Por tanto,\n\nDecretan:\n\nReglamento de\nCreación y Funcionamiento de la\n\nComisión Nacional\nAsesora del Ministro\n\ny del Servicio\nFitosanitario del Estado\n\n            Artículo 1º-Créase la\nComisión Nacional Asesora del Ministro de Agricultura y Ganadería y del\nServicio Fitosanitario del Estado, conocida en este Decreto como \"CONAFI\", con\ncarácter de asesora, para dar apoyo tanto a este como a la Dirección General\ndel Servicio Fitosanitario del Estado (en adelante \"SFE\"), para obtener opinión\ny consejo del sector privado y académico universitario en política\nfitosanitaria, en la búsqueda de soluciones y propuestas conjuntas que mejoren\nel desarrollo de la acción fitosanitaria y la calidad de nuestro patrimonio\nagrícola y lograr una articulación entre el sector público, representado por\neste Ministerio y los sectores de producción y de exportación agrícola,\nprofesional y académico.\n\n            Artículo\n2º-La CONAFI estará integrada por los siguientes miembros:\n\n \n\n1. El Director General del SFE, quien presidirá la\nCONAFI.\n\n2. Un representante del Colegio de Ingenieros\nAgrónomos (CIAgro).\n\n3. Un representante de la Cámara Nacional de\nAgricultura y Agroindustria (CNAA).\n\n4. Un representante de la Cámara de Exportadores\nde Costa Rica (CADEXCO).\n\n5. Un representante de las Organizaciones de\npequeños y medianos productores agropecuarios, designado por el Ministro de\nAgricultura y Ganadería.\n\n6. Un representante de las Universidades\nestatales, designado por el Consejo Nacional de Rectores (CONARE).\n\n \n\n            El Ministro de Agricultura\ny Ganadería designará entre las diversas organizaciones de pequeños y medianos\nproductores agropecuarios cuál será el grupo que representará al sector en la\nCONAFI.\n\n            Artículo\n3º-La CONAFI podrá convocar a organizaciones y técnicos especializados para que\nactúen como órganos consultivos, quiénes podrán participar en las sesiones como\ninvitados especiales con voz pero sin voto.\n\n            Artículo\n4º-La Secretaría de dicho órgano colegiado la ejercerá un representante del\nSFE, designado por el Director General, el cual tendrá voz pero no voto.\n\n            Artículo\n5º-El Ministro de Agricultura y Ganadería delega en la persona del Director del\nSFE, la potestad de solicitar a las entidades que conforman la CONAFI, la\ndesignación de su representante propietario y suplente. Con excepción del\nrepresentante de los pequeños y medianos productores, que será designado por el\nMinistro.\n\n \n\n            El\nDirector General del SFE deberá enviar la solicitud de postulación a las\norganizaciones que conforman la CONAFI en un plazo no mayor de ocho días\nhábiles cada vez que se presente una vacante.\n\n            Artículo\n6º-Los miembros tanto del sector público como privado serán nombrados por\ntiempo indefinido, sin perjuicio de las facultades del jerarca para el caso del\nsector público, o de las organizaciones del sector privado de poder cambiar en\nel momento que consideren necesario a sus representantes, comunicando con nota\na la Dirección General del SFE y a la Secretaría de la CONAFI. En caso de\nrenuncia o remoción, el Director General del SFE solicitará al ente respectivo\nsu sustitución.\n\n            Artículo\n7º-El Poder Ejecutivo procederá a emitir el Acuerdo y publicar en el Diario\nOficial La Gaceta el nombramiento respectivo. Los integrantes de la\nCONAFI no percibirán dietas, ni emolumento alguno por participar e integrar\ndicho órgano colegiado.\n\n            Artículo\n8º-Son funciones de la CONAFI:\n\n \n\n1. Asesorar al Ministro de Agricultura y Ganadería\ny al Director General del SFE a fin de que cumplan en forma eficiente y eficaz\nsus funciones y obligaciones en materia fitosanitaria respondiendo a las\nnecesidades actuales del sector agrícola y del comercio internacional de\nproductos agrícolas.\n\n2. Presidir las sesiones de la CONAFI, decidir\ncuándo los temas de discusión han sido suficientemente discutidos y someterlos\na votación.\n\n2. Solicitar a la Secretaría de la CONAFI la\nconvocatoria a sesiones extraordinarias.\n\n3. Fijar directrices técnicas e impartir\ninstrucciones, en cuanto a los aspectos de forma de las tareas de la CONAFI.\n\n4. Las demás funciones propias de su cargo.\n\n            Artículo 10.-La CONAFI se\nreunirá ordinariamente una vez cada mes en el lugar que se acuerde en la\nreunión anterior, o donde defina la presidencia. También podrá reunirse\nextraordinariamente cada vez que sea convocada por la presidencia o por tres de\nsus miembros.\n\n            Artículo\n11.-El quórum de las sesiones se formará con un mínimo de tres miembros. Los\nacuerdos se tomarán por mayoría simple. En caso de empate, el presidente\nejercerá doble voto.\n\n            Artículo\n12.-Perderá su condición de miembro de la CONAFI, aquel propietario que no\nparticipe durante tres sesiones consecutivas o cinco alternas, en un período de\nseis meses, ya sean sesiones ordinarias o extraordinarias, no habiendo delegado\nsu representación en su suplente. El Director del SFE comunicará esta situación\na la institución o sector representado con el objeto de proceder a la\nsustitución del representante.\n\n            Artículo\n13.-Los miembros de la CONAFI actuarán en representación de su respectiva\norganización, en exclusiva consideración a su capacidad y excelencia\nprofesional.\n\n            Artículo\n14.-Los integrantes de la CONAFI, tendrán la obligación de declarar su\ninhabilidad o incompatibilidad real o moral, respecto de cualquier tema sobre\nel que tengan interés directo, tener vínculo de parentesco con el patrocinante\nde algún tema, o prestar asesoría profesional sobre el mismo.\n\n            Artículo\n15.-Las actas de las sesiones, serán aprobadas por la CONAFI y firmadas en la\nsesión siguiente por el Presidente y la Secretaría, dando fe de ello.\n\nLos acuerdos declarados en firme podrán ejecutarse a\npartir de la fecha en que fueron adoptados. Éstos podrán declararse en firme en\nla misma sesión donde se tomó la resolución. La CONAFI designará quién los\nejecuta, la Secretaría dará seguimiento.\n\n            Artículo\n16.-Cualquier miembro de la CONAFI podrá solicitar revisión de los acuerdos\nadoptados en la sesión anterior. Dicha solicitud deberá hacerse efectiva al\nmomento de lectura y discusión del acta de la sesión anterior.\n\n            Artículo\n17.-Son funciones y deberes de la Secretaría de la CONAFI:\n\n \n\n1. Efectuar las invitaciones y convocar de oficio\na las sesiones ordinarias, así como convocar a las extraordinarias, a instancia\ndel Presidente, de los interesados o de tres miembros de la CONAFI, con no\nmenos de cuarenta y ocho horas de antelación.\n\n2. Recibir y someter a conocimiento de la CONAFI\nla correspondencia, las solicitudes y documentos técnicos para su análisis.\n\n3. Llevar el Libro de Actas, el cual deberá estar\ndebida y consecutivamente foliado y sellado, donde se anotarán los acuerdos\ntomados por la CONAFI.\n\n4. Presentar en conjunto con la Presidencia, la\nagenda de los asuntos a tratar en cada reunión.\n\n5. Registrar, archivar, clasificar y ordenar\ncronológicamente la correspondencia o documentos recibidos y emitidos por la\nCONAFI.\n\n6. Ejecutar y coordinar los estudios que solicita\nla CONAFI, para lo cual contará con el respaldo de todas las instancias\nespecializadas en la materia de estudio.\n\n7. Mantener actualizado un archivo técnico.\n\n8. Contestar la correspondencia.\n\n9. Comunicar y notificar a los interesados los\nacuerdos de la CONAFI.\n\n10.       Preparar y distribuir oportunamente la\ndocumentación referente a los antecedentes ilustrativos y técnicos de la\nmateria a tratar.\n\n11.       Coordinar la participación de los\nespecialistas tanto del sector público como del sector privado, cuando el\nPresidente de la CONAFI lo estime necesario o conveniente.\n\n12.       Coordinar la preparación de las\nconclusiones e informes para el Presidente de la CONAFI de los asuntos que\nemanen como resultado de las sesiones.\n\n13.       Las demás funciones propias de una\nSecretaría que le asigne la CONAFI.\n\n            Artículo 18.-En lo no\nregulado por el presente Decreto en materia de órganos colegiados, rige\nsupletoriamente lo dispuesto por la Ley General de la Administración Pública.\n\n            Artículo\n19.-Para poder ejercer las facultades que la Ley de Protección Fitosanitaria,\nsu Reglamento y este Decreto Ejecutivo indican, los funcionarios del SFE\ndeberán colaborar con la CONAFI y brindarles la información que éstos requieran\nde una manera ágil y transparente, siempre que no sea clasificada como\nconfidencial; estas solicitudes se canalizarán a través del Director del SFE.\n\n \n\n            El\nDirector del SFE actuará como ente de enlace hacia las diferentes instancias de\neste.\n\n            Artículo\n20.-El presente Decreto Ejecutivo no crea cargos ni compromete los recursos\npresupuestarios del SFE. El apoyo que se ofrece a la CONAFI consiste únicamente\nen el aporte de un funcionario que ejercerá la Secretaría y el aporte de un\nasesor legal, sólo cuando sea solicitado por acuerdo de la CONAFI. Ambos\nfuncionarios participarán con voz pero sin voto.\n\n            Artículo\n21.-Deróguese el Decreto 34929-MAG publicado en La Gaceta N° 241 del 12\nde diciembre del año 2008.\n\n            Artículo\n22.-Rige a partir de su publicación.\n\n \n\n            Dado en la Presidencia de\nla República.-San José, a los cuatro días del mes de febrero del dos mil diez.", "body_en_text": "in the entirety of the text\n\n -\n\n Full Text of Regulation 35775\n\n Regulation for the Creation and Operation of the National Advisory Commission to the Minister and to the State Phytosanitary Service\n\nFull Text of record: CE323\n\nNo. 35775-MAG\n\nTHE PRESIDENT OF THE\nREPUBLIC\n\nAND THE MINISTER OF\nAGRICULTURE AND LIVESTOCK\n\n In exercise of the\npowers conferred by Articles 140, subsections 3), 18), and 20), Article 146\nof the Political Constitution; Articles 25 subsection 1), 27 subsection 1), 28 subsections\nb) and j), of Law No. 6227 of May 2, 1978, which is the General Law of\nPublic Administration, and Law No. 7664 of April 8, 1997, which is the Law\nof Phytosanitary Protection.\n\nConsidering:\n\n 1.—That it is the responsibility of the\nMinistry of Agriculture and Livestock to protect plants from the harm\ncaused by pests, as well as to avoid and prevent the introduction and spread\nof pests that threaten the economic activity based on agricultural\nproduction.\n\n 2.—That\nthe opinion and advice of the different actors involved in productive agricultural\nactivities, such as the producer, exporter, university, and research sectors, are of\ninterest to the administration in the search for joint solutions to the\ndifferent problems that occur in the activity.\n\n 3.—That\nthe Ministry of Agriculture and Livestock may establish advisory commissions\nfor the application of Law 7664, as established in Article 7 of said Law.\n\n 4.—That\nthe State Phytosanitary Service is the public body responsible for the\napplication of phytosanitary measures, ensuring they are those necessary\nto protect the health and life of persons and animals or to preserve\nplants, provided that such measures are not incompatible with the\nprovisions of the Agreement on Sanitary and Phytosanitary Measures of the\nWorld Trade Organization (WTO), and is the official counterpart for the\nMultilateral and Bilateral Agreements signed by the country on phytosanitary\nmatters. Therefore,\n\nThey Decree:\n\nRegulation for the\nCreation and Operation of the\n\nNational Advisory Commission to the Minister\n\nand to the State\nPhytosanitary Service\n\n Article 1.—The National Advisory Commission to the Minister of\nAgriculture and Livestock and to the State Phytosanitary Service is hereby created, known in this Decree as \"CONAFI,\" with an advisory\ncapacity, to support both the Minister and the General Directorate\nof the State Phytosanitary Service (hereinafter \"SFE\"), to obtain the\nopinion and counsel of the private sector and the university academic sector on phytosanitary\npolicy, in the search for joint solutions and proposals that improve\nthe development of phytosanitary action and the quality of our agricultural\nheritage, and to achieve a linkage between the public sector, represented by\nthis Ministry, and the agricultural production, export, professional, and academic\nsectors.\n\n Article\n2.—CONAFI shall be composed of the following members:\n\n\n1. The General Director of the SFE, who shall preside over\nCONAFI.\n\n2. A representative of the College of Agronomist\nEngineers (CIAgro).\n\n3. A representative of the National Chamber of\nAgriculture and Agroindustry (CNAA).\n\n4. A representative of the Chamber of Exporters\nof Costa Rica (CADEXCO).\n\n5. A representative of the organizations of\nsmall and medium-sized agricultural and livestock producers, designated by the Minister\nof Agriculture and Livestock.\n\n6. A representative of the state\nUniversities, designated by the National Council of Rectors (CONARE).\n\n\n The Minister of Agriculture\nand Livestock shall designate, from among the various organizations of small and medium-sized\nagricultural and livestock producers, which group shall represent the sector on\nCONAFI.\n\n Article\n3.—CONAFI may convene specialized organizations and technicians to\nact as consultative bodies, who may participate in the sessions as\nspecial guests with voice but without vote.\n\n Article\n4.—The Secretariat of said collegiate body shall be exercised by a representative of the\nSFE, designated by the General Director, who shall have voice but no vote.\n\n Article\n5.—The Minister of Agriculture and Livestock delegates to the person of the Director of the\nSFE the power to request the entities that make up CONAFI to\ndesignate their permanent representative and alternate. Except for the\nrepresentative of the small and medium-sized producers, who shall be designated by the\nMinister.\n\n\n The\nGeneral Director of the SFE must send the request for nomination to the\norganizations that make up CONAFI within a period not exceeding eight business\ndays each time a vacancy arises.\n\n Article\n6.—The members from both the public and private sectors shall be appointed for\nan indefinite period, without prejudice to the powers of the head of the entity in the case\nof the public sector, or of the private sector organizations to change\ntheir representatives at any time they deem necessary, communicating this by note\nto the General Directorate of the SFE and to the Secretariat of CONAFI. In the event of\nresignation or removal, the General Director of the SFE shall request the respective entity\nto provide a substitute.\n\n Article\n7.—The Executive Branch shall proceed to issue the corresponding Accord and publish the\nrespective appointment in the Official Gazette La Gaceta. The members of\nCONAFI shall not receive per diem allowances or any emolument whatsoever for participating in and making up\nsaid collegiate body.\n\n Article\n8.—The functions of CONAFI are:\n\n\n1. To advise the Minister of Agriculture and Livestock\nand the General Director of the SFE so that they efficiently and effectively fulfill\ntheir functions and obligations in phytosanitary matters, responding to the\ncurrent needs of the agricultural sector and the international trade of\nagricultural products.\n\n2. To analyze and give opinions on the technical\nrecommendations or phytosanitary measures proposed by the SFE, in matters within its\ncompetence, brought to the attention of CONAFI by the General Director of the\nSFE.\n\n3. To analyze and give opinions on the progress of\nthe pest prevention and control programs executed by the SFE, brought to the\nattention of CONAFI by the General Director of the SFE.\n\n4. To form the working subcommittees necessary for\nits better operation within the scope of action of CONAFI.\n\n5. To recommend phytosanitary\nresearch programs, as well as training programs for field technicians and producers in matters of\nphytosanitary protection in general, as well as in all work areas of the\nSFE when a specific need arises.\n\n6. To propose topics in phytosanitary matters that\nrequire analysis and coordination by the public and private sectors; as well\nas those that the private sector has brought to the attention of CONAFI,\ndefining their priority.\n\n7. To collaborate on tasks entrusted by the General\nDirector of the SFE or the Minister of Agriculture and Livestock.\n\n Article 9.—The functions\nof the President of CONAFI are:\n\n\n1. To preside over the sessions of CONAFI, decide\nwhen discussion topics have been sufficiently discussed, and submit them\nto a vote.\n\n2. To request the Secretariat of CONAFI to\nconvene extraordinary sessions.\n\n3. To set technical directives and issue\ninstructions regarding the procedural aspects of CONAFI's tasks.\n\n4. The other functions inherent to the position.\n\n Article 10.—CONAFI shall\nmeet ordinarily once a month at the place agreed upon at the\nprevious meeting, or as defined by the presidency. It may also meet\nextraordinarily whenever convened by the presidency or by three of\nits members.\n\n Article\n11.—The quorum for sessions shall be formed with a minimum of three members.\nDecisions shall be adopted by simple majority. In the event of a tie, the president\nshall exercise a double vote.\n\n Article\n12.—Any permanent member who fails\nto participate during three consecutive sessions or five alternate sessions, within a period\nof six months, whether ordinary or extraordinary sessions, without having delegated\ntheir representation to their alternate, shall lose their status as a member of CONAFI. The Director of the SFE shall communicate this situation\nto the institution or sector represented for the purpose of proceeding with the\nsubstitution of the representative.\n\n Article\n13.—The members of CONAFI shall act in representation of their respective\norganization, in exclusive consideration of their capacity and professional\nexcellence.\n\n Article\n14.—The members of CONAFI shall have the obligation to declare their\ndisqualification or real or moral incompatibility with respect to any topic\nin which they have a direct interest, have a kinship relationship with the sponsor\nof a topic, or provide professional advisory services on it.\n\n Article\n15.—The minutes of the sessions shall be approved by CONAFI and signed at the\nfollowing session by the President and the Secretariat, attesting to them.\n\nThe\nagreements declared firm may be executed as\nof the date they were adopted. These may be declared firm at\nthe same session where the resolution was taken. CONAFI shall designate who shall\nexecute them, and the Secretariat shall follow up.\n\n Article\n16.—Any member of CONAFI may request a review of the agreements\nadopted at the previous session. Said request must be made effective at the\ntime of the reading and discussion of the minutes of the previous session.\n\n Article\n17.—The functions and duties of the Secretariat of CONAFI are:\n\n\n1. To issue the invitations and officially convene\nthe ordinary sessions, as well as to convene the extraordinary ones, at the request\nof the President, the interested parties, or three members of CONAFI, with no\nless than forty-eight hours’ notice.\n\n2. To receive and submit for the knowledge of CONAFI\nthe correspondence, requests, and technical documents for analysis.\n\n3. To maintain the Book of Minutes, which must be\nduly and consecutively foliated and sealed, where the agreements\nadopted by CONAFI shall be recorded.\n\n4. To present, together with the Presidency, the\nagenda of matters to be addressed at each meeting.\n\n5. To register, archive, classify, and organize\nchronologically the correspondence or documents received and issued by\nCONAFI.\n\n6. To execute and coordinate the studies requested by\nCONAFI, for which it shall have the support of all the\nspecialized bodies in the matter under study.\n\n7. To keep a technical archive updated.\n\n8. To reply to correspondence.\n\n9. To communicate and notify the interested parties of\nthe agreements of CONAFI.\n\n10. To prepare and distribute in a timely manner the\ndocumentation referring to the illustrative and technical background of the\nmatter to be addressed.\n\n11. To coordinate the participation of\nspecialists from both the public sector and the private sector, when the\nPresident of CONAFI deems it necessary or convenient.\n\n12. To coordinate the preparation of the\nconclusions and reports for the President of CONAFI on the matters that\narise as a result of the sessions.\n\n13. The other functions inherent to a\nSecretariat as assigned by CONAFI.\n\n Article 18.—In matters\nnot regulated by this Decree regarding collegiate bodies, the provisions\nof the General Law of Public Administration shall apply supplementarily.\n\n Article\n19.—In order to exercise the powers indicated by the Law of Phytosanitary Protection,\nits Regulation, and this Executive Decree, the officials of the SFE\nmust collaborate with CONAFI and provide the information it requires\nin an agile and transparent manner, provided it is not classified as\nconfidential; these requests shall be channeled through the Director of the SFE.\n\n\n The\nDirector of the SFE shall act as the liaison entity with the various bodies of\nthe SFE.\n\n Article\n20.—This Executive Decree does not create positions nor commits the budget\nresources of the SFE. The support offered to CONAFI consists solely\nof the contribution of an official who shall exercise the Secretariat and the contribution of a\nlegal advisor, only when requested by agreement of CONAFI. Both\nofficials shall participate with voice but without vote.\n\n Article\n21.—Decree 34929-MAG published in Gazette No. 241 of December 12,\n2008, is hereby repealed.\n\n Article\n22.—It shall be effective as of its publication.\n\n\n Issued at the Presidency of the\nRepublic.—San José, on the fourth day of February of two thousand ten." }
