Además el Reglamento Orgánico del Poder\nEjecutivo, Decreto Nº 34582 de 4 de junio del 2008, publicado en La Gaceta Nº\n126 del 1º de julio del 2008, le otorga la rectoría sobre el sector ambiente,\nenergía y telecomunicaciones.\n\n            5º-Que\nel recurso hídrico es un bien con valor económico, social y ambiental\ninapreciable; fundamental y estratégico para el desarrollo sostenible del país,\nal dinamizar la economía, generar energía limpia, favorecer la construcción de\ninfraestructura sanitaria y tecnológica para vivienda, agraria, turismo,\nindustria y comercio.\n\n            6º-Que\nla gestión integrada y sostenible de los recursos hídricos del país es un tema de\nprioridad nacional y que se requiere la adopción de lineamientos generales de\npolítica para orientar el accionar de las entidades públicas involucradas.\n\n            7º-Que\nla Ley Orgánica del Ambiente en su artículo 2 inciso c), señala que \"El Estado\nvelará por la utilización racional de los elementos ambientales, con el fin de\nproteger y mejorar la calidad de vida de los habitantes del territorio\nnacional. Asimismo, está obligado a propiciar un desarrollo económico y\nambientalmente sostenible, entendido como el desarrollo que satisface las\nnecesidades humanas básicas, sin comprometer las opciones de las generaciones\nfuturas\".\n\n            8º-La\npoblación de Cuatro Esquinas de los Chiles actualmente se abastece de agua\nmediante pozos artesanales en cada propiedad, los cuales después de la sequía\nque se dio en los primeros meses del año 2008, llegaron en su mayoría a\nsecarse, generando una situación de escasez de agua, lo que originó que los\nhabitantes de la zona pasaran serios problemas para obtener el agua necesaria\npara su subsistencia, trayendo problemas económicos, de salud e higiene entre\notros.\n\n            9º-La\nrelacionada población en este momento solo cuenta con los pozos artesanales,\nque en el verano del año 2009, y en cualquier futura sequía que se presente en\nla zona se verán afectados dejando a la población sin agua y sometiéndolos\nnuevamente a condiciones infrahumanas que generan problemas de salud y por ende\nse debe dictar por medio de Decreto Ejecutivo una declaratoria de interés\npúblico. El proyecto de Cuatro Esquinas de los Chiles se abastece de fuentes de\nagua de calidad dudosa, debido a que los pozos artesanales con una época seca\nfuerte llegan a quedarse sin agua a raíz de cambios climáticos como los\npresentados en los últimos años. Por lo tanto el Instituto de Acueductos y\nAlcantarillados como medidas inmediatas para solventar esta emergencia realizó\ntodos los estudios y diseños necesarios para que estas comunidades puedan\nafrontar con un sistema de abastecimiento que no sea propenso a verse afectado\ncon las sequías, a través de la construcción de una acueducto integral que\ncubra toda la población y que tenga la fuente apropiada y el volumen de\nabastecimiento para suplir las variaciones que se presentan durante el día en\nel consumo de agua.\n\n            10.-Que\nde conformidad con inspección del 4 de noviembre de 2009, realizada por la\nSubgerencia de Sistemas Delegados de Acueductos Rurales del AyA, se indicó que\nla Comunidad de Achotal de Los Chiles, se ubica cerca de los pozos del\nacueducto de Los Chiles, administrado por el Instituto Costarricense de\nAcueductos y Alcantarillados, conformado por un centro de población con 182\nlotes de los cuales 156 tienen casa, un asentamiento con 90 parcelas y 92\ngranjas, de estas últimas algunas con casa.\n\n            11.-Que\nse requiere la perforación de pozos para abastecer a 364 familias y la\nconstrucción de un tanque elevado debido a la ausencia de terrenos altos en la\ncomunidad de Achotal, comprendiendo la construcción del acueducto 9350 metros de tubería,\nasí como una carretera pequeña de camino de asfalto que une Los Chiles con la\nFrontera Norte del país.\n\n            12.-Que\nel Instituto Costarricense de Acueductos y Alcantarillados debe dirigir, y de\nresolver todo lo relacionado con el suministro de agua potable y recolección de\naguas negras y residuos industriales líquidos, lo mismo que el aspecto\nnormativo de los sistemas de alcantarillado pluvial en áreas urbanas para todo\nel territorio nacional.\n\n            13.-Que\nes un derecho universal protegido por nuestra legislación el garantizar que\ntodos los ciudadanos tengamos agua en calidad y cantidad suficiente para\nsatisfacer nuestras necesidades y desarrollar nuestras actividades, todo de\nacuerdo a una debida priorización del recurso.\n\n            14.-Que\nel artículo 271 de la Ley General de Salud, regula el autoabastecimiento en las\nregiones del país donde no hubiere abastos públicos de agua potable y en tanto\nestos se establecen, los habitantes deberán utilizar los sistemas de\nabastecimiento de agua para el consumo y uso doméstico que el Ministerio de\nSalud señale. Por tanto,\n\n \n\nDecretan:\n\nDECLARATORIA DE\nINTERÉS PÚBLICO PARA EL CONSUMO\n\nY AUTOABASTECIMIENTO\nDE AGUA EN LA ZONA DEL\n\nREFUGIO NACIONAL DE\nVIDA SILVESTRE\n\nCORREDOR FRONTERIZO\n\n            Artículo 1º-Declarar de\nInterés Público el Proyecto de Autoabastecimiento de Agua Potable de Cuatro\nEsquinas de los Chiles, Achotal, Isla Chica, y demás poblados vecinos del área\nde influencia directa que se vean afectados con la ausencia del servicio básico\nde agua potable.\n\n            Artículo\n2º-En virtud de la presente declaratoria, el Área de Conservación Arenal Huetar\nNorte, velará por la conservación del medio ambiente, tomándose en\nconsideración que el Proyecto requiere de Evaluación de Impacto Ambiental ante\nla SETENA.\n\n            En\ncaso de requerirse corta de árboles se debe tramitar la autorización de la\noficina correspondiente del Sistema Nacional de Áreas de Conservación, para\nproceder a la corta de árboles ubicados en las áreas del proyecto, que así lo\nrequieran.\n\n            Artículo\n3º-Para la conservación de especies forestales que se puedan ver afectadas,\ndeberán reponerlas y dar mantenimiento por un período mínimo de cinco años, en\nla proporción que recomienden las autoridades del Sistema Nacional de Áreas de\nConservación. Los árboles deberán plantarse en la misma zona donde se produzca\nla corta. Esta acción y las derivadas de la misma se resolverán en coordinación\ncon el Área de Conservación respectiva del Ministerio de Ambiente, Energía y\nTelecomunicaciones, la que por su parte certificará el cumplimiento de la\nreposición.\n\n            Artículo\n4º-En consecuencia de lo aquí expuesto, se autoriza la construcción del Acueducto\nde Cuatro Esquinas de los Chiles, específicamente la red de distribución, línea\nde impulsión, sistema de bombeo, caseta de bombeo, cloración y tanque de\nalmacenamiento de 75m³. Las obras específicas involucran:\n\n \n\n1. Construcción de una caseta de bombeo-cloración,\ncon sus respectivos equipos de cloración y bombeo.\n\n2. Instalación de 116 previstas domiciliarias, con\nsus respectivos hidrómetros y cajas de concreto.\n\n3. Construcción de un tanque de almacenamiento\nelevado de 75m³.\n\n4. Instalación de 8353 metros lineales de\ntubería en red de distribución.\n\n5.   "body_en_text": "across the entire text\n\n-\n\nFull Text of Norm 35818\n\nDeclares of Public Interest the Self-Supply of Potable Water Project for Cuatro Esquinas de los Chiles, Achotal, Isla Chica, and other neighboring villages in the direct area of influence\n\nFull Text of record: CE4C0\n\nNo. 35818-S-MINAET\n\nTHE PRESIDENT OF THE REPUBLIC\n\nTHE MINISTER OF HEALTH\n\nAND THE MINISTER OF ENVIRONMENT, ENERGY, AND TELECOMMUNICATIONS\n\nIn exercise of the powers conferred upon them by Articles 50, 140 subsections 3), 18), and 146 of the Political Constitution; 28 of Law No. 6227 of May 2, 1978, \"General Law of Public Administration\"; Law No. 4240 of November 15, 1968, \"Urban Planning Law\"; 1, 2, 271 of Law No. 5395 of October 30, 1973, \"General Health Law\"; Law No. 8220 of March 4, 2002, \"Law for the Protection of Citizens from Excessive Requirements and Administrative Procedures\"; Law No. 7554 of October 4, 1995, \"Organic Law of the Environment\"; and Law No. 276 of August 27, 1942, \"Water Law.\"\n\nWhereas:\n\n1º—That under the provisions contained in Article 50 of the Political Constitution, the State must seek the greatest well-being of its citizens, planning production toward an adequate distribution of wealth, through the conservation, protection, rational and sustainable use of natural resources and wealth.\n\n2º—That in accordance with Article 1 of the General Health Law, the health of the population is a public interest good protected by the State.\n\n3º—That pursuant to the Water Law, the Ministry of Environment, Energy, and Telecommunications is responsible for deciding and resolving on the ownership, exploitation, utilization, governance, and oversight of water.\n\n4º—That the Ministry of Environment, Energy, and Telecommunications, in accordance with Law No. 7152 of June 5, 1990, is granted the stewardship of the natural resources, energy, and mines sector. Furthermore, the Organic Regulation of the Executive Branch, Executive Decree (Decreto Ejecutivo) No. 34582 of June 4, 2008, published in La Gaceta No. 126 of July 1, 2008, grants it stewardship over the environment, energy, and telecommunications sector.\n\n5º—That water resources are a good of inestimable economic, social, and environmental value; fundamental and strategic for the country's sustainable development, by energizing the economy, generating clean energy, and favoring the construction of sanitary and technological infrastructure for housing, agriculture, tourism, industry, and commerce.\n\n6º—That the integrated and sustainable management of the country's water resources is a matter of national priority and that the adoption of general policy guidelines is required to guide the actions of the public entities involved.\n\n7º—That the Organic Law of the Environment, in its Article 2 subsection c), states that \"The State shall ensure the rational use of environmental elements, in order to protect and improve the quality of life of the inhabitants of the national territory. Likewise, it is obligated to promote economically and environmentally sustainable development, understood as development that satisfies basic human needs, without compromising the options of future generations.\"\n\n8º—The population of Cuatro Esquinas de los Chiles currently supplies itself with water through artisanal wells on each property, which, after the drought that occurred in the first months of 2008, mostly dried up, generating a situation of water scarcity, which caused the inhabitants of the area to experience serious problems in obtaining the water necessary for their subsistence, bringing about economic, health, and hygiene problems, among others.\n\n9º—The related population at this moment only has artisanal wells, which in the summer of 2009, and in any future drought that occurs in the area, will be affected, leaving the population without water and subjecting them again to subhuman conditions that generate health problems; therefore, a declaration of public interest must be issued by means of an Executive Decree (Decreto Ejecutivo). The Cuatro Esquinas de los Chiles project is supplied from water sources of dubious quality, since the artisanal wells, during a severe dry season, end up without water as a result of climate changes like those seen in recent years. Therefore, the Instituto Costarricense de Acueductos y Alcantarillados, as immediate measures to solve this emergency, carried out all the necessary studies and designs so that these communities can rely on a supply system that is not prone to being affected by droughts, through the construction of an integrated aqueduct that covers the entire population and has the appropriate source and supply volume to meet the variations in water consumption that occur during the day.\n\n10.—That in accordance with the inspection of November 4, 2009, carried out by the Sub-Department of Delegated Systems of Rural Aqueducts of AyA, it was indicated that the Community of Achotal de Los Chiles is located near the wells of the Los Chiles aqueduct, administered by the Instituto Costarricense de Acueductos y Alcantarillados, consisting of a population center with 182 lots, of which 156 have houses, a settlement with 90 parcels and 92 farms, some of these latter with houses.\n\n11.—That the drilling of wells is required to supply 364 families and the construction of an elevated tank due to the absence of high ground in the community of Achotal, with the aqueduct construction comprising 9350 meters of pipe, as well as a small asphalt access road connecting Los Chiles to the Northern Border of the country.\n\n12.—That the Instituto Costarricense de Acueductos y Alcantarillados must direct and resolve everything related to the supply of potable water and the collection of sewage and liquid industrial waste, as well as the regulatory aspects of stormwater drainage systems in urban areas for the entire national territory.\n\n13.—That ensuring all citizens have water in sufficient quality and quantity to satisfy our needs and carry out our activities, all in accordance with a proper prioritization of the resource, is a universal right protected by our legislation.\n\n14.—That Article 271 of the General Health Law regulates self-supply (autoabastecimiento) in the country's regions where there are no public potable water supplies, and while these are established, the inhabitants must use the water supply systems for consumption and domestic use indicated by the Ministry of Health. Therefore,\n\nDecree:\n\nDECLARATION OF PUBLIC INTEREST FOR THE CONSUMPTION AND SELF-SUPPLY OF WATER IN THE AREA OF THE CORREDOR FRONTERIZO NATIONAL WILDLIFE REFUGE\n\nArticle 1—To declare of Public Interest the Self-Supply of Potable Water Project for Cuatro Esquinas de los Chiles, Achotal, Isla Chica, and other neighboring villages in the direct area of influence that are affected by the absence of basic potable water service.\n\nArticle 2—By virtue of this declaration, the Área de Conservación Arenal Huetar Norte shall ensure the conservation of the environment, taking into consideration that the Project requires an environmental impact assessment (Evaluación de Impacto Ambiental) before SETENA.\n\nShould tree felling be required, authorization must be processed from the corresponding office of the Sistema Nacional de Áreas de Conservación, in order to proceed with the felling of trees located in the project areas that so require it.\n\nArticle 3—For the conservation of forest species that may be affected, they must be replaced and maintained for a minimum period of five years, in the proportion recommended by the authorities of the Sistema Nacional de Áreas de Conservación. The trees must be planted in the same area where the felling occurs. This action and those derived from it will be resolved in coordination with the respective Área de Conservación of the Ministry of Environment, Energy, and Telecommunications, which, for its part, will certify the fulfillment of the replacement.\n\nArticle 4—As a consequence of what is set forth herein, the construction of the Cuatro Esquinas de los Chiles Aqueduct is authorized, specifically the distribution network, force main, pumping system, pump-chlorination house, chlorination, and 75m³ storage tank. The specific works involve:\n\n1. Construction of a pump-chlorination house, with its respective chlorination and pumping equipment.\n2. Installation of 116 domestic connections, with their respective water meters and concrete boxes.\n3. Construction of an elevated 75m³ storage tank.\n4. Installation of 8353 linear meters of pipe in the distribution network.\n5. Installation of 380 linear meters of pipe in the force main.\n\nArticle 5—Effective from its publication.\n\nGiven at the Presidency of the Republic.—San José, on the eighth day of February of two thousand ten."
