 10.-Effective as of this date.\n\n \n\n            Given at the Presidency of the Republic, San José, on the twenty-eighth day of the month of August, two thousand nine."
