  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 31\n\n                        Reforma Reglamento de Zonificación de Playa Dominical\n\nTexto Completo acta: CC79C\n\n \n\nMUNICIPALIDAD\nDE OSA\n\n \n\n            Acuerdo tomado por el Concejo\nMunicipal de Osa, en sesión Ordinaria número 31-2008, celebrada el día 6 de\nagosto del 2008, Mediante Capítulo VII, Acuerdos y Mociones, Acuerdo 8, el cual\ndice:\n\n \n\nConsiderando:\n\n \n\n            I.-Que el plan regulador de Playa\nDominical fue elaborado desde hace diecisiete años, y por entonces no se contaba\ncon la precisión y tecnología de georeferenciamiento, ni imágenes satelitales,\ncomo si se posee en la actualidad, además de otras herramientas útiles para\ngarantizar en la elaboración de este tipo de trabajos, el reflejo fiel y claro\nde accidentes geográficos, así como delimitaciones como los amojonamientos.\n\n            II.-Que\nen dicho Plan Regulador se zonificó un área como ZPQ o Zona de Protección de\nQuebrada donde se presumió un cuerpo de agua a largo del frente a zona pública\nde la propiedad en concesión Z-120, y con plano P-261140-1995, ubicada entre\nlos mojones M1A y M5A y al mismo se le adujeron condiciones de quebrada y por\nlo tanto de cauce de dominio público, lo cual justifico en su momento la\ndelimitación de dicha zona como área de protección de quebrada conforme lo\ndicta el artículo 33º de la Ley Forestal, así como el artículo 3.III.7º del\nReglamento para el Control Nacional de Fraccionamientos y Urbanizaciones.\n\n            III.-Que el artículo 12º del citado Plan Regulador se indica lo\nsiguiente:\n\n\"Artículo\n12: Zona de Protección de Quebradas\n\n \n\na. Propósito: Zona establecida con el propósito de cumplir con\nlo expresado en el capítulo III, artículo 3º, inciso 7.1., del Reglamento para\nel Control de Fraccionamiento y Urbanizaciones.\n\nb. Localización: Zona denominada Z. P. Q. según mapa Nº 21 y\nlocalizada a ambos lados de la quebrada, hacia el suroeste del área de estudio.\n\nc. Usos permitidos: Protección, conservación, limpieza y\nrectificación de cauces, bosque urbano, colocación de infraestructura de aguas\no similares.\n\nd. Usos condicionales: Parques, senderos, ranchos para almuerzo,\nrefugios, bancas e iluminación.\n\ne. Usos conflictivos: Cualquier tipo de edificación no expresada\nen los incisos c) y d).\n\nf.  Concesiones: Se otorgar en concesión a los ocupantes\nactuales con el propósito de conservación y protección conforme a la Ley 6043.\n\n            IV.-Que ante consultas directas al\nente legalmente autorizado para manifestarse en materia de cauces de dominio\npúblico y en particular referentes a quebradas como en caso que nos ocupa,\nmediante oficio número IMN-DA-2826-05 el Departamento de Aguas del MINAE señala\nen relación con dicha zona ZPQ, y que conforme las siguientes coordenadas:\n\n \n\nUBICACIÓN CARTOGRAFICA:\n\n \n\n| Fuente | Hoja Cartográfica | Escala | Coordenadas |  |  |  |  |\n| --- | --- | --- | --- | --- | --- | --- | --- |\n| Inicio | Final |  |  |  |  |  |  |\n| Latitud | Longitud | Latitud | Longitud |  |  |  |  |\n| 1 | Dominical | 3443IV | 1:50000 | 355.830 | 478.620 | 355-650 | 478.650 |\n| 2 | 355.600 | 479.040 | 355.550 | 479-010 |  |  |  |\n| 3 | 355.750 | 478.800 | 355.550 | 479.010 |  |  |  |\n\n \n\n            De acuerdo a nuestros registros a\nlectura cartográfica y a inspección de campo realizada el pasado 17 de octubre,\nes criterio de este Departamento que la corriente de agua denominada N° 1,\ncorresponde a un cauce natural de dominio público de caudal permanente,\ndenominado quebrada sin nombre la corriente denominada N° 2 son aguas\noriginadas por la escorrentía proveniente de la carreta Costanera Sur y la\ncorriente denominada N° 3 son aguas originadas por la escorrentía de la misma\npropiedad la cual es relativamente plana con una ligera pendiente hacia el Sur,\ntodas afluentes al Océano Pacífico.\"\n\n            El\nárea ZPQ se componía por tanto de dos diferentes componentes, de acuerdo a su\nnaturaleza y por lo tanto se transfirieron las características de dominio\npúblico a un segmento de terreno que afecta terrenos en concesión de zona\npública, sin necesidad, siendo que el cauce de dominio público y por lo tanto\nsujeto a las áreas de protección que deben prevalecer en esta zona, se\nencuentra delimitada en la actualidad, mediante levantamiento de coordenadas en\nel sistema Lambert Sur.\n\n            V.-Que,\nsin embargo y no obstante lo anterior, y por gestión de otras instituciones, se\nle reiteró al Departamento de Aguas del MINAE, una nueva valoración de la\nsituación, por lo que dicho departamento concluyo mediante oficio\nIMN-DA-3052-07 con fecha 16 de octubre de 2007, se ratifica que la fuente 2 es\nun canal artificial de desfogue pluvial que recoge aguas de escorrentía\nderivadas por la carretera costanera sur, toda vez que indica: \"Por lo anterior\nse considera conveniente indicar que se mantiene el criterio emanado por el\nLic. Álvaro Porras Vega indicando que la fuente no.2 no se considera cauce del\ndominio público por ser un canal que lo que hace es colectar las aguas\npluviales drenadas de la parte alta\".\n\n            VI.-Que\ncon base en las coordenadas dadas por el citado informe del Departamento de\nAguas y la información topográfica levantada en campo, corroborando con\nsistemas de posicionamiento global (GPS) se determinó la ubicación real en el Plan\nRegulador vigente, de las fuentes estudiadas y se estableció el retiro de ley\npara el cauce natural de dominio público, en donde claramente puede\nconfrontarse el curso real del cauce denominado 1 y que corresponde con el\nverdadero, único y real cauce de dominio público, y que mediante documento\nanexo se representa. Las coordenadas siguiendo el sistema Lambert Sur para\ndefinir dicho cuerpo son:\n\n \n\nZPQ EN CAUCE DE DOMINIO PÚBLICO\n\n \n\n| Descripción del punto | LATITUD* | LONGITUD* |\n| --- | --- | --- |\n| Ingreso | 355963 | 478605 |\n| Salida | 355592 | 478696 |\n\n*sistema Lambert Sur\n\n \n\n            VII.-Que en\ninforme del MINAE ACOSA de fecha 04 de febrero del 2008 se manifiesta en lo que\ninteresa: \"en el sector norte de la propiedad se encuentra una quebrada que\nviene desde el sector montañoso atravesando la carretera costanera hasta llegar\nal mar\" igualmente indica que: \"Existe una quebrada que atraviesa un sector\ncontiguo al proyecto Kiana (sector Norte), la misma drena al mar en el sector\nnoroeste del proyecto. El canal artificial existe en el sector Noroeste, este\nmismo recoge aguas pluviales y las que drenan por escorrentía, producto al alto\nnivel freático del sitio...\"\n\n            VIII.-Que con base en la información aportada, las inspecciones\nrealizadas en la zona de estudio y al razonamiento y lógica común, se hace\nevidente que cuando se creó el Plan Regulador de Playa Dominical, se provocó un\nerror material al considerarse una canal pluvial artificial como afluente\nnatural de dominio público, afectando dicho canal con el retiro de protección\nestipulado por ley para ese tipo de patrimonio natural.\n\n            IX.-Que de conformidad con el artículo 157 de la Ley General\nde la Administración Pública, \"En cualquier tiempo podrá la Administración\nrectificar los errores materiales o de hecho y los aritméticos\".\n\n            X.-Que,\nen consecuencia, es necesario modificar, por la existencia de un error\nmaterial, el Plan Regulador de Playa Dominical en la zona existente como ZPQ\n(Zona de Protección de Quebrada) quedando fuera de tal definición y por lo tanto\nafectación los cuerpos de agua que no estén contenidos en el segmento definido\npor las coordenadas de latitud y longitud que se detallan en el punto 6 de\nestos considerandos y con ello el canal pluvial identificado por las entidades\ngubernamentales en los oficios e informes IMN-DA-2826-05, IMN-DA-3052-07 y el\n\"Informe del levantamiento de las áreas del patrimonio natural del Estado en el\nPlan Regulador de Dominical\" de febrero 2004 elaborado por ACOSA, dado que este\ntipo de desfogue no se considera cauce del dominio público.\n\n            Por lo todo lo anterior recomiendo\nal Honorable Concejo Municipal tomar el siguiente acuerdo:\n\n \n\n1) Por haber incurrido la Administración en un error material, se\nacuerda rectificar: el Plan Regulador de Playa Dominical en la zona existente\ndenominada ( ZPQ) Zona de Protección de Quebrada, quedando delimitada por las\ncoordenadas 355830-478620 y 355592-478696, desafectándose el resto del área que\nse incorpora al área ZAC o Zona Alojamiento de Cabinas. En consecuencia, el\nartículo 12 de dicho Plan deberá leerse como sigue:\n\n \n\n\"Artículo\n12: Zona de Protección de Quebradas\n\n \n\na. Concessions: They shall be granted in concession to the current occupants for the purpose of conservation and protection in accordance with Law 6043.\n\n            IV.- That upon direct consultation with the entity legally authorized to pronounce on matters of public domain watercourses (cauces de dominio público) and in particular regarding streams (quebradas) as in the case at hand, through official letter number IMN-DA-2826-05, the Water Department of MINAE states, in relation to said ZPQ zone, and according to the following coordinates:\n\n \n\nCARTOGRAPHIC LOCATION:\n\n \n\n| Source | Cartographic Sheet | Scale | Coordinates |  |  |  |  |\n| --- | --- | --- | --- | --- | --- | --- | --- |\n| Start | End |  |  |  |  |  |  |\n| Latitude | Longitude | Latitude | Longitude |  |  |  |  |\n| 1 | Dominical | 3443IV | 1:50000 | 355.830 | 478.620 | 355-650 | 478.650 |\n| 2 | 355.600 | 479.040 | 355.550 | 479-010 |  |  |  |\n| 3 | 355.750 | 478.800 | 355.550 | 479.010 |  |  |  |\n\n \n\n            According to our records, cartographic reading, and field inspection carried out on October 17 of last year, it is the criterion of this Department that the water current called No. 1, corresponds to a natural public domain watercourse of permanent flow, called an unnamed stream, the current called No. 2 is water originating from runoff coming from the Costanera Sur highway, and the current called No. 3 is water originating from runoff from the same property, which is relatively flat with a slight slope to the South, all tributaries to the Pacific Ocean.\"\n\n            The ZPQ area was therefore composed of two different components, according to their nature, and therefore the characteristics of public domain were transferred to a segment of land that affects lands under concession in the public zone, unnecessarily, given that the public domain watercourse (cauce de dominio público), and therefore subject to the protection areas that must prevail in this zone, is currently delimited by way of a coordinate survey in the Lambert Sur system.\n\n            V.- That, however and notwithstanding the foregoing, and through the efforts of other institutions, a new assessment of the situation was reiterated to the Water Department of MINAE, for which reason said department concluded, through official letter IMN-DA-3052-07 dated October 16, 2007, that it is ratified that source 2 is an artificial storm drainage channel that collects runoff waters diverted by the Costanera Sur highway, as it indicates: \"For the foregoing, it is considered appropriate to indicate that the criterion issued by Lic. Álvaro Porras Vega is maintained, indicating that source No. 2 is not considered a public domain watercourse because it is a channel that collects the pluvial waters drained from the upper part.\"\n\n            VI.- That based on the coordinates given by the aforementioned report of the Water Department and the topographic information surveyed in the field, corroborating with global positioning systems (GPS), the real location in the current Regulatory Plan of the studied sources was determined, and the legal setback (retiro de ley) was established for the natural public domain watercourse, where the real course of the watercourse (cauce) called 1 can be clearly seen and which corresponds to the true, sole, and real public domain watercourse, and which is represented in an attached document. The coordinates following the Lambert Sur system to define said body are:\n\n \n\nZPQ IN PUBLIC DOMAIN WATERCOURSE\n\n \n\n| Point description | LATITUDE* | LONGITUDE* |\n| --- | --- | --- |\n| Entry | 355963 | 478605 |\n| Exit | 355592 | 478696 |\n\n*Lambert Sur system\n\n \n\n            VII.- That in a report from MINAE ACOSA dated February 4, 2008, it is stated, as relevant: \"in the northern sector of the property, there is a stream (quebrada) that comes from the mountainous sector, crossing the Costanera highway until reaching the sea,\" it equally indicates that: \"There is a stream that crosses a sector adjacent to the Kiana project (Northern sector), the same drains into the sea in the northwestern sector of the project. The artificial channel exists in the Northwestern sector, this same channel collects pluvial waters and those drained by runoff, a product of the high water table of the site...\"\n\n            VIII.- That based on the information provided, the inspections carried out in the study area, and common reasoning and logic, it becomes evident that when the Playa Dominical Regulatory Plan was created, a material error (error material) was caused by considering an artificial pluvial channel as a natural public domain tributary, affecting said channel with the protection setback stipulated by law for that type of natural heritage.\n\n            IX.- That in accordance with Article 157 of the Ley General de la Administración Pública, \"At any time, the Administration may rectify material or factual errors and arithmetic errors.\"\n\n            X.- That, consequently, it is necessary to modify, due to the existence of a material error (error material), the Playa Dominical Regulatory Plan in the zone existing as ZPQ (Zona de Protección de Quebrada), leaving out of such definition and therefore out of the affected area, the bodies of water that are not contained in the segment defined by the latitude and longitude coordinates detailed in point 6 of these consideranda, and with it the pluvial channel identified by government entities in official letters and reports IMN-DA-2826-05, IMN-DA-3052-07 and the \"Report of the survey of the areas of the State’s natural heritage in the Dominical Regulatory Plan\" of February 2004 prepared by ACOSA, given that this type of drainage is not considered a public domain watercourse (cauce del dominio público).\n\n            For all the foregoing, I recommend that the Honorable Municipal Council adopt the following agreement:\n\n \n\n1) Because the Administration has incurred a material error (error material), it is agreed to rectify: the Playa Dominical Regulatory Plan in the existing zone called (ZPQ) Zona de Protección de Quebrada, leaving it delimited by coordinates 355830-478620 and 355592-478696, with the rest of the area being de-affected and incorporated into the ZAC or Zona Alojamiento de Cabinas area. Consequently, Article 12 of said Plan shall read as follows:\n\n \n\n\"Article 12: Zona de Protección de Quebradas\n\n \n\na. Purpose: Zone established for the purpose of complying with the provisions of Chapter III, Article 3, subsection 7.1. of the Reglamento para el Control de Fraccionamiento y Urbanizaciones.\n\nb. Location: Zone called Z.P.Q. according to map No. 21 and located on both sides of the stream (quebrada), to the southwest of the study area, and determined by entry coordinates 355830-478620 and exit coordinates 355592-478696, between the existing boundary markers (mojones) M2A and M3A.\n\nc. Permitted uses: Protection, conservation, cleaning and rectification of watercourses, urban forest, placement of water infrastructure or similar.\n\nd. Conditional uses: Parks, trails, lunch ranches, shelters, benches and lighting.\n\ne. Conflicting uses: Any type of building not expressed in subsections c) and d).\n\nf.  Concessions: They shall be granted in concession to the current occupants for the purpose of conservation and protection in accordance with Law 6043.\n\n2) Issue instructions to the ZMT Department so that the pertinent documents of the concessions that are modified by this correction are adjusted and notify the concessionaires thereof in order to regularize any situation derived from this administrative act.\n\n3) This agreement is declared final and the Mayor is commissioned for its publication in La Gaceta immediately.\n\n4) Plates No. 1 and No. 2, which graphically detail the scope of this correction, are attached to this agreement.\n\n            Said modification was approved by the Municipal Council of Osa in ordinary session 31-2008, as stated in transcription No. 778-08. Approval by the ICT, on February 3, 2009, in ordinary session of the Board of Directors No. 5561, as stated in official letter MPD-P-184-2009, of February 17, 2009, and in the stamp on the plate.
