Para efecto de clasificarlos, existen tres clases de refugios\nnacionales de vida silvestre: Refugios de propiedad estatal, Refugios de\npropiedad mixta y Refugios de propiedad privada.\n\n            4º-Que\nla Ley Orgánica del Ambiente en su artículo 41 declara de interés público los\nhumedales y su conservación, por ser de uso múltiple, estén o no estén protegidos\npor las leyes que rijan esta materia.\n\n            5º-Que\nDesarrollos Mil Novecientos Veintiuno, Sociedad Anónima, cédula jurídica número\n3-101-237706, a\ntravés de su representante legal el señor José Álvaro Jenkins Rodríguez, cédula\nnúmero 2-0367-0674, propietaria del inmueble finca Nº 5- 119634-000, ubicada en\nel distrito primero Filadelfia, cantón quinto Carrillo de la Provincia de\nGuanacaste, promovió la creación del Refugio Nacional de Vida Silvestre\ndenominado Hacienda El Viejo de categoría privada y presentó solicitud para\nincorporar voluntariamente a éste, una sección de la propiedad actualmente\nllamada Hacienda El Viejo, la cual ocupa una superficie de 1138 ha con 8309,94 m2,\ncorrespondiente al plano catastrado Nº G-636506-2000, por un periodo de 10\naños.\n\n            6º-Que\ndicha propiedad se encuentra ubicada en el distrito 01 Filadelfia, del cantón\n05 Carrillo, provincia de Guanacaste, específicamente en la planicie aluvial\nformada entre los ríos Tempisque y Bolsón, colinda al norte y oeste con resto\nde las propiedades de Desarrollos Mil novecientos veintiuno, Sociedad Anónima,\nal sur con el río Bolsón, al este con margen derecho del río Tempisque y que\ndicha finca se localiza en la hoja cartográfica Tempisque Nº 3147-III escala 1:50.000.\n\n            7º-Que\nel área que se dedicará a refugio es considerada de gran importancia para la\nprotección de la biodiversidad de la región de Guanacaste, pues producto de las\ninterrelaciones geográficas (geología, topografía, suelos, clima), se ha dado\nlugar a la formación de grupos vegetales que van desde formaciones boscosas en\náreas de serranías (lomas y cerros), hasta ecosistemas semiacuáticos en donde\nse destacan los pantanos herbáceos y bosques anegados.\n\n            8º-Que\nlas asociaciones vegetales de la cuenca baja del río Tempisque poseen un alto\nvalor ambiental, económico y social no sólo por su belleza paisajística, sino\nporque la intrincada red de relaciones ecosistemáticas entre dichos hábitat\npermite el equilibrio hídrico y la regulación de los ciclos vitales de los que\ndependen las actividades agroindustrial, turística y pesquera.\n\n            9º-Que\nDesarrollos Mil Novecientos Veintiuno, Sociedad Anónima, elaboró un Plan de\nManejo que fue aprobado mediante resolución ACT-OR-007 del 15 de noviembre de\n2007 por el Comité Técnico del Área de Conservación Tempisque, por el Consejo\nRegional del Área de Conservación Tempisque el 20 de diciembre del 2007 y por\nel Consejo Nacional de Áreas de Conservación en la sesión Nº 3-2008, Acuerdo\nnúmero 16 del 1º de abril del 2008.\n\n            10.-Que\nanalizada la documentación presentada por Desarrollos Mil Novecientos\nVeintiuno, Sociedad Anónima se determinó que cumplió con lo establecido en el\nartículo 171 del decreto Ejecutivo Nº 32633- MINAE denominado Reglamento a la\nLey de Conservación de la Vida Silvestre.\n\n            11.-Que\nmediante Acuerdo Nº 16 de la Sesión Extraordinaria Nº 3-2008 del 31 de marzo y\n01 de abril del 2008 el Consejo Nacional de Áreas de Conservación (CONAC)\naprobó el Plan de Manejo y creación del Refugio Nacional de Vida Silvestre\nHacienda El Viejo, propiedad privada, de conformidad al artículo 12 inciso d)\ndel Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE del\n11 de marzo del 2008. Por tanto:\n\n \n\nDecretan:\n\nCréase el Refugio Nacional de\nVida Silvestre\n\nHacienda El Viejo, Categoría\nPrivada\n\n \n\n            Artículo 1º-Créase el Refugio Nacional de Vida Silvestre Hacienda El Viejo, categoría\nprivada, el cual estará afecto a la finca folio real Nº 5-119634-000 ubicada en el distrito de\nFiladelfia de la provincia de Guanacaste, la cual consta de un área total de 1 138 ha con 8 309,94\nm2, misma que tendrá una zonificación de la siguiente manera:\n\n \n\n| Zona | Porcentaje | Criterio | | --- | --- | --- | | Uso Sostenible de recursos | 74% | Presenta\nprocesos de regeneración natural. Propiciar la vigilancia, la restauración de hábitat o ecosistemas, la capacitación y la\nconciencia ambientalista en las diferentes actividades de producción. |\n\n \n\n            Los porcentajes que se indican en las\nlíneas anteriores corresponden a fracciones de la finca dedicadas a esos usos.\n\n \n\n            En\nel apartado correspondiente a la zona de amortiguamiento no se indica\nporcentaje, porque corresponde a las fincas aledañas al refugio, al Río\nTempisque y a las comunidades cercanas, todo lo cual esta fuera del refugio y\nconsiste en un área de influencia.\n\n            Artículo\n2º-Desarrollos Mil Novecientos Veintiuno, Sociedad Anónima, como propietaria\ndel inmueble, deberá abstenerse de desarrollar cualquier actividad que\ncomprometa la existencia de la flora y fauna del lugar, sin contar con los\nrespectivos permisos del Ministerio de Ambiente, Energía y Telecomunicaciones\nen adelante denominado MINAET, debiendo brindar además, toda la colaboración\nnecesaria a investigadores, inspectores de recursos naturales y funcionarios de\neste Ministerio que en funciones oficiales visiten dicha área.\n\n \n\n            De\nigual manera, el Sistema Nacional de Áreas de Conservación (SINAC) ofrecerá a\nDesarrollos mil novecientos veintiuno, Sociedad Anónima, todo el apoyo\nrequerido para asegurar la conservación de los ecosistemas presentes en el\nrefugio.\n\n            Artículo\n3º-El manejo de la vida silvestre y de los sitios de humedales estará sujeto\ntanto a la legislación y políticas existentes en el SINAC, como al Plan de\nManejo aprobado por el Área de Conservación Tempisque, por el Consejo Regional\ndel Área de Conservación Tempisque y por el Consejo Nacional de Áreas de\nConservación.\n\n            Artículo\n4º-En el Plan de Manejo se definen los objetivos, las actividades y las\nregulaciones que se tendrán en el Refugio Nacional de Vida Silvestre Hacienda\nEl Viejo, para un periodo de cinco años, el cual será evaluado al menos 6 meses\nantes de cumplir los 5 años y redefinido por un periodo igual hasta el\ncumplimiento de los 10 años.\n\n            Artículo\n5º-El inmueble dado por Hacienda El Viejo estará sometido a la categoría de\nRefugio Nacional de Vida Silvestre, en categoría privada durante un período de\ndiez años prorrogables por períodos iguales, en cuyo caso el propietario deberá\nsolicitarlo con tres meses de antelación a la finalización de dicho período.\n\n            Artículo\n6º-En caso de que Desarrollos Mil Novecientos Veintiuno, Sociedad Anónima como\npropietaria del bien, no desee seguir sometiendo su propiedad a la categoría de\nRefugio de Vida Silvestre, deberá notificarlo al Área de Conservación Tempisque\ncon no menos de seis meses de anticipación al vencimiento del plazo de\nafectación; para iniciar los trámites correspondientes a la desafectación de la\nmisma y asegurarse el cumplimiento satisfactorio de los planes operativos que\nse estén ejecutando; y en todo caso deberán respetarse las limitaciones legales\nindicadas en la Ley Forestal y en la demás legislación ambiental con respecto al\ncambio de uso del suelo y a la protección de los humedales.\n\n            Artículo\n7º-Con fin de dar seguimiento y evaluación al plan de manejo y al Refugio, se\ncreará una Comisión de Seguimiento, en adelante denominada Comisión.\n\n            Artículo\n8º-Las funciones de la Comisión serán el propiciar un manejo integral y\nsostenible de los recursos naturales en dicha área silvestre y asumir el manejo\nintegral de la cuenca baja del río Tempisque incluyendo las otras áreas\nsilvestres existentes.\n\n            Artículo\n9º-La Comisión estará integrada por dos miembros para la parte estatal y dos\nmiembros para la parte privada, cuyo nombramiento deberá realizarse dentro de\nlos tres meses posteriores a la publicación de este decreto. For the purpose of classifying them, there are three classes of national wildlife refuges: State-owned Refuges, Mixed-ownership Refuges, and Privately-owned Refuges.\n\n 4º-That the Organic Law of the Environment in its Article 41 declares wetlands and their conservation to be of public interest, due to their multiple use, whether or not they are protected by the laws governing this matter.\n\n 5º-That Desarrollos Mil Novecientos Veintiuno, Sociedad Anónima, legal identification number 3-101-237706, through its legal representative Mr. José Álvaro Jenkins Rodríguez, identification number 2-0367-0674, owner of the property farm No. 5-119634-000, located in the first district of Filadelfia, fifth canton of Carrillo, Province of Guanacaste, promoted the creation of the National Wildlife Refuge called Hacienda El Viejo of private category and submitted an application to voluntarily incorporate into it a section of the property currently called Hacienda El Viejo, which occupies an area of 1138 ha with 8309.94 m2, corresponding to the cadastral map No. G-636506-2000, for a period of 10 years.\n\n 6º-That said property is located in district 01 Filadelfia, canton 05 Carrillo, province of Guanacaste, specifically on the alluvial plain formed between the Tempisque and Bolsón rivers, bordering to the north and west with the rest of the properties of Desarrollos Mil novecientos veintiuno, Sociedad Anónima, to the south with the Bolsón River, to the east with the right bank of the Tempisque River, and that said farm is located on the cartographic sheet Tempisque No. 3147-III at a scale of 1:50,000.\n\n 7º-That the area to be dedicated as a refuge is considered of great importance for the protection of biodiversity in the region of Guanacaste, since as a result of geographic interrelations (geology, topography, soils, climate), the formation of plant groups has occurred, ranging from forest formations in mountain range areas (hills and mountains) to semi-aquatic ecosystems where herbaceous swamps and flooded forests stand out.\n\n 8º-That the plant associations of the lower basin of the Tempisque River possess high environmental, economic, and social value, not only for their scenic beauty but also because the intricate network of ecosystemic relationships among these habitats allows for water balance and the regulation of the vital cycles upon which agro-industrial, tourism, and fishing activities depend.\n\n 9º-That Desarrollos Mil Novecientos Veintiuno, Sociedad Anónima, prepared a Management Plan (Plan de Manejo) that was approved by resolution ACT-OR-007 of November 15, 2007, by the Technical Committee of the Tempisque Conservation Area (Área de Conservación Tempisque), by the Regional Council of the Tempisque Conservation Area on December 20, 2007, and by the National Council of Conservation Areas (CONAC) in session No. 3-2008, Agreement number 16 of April 1, 2008.\n\n 10.-That upon analyzing the documentation submitted by Desarrollos Mil Novecientos Veintiuno, Sociedad Anónima, it was determined that it complied with the provisions of Article 171 of Executive Decree No. 32633-MINAE called the Regulation to the Wildlife Conservation Law.\n\n 11.-That through Agreement No. 16 of the Extraordinary Session No. 3-2008 of March 31 and April 1, 2008, the National Council of Conservation Areas (CONAC) approved the Management Plan and creation of the Hacienda El Viejo National Wildlife Refuge, private property, in accordance with Article 12 subsection d) of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE of March 11, 2008. Therefore:\n\n \n\nThey Decree:\n\nCreation of the Hacienda El Viejo National Wildlife Refuge, Private Category\n\n \n\n Article 1º-The Hacienda El Viejo National Wildlife Refuge, private category, is hereby created, which shall be constituted by the farm with real estate folio No. 5-119634-000 located in the district of Filadelfia, province of Guanacaste, which consists of a total area of 1,138 ha with 8,309.94 m2, which shall have the following zoning:\n\n \n\n| Zone | Percentage | Criteria | | --- | --- | --- | | Sustainable Use of Resources | 74% | Presents processes of natural regeneration. Public use regulated through guided tours. | | Special Use | 0.76% | Sites for administrative facilities. Presence of towers, control post, high-voltage power line. Firebreaks (Rondas corta fuego). | | Social Interaction Zone (Buffer Zone). | 2 km wide along the perimeter of the Refuge. | Zone immediately adjacent to the protected wild area, which hosts a socio-environmental and production dynamic. Actions should be promoted for the protection of ecosystems and biodiversity elements and to contribute to the ecological viability of the protected area. To foster surveillance, the restoration of habitat or ecosystems, training, and environmental awareness in the different production activities. |\n\n \n\n The percentages indicated in the preceding lines correspond to fractions of the farm dedicated to those uses.\n\n \n\n In the section corresponding to the buffer zone, no percentage is indicated because it corresponds to the farms adjacent to the refuge, the Tempisque River, and the nearby communities, all of which are outside the refuge and constitute an area of influence.\n\n Article 2º-Desarrollos Mil Novecientos Veintiuno, Sociedad Anónima, as owner of the property, must refrain from developing any activity that compromises the existence of the flora and fauna of the place, without having the respective permits from the Ministry of Environment, Energy and Telecommunications, hereinafter referred to as MINAET, and must also provide all necessary collaboration to researchers, natural resource inspectors, and officials of this Ministry who visit said area on official business.\n\n \n\n Likewise, the National System of Conservation Areas (SINAC) shall offer Desarrollos mil novecientos veintiuno, Sociedad Anónima, all the support required to ensure the conservation of the ecosystems present in the refuge.\n\n Article 3º-The management of wildlife and wetland sites shall be subject to both the existing legislation and policies in SINAC and the Management Plan approved by the Tempisque Conservation Area, the Regional Council of the Tempisque Conservation Area, and the National Council of Conservation Areas.\n\n Article 4º-The Management Plan defines the objectives, activities, and regulations that shall apply in the Hacienda El Viejo National Wildlife Refuge for a period of five years, which shall be evaluated at least 6 months before the completion of the 5 years and redefined for a similar period until the completion of the 10 years.\n\n Article 5º-The property provided as Hacienda El Viejo shall be subject to the category of National Wildlife Refuge, private category, for a period of ten years, renewable for equal periods, in which case the owner must request it three months in advance of the expiration of said period.\n\n Article 6º-In the event that Desarrollos Mil Novecientos Veintiuno, Sociedad Anónima, as owner of the asset, does not wish to continue subjecting its property to the category of Wildlife Refuge, it must notify the Tempisque Conservation Area no less than six months prior to the expiration of the term of the encumbrance; to initiate the corresponding procedures for its decategorization and ensure satisfactory compliance with the operational plans being executed; and in any case, the legal limitations indicated in the Forest Law and in other environmental legislation regarding land-use change (cambio de uso del suelo) and the protection of wetlands must be respected.\n\n Article 7º-In order to monitor and evaluate the management plan and the Refuge, a Follow-up Commission shall be created, hereinafter referred to as the Commission.\n\n Article 8º-The functions of the Commission shall be to promote integral and sustainable management of the natural resources in said wild area and to assume the integral management of the lower basin of the Tempisque River, including the other existing wild areas.\n\n Article 9º-The Commission shall be composed of two members for the state party and two members for the private party, whose appointment must be made within three months following the publication of this decree. The representatives of the private party shall be designated by the private company in writing, and the representatives of the state party shall be appointed by the Director of the Tempisque Conservation Area.\n\n \n\n This Commission shall meet at least once every semester and shall prepare a monitoring and results report concerning the integral management of said wild area.\n\n Article 10.-It shall take effect upon its publication in the Official Gazette La Gaceta.\n\n \n\n Given at the Presidency of the Republic.-San José, on the fourteenth day of the month of August of two thousand nine." }
