  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 01\n\n                        Reforma Manual de Procedimientos para el pago de Servicios Ambientales\n\nTexto Completo acta: CCEDB\nFONDO NACIONAL DE FINANCIAMIENTO FORESTAL\n\nFONDO\nNACIONAL DE FINANCIAMIENTO FORESTAL\n\nSegún acuerdo\ndieciséis celebrado en la sesión ordinaria 01-2010 del día dieciocho del mes de\nenero del 2010.\n\nConsiderando:\n\n1º-Que mediante\nacuerdo número décimo primero tomado en la sesión ordinaria Nº 01-2009 del 28\nde enero 2009, la Junta Directiva del Fondo Nacional de Financiamiento\nForestal-FONAFIFO, aprueba el Manual de Procedimientos para el Pago de\nServicios Ambientales, el cual fue publicado en La Gaceta Nº 46 del día\nviernes 6 de marzo 2009.\n\n2º-Que\nen vista de la incorporación de nuevas modalidades, así como un surgimiento de\nnuevas situaciones que requieren regulación, mediante acuerdo firme Nº 16,\ntomado en la sesión ordinaria Nº 01-2010, la Junta Directiva del Fondo Nacional\nde Financiamiento Forestal, el dieciocho de enero del dos mil diez, se aprueba\nuna modificación al Manual de Procedimientos para el Pago de Servicios\nAmbientales vigente.\n\n3º-Que\nde conformidad con lo dispuesto en el artículo 48 de la Ley Forestal Nº 7575 y\nel articulo a la Ley Forestal Decreto Nº 215721 MINAE y sus reformas, la Junta\nDirectiva del Fondo Nacional de Financiamiento Forestal es la competente para\nemitir las directrices generales, los reglamentos y las disposiciones\nnecesarias para implementar el programa de pago por servicios ambientales. Por\ntanto:\n\nLa Junta Directiva\ndel Fondo Nacional de Financiamiento Forestal, emite la siguiente modificación\ny adición al Manual de Procedimientos Administrativos vigente:\n\nArtículo 1º-Para que se modifique el punto\nuno Del Objetivo y en lo sucesivo se lea de la siguiente forma:\n\n1. Objetivo: Establecer los procedimientos\nque se aplicaran en el Pago de los Servicios Ambientales (PSA) generados por\nlos bosques y las plantaciones forestales del país, mediante el fomento de las\nactividades de reforestación, protección de la cobertura boscosa, manejo de\nbosque, recuperación de cobertura mediante regeneración natural y plantación de\nárboles forestales en sistema agroforestales (SAF), pagados con recursos\nprovenientes del Presupuesto Nacional y de cualquier otro donante o\ninversionista que no establezca condiciones diferentes, a las establecidas en\neste Manual.\n\nArtículo 2º-Para que se modifique el párrafo\nprimero del punto dos Criterios de priorización de proyectos y en lo sucesivo\nse lea de la siguiente forma:\n\n2. Criterios de priorización de proyectos.\nLas áreas prioritarias para el Pago de Servicios Ambientales (PSA), serán las\nestablecidas mediante el Decreto Ejecutivo que emitirá el Poder Ejecutivo, en\nlas modalidades de protección, reforestación, recuperación de cobertura\nmediante regeneración natural, manejo de bosque y plantación de árboles\nforestales en SAF, los cuales serán aplicados para la selección de los\nproyectos que se considerarán en el programa de PSA. Solamente, en aquellos\ncasos cuando la demanda nacional de las áreas prioritarias ha sido satisfecha,\nse aceptarán proyectos en otras áreas que oportunamente el FONAFIFO dará a\nconocer.\n\nPara inmuebles que\nse encuentren sobre el límite de las áreas prioritarias se considerarán para\nefectos del Programa de PSA aquellas que al menos tengan un 30% dentro de\ndichas áreas.\n\nArtículo 3º-Para que se modifique el punto\nDos punto cuatro, inciso 2.4.2 y en lo sucesivo se lea de la siguiente forma:\n\n2.4.2 Tierras con capacidad de uso2, I,\nII, III, IV, V y VI.\n\n2 Ministerio de Agricultura y Ganadería. 1995.\nMetodología para la Determinación de la Capacidad de Uso de las Tierras de\nCosta Rica. San José, Costa Rica. 60p.\n\nArtículo\n4º-Para que se adicione en el punto dos, un nuevo inciso 2.6 que en lo sucesivo\nse lea de la siguiente forma:\n\n2.6.  Proyectos de Manejo de Bosque.\n\n2.6.1    Inmuebles que tienen planes de manejo\naprobados por la Administración Forestal del Estado, en los cuales se realizó\nla cosecha de acuerdo a los Estándares de Sostenibilidad para Manejo de Bosques\nNaturales: Principios, Criterios e Indicadores, Código de Prácticas y Manual de\nProcedimientos, de acuerdo al Decreto Ejecutivo Nº 34559-MINAE, publicado en La\nGaceta Nº 115 del día lunes 16 de junio del 2008, la Administración\nForestal de Estado (AFE) certificará el cumplimiento de lo establecido en el\nplan de manejo.\n\nArtículo 5º-Para que se modifiquen los\nincisos 3.7, 3.9.5 y se adiciones un punto 3.11, del punto tres de las aéreas y\ncantidades mínimas y máximas y en lo sucesivo se lea de la siguiente forma:\n\n3. De las áreas y cantidades mínimas y máximas.\nLas áreas mínimas y máximas anuales a considerar para el PSA a través de las\ndiferentes modalidades, serán las que se detallan a continuación:\n\n3.7   Para la modalidad de plantación de árboles\nforestales en SAF, la cantidad mínima será de trescientos cincuenta (350)\nárboles y máxima de cinco mil árboles (5.000) por beneficiario(a).\n\n3.9.5. Plantaciones en bloque de menos de una\nhectárea, con densidades equivalentes entre 625 y 1.111 árboles por hectárea.\nSe considera como máximo cinco bloques de una hectárea por beneficiario(a).\n\n3.11 Para proyectos de Manejo de Bosque el área\nmínima es de dos hectáreas y un área máxima de trescientas hectáreas.\n\nArtículo 6º-Para que se modifiquen los\nincisos 4.1, 4.2 y 4.4. del punto cuatro de los\nbeneficiarios y en lo sucesivo se lea de la siguiente forma:\n\n4. De los beneficiarios (as). Se\nconsiderarán beneficiarios (as) del Programa PSA, todas aquellas personas\nfísicas o jurídicas, propietarios (as), arrendatarios, usufructuarios de\ninmuebles inscritos en el Registro Nacional que deseen gozar del Pago de los\nServicios Ambientales en las diversas modalidades. Para proyectos de protección\nde bosque también se considerará a los poseedores (as) que cumplan con lo establecido\nen el artículo 9º de la Ley Nº 8640, Proyecto Ecomercados II y el reglamento a\nla Ley Forestal. Los (las) solicitantes interesados podrán presentar\npresolicitudes de la siguiente manera:\n\n4.1.  En forma individual: Para la protección de\nbosque, protección de bosque en vacíos de conservación y protección de recurso\nhídrico, recuperación de cobertura mediante regeneración natural,\nreforestación, manejo de bosque y establecimiento de árboles forestales en SAF.\n\n4.2.  En proyectos regentados por organizaciones\npara la protección de bosques, protección de recurso hídrico, reforestación,\nrecuperación de cobertura mediante regeneración natural, manejo de bosque y el\nestablecimiento de árboles forestales en SAF.\n\nLas presolicitudes\nque correspondan a las cuotas asignadas por FONAFIFO a las organizaciones,\ndeberán indicar expresamente si corresponden o no a dichas cuotas.\n\n4.4.  Todos los beneficiarios (as) individuales de\nPSA, deberán presentar al FONAFIFO una certificación de su cuenta cliente en\ncolones emitida por una entidad bancaria, financieras, mutual y/o cooperativa\nde ahorro y crédito, por cada presolicitud presentada, para recibir los pagos\ndel Programa de PSA.\n\nArtículo 7º-Para que se modifiquen el inciso\n7.1 y se adiciones dos nuevos incisos 7.1.9 y 7.1.10. del\npunto sétimo Procedimientos para el trámite de las presolicitudes para PSA,\npara que en lo sucesivo se lea de la siguiente forma:\n\n7.1.  Dentro de los requisitos para ingresar al PSA,\nel solicitante o su representante debe presentar por escrito y ante la Oficina\nRegional del FONAFIFO correspondiente, la presolicitud firmada por el\nsolicitante (Anexos 1 y 2). Adjuntando copia para sello de recibido, en la cual\nel personal de la Oficina Regional le indicará el número de presolicitud\nasignado. No se recibirán las presolicitudes que presenten información\nincompleta o que no adjunte los requisitos establecidos en el presente Manual.\nSe admitirá un máximo de cinco presolicitudes por persona por turno de\npresentación.\n\n7.1.9  En las presolicitudes de la modalidad de\nmanejo de bosque, una vez cumplidos los requisitos legales establecidos en los\nincisos 7.1.1 al 7.1.5, los solicitantes deberán aportar junto con el estudio\ntécnico, una certificación del emitida por los funcionarios competentes del\nSINAC, que indique el cumplimiento de lo establecido en el plan de Manejo según\nlos Estándares de Sostenibilidad para Manejo de Bosques Naturales: Principios,\nCriterios e Indicadores, Código de Practicas y Manual de Procedimientos,\nDecreto Ejecutivo Nº 34559-MINAE, publicado en La Gaceta Nº 115 del 16\nde junio del 2008.\n\n7.10 Estudio técnico según el Anexo 16.\n\nArtículo 8º-Para que se modifiquen el incisos 10.1 y 10.2 del punto diez, Emisión y entrega del\npago por servicio ambiental y se adicione un nuevo inciso que será el 10.12,\npara que en lo sucesivo se lea de la siguiente forma:\n\n10.1. Tratándose\nde protección de bosque, protección de bosque en vacíos de conservación,\nprotección de recurso hídrico y manejo de bosque, una vez firmado el contrato\npor todas las partes, inscrita la afectación del inmueble ante el Registro de\nla Propiedad o protocolizado el contrato en caso de fincas en posesión, el\nFONAFIFO tramitará la Orden de Pago respectiva. El pago de los contratos por\naño vencido se tramitará doce meses después de su vigencia. (ver\npuntos 8.4 y 8.9).\n\n10.2. Para pagos posteriores, el Regente Forestal\nentregará a la Oficina Regional respectiva de FONAFIFO un informe certificado\nanual a los 12, 24, 36 y 48 meses de la fecha de vigencia de contrato, o de 24,\n36, 48 y 60 meses cuando se trate de contratos suscritos sobre fincas por año\nvencido según la guía del Anexo 6 y anexo 17, el funcionario(a) responsable de\nla Oficina Regional de FONAFIFO, valorará informe certificado y procederá a\nasignar un número de consecutivo, para continuar con el trámite. El FONAFIFO\ntramitará la Orden de Pago respectiva.\n\n10.12.   El primer pago de servicios ambientales para\nla para la modalidad de manejo de bosque, será de un 20% del monto establecido\nen el Decreto Ejecutivo respectivo se realizará una vez formalizado el\nrespectivo contrato.\n\nArtículo 9º-Para que se adicione un nuevo\nanexo que llevara el numero dieciséis y se denominara\nInstructivo para elaborar el estudio técnico para proyectos de manejo de bosque\ny en lo sucesivo se lea de la siguiente forma:\n\nAnexo\n16. Instructivo para elaborar\n\nel estudio técnico para proyectos de manejo de\nbosque\n\nEl suscrito ____________, Nº colegiado ______,\nEn mi calidad de Regente Forestal, con póliza de fidelidad Nº ______,\namparado a la Ley Forestal, su reglamentación, sus modificaciones, reglamento\nde regencias forestales y la normativa vigente. Certifico el contenido del\nsiguiente Estudio Técnico:\n\n1.        Nombre de beneficiarios\n(as), números de cédula, folio(s) real (es), número(s) de plano, área(s) total\n(es) de folio(s), uso actual, ubicación administrativa, la dirección exacta de\nla(s) finca(s) y los colindantes encontrados en el campo.\n\n2.        Número de formulario de\nregencia, fecha de visita.\n\n3.        Indicar si el área se\nencuentra en un área silvestre protegida, señalando el nombre de la misma.\n\n4.        Indicar la modalidad y el\nnúmero de Presolicitud asignado de previo por la Oficina Regional respectiva.\n\n5.        El plano de la propiedad\ndebe estar georeferenciado con al menos tres puntos ubicados mediante GPS con\nel datum WGS 84 y en formato grados-decimales (GG.dddd). Dos de estos puntos\ncomo mínimo deben ser vértices del plano. Todos los puntos GPS, deben de estar\na una distancia no menor a 50\n metros entre ellos. (deben indicarse en el croquis, las\nubicaciones de los puntos y se deben de aportar de forma digital mediante un\narchivo de puntos shape, en el mismo sistema de coordenadas del croquis,\nindicando la referencia de cada punto). La información, de los puntos GPS debe\nestar incluida.\n\n6.        Asimismo, cada Estudio\nTécnico debe contener el croquis del área a someter a PSA con respecto al área\ntotal de la propiedad, indicando el derrotero y la numeración correspondiente\nde vértices, Debe indicarse el sistema empleado y exactitud del mismo; además\ndebe amarrarse el punto de inicio (punto 1) del área a someter de un punto con\ncoordenadas conocidas El croquis del área efectiva PSA, así como el croquis de\nla totalidad del plano debe entregarse impreso y en digital\n\nEl digital debe de\ncumplir con:\n\n-   El archivo debe ser en formato Shape File de\nArcview (polígono), no se admitirán otros formatos.\n\n-   El archivo Shape debe venir nombrado con el\nnúmero de solicitud asignado por la Oficina Regional (ejemplo, SJ01000108).\n\n-   Se debe presentar un solo Shape que incluya\nen la tabla de atributos la cuantificación del área, uso (área PSA, resto de la\nfinca) y el número de plano catastrado cuando sea el caso.\n\n-   En caso de existir contratos vigentes,\nincluir la ubicación de los mismos.\n\n-   El archivo debe presentarse georeferenciado\nen el sistema de coordenadas CRTM05 (oficializado mediante el Decreto Nº\n33797-MJ-MOPT publicado en La Gaceta Nº 108 del miércoles 6 de junio del\n2007) o bien en sistema de coordenadas geográficas, datum WGS84 y en formato\ngrados decimales (GG.dddd).\n\n-   Debe ser entregado en un disco compacto (cd).\n\n7. Las escalas a utilizar para áreas menores a\ntreinta hectáreas deben de ser 1:5.000 a 1:10.000. Para el caso de áreas\nmayores pueden utilizarse a conveniencia profesional.\n\n8. Además, el Estudio deberá elaborarse con base\nal área legal del terreno, es decir la 'superficie agraria', definiéndose ésta\ncomo el área de una porción de terreno determinada por la proyección horizontal\nde su perímetro.\n\n9. Manifestación expresa de la existencia de otros\ncontratos de PSA vigentes indicando el área, ubicación y certificando la cabida\nde los contratos.\n\n10. En inmuebles con arrendamientos debe\ncertificarse que las áreas PSA están excluidas de las áreas en arriendo, esto\nen caso de que sea el propietario del inmueble que solicita el ingreso al PSA.\nCaso contrario, certificar que los arriendos corresponden efectivamente a áreas\nPSA solicitados por los arrendatarios.\n\n11. Solo se admitirán Estudios Técnicos\nCertificados que se refieran a planos cuyos desplazamientos en la ubicación\ncartográfica no superen los 500\n metros, con respecto a lo indicado en el plano y la\nubicación real de la finca. En los casos que supere\nlos 500 metros\nse deberá adjuntar una certificación emitida por un topógrafo colegiado que\nindique la ubicación correcta del plano.\n\n12. En todos los casos, los Estudios Técnicos\nCertificados deben ser elaborados en papel de seguridad, contener el nombre,\nnúmero de colegiado y firma del profesional responsable, la fecha de\nelaboración y con los timbres respectivos.\n\nNota: Instalación de letreros preventivos, El rótulo\ndebe de contener la siguiente información: nombre del beneficiario(a),\nmodalidad, área PSA sometida y número de contrato forestal.\n\nArtículo 10.-Para\nque se adicione un nuevo anexo que llevará el número diecisiete y se denominará\nInstructivo para elaborar el informe certificado de seguimiento para proyectos\nPSA de manejo de bosque y en lo sucesivo se lea de la siguiente forma:\n\nAnexo\n17. Instructivo para elaborar el informe certificado\n\nde seguimiento para proyectos PSA de manejo de\nbosque.\n\nPara el trámite de los pagos a los 12, 24, 36 y 48\nmeses de la firma del contrato, el Regente Forestal debe presentar la\ncertificación considerando los siguientes aspectos:\n\nEl suscrito ____________, Nº colegiado ______,\nEn mi calidad de Regente Forestal, con póliza de fidelidad Nº ______,\namparado a la Ley Forestal, su reglamentación, sus modificaciones y la\nnormativa vigente. Certifico el estado del bosque de acuerdo a los\nsiguientes criterios.\n\n1. Indicar el nombre del propietario, folio real y\nárea efectiva de PSA.\n\n2. Agregar el número de contrato PSA y el número\nde cuota respectiva.\n\n3. Número de formulario de regencia, fecha de\nvisita.\n\n4. Indicar las acciones realizadas para evitar la\ncacería, tala e incendios forestales, rotulación e informar de cualquier\nanomalía detectada.\n\n5. Para los pagos posteriores, el Regente Forestal\ndebe certificar el estado del bosque, así como el cumplimiento de lo\nestablecido en el plan de manejo aprobado por el SINAC, y cualquier otro\naspecto relacionado con la permanencia del bosque.\n\n6. En todos los casos, las Certificaciones deben\nser elaborados en papel de seguridad, contener el nombre, número de colegiado y\nfirma del profesional responsable, la fecha de elaboración y con los timbres\nrespectivos.\n\nEn todos los demás aspectos no considerados\nen la presente modificación, se mantiene vigente el Manual de Procedimientos\npara el Pago Servicios Ambientales, publicado en el Nº 46 del día viernes 6 de\nmarzo 2009.\n\nArtículo\n11.-Rige a partir de su publicación.",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 01\n\n                        Reform of the Procedures Manual for the Payment of Environmental Services\n\nFull Text of Act: CCEDB\nNATIONAL FOREST FINANCING FUND\n\nNATIONAL\nFOREST FINANCING FUND\n\nAccording to agreement\nsixteen adopted at ordinary session 01-2010 of the eighteenth day of January\n2010.\n\nConsidering:\n\n1º-That by means of\nagreement number eleventh adopted at ordinary session No. 01-2009 of January 28,\n2009, the Board of Directors of the National Forest Financing Fund-FONAFIFO,\napproved the Procedures Manual for the Payment of Environmental Services, which was published in La Gaceta No. 46 of Friday,\nMarch 6, 2009.\n\n2º-That\nin view of the incorporation of new modalities, as well as the emergence of\nnew situations requiring regulation, by means of firm agreement No. 16,\nadopted at ordinary session No. 01-2010, the Board of Directors of the National\nForest Financing Fund, on January eighteen, two thousand ten, approved an\namendment to the current Procedures Manual for the Payment of Environmental\nServices.\n\n3º-That\nin accordance with the provisions of Article 48 of Forestry Law No. 7575 and\nArticle [blank in original] of Forestry Law Decree No. 25721-MINAE and its amendments, the\nBoard of Directors of the National Forest Financing Fund is the competent body\nto issue the general directives, regulations, and provisions necessary\nto implement the program of payment for environmental services (pago por servicios ambientales, PSA). Therefore:\n\nThe Board of Directors\nof the National Forest Financing Fund, issues the following amendment\nand addition to the current Administrative Procedures Manual:\n\nArticle 1º-So that point one, On the Objective, is modified and henceforth reads as follows:\n\n1. Objective: To establish the procedures\nto be applied in the Payment of Environmental Services (Pago de Servicios Ambientales, PSA) generated by\nthe country’s forests and forest plantations, through the promotion of the\nactivities of reforestation, protection of forest cover (cobertura boscosa), forest management,\nrecovery of cover through natural regeneration, and planting of forest trees in\nagroforestry systems (sistemas agroforestales, SAF), paid with resources\nfrom the National Budget and any other donor or\ninvestor that does not establish conditions different from those established in\nthis Manual.\n\nArticle 2º-So that the first paragraph of point two, Criteria for the prioritization of projects, is modified and henceforth reads as follows:\n\n2. Criteria for the prioritization of projects.\nThe priority areas for Payment of Environmental Services (PSA), shall be those\nestablished through the Executive Decree to be issued by the Executive Branch,\nin the modalities of protection, reforestation, recovery of cover\nthrough natural regeneration, forest management, and planting of forest trees\nin SAF, which shall be applied for the selection of\nprojects to be considered in the PSA program. Only, in\nthose cases when the national demand for priority areas has been satisfied,\nwill projects be accepted in other areas that FONAFIFO will opportunely make\nknown.\n\nFor properties that\nare on the boundary of the priority areas, those that have at least 30% within\nsaid areas shall be considered for the purposes of the PSA Program.\n\nArticle 3º-So that point Two point four, subsection 2.4.2, is modified and henceforth reads as follows:\n\n2.4.2 Lands with land-use capacity (capacidad de uso)2, I,\nII, III, IV, V, and VI.\n\n2 Ministry of Agriculture and Livestock. 1995.\nMethodology for the Determination of Land-Use Capacity of the Lands of\nCosta Rica. San José, Costa Rica. 60p.\n\nArticle\n4º-So that a new subsection 2.6 is added to point two, which shall henceforth read as follows:\n\n2.6. Forest Management Projects.\n\n2.6.1    Properties that have management plans\napproved by the State Forestry Administration, in which harvesting was carried\nout according to the Sustainability Standards for Natural Forest Management:\nPrinciples, Criteria and Indicators, Code of Practices, and Procedures Manual,\nin accordance with Executive Decree No. 34559-MINAE, published in La\nGaceta No. 115 of Monday, June 16, 2008, the State Forestry Administration\n(AFE) shall certify compliance with what is established in the\nmanagement plan.\n\nArticle 5º-So that subsections 3.7 and 3.9.5 are modified and a point 3.11 is added, to point three, On the areas and minimum and maximum quantities, and henceforth reads as follows:\n\n3. On the areas and minimum and maximum quantities.\nThe minimum and maximum annual areas to be considered for PSA through the\ndifferent modalities, shall be those detailed below:\n\n3.7   For the modality of planting forest trees in SAF, the minimum quantity shall be three hundred fifty (350)\ntrees and the maximum quantity five thousand (5,000) trees per beneficiary.\n\n3.9.5. Block plantations of less than one\nhectare, with equivalent densities between 625 and 1,111 trees per hectare.\nA maximum of five blocks of one hectare per beneficiary is considered.\n\n3.11 For Forest Management projects, the minimum\narea is two hectares and the maximum area is three hundred hectares.\n\nArticle 6º-So that subsections 4.1, 4.2, and 4.4. of point four, On\nbeneficiaries, are modified and henceforth read as follows:\n\n4. On beneficiaries. As\nbeneficiaries of the PSA Program shall be considered all those natural or\nlegal persons, owners, lessees (arrendatarios), usufructuaries (usufructuarios) of\nproperties registered in the National Registry who wish to enjoy the Payment of\nthe Environmental Services in the various modalities. For forest protection projects,\npossessors (poseedores) who comply with the provisions of Article 9 of Law No. 8640, Ecomercados II Project, and the regulations to\nthe Forestry Law shall also be considered. Interested applicants may submit\npre-applications in the following manner:\n\n4.1.  Individually: For forest protection,\nforest protection in conservation gaps and water resource protection, recovery of cover through natural regeneration,\nreforestation, forest management, and establishment of forest trees in SAF.\n\n4.2.  In projects managed by organizations\nfor forest protection, water resource protection, reforestation,\nrecovery of cover through natural regeneration, forest management, and the\nestablishment of forest trees in SAF.\n\nPre-applications\nthat correspond to the quotas assigned by FONAFIFO to organizations,\nmust expressly indicate whether or not they correspond to said quotas.\n\n4.4.  All individual PSA beneficiaries, must present to FONAFIFO a certification of their client account in\ncolones issued by a banking, financial, mutual, and/or savings and credit\ncooperative entity, for each pre-application submitted, to receive the payments\nof the PSA Program.\n\nArticle 7º-So that subsection 7.1 is modified and two new subsections 7.1.9 and 7.1.10 are added. to\nthe seventh point, Procedures for processing pre-applications for PSA,\nso that henceforth it reads as follows:\n\n7.1.  Within the requirements to enter the PSA,\nthe applicant or their representative must submit in writing and to the corresponding FONAFIFO Regional Office, the pre-application signed by the\napplicant (Annexes 1 and 2). Attaching a copy for a received stamp, on which\nthe Regional Office personnel shall indicate the assigned pre-application number. Pre-applications that present incomplete\ninformation or that do not attach the requirements established in this Manual shall not be received.\nA maximum of five pre-applications per person per submission turn shall be admitted.\n\n7.1.9  In pre-applications for the forest management modality, once the legal requirements established in subsections 7.1.1 through 7.1.5 have been met, applicants must provide, along with the technical study, a certification issued by the competent officials of SINAC, indicating compliance with what is established in the Management Plan according to\nthe Sustainability Standards for Natural Forest Management: Principles,\nCriteria and Indicators, Code of Practices and Procedures Manual,\nExecutive Decree No. 34559-MINAE, published in La Gaceta No. 115 of June 16,\n2008.\n\n7.1.10 Technical study according to Annex 16.\n\nArticle 8º-So that subsections 10.1 and 10.2 of point ten, Issuance and delivery of the\npayment for environmental service, are modified and a new subsection is added, which will be 10.12,\nso that henceforth it reads as follows:\n\n10.1. In the case\nof forest protection, forest protection in conservation gaps,\nwater resource protection, and forest management, once the contract is signed\nby all parties, the encumbrance (afectación) of the property is registered before the Property\nRegistry, or the contract is notarized (protocolizado) in the case of farms under possession (fincas en posesión),\nFONAFIFO shall process the respective Payment Order. The payment of contracts on a\nyear-in-arrears basis (año vencido) shall be processed twelve months after their effective date. (see\npoints 8.4 and 8.9).\n\n10.2. For subsequent payments, the Forestry Regent (Regente Forestal) shall deliver to the respective FONAFIFO Regional Office a certified annual report at 12, 24, 36, and 48 months from the contract effective date, or at 24,\n36, 48, and 60 months in the case of contracts signed on farms on a year-in-arrears basis according to the guide in Annex 6 and Annex 17, the responsible official of the FONAFIFO Regional Office shall evaluate the certified report and proceed to\nassign a consecutive number, to continue with the processing. FONAFIFO shall process the respective Payment Order.\n\n10.12. The first payment of environmental services for the forest management modality shall be 20% of the amount established\nin the respective Executive Decree and shall be made once the respective contract is formalized.\n\nArticle 9º-So that a new annex is added, which will bear the number sixteen and be named\nInstructions for preparing the technical study for forest management projects,\nand henceforth reads as follows:\n\nAnnex\n16. Instructions for preparing\n\nthe technical study for forest management projects\n\nThe undersigned ____________, Professional License No. ______,\nIn my capacity as Forestry Regent, with fidelity bond No. ______,\nprotected by the Forestry Law, its regulations, its amendments, forestry regency regulations, and current legislation. I certify the content of the\nfollowing Technical Study:\n\n1.        Name of beneficiaries, ID numbers, Folio(s) Real(es), plan number(s), total folio\narea(s), current use, administrative location, the exact address of the\nfarm(s), and the adjacent landowners found in the field.\n\n2.        Regency form number, date of visit.\n\n3.        Indicate if the area is located in a protected wilderness area, stating its name.\n\n4.        Indicate the modality and the Pre-application number previously assigned by the respective Regional Office.\n\n5.        The property plan must be georeferenced with at least three points located by GPS with\nthe WGS 84 datum and in decimal degrees format (GG.dddd). At least two of these points\nmust be vertices of the plan. All GPS points must be\nat a distance of no less than 50\n meters from each other. (the locations of the points must be indicated on the sketch, and they must be provided digitally using a point shape file, in the same coordinate system as the sketch,\nindicating the reference of each point). The information on the GPS points must\nbe included.\n\n6.        Likewise, each Technical Study must contain the sketch of the area to be submitted to PSA with respect to the total\narea of the property, indicating the boundary survey (derrotero) and the corresponding vertex numbering. The system used and its accuracy must be indicated; also,\nthe starting point (point 1) of the area to be submitted must be tied to a point with\nknown coordinates. The sketch of the effective PSA area, as well as the sketch of\nthe entirety of the plan, must be submitted printed and in digital form.\n\nThe digital form must\ncomply with:\n\n-   The file must be in Arcview Shape File format (polygon), other formats will not be admitted.\n\n-   The Shape file must be named with the\napplication number assigned by the Regional Office (e.g., SJ01000108).\n\n-   A single Shape file must be presented that includes\nin the attribute table the quantification of the area, use (PSA area, rest of the\nfarm), and the surveyed plan number when applicable.\n\n-   In case of existing current contracts,\ninclude their location.\n\n-   The file must be presented georeferenced\nin the CRTM05 coordinate system (made official through Decree No.\n33797-MJ-MOPT published in La Gaceta No. 108 of Wednesday, June 6,\n2007) or in a geographic coordinate system, WGS84 datum, and in decimal\ndegrees format (GG.dddd).\n\n-   It must be submitted on a compact disc (cd).\n\n7. The scales to be used for areas smaller than\nthirty hectares must be 1:5,000 to 1:10,000. For larger areas,\nthey may be used at professional convenience.\n\n8. Furthermore, the Study must be prepared based\non the legal area of the land, that is, the 'agricultural surface' (superficie agraria), this being defined\nas the area of a portion of land determined by the horizontal projection\nof its perimeter.\n\n9. Express statement of the existence of other\ncurrent PSA contracts, indicating the area, location, and certifying the capacity (cabida)\nof the contracts.\n\n10. On properties with leases (arrendamientos), it must be\ncertified that the PSA areas are excluded from the leased areas, this\nin case it is the property owner who requests entry to the PSA.\nOtherwise, certify that the leases effectively correspond to PSA\nareas requested by the lessees.\n\n11. Only Certified Technical Studies shall be admitted that refer to plans whose displacements in the cartographic\nlocation do not exceed 500\n meters, with respect to what is indicated on the plan and the\nreal location of the farm. In cases where it\nexceeds 500 meters,\na certification issued by a licensed surveyor must be attached,\nindicating the correct location of the plan.\n\n12. In all cases, Certified Technical Studies must be prepared on security paper, contain the name,\nprofessional license number, and signature of the responsible professional, the date of\npreparation, and with the respective stamps.\n\nNote: Installation of preventive signs. The sign\nmust contain the following information: name of the beneficiary,\nmodality, PSA area submitted, and forestry contract number.\n\nArticle 10.-So\nthat a new annex is added, which will bear the number seventeen and be named\nInstructions for preparing the certified monitoring report for forest management PSA\nprojects, and henceforth reads as follows:\n\nAnnex\n17. Instructions for preparing the certified report\n\nfor monitoring forest management PSA projects.\n\nFor processing payments at 12, 24, 36, and 48\nmonths from the signing of the contract, the Forestry Regent must submit the\ncertification considering the following aspects:\n\nThe undersigned ____________, Professional License No. ______,\nIn my capacity as Forestry Regent, with fidelity bond No. ______,\nprotected by the Forestry Law, its regulations, its amendments, and current\nlegislation. I certify the state of the forest according to the\nfollowing criteria.\n\n1. Indicate the name of the owner, Folio Real, and\neffective PSA area.\n\n2. Add the PSA contract number and the respective\ninstallment number.\n\n3. Regency form number, date of visit.\n\n4. Indicate the actions taken to prevent\nhunting, felling, and forest fires, signage, and report any\nanomaly detected.\n\n5. For subsequent payments, the Forestry Regent\nmust certify the state of the forest, as well as compliance with what is\nestablished in the management plan approved by SINAC, and any other\naspect related to the permanence of the forest.\n\n6. In all cases, Certifications must\nbe prepared on security paper, contain the name, professional license number, and\nsignature of the responsible professional, the date of preparation, and with the respective\nstamps.\n\nIn all other aspects not covered\nin this amendment, the Procedures Manual for the Payment of Environmental Services, published in No. 46 of Friday, March 6,\n2009, remains in force.\n\nArticle\n11.-It becomes effective upon its publication."
