  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 35753\n\n                        Reforma Fijación de tarifas de los servicios del Ministerio de Agricultura y\nGanadería y Crea Registro de Importadores de Vegetales y Productos de Origen Vegetal\n\nTexto Completo acta: CDB11\n\nNº 35753-MAG\n\nEL PRESIDENTE DE LA\nREPÚBLICA\n\nY EL\nMINISTRO DE AGRICULTURA Y GANADERÍA\n\n \n\n            En\nuso de las facultades que les confiere los artículos 140 incisos 3), 7), 8) y 18)\ny 146 de la Constitución Política y lo dispuesto en la Ley Nº 7064 del 29 de\nabril de 1987, Ley de Fomento a la Producción Agropecuaria y Orgánica del\nMinisterio de Agricultura y Ganadería; artículo 63 de la Ley Nº 7664 del 8 de\nabril de 1997, Ley de Protección Fitosanitaria; Ley Nº 7475 del 20 de diciembre\nde 1994, Ley de Ejecución de los Acuerdos de la Ronda Uruguay de Negociaciones\nComerciales Multilaterales; Ley 7472 del 20 de diciembre de 1994, Ley de la\nPromoción de la Competencia y Defensa Efectiva del consumidor y Decreto\nEjecutivo Nº 26431-MAG del 5 de octubre de 1997, Reglamento a la Ley Orgánica\ndel Ministerio de Agricultura y Ganadería;\n\nConsiderando:\n\n            1º-Que\nes función esencial del Estado proteger los vegetales de los perjuicios\ncausados por las plagas, así como regular el uso y manejo de sustancias\nquímicas, biológicas y afines en aras de proteger la sanidad de los vegetales,\nde salud humana y del ambiente.\n\n            2º-Que\npara la economía nacional y la seguridad alimentaria, la protección fitosanitaria\nde los productos de origen vegetal resulta fundamental, lo que obliga al Estado\na adoptar todas las medidas de prevención, vigilancia y control necesarias para\nevitar el ingreso y diseminación de plagas que pongan en peligro o puedan\ncausar daño a las personas o al patrimonio agrícola nacional.\n\n            3º-Que\nel Estado con base en el marco del acuerdo para la aplicación de las medidas\nsanitarias y fitosanitarias, debe adoptar aquellas que resulten necesarias para\nproteger la salud y la vida de las personas, de los animales y vegetales,\nbasando estas medidas en una evaluación adecuada a las circunstancias y a los\nriesgos eventuales que ello conlleve, asegurando que estas medidas no\nconstituyan obstáculos para el comercio internacional.\n\n            4º-Que\nel Ministerio de Agricultura y Ganadería brinda una gran diversidad de\nservicios a los productores agropecuarios por medio del Servicio Fitosanitario\ndel Estado.\n\n            5º-Que\nen aras de garantizar un permanente y eficaz funcionamiento de esta Institución\nque brinda servicios regulatorios fitosanitarios para la protección de los\nvegetales, y uso de los agroquímicos, entre otros, se hace necesaria la\nreposición oportuna de los insumos tales como equipos, reactivos, materiales, y\ncontratar el recurso humano idóneo y necesario para la realización de los\nservicios que se prestan, como inspecciones a productos vegetales y\nagroquímicos tanto de importación como exportación, certificación de los envíos\nexportados, análisis de laboratorio a estos productos, diagnóstico y control de\nplagas cuarentenarias y de importancia económica y demás servicios de igual\ngénero.\n\n            6º-Que\nexiste suficiente evidencia técnica que demuestra que una de las principales\nvías de diseminación de plagas es mediante el traslado de material de origen\nvegetal cuyo medio de transporte son los equipajes como: valijas, maletines,\nsalveques entre otros, empleados por las personas que ingresan al país\nutilizando ya sea la vía terrestre, aérea, marítima o pluvial, lo que ha\nprovocado que muchos países, en aras de proteger el patrimonio agrícola hayan\nestablecido el escaneo de equipajes para disminuir el riesgo de introducción de\nnuevas plagas.\n\n            7º-Que\npara mantener la eficiencia y eficacia en los servicios que se brindan a los\nproductores, es necesario realizar ajustes en las tarifas, a efecto de\ncompensar los incrementos en los costos que durante el último año se han\ngenerado y por lo que se hace necesario reestablecer una indexación automática\ncon base en el valor del índice de precios al consumidor del año anterior y que\nrija a partir del 1 de febrero de cada año.\n\n            8º-Que\nen el año 2000 fue la última fecha en que se reformó el artículo 2 del Decreto\nN° 27763 antes citado, para hacer una publicación general de las tarifas de los\nservicios que presta el Ministerio de Agricultura y Ganadería a través del\nServicio Fitosanitario del Estado. Por tanto:\n\n \n\nDecretan:\n\nREFORMA\nA LOS ARTÍCULOS 2, 6 Y 8 DEL DECRETO N° 27763-MAG DEL\n\n10\nDE MARZO DE 1999, CORRESPONDIENTE A LA FIJACIÓN\n\nDE TARIFAS\nDE LOS SERVICIOS DEL MINISTERIO   "body_en_text": "in the full text\n\n                    -\n\n                        Full Text of Norma 35753\n\n                        Reform of the Setting of Tariffs for the Services of the Ministry of Agriculture and Livestock and Creation of the Registry of Importers of Plants and Plant Products\n\nFull Text of acta: CDB11\n\nNº 35753-MAG\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF AGRICULTURE AND LIVESTOCK\n\nIn use of the powers conferred upon them by articles 140, subsections 3), 7), 8), and 18), and 146 of the Political Constitution and the provisions of Law Nº 7064 of April 29, 1987, Law for the Promotion of Agricultural and Organic Production of the Ministry of Agriculture and Livestock; article 63 of Law Nº 7664 of April 8, 1997, Plant Protection Law; Law Nº 7475 of December 20, 1994, Law on the Implementation of the Uruguay Round Agreements of Multilateral Trade Negotiations; Law 7472 of December 20, 1994, Law for the Promotion of Competition and Effective Consumer Protection, and Executive Decree Nº 26431-MAG of October 5, 1997, Regulation to the Organic Law of the Ministry of Agriculture and Livestock;\n\nConsidering:\n\n1º-That it is an essential function of the State to protect plants from damage caused by pests, as well as to regulate the use and handling of chemical, biological, and related substances in order to protect plant health, human health, and the environment.\n\n2º-That for the national economy and food security, the phytosanitary protection of products of plant origin is fundamental, compelling the State to adopt all necessary prevention, surveillance, and control measures to prevent the entry and dissemination of pests that endanger or could cause harm to people or the national agricultural heritage.\n\n3º-That the State, based on the framework of the Agreement on the Application of Sanitary and Phytosanitary Measures, must adopt those measures necessary to protect the health and life of people, animals, and plants, basing these measures on an assessment appropriate to the circumstances and the potential risks involved, ensuring that these measures do not constitute obstacles to international trade.\n\n4º-That the Ministry of Agriculture and Livestock provides a great diversity of services to agricultural producers through the State Phytosanitary Service (Servicio Fitosanitario del Estado, SFE).\n\n5º-That in order to guarantee a permanent and effective operation of this Institution that provides regulatory phytosanitary services for the protection of plants and the use of agrochemicals, among others, the timely replenishment of inputs such as equipment, reagents, materials, and the hiring of the suitable and necessary human resources for the performance of the services provided becomes necessary, such as inspections of plant and agrochemical products, both for import and export, certification of exported shipments, laboratory analysis of these products, diagnosis and control of quarantine and economically important pests, and other services of the same kind.\n\n6º-That there is sufficient technical evidence demonstrating that one of the main pathways for pest dissemination is through the transfer of material of plant origin, the means of transport for which are luggage items such as: valijas, maletines, salveques, among others, used by people entering the country via land, air, sea, or river routes, which has led many countries, in order to protect their agricultural heritage, to establish luggage scanning to reduce the risk of introducing new pests.\n\n7º-That to maintain efficiency and effectiveness in the services provided to producers, it is necessary to make adjustments to the tariffs, in order to compensate for the increases in costs that have been generated over the past year, and therefore it is necessary to re-establish an automatic indexation based on the value of the consumer price index of the previous year, effective as of February 1st of each year.\n\n8º-That the year 2000 was the last date on which article 2 of the aforementioned Decree N° 27763 was reformed to make a general publication of the tariffs for the services provided by the Ministry of Agriculture and Livestock through the State Phytosanitary Service. The cost of the registration service in the registry of importers for the year 2009 shall be ¢ 46,575.00, which must be paid at the beginning of the period. Likewise, this amount shall be updated automatically based on the value of the consumer price index of the previous year and effective as of February 1st of each year.\"\n\nArticle 3º-The services for X-ray scanning or luggage inspection will have a cost of $2.00 per person. Said charge will be made upon entry or exit of persons, as deemed convenient by the administration.\n\nThe scanning services for non-intrusive inspection of goods passing as exports, imports, or national transit through the land borders, ports, and airports of the entire country, will have a cost of $25.00 per container.\n\n(Thus amended by article 3° of Executive Decree N° 44902 of January 30, 2025)\n\nArticle 4º-All income received by the State Phytosanitary Service (SFE) must be made in cash, or by other suitable and legally authorized means, upon delivery of the official cash receipt, signed and sealed by the officials authorized for this purpose.\n\nThose companies to which phytosanitary services related to import and export are provided on a continuous basis may pay for the services rendered within fifteen calendar days following the effective provision of the same. When the company fails to make the corresponding payment within the described period, the services provided by the State Phytosanitary Service (SFE) will be immediately suspended, and the corresponding administrative or judicial collection process will be initiated.\n\nThe foregoing provision shall be regulated by the Directorate, jointly with the Administrative and Financial Department, through a procedure.\n\nArticle 5º-Effective as of February 01, 2010.\n\nGiven at the Presidency of the Republic on the 11th day of January of the year 2010."
