  "excerpt_es": "Considerando:\n\n1º-Que el país ha ratificado la Convención de las Naciones Unidas sobre el Cambio Climático (CMNUCC) y el Protocolo de Kyoto.\n2º-Que la Conferencia de las Partes de la Convención se encarga de mantener los esfuerzos internacionales por resolver los problemas del cambio climático, examina la aplicación de la Convención y los compromisos de las Partes en función de los objetivos de la Convención, los nuevos descubrimientos científicos y la experiencia obtenida en la aplicación de las políticas relativas al cambio climático.\n3º-Que la Conferencia de las Partes se reúne todos los años y que los Órganos Subsidiarios Permanentes mantienen reuniones periódicas cuyos resultados sirven de base para la discusión de los temas que se discuten en la Conferencia de las Partes.\n4º-Que nuestro país ha asumido el compromiso de participar en los esfuerzos de fortalecer el régimen establecido por la CMNUCC y su Protocolo de Kyoto, a fin de contribuir a garantizar una respuesta global y oportuna, con base en la información aportada por el Panel Intergubernamental sobre Cambio Climático (IPCC) en sus cuatro informes y sobre la base de los principios que rigen la CMNUCC.\n5º-Que el tema del cambio climático está surgiendo como un eje transversal en el trabajo que desarrollan los diferentes sectores, los cuales involucran programas e instancias de la Administración Pública, que requieren coordinación para direccionar las acciones bajo una visión de país.\n6º-Que Costa Rica ha tenido un rol relevante y de liderazgo en materia ambiental debido a la importancia y la trascendencia de nuestra visión de país; además de las obligaciones contraídas a nivel internacional, lo cual incluye la necesidad urgente de establecer medidas para proteger los ecosistemas más vulnerables contra los efectos del cambio climático.\n7º-Que la mitigación de gases de efecto invernadero y la adaptación al cambio climático está compuesta de ejes transversales en toda la economía y la sociedad.\n8º-Que los futuros acuerdos sobre cambio climático llevarán aparejada la definición de un nuevo rumbo para la economía global, dados los compromisos que habrán de asumir los países para convertirse en economías de bajo carbono, con implicaciones en el comercio internacional.\n9º-Que la construcción de la posición nacional en materia de cambio climático debe tomar en consideración el impacto de tales acuerdos en la economía mundial y la sensibilidad del tema, tanto desde la perspectiva multilateral -en el marco de la OMC- como desde la perspectiva de la estrategia nacional de promoción del comercio y la inversión, sin dejar de lado la promoción y búsqueda de nuevas oportunidades comerciales para los bienes y servicios costarricenses que asuman compromisos de reducción de emisiones de carbono, que puedan servir como facilitadores de reducción de tales emisiones en los sectores productivos, estimulen la innovación tecnológica y la creatividad de nuevos negocios relacionados con este tema y que permitan diversificar aún más la oferta de bienes y servicios exportables costarricenses.\n10.-Que las negociaciones internacionales han venido evolucionando en cuanto a su nivel de trabajo y de especialización demandando un alto nivel técnico y político, por lo que se hace necesario oficializar el Equipo Negociador de Alto Nivel para Cambio Climático que ha venido desarrollando sus funciones desde hace aproximadamente 15 años en diversos foros internacionales, a efecto de definir su integración y funciones. Por tanto,\n\nDecretan:\n\nArtículo 1º-Equipo Negociador. Se nombrará al señor Álvaro Umaña Quesada, cédula de\nidentidad Nº 1-0451-0568 como Coordinador Político del Equipo Negociador de\nAlto Nivel para Cambio Climático, quien viajará en calidad de Embajador en\nMisión Especial para Cambio Climático y fungirá como Jefe Negociador Oficial.\nEn ausencia del Jefe Negociador Oficial, los Ministros de Relaciones Exteriores\ny Culto; de Ambiente, Energía y Telecomunicaciones y de Comercio Exterior, de\ncomún acuerdo, nombrarán para cada una de las actividades internacionales a las\nque se asista, un Jefe Negociador y un Jefe Negociador Alterno en sustitución\ntemporal.\n\n \n\n            Para\nel caso de la Conferencia de las Partes de la CMNUCC, el punto focal nacional,\nen ausencia del Jefe Negociador Oficial y de no asistir un funcionario de mayor\nrango, asumirá como Jefe Negociador.\n\n            Artículo\n4º-Secretaría del Equipo Negociador. La Secretaría del Equipo Negociador\nestará ubicada en el Viceministerio de Calidad Ambiental y Agua del Ministerio\nde Ambiente, Energía y Telecomunicaciones.\n\n            Artículo\n5º-Reuniones del Equipo Negociador. El Equipo Negociador establecerá su\nmetodología interna de trabajo de conformidad con las necesidades y las\ncircunstancias.\n\n \n\n            El\nEquipo Negociador podrá invitar a sus sesiones formales o sesiones de trabajo a\ncualquier representante gubernamental o no gubernamental, nacional o extranjero\na dar sus puntos de vista, si así se considera pertinente.\n\n            Artículo\n6º-Funciones. Serán funciones del Equipo Negociador de Alto Nivel para\nCambio Climático las siguientes:\n\n \n\na) Preparar documentos de posición nacional de acuerdo con las\nprioridades de negociación del país en materia de Cambio Climático.\n\n \n\nb) Procurar que los documentos de posición nacional sean consensuados\ncon los sectores interesados y relevantes en materia de cambio climático de la\nsociedad costarricense.\n\n \n\nc) Proveer opiniones, recomendaciones y consejo a las autoridades de\nlos Ministerios de Relaciones Exteriores y Culto, y de Ambiente, Energía y\nTelecomunicaciones y de Comercio Exterior, o cualquier otra institución que así\nlo solicitase.\n\n \n\nd) Plantear y negociar en los diferentes foros de negociación las\nposiciones nacionales previamente preparadas y consensuadas.\n\n \n\ne) Participar y representar al país -con la designación correspondiente\npor parte de las autoridades de los Ministerios de Relaciones Exteriores y\nCulto; de Ambiente, Energía y Telecomunicaciones y de Comercio Exterior- en\nencuentros, reuniones, conferencias y eventos sobre Cambio Climático, tanto a\nnivel local como aquellas que se organicen en el exterior.\n\n            Artículo 7º-Colaboración. Las\ninstituciones del sector público informarán y cooperarán -en la medida de sus\nposibilidades- con el Equipo Negociador de Alto Nivel en la preparación de las\nposiciones nacionales en Cambio Climático cada vez que éste lo solicite.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 35549\n\n                        Creates the High-Level Negotiating Team for Climate Change\n\nComplete Text of act: CA38D\n\nNo.\n35549-RE-MINAET-COMEX\n\nTHE PRESIDENT OF THE REPUBLIC,\n\nAND THE MINISTERS OF FOREIGN AFFAIRS\nAND WORSHIP,\n\nOF ENVIRONMENT, ENERGY AND\nTELECOMMUNICATIONS\n\nAND OF FOREIGN TRADE\n\nIn use of the powers granted to them by Articles 140, subsections 3), 8), 12, 20) and 146 of the Political Constitution; Articles 27 and 28 of the General Law of Public Administration, No. 6227 of May 2, 1978; Article 17 of the Organic Law of the Ministry of Foreign Affairs and Worship, No. 3008 of July 18, 1962; Article 2, subsections a), b), ch) and e) of the Law of Conversion of the Ministry of Industry, Energy and Mines, Law No. 7152 of June 5, 1990; the United Nations Framework Convention on Climate Change of May 9, 1992, approving Law No. 7414 of June 13, 1994; the Organic Law of the Environment, Law No. 7554 of October 4, 1995; the Kyoto Protocol to the United Nations Framework Convention on Climate Change, approving Law No. 8219 of March 8, 2002 and Executive Decree No. 25066-MINAE of March 21, 1996, which creates the Costa Rican Office for Joint Implementation.\n\nConsidering:\n\n1º-That the country has ratified the United Nations Convention on Climate Change (CMNUCC) and the Kyoto Protocol.\n\n2º-That the Conference of the Parties to the Convention is responsible for maintaining international efforts to solve climate change problems, examines the implementation of the Convention and the commitments of the Parties based on the objectives of the Convention, new scientific discoveries and the experience gained in the implementation of climate change policies.\n\n3º-That the Conference of the Parties meets every year and that the Permanent Subsidiary Bodies hold periodic meetings whose results serve as the basis for the discussion of the topics discussed at the Conference of the Parties.\n\n4º-That our country has assumed the commitment to participate in efforts to strengthen the regime established by the CMNUCC and its Kyoto Protocol, in order to contribute to guaranteeing a global and timely response, based on the information provided by the Intergovernmental Panel on Climate Change (IPCC) in its four reports and based on the principles governing the CMNUCC.\n\n5º-That the issue of climate change is emerging as a cross-cutting axis in the work carried out by different sectors, which involve programs and bodies of the Public Administration, requiring coordination to direct actions under a national vision.\n\n6º-That Costa Rica has played a relevant and leading role in environmental matters due to the importance and transcendence of our national vision; in addition to the obligations contracted at the international level, which includes the urgent need to establish measures to protect the most vulnerable ecosystems against the effects of climate change.\n\n7º-That the mitigation of greenhouse gases (mitigación de gases de efecto invernadero) and adaptation to climate change is composed of cross-cutting axes throughout the economy and society.\n\n8º-That future agreements on climate change will entail the definition of a new course for the global economy, given the commitments that countries will have to assume to become low-carbon economies, with implications for international trade.\n\n9º-That the construction of the national position on climate change must take into consideration the impact of such agreements on the world economy and the sensitivity of the issue, both from the multilateral perspective -within the framework of the WTO- and from the perspective of the national strategy for promoting trade and investment, without neglecting the promotion and search for new commercial opportunities for Costa Rican goods and services that assume carbon emission reduction commitments, that can serve as facilitators for reducing such emissions in productive sectors, stimulate technological innovation and the creativity of new businesses related to this issue and that allow for further diversification of the supply of exportable Costa Rican goods and services.\n\n10.-That international negotiations have been evolving in terms of their level of work and specialization, demanding a high technical and political level, making it necessary to formalize the High-Level Negotiating Team for Climate Change that has been carrying out its functions for approximately 15 years in various international forums, in order to define its composition and functions. Therefore,\n\nDecree:\n\nArticle 1-Negotiating Team. Create the High-Level Negotiating Team for Climate Change, of a permanent nature, which shall have the functions established in Article 7 of this Decree.\n\nArticle 2-Composition. The High-Level Negotiating Team for Climate Change shall be composed of the representatives accredited by the following entities and bodies:\n\n-   The Presidency of the Republic.\n\n-   The Ministry of Foreign Affairs and Worship.\n\n-   The National Meteorological Institute of the Ministry of Environment, Energy and Telecommunications.\n\n-   The Ministry of Environment, Energy and Telecommunications.\n\n-   The National Forest Financing Fund of the Ministry of Environment, Energy and Telecommunications.\n\n-   The Peace with Nature Initiative of the Presidency of the Republic.\n\n-   The Ministry of Foreign Trade.\n\n-   The designated National Authority for the Clean Development Mechanism.\n\n-   The Focal Point of Costa Rica to the United Nations Convention on Climate Change, shall act as Technical Coordinator of the Team.\n\n-   The Focal Point of Costa Rica to the Intergovernmental Panel of Experts on Climate Change.\n\nFor special cases, by agreement of the Ministers of Foreign Affairs and Worship; of Environment, Energy and Telecommunications and of Foreign Trade, the conformation of this team may be expanded with persons who, due to their work and experience, are deemed appropriate to incorporate on a temporary basis.\n\nThe members of the Negotiating Team for Climate Change shall perform their functions on an ad honorem basis, and therefore shall not receive per diems or remuneration for their participation in it.\n\nArticle 3-The Coordinator. Mr. Álvaro Umaña Quesada, identity card No. 1-0451-0568, is appointed as Political Coordinator of the High-Level Negotiating Team for Climate Change, who shall travel as Ambassador on Special Mission for Climate Change and shall act as Official Chief Negotiator. In the absence of the Official Chief Negotiator, the Ministers of Foreign Affairs and Worship; of Environment, Energy and Telecommunications and of Foreign Trade, by mutual agreement, shall appoint for each of the international activities attended, a Chief Negotiator and an Alternate Chief Negotiator as a temporary substitute.\n\nFor the case of the Conference of the Parties of the CMNUCC, the national focal point, in the absence of the Official Chief Negotiator and if no higher-ranking official attends, shall assume the role of Chief Negotiator.\n\nArticle 4-Secretariat of the Negotiating Team. The Secretariat of the Negotiating Team shall be located in the Vice-Ministry of Environmental Quality and Water of the Ministry of Environment, Energy and Telecommunications.\n\nArticle 5-Meetings of the Negotiating Team. The Negotiating Team shall establish its internal working methodology in accordance with needs and circumstances.\n\nThe Negotiating Team may invite any governmental or non-governmental, national or foreign representative to its formal sessions or working sessions to give their points of view, if deemed pertinent.\n\nArticle 6-Functions. The functions of the High-Level Negotiating Team for Climate Change shall be the following:\n\na) Prepare national position documents in accordance with the country's negotiation priorities regarding Climate Change.\n\nb) Ensure that national position documents are agreed upon by consensus with the interested and relevant sectors of Costa Rican society regarding climate change.\n\nc) Provide opinions, recommendations and advice to the authorities of the Ministries of Foreign Affairs and Worship, and of Environment, Energy and Telecommunications and of Foreign Trade, or any other institution that so requests.\n\nd) Propose and negotiate, in the different negotiation forums, the national positions previously prepared and agreed upon by consensus.\n\ne) Participate and represent the country -with the corresponding designation by the authorities of the Ministries of Foreign Affairs and Worship; of Environment, Energy and Telecommunications and of Foreign Trade- in meetings, assemblies, conferences and events on Climate Change, both locally and those organized abroad.\n\nArticle 7-Collaboration. Public sector institutions shall inform and cooperate -to the extent of their possibilities- with the High-Level Negotiating Team in the preparation of national positions on Climate Change whenever it so requests. Likewise, they shall keep the Negotiating Team informed of all aspects that affect the national position on Climate Change.\n\nArticle 8-Reports. The negotiating team shall prepare the reports it deems pertinent and a single final report of its participation in each of the Conferences of the Parties to the United Nations Convention on Climate Change in which it participates, which shall be addressed to the Ministers of Foreign Affairs and Worship; of Environment, Energy and Telecommunications and of Foreign Trade.\n\nArticle 9-Effectiveness.
