  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 35679\n\n                        Modifica para el Instituto Costarricense de Acueductos y Alcantarillados el\ngasto presupuestario máximo fijado para el año 2010\n\nTexto Completo acta: D2E1F\n\nNº 35679-H\n\n \n\nEL PRESIDENTE DE LA REPÚBLICA EN\nEJERCICIO\n\nY LA MINISTRA DE HACIENDA\n\n            Con fundamento en las atribuciones\nque les confieren los artículos 140, incisos 3) y 18) y 146 de la Constitución Política;\nlos artículos 25, inciso 1); 27, inciso 1) y 28, inciso 2), acápite b) de la\nLey Nº 6227, Ley General de la Administración Pública del 2 de mayo de 1978 y\nsus reformas; la Ley Nº 8131, Ley de la Administración Financiera de la\nRepública y Presupuestos Públicos del 18 de setiembre de 2001 y sus reformas;\nsu Reglamento, el Decreto Ejecutivo Nº 32988-H-MP-PLAN\ndel 31 de enero de 2006 y sus reformas; la Ley Nº 2726, Ley Constitutiva del\nInstituto Costarricense de Acueductos y Alcantarillados del 14 de abril de 1961\ny sus reformas y el Decreto Ejecutivo Nº 35111-H del 4 de marzo de 2009 y sus\nreformas.\n\nConsiderando:\n\n \n\n            1º-Que mediante la Ley Nº 2726,\npublicada en La Gaceta Nº 89 del 20 de abril de 1961 y sus reformas, se\ncreó el Instituto Costarricense de Acueductos y Alcantarillados (ICAA),\nencargado de suplir a los costarricenses los servicios públicos de agua potable\ny alcantarillado sanitario.\n\n            2º-Que\npor medio del oficio PLA-2009-361\ndel 27 de setiembre de 2009, el Director de Planificación Estratégica del ICAA\nsolicita la ampliación del gasto presupuestario máximo del Instituto en\n¢4.421.396.570,00 (cuatro mil cuatrocientos veintiún millones trescientos\nnoventa y seis mil quinientos setenta colones exactos), con el propósito de\ndarle prioridad a las actividades de operación y mantenimiento de los sistemas\nde acueductos y alcantarillados, y reforzar el presupuesto para acueductos\nasumidos por la institución, entre otros.\n\n            3º-Que\ndicho monto se financiará con recursos generados por la propia institución y se\nutilizará para financiar los acueductos asumidos; la operación, mantenimiento y\ncomercialización de acueductos; gastos administrativos; el sello de calidad\nsanitaria (PSCS); estandarización de oficinas; proyectos especiales y el\nproyecto Limón-Ciudad Puerto.\n\n            4º-Que\nmediante el Decreto Ejecutivo Nº 35111-H, publicado en La Gaceta Nº 58\ndel 24 de marzo de 2009 y sus reformas, se emitieron las Directrices Generales\nde Política Presupuestaria para el año 2010, estableciéndose en el artículo 1º\ndel citado Decreto, el gasto presupuestario del año 2010 para las entidades\ncubiertas por el ámbito de la Autoridad Presupuestaria.\n\n            5º-Que\ncon el oficio STAP-0650-2009 del 28 de abril de 2009, se le comunicó al ICAA el\ngasto presupuestario máximo autorizado a dicha institución para el año 2010, el\ncual se fijó en ¢51.824.000.000,00 (cincuenta y un mil ochocientos veinticuatro\nmillones de colones exactos), cifra que no contempla los gastos indicados en el\npresente decreto.\n\n            6º-Que\npor lo anterior, resulta necesario modificar el gasto presupuestario máximo\nfijado al Instituto Costarricense de Acueductos y Alcantarillados para el año\n2010, incrementándolo en la suma de ¢4.421.396.570,00 (cuatro mil cuatrocientos\nveintiún millones trescientos noventa y seis mil quinientos setenta colones\nexactos).
