  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 35581\n\n                        Prórroga de la Declaratoria de emergencia fitosanitaria para los cantones de\nPérez Zeledón y Buenos Aires en la Zona Sur, y San Carlos y Los Chiles en la Zona Norte, por\npresencia de la plaga Puccinia kuehnii (Roya Naranja)\n\nTexto Completo acta: CC08B\n\nNº\n35581-MAG\n\n \n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE AGRICULTURA Y\nGANADERÍA\n\n \n\n            En ejercicio de las facultades que\nles confieren los artículos 140, incisos 3), 8), 18) y 20) y 146 de la Constitución\nPolítica; los artículos 25, 27.1, 28.2 b) de la Ley Nº 6227 del 2 de mayo de\n1978, Ley General de la Administración Pública; la Ley de Fomento a la\nProducción Agropecuaria FODEA, que incorpora la Ley Orgánica del Ministerio de\nAgricultura y Ganadería, Ley Nº 7064 del 29 de abril de 1987; la Ley Nº 7664\ndel 8 de abril de 1997, Ley de Protección Fitosanitaria; Ley Nº 7818 del 2 de\nsetiembre de 1998, Ley Orgánica de la Agricultura e Industria de la Caña de\nAzúcar; Ley Nº 6735 del 29 de marzo de 1982, Ley del Instituto de Desarrollo\nAgrario; Ley Nº 8634 del 23 de abril del 2008, Ley del Sistema de Banca para el\nDesarrollo.\n\n \n\nConsiderando:\n\n \n\n            1º-Que es función esencial del\nEstado proteger la salud y la vida de las personas y de los animales, así como\ngarantizar la efectiva y eficiente protección de los cultivos agrícolas de las\nplagas que puedan poner en riesgo o causar daños al patrimonio agrícola del\nPaís.\n\n            2º-Que\ncorresponde al Ministerio de Agricultura y Ganadería a través del Servicio\nFitosanitario del Estado, velar por la protección fitosanitaria de los\ncultivos, disponiendo, una vez comprobada la existencia de una plaga, las\nmedidas técnicas y de control que eviten la propagación de estas.\n\n            3º-Que\ncorresponde al Instituto de Desarrollo Agrario (IDA) determinar que la\npropiedad de la tierra se debe promover para el aumento gradual de su\nproductividad y para una justa distribución de su producto, elevando la\ncondición social del campesino y haciéndolo participe consciente del desarrollo\neconómico-social de la Nación.\n\n            4º-Que\nlos factores climáticos han favorecido el desarrollo y diseminación de nuevas\nplagas de importancia económica y cuarentenaria que afectan cultivos básicos y\nde exportación.\n\n            5º-Que\nel Servicio Fitosanitario del Estado confirmó la presencia de la plaga Puccinia\nkuehnii (Roya Naranja), afectando severamente las áreas de cultivo de caña\nde azúcar en los cantones de Pérez Zeledón y Buenos Aires en la Zona Sur, y San\nCarlos y Los Chiles en la Zona Norte, poniendo en riesgo la manutención y\nsupervivencia de un número importante de productores y sus familias, lo cual\nmotivó que se emitiera el Decreto Ejecutivo Nº 34791-MAG, publicado en La\nGaceta Nº 201 del 17 de Octubre de 2008.\n\n            6°-Que\nsi bien se ha venido desarrollando una importante labor interinstitucional para\nmitigar los efectos y el impacto productivo de la plaga Puccinia kuehnii (Roya\nNaranja), ésta aún no ha sido controlada totalmente en las zonas afectadas,\nsegún informe técnico del Servicio Fitosanitario del Estado, razón por la cual\nhace necesaria la prórroga de la Declaratoria de Emergencia, para continuar\nejecutando las medidas técnicas necesarias para controlar la plaga antes\nmencionada.
