responsabilidad de\nsupervisar el manejo y funcionamiento de la Finca La Soledad, propiedad del\nPoder Judicial, dentro del marco de lo estipulado en este Reglamento. Para ese\ncometido deberá nombrar varias personas que se encarguen de controlar el\ningreso a la finca y vigilar el cumplimiento de las siguientes disposiciones.\n\nArtículo 3º-Corresponde a la Administración Regional, conocer y otorgar los\npermisos para el uso ocasional de las instalaciones de la Finca La Soledad que\ncontempla el Proyecto Justicia en la Naturaleza, con el objeto de realizar\nactividades de orden laboral, cultural, social y recreativo, conforme al\nsiguiente orden:\n\n \n\na) Actividades oficiales del Poder Judicial de Costa Rica.\n\n \n\nb) Actividades del Proyecto Justicia en la Naturaleza, adscrito al Poder Judicial.\n\n \n\nc) Actividades de los Despachos de la Ciudad Judicial de San Joaquín de\nFlores.\n\n \n\nch) Actividades de Despachos del Poder Judicial de todo el país.\n\n \n\nd) Actividades de otras instituciones, sujetas a la aprobación del Consejo Superior,\nla Dirección Ejecutiva o de la Administración Regional.\n\nArtículo 4º-Tendrán derecho al uso y disfrute de las instalaciones de la\nFinca La Soledad, sin costo alguno:\n\n \n\na) Las y los servidores activos del Poder Judicial.\n\n \n\nb) Las y los compañeros Jubilados.\n\n \n\nc) Visitantes especiales a quienes la Dirección Ejecutiva y la Administración\nRegional concedan autorización por el término y bajo las condiciones que se\nindiquen.\n\nArtículo 5º-Las instalaciones de la Finca La Soledad se cederán gratuitamente\npara la realización de las actividades indicadas en el artículo tercero.\n\nCAPÍTULO II\n\nDerechos y obligaciones de las personas usuarias\n\n \n\nArtículo 6º-Las personas usuarias tendrán derecho a utilizar las\ninstalaciones de la Finca La Soledad, que comprende entre otras, áreas verdes,\nmariposario, ranchos, salón multiuso, senderos y áreas de reforestación.\n\nArtículo 7º-Las servidoras y los servidores judiciales podrán ingresar a\nlas instalaciones de la Finca La Soledad, previa identificación mediante el\nrespectivo carné. El servidor o servidora que por motivos especiales no\npresente su carné, podrá presentar excepcionalmente su cédula de identidad,\npara autorizar su ingreso a la Finca. Por su parte, los visitantes especiales\ndeberán presentar la autorización y la identificación que se determine para ese\nfin.\n\nEl encargado de la finca de previo a autorizar el ingreso, deberá consignar\nel nombre de la persona con su número de cédula o identificación, haciendo\nindicación si se trata de un servidor/a judicial o de un visitante. De esa\nforma, se podrá llevar un control de las personas que ingresan diariamente a la\nfinca, en caso de que se presente algún tipo de anomalía.\n\nArtículo 8º-Las servidoras y los servidores judiciales serán responsables\nde observar y acatar las disposiciones sobre el uso y cuido de las\ninstalaciones de la Finca La Soledad. Lo anterior, sin perjuicio de la\naplicación del régimen disciplinario y de la responsabilidad civil que proceda,\nen caso de que se demuestre que por su negligencia o la de sus invitados\nresultaron daños en las instalaciones.\n\nArtículo 9º-Los visitantes especiales a quienes la Administración Regional\nles conceda autorización, según lo dispuesto en el artículo 4, deberán observar\ny acatar las disposiciones sobre el uso y cuido de las mismas. En caso de que\nproducto de su actuar negligente, resulte algún daño en las instalaciones de la\nFinca, serán civilmente responsables de conformidad con lo dispuesto en el artículo\n1045 del Código Civil.\n\nArtículo 10.-Las personas usuarias deberán velar por el cuidado de las\ninstalaciones y la flora y fauna del lugar, además de asegurarse de no dejar\ndesechos ni basura fuera de los recipientes colocados para ese fin.\n\nArtículo 11.-Es deber de las personas usuarias mantener el orden y el aseo\nen las instalaciones de la Finca de Recreo.\n\nCAPÍTULO III\n\nDe la observancia de este reglamento\n\n \n\n \n\nArtículo 12.-Las personas usuarias tienen el derecho y el deber de denunciar\nante la Inspección Judicial, la Administración Regional o ante el cuidador de\nla Finca, aquellos actos que en su concepto hayan ofendido las reglas\nconvencionales de la moral o que hayan dañado las instalaciones físicas de la\nFinca.\n\nTodo comportamiento de los/as servidores/as que comprometa la imagen del\nPoder Judicial dentro de las instalaciones de la Finca, será comunicado a la\nInspección Judicial para que se investigue su proceder.\n\nArtículo 13.-El Administrador Regional o el encargado de la Finca, estarán\nfacultados para desalojar de las instalaciones de la finca a las personas\nusuarias que hayan incurrido en comportamientos indebidos, sin perjuicio de\ncualquier otra sanción que se les pueda imponer.\n\nArtículo 14.-En el caso de los servidores/as judiciales, se aplicará lo\ndispuesto en el Título VIII de la Ley Orgánica del Poder Judicial que trata\nacerca del régimen disciplinario. Además de las sanciones previstas en el\nartículo 195 de esa ley, se podrá prohibir el ingreso del servidor/a a las instalaciones\nde la Finca.\n\nEn el caso de los visitantes se procederá a prohibirles el ingreso a las\ninstalaciones de la Finca, hasta que se cancelen los daños ocasionados o\ntranscurra un plazo, el cual será fijado por la Administración Regional.\n\nArtículo 15.-De previo a la imposición de una sanción, el visitante contra\nquien se presente una queja formal, será emplazado por la Administración\nRegional, por un plazo de cinco días hábiles, para que responda y ofrezca la\nprueba que considere pertinente. Una vez transcurrido el plazo de la audiencia,\na que se refiere este artículo, sin respuesta del emplazado o una vez recibida\nsu defensa y evacuadas las pruebas pertinentes, la Administración Regional\nprocederá a dictar la resolución que corresponda.\n\nArtículo 16.-Los/as servidores/as judiciales e invitados deberán acatar y\nrespetar las sugerencias de la Administración Regional y del cuidador de la\nfinca, así como las disposiciones que en su momento dicten las autoridades\nrespectivas, quienes tienen la obligación de velar por el cumplimiento de lo\nestipulado en este Reglamento. Queda entendido que el Poder Judicial no será\nresponsable de los daños que pudieren sufrir las personas que visitan las\ninstalaciones de la Finca La Soledad, con excepción de aquellas que se refieran\na una actividad de índole laboral, ni de las cosas que lleven o transporten\nconsigo, salvo en los casos en que hubiera una acción directa y deliberada del\nPoder Judicial o de sus servidores/as que hubiera determinado causalmente el\ndaño sufrido.\n\nCAPÍTULO IV\n\nUso de las instalaciones\n\n \n\nArtículo 17.-Es prohibido el ingreso a las instalaciones con cualquier tipo\nde animales, con excepción de aquellos animales adiestrados para asistir a\npersonas con alguna discapacidad física. Asimismo, se permitirá el ingreso de\nanimales a los servidores/as que por la naturaleza de sus funciones, deban\nrealizar prácticas o actividades que involucre el trato con animales, como es\nel caso de los/as servidores/as que laboran en la Unidad Canina del Organismo\nde Investigación Judicial.\n\nArtículo 18.-Se prohíbe el uso de armas de fuego, de aire comprimido o\nflechas de cualquier tipo dentro de las instalaciones de la Finca La Soledad.\n\nArtículo 19.-El uso de equipos de sonido y aparatos de televisión está\npermitido, siempre y cuando su sonido no perturbe la tranquilidad de otras\npersonas.\n\nArtículo 20.-Es prohibida la caza de cualquier especie y el retiro de cualesquier\ntipo de planta y árbol dentro de la Finca La Soledad.\n\nArtículo 21.-Es prohibido bajar frutas de los árboles y plantas, ya que\nestas son para la alimentación de la fauna del lugar.\n\nArtículo 22.-Toda actividad programada en forma oficial por el Consejo\nSuperior del Poder Judicial tendrá prioridad en el orden de uso de las\ninstalaciones de la Finca La Soledad.\n\nArtículo 23.-Tratándose de cualquier otro aspecto sobre acceso y\nutilización de las instalaciones de la Finca La Soledad, no previstos en este\nReglamento, se estará a lo dispuesto por el Consejo Superior del Poder Judicial.\n\nArtículo 24.-Este Reglamento rige a partir de su publicación.\"\n\n \n\nSan José, 22 de marzo de 2010.", "body_en_text": "in the entirety of the text\n\n -\n\n Complete Text of Norm 07\n\n Regulations for the use and enjoyment of the facilities of the La\nSoledad farm within the framework of the project called Justice with Nature\n\nComplete Text of act: CEBD1\n\nCIRCULAR 052-2010\n\n \n\nSubject: Regulations for the use and enjoyment of the facilities of the La\nSoledad farm within the framework of the project called Justice with Nature.\n\n \n\nTO ALL EMPLOYEES OF THE JUDICIAL BRANCH\n\n \n\nBE IT KNOWN THAT:\n\n \n\nThe Full Court, in session Nº 07-10, held on March 1st of the current\nyear, article XIV, approved the regulations for the use and enjoyment of the\nfacilities of the La Soledad farm within the framework of the project called\nJustice with Nature, which literally states:\n\n \n\n\"REGULATIONS FOR THE USE AND ENJOYMENT\n\nOF THE FACILITIES OF THE LA SOLEDAD FARM\n\nWITHIN THE FRAMEWORK OF THE PROJECT CALLED\n\nJUSTICE IN NATURE\n\n \n\nCHAPTER I\n\nGeneral Provisions\n\n \n\nArticle 1º-The provisions of these regulations are mandatory for the\nemployees of the Judicial Branch, as well as for all those\npersons who make use of the facilities of the La Soledad farm, which is\nlocated in the Judicial City of San Joaquín de Flores, in the province of\nHeredia.\n\nFor the purposes of these regulations, it is understood that users\nare all those who make use of the farm's facilities,\nregardless of whether they are employees, guests, or special visitors.\n\nArticle 2º-The Regional Administration of the Judicial City of San Joaquín\nde Flores, hereinafter the Regional Administration, shall have the responsibility of\nsupervising the management and operation of the La Soledad Farm, property of the\nJudicial Branch, within the framework of what is stipulated in these Regulations. For this\ntask, it must appoint several persons to control\nentry to the farm and monitor compliance with the following provisions.\n\nArticle 3º-It is the responsibility of the Regional Administration to hear and grant\npermits for the occasional use of the facilities of the La Soledad Farm\ncontemplated by the Justice in Nature Project, for the purpose of carrying out\nactivities of a labor, cultural, social, and recreational nature, in accordance with the\nfollowing order:\n\n \n\na) Official activities of the Judicial Branch of Costa Rica.\n\n \n\nb) Activities of the Justice in Nature Project, attached to the Judicial Branch.\n\n \n\nc) Activities of the Offices of the Judicial City of San Joaquín de\nFlores.\n\n \n\nch) Activities of Offices of the Judicial Branch from across the country.\n\n \n\nd) Activities of other institutions, subject to the approval of the Superior Council,\nthe Executive Directorate, or the Regional Administration.\n\nArticle 4º-The following shall have the right to the use and enjoyment of the facilities of the\nLa Soledad Farm, at no cost:\n\n \n\na) Active employees of the Judicial Branch.\n\n \n\nb) Retired colleagues.\n\n \n\nc) Special visitors to whom the Executive Directorate and the Regional Administration\ngrant authorization for the term and under the conditions indicated.\n\nArticle 5º-The facilities of the La Soledad Farm shall be ceded free of charge\nfor the realization of the activities indicated in article three.\n\nCHAPTER II\n\nRights and Obligations of Users\n\n \n\nArticle 6º-Users shall have the right to use the\nfacilities of the La Soledad Farm, which include, among others, green areas,\na butterfly garden (mariposario), ranch-style structures (ranchos), a multipurpose hall, trails, and reforestation areas.\n\nArticle 7º-Judicial employees may enter\nthe facilities of the La Soledad Farm, upon prior identification by means of their\nrespective identification card. An employee who, for special reasons, does not\npresent their identification card, may exceptionally present their identity card,\nto authorize their entry to the Farm. In turn, special visitors\nmust present the authorization and identification determined for that\npurpose.\n\nThe person in charge of the farm, prior to authorizing entry, must record\nthe name of the person along with their identity card or identification number, indicating\nwhether they are a judicial employee or a visitor. In this\nway, a record can be kept of the persons who enter the\nfarm daily, in case any type of anomaly occurs.\n\nArticle 8º-Judicial employees shall be responsible\nfor observing and complying with the provisions on the use and care of the\nfacilities of the La Soledad Farm. The foregoing, without prejudice to the\napplication of the disciplinary regime and the civil liability that may proceed,\nin the event that it is demonstrated that due to their negligence or that of their guests,\ndamages to the facilities resulted.\n\nArticle 9º-Special visitors to whom the Regional Administration\ngrants authorization, pursuant to the provisions of article 4, must observe\nand comply with the provisions on the use and care of the same. In the event that,\nas a result of their negligent actions, any damage to the facilities of the\nFarm results, they shall be civilly liable in accordance with the provisions of article\n1045 of the Civil Code.\n\nArticle 10.-Users must ensure the care of the\nfacilities and the flora and fauna of the place, in addition to ensuring they do not leave\nwaste or garbage outside the containers placed for this purpose.\n\nArticle 11.-It is the duty of users to maintain order and cleanliness\nin the facilities of the Recreation Farm.\n\nCHAPTER III\n\nOn the Observance of these Regulations\n\n \n\n \n\nArticle 12.-Users have the right and the duty to denounce\nbefore the Judicial Inspection, the Regional Administration, or the caretaker of\nthe Farm, those acts that in their opinion have offended the conventional rules\nof morality or that have damaged the physical facilities of the\nFarm.\n\nAny behavior of the employees that compromises the image of the\nJudicial Branch within the facilities of the Farm shall be communicated to the\nJudicial Inspection so that their conduct may be investigated.\n\nArticle 13.-The Regional Administrator or the person in charge of the Farm shall be\nempowered to evict from the farm's facilities those\nusers who have incurred in improper behavior, without prejudice to\nany other sanction that may be imposed upon them.\n\nArticle 14.-In the case of judicial employees, the provisions\nof Title VIII of the Organic Law of the Judicial Branch, which deals\nwith the disciplinary regime, shall apply. In addition to the sanctions provided for in\narticle 195 of that law, the entry of the employee to the facilities\nof the Farm may be prohibited.\n\nIn the case of visitors, they shall be prohibited from entering the\nfacilities of the Farm, until the damages caused are paid for or\na period of time, to be set by the Regional Administration, has elapsed.\n\nArticle 15.-Prior to the imposition of a sanction, the visitor against\nwhom a formal complaint is filed shall be summoned by the Regional Administration,\nfor a period of five business days, to respond and offer the\nevidence they deem pertinent. Once the period for the hearing\nreferred to in this article has elapsed without a response from the summoned party, or once their\ndefense has been received and the pertinent evidence examined, the Regional Administration\nshall proceed to issue the corresponding resolution.\n\nArticle 16.-Judicial employees and guests must observe and\nrespect the suggestions of the Regional Administration and the caretaker of the\nfarm, as well as the provisions that the respective\nauthorities may issue in due course, who have the obligation to ensure compliance with what is\nstipulated in these Regulations. It is understood that the Judicial Branch shall not be\nresponsible for damages that persons visiting the\nfacilities of the La Soledad Farm may suffer, with the exception of those relating\nto an activity of a labor nature, nor for the things they carry or transport\nwith them, except in cases where there was a direct and deliberate action by the\nJudicial Branch or its employees that causally determined the\ndamage suffered.\n\nCHAPTER IV\n\nUse of the Facilities\n\n \n\nArticle 17.-Entry to the facilities with any type\nof animal is prohibited, with the exception of those animals trained to assist\npersons with some physical disability. Likewise, the entry of\nanimals shall be permitted for employees who, by the nature of their duties, must\ncarry out practices or activities involving the handling of animals, as is\nthe case of the employees working in the Canine Unit of the Judicial\nInvestigation Agency.\n\nArticle 18.-The use of firearms, compressed air weapons, or\narrows of any type is prohibited within the facilities of the La Soledad Farm.\n\nArticle 19.-The use of sound equipment and television sets is\npermitted, provided that their sound does not disturb the tranquility of other\npersons.\n\nArticle 20.-The hunting of any species and the removal of any\ntype of plant and tree within the La Soledad Farm is prohibited.\n\nArticle 21.-It is prohibited to pick fruits from the trees and plants, as\nthese are for the feeding of the local fauna.\n\nArticle 22.-Any activity officially scheduled by the Superior Council\nof the Judicial Branch shall have priority in the order of use of the\nfacilities of the La Soledad Farm.\n\nArticle 23.-Regarding any other aspect of access and\nuse of the facilities of the La Soledad Farm not provided for in these\nRegulations, the provisions of the Superior Council of the Judicial Branch shall apply.\n\nArticle 24.-These Regulations take effect upon their publication.\"\n\n \n\nSan José, March 22, 2010." }
