  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 35993\n\n                        Crea Comisión Técnica para la Gestión de la Reserva de Biosfera Agua y Paz\nde Costa Rica\n\nTexto Completo acta: CFD93\n\nN° 35993-MINAET\n\nEL PRESIDENTE DE\nLA REPÚBLICA\n\nY EL MINISTRO DE\nAMBIENTE, ENERGÍA\n\nY TELECOMUNICACIONES\n\nEn ejercicio de las facultades que nos confieren los\nincisos 3) y 18) del artículo 140 y 146 de la Constitución Política.\n\nConsiderando:\n\n1º-Que el Programa sobre el Hombre y\nla Biosfera (MAB), fue\ncreado en el año 1970, como un programa interdisciplinario a largo plazo de\nla Organización\nde las Naciones Unidas para\nla Educación,\nla Ciencia y\nla Cultura (UNESCO).\n\n2º-Que el Programa\nsobre el Hombre y la Biosfera\n(MAB) se centra en actividades de investigación, formación, monitoreo y\neducación, tendientes a la búsqueda de la compensación y el equilibrio mediante\nla responsabilidad humana; que garantice la conservación de la biodiversidad y\nel uso racional de los recursos naturales para el mejoramiento del bienestar\nsocial y económico de las poblaciones.\n\n3º-Que para tal\nefecto cuenta, desde hace varios años, con\nla Red Mundial de\nReservas de Biosfera que utiliza como vehículo para compartir conocimientos,\npromover la investigación, educación y formación; y fomentar la toma de\ndecisiones participativa, con el objetivo de garantizar todos los aspectos de\nla sostenibilidad medioambiental, económica y social.\n\n4º-Que el Programa\nsobre el Hombre y la Biosfera\n(MAB) por intermedio de esta Red Mundial de Reservas de Biosfera, abarca 531\nsitios en más de 105 países, con diversos tipos de ecosistemas que van desde\nmontañosos a marinos, así como paisajes rurales y urbanos.\n\n5º-Que el concepto de\nReservas de Biosfera se desarrolló por primera vez en el año 1974 y fue\nrevisado en 1995 cuando\nla Conferencia General de\nla UNESCO adoptó el Marco\nEstatutario y la Estrategia\nde Sevilla para Reservas de Biosfera.\n\n6º-Que las Reservas\nde Biosfera proveen oportunidades adaptadas al contexto de los diferentes\npaíses, que permiten combinar el conocimiento científico con modalidades de\ngobernanza, a fin de reducir la pérdida de biodiversidad, mejorar la calidad de\nvida de las personas, elevar las condiciones sociales, económicas y culturales,\nnecesarias para un medio ambiente sostenible.\n\n7º-Que las Reservas\nde Biosfera también pueden servir como sitios de demostración y aprendizaje en\ncuanto a la educación para el desarrollo sostenible, en el marco de las\nNaciones Unidas.\n\n8º-Que a las Reservas\nde Biosfera se les debe brindar un papel protagonice, en virtud de los aspectos\napuntados y del rol intersectorial e interinstitucional/organizacional que éstas\ndesempeñan. Lo anterior en pro de la aplicación de los principios establecidos\npor la UNESCO,\nrelacionados con el desarrollo, la conservación y el conocimiento; todos ellos\níntimamente ligados con las acciones de mitigación y adaptación al cambio climático.\n\n9º-Que\nla Reserva de Biosfera Agua y\nPaz, designada por la UNESCO\na finales del año 2007, (que comprende en su totalidad los cantones de Guatuso,\nLos Chiles, San Carlos, Alfaro Ruiz, parte de los cantones de Upala, Tilarán y\nSarapiquí, así como la totalidad del Distrito de Monteverde del Cantón de\nPuntarenas) ha sido declarada prototipo carbono neutral, dentro del marco de\nla Estrategia Nacional\nde Cambio Climático de Costa Rica.\n\n10.-Que\nla Reserva de Biosfera Agua y\nPaz fue seleccionada mediante Acuerdo entre\nla Cátedra UNESCO\ny Sitios de Patrimonio Natural y Mixtos y\nla Reserva de Biosfera Agua y Paz, como la sede en\ndonde se impartirá esta Cátedra; en el contexto de un proyecto piloto en el que\nparticiparán además,\nla Cátedra UNESCO en Desarrollo Sostenible y\nEducación Ambiental del País Vasco y\nla Reserva de Biosfera de Urdaibai en España, así\ncomo la Cátedra\n UNESCO Sur/Sur, Cooperación al Desarrollo Sostenible y la\nfutura Reserva de Biosfera Marajó en Brasil.\n\n11.-Que dentro de\neste contexto, es necesario coordinar y gestionar en\nla Reserva de Biosfera Agua y\nPaz, las actividades productivas, de conservación de los recursos naturales y\nde conocimiento, de manera que faciliten una articulación de los esfuerzos que\nrealizan las instituciones públicas, las municipalidades, las empresa privadas\ny las organizaciones de la población; lo anterior con el objeto fundamental de\npromover el desarrollo sostenible conforme el compromiso asumido con\nla UNESCO.\n\n12.-Que para\nimplementar y fortalecer el modelo de\nla Reserva de Biosfera Agua y Paz, ésta requiere\n(según lineamientos establecidos por\nla UNESCO), de una plataforma de funcionamiento\nefectiva, que sea participativa, funcional y permanente, capaz de aglutinar a\ntodos los sectores y actores relevantes presentes en el área geográfica de\nla Reserva.\n\n13º-Que los órganos\nque se constituyan para la gestión de\nla Reserva de Biosfera Agua y Paz considerarán para\nsu accionar, las recomendaciones y lincamientos promulgados en\nla Estrategia de Sevilla y\nel Marco Estatutario de la\n Red Mundial de Reservas de Biosfera adoptados por\nla Conferencia General\nde la UNESCO\nen el año 1995; así como los objetivos incluidos en el Plan de Acción de Madrid\ndel año 2008. Por tanto,\n\nDecretan:\n\nCREAR\nLA COMISIÓN TÉCNICA PARA LA GESTIÓN DE LA\n\nRESERVA DE BIOSFERA AGUA Y PAZ DE COSTA RICA\n\n \n\nCAPÍTULO\nI\n\nDefiniciones\n\n \n\nArtículo 1°: En el presente Decreto se emplearán las\nsiguientes abreviaturas con su respectivo significado:\n\nComisión Técnica: Comisión Técnica\npara la Gestión\nde la Reserva\nde Biosfera Agua y Paz de Costa Rica.\n\nÓrgano Consultivo: Órgano\nConsultivo de la Reserva\nde Biosfera Agua y Paz.\n\nComité MAB: Comité\nNacional sobre el Hombre y la\n Biosfera.\n\nPrograma MAB:\nPrograma sobre el Hombre y la\n Biosfera.\n\nMinistro Rector:\nMinistro Rector del Sector Ambiente, Energía y Telecomunicaciones.\n\nMINAET:\nMinisterio de Ambiente, Energía y Telecomunicaciones.\n\nSAET: Sector\nAmbiente, Energía y Telecomunicaciones.\n\nRMRB: Red\nMundial de Reservas de Biosfera.\n\nCAPÍTULO II\n\nDe la constitución y deberes de la Comisión Técnica\npara\n\nla Gestión de la Reserva de Biosfera\nAgua y Paz de Costa Rica\n\n \n\nArtículo 2º-Se crea\n\nla Comisión Técnica para\nla Gestión de\nla Reserva de Biosfera Agua y\nPaz de Costa Rica, que en adelante se denominará\n\nla Comisión Técnica, adscrita al Sector Ambiente,\nEnergía y Telecomunicaciones, bajo\nla Rectoría del Ministro Rector; ente que será\nresponsable de promover el desarrollo sostenible mejorando su capacidad de\ngestión, a través del establecimiento y fortalecimiento de canales de\ncomunicación y coordinación entre instituciones (sectoriales, regionales,\nmunicipales y organizaciones de la población).\n\nArtículo 3º-\n\nLa Comisión Técnica tendrá como función la promoción\ndel desarrollo sostenible, a través del establecimiento y fortalecimiento de\ncanales de comunicación, coordinación y articulación de los esfuerzos que\nrealizan las instituciones públicas, municipalidades, empresas privadas y las\norganizaciones de la población. Lo anterior con el propósito de mejorar la\ngestión de las actividades productivas, de conservación de los recursos\nnaturales y de desarrollo del conocimiento, en el área geográfica de\nla Reserva de Biosfera Agua y\nPaz.\n\nArtículo 4º-\n\nLa Comisión Técnica continuará desarrollando, en su\nárea geográfica, las acciones \"Carbono Neutral\", conforme al acuerdo de\ncompromiso establecido para algunos cantones del territorio de\nla Reserva de Biosfera Agua y\nPaz, en función de lo que plantea\nla Estrategia Nacional\nde Cambio Climático y la propuesta del Gobierno, de convertir a Costa Rica en\nun país \"Carbono Neutral\" al año 2021.\n\nCAPÍTULO III\n\nDe la organización e integración de la Comisión\nTécnica para la\n\nGestión de la Reserva de Biosfera\nAgua y Paz de Costa Rica\n\n \n\nArtículo 5º-\n\nLa Comisión Técnica estará integrada por un grupo\ninterdisciplinario de personas, las cuales serán designadas vía convenio por\nuna o varias de las Instituciones que conforman el Sector Ambiente, Energía y\nTelecomunicaciones, otras instituciones públicas, municipalidades, empresas del\nsector privado u organizaciones de la población.\n\nArticulo 6º-\nLa Comisión Técnica contará con un Director,\nconforme a lo establecido por la\n UNESCO para las Reservas de Biosfera. Será designado por el\nMinistro Rector del Sector Ambiente, Energía y Telecomunicaciones, por un plazo\nde cuatro años y tendrá en términos generales las siguientes funciones:\n\na. Dirigir al personal de\nla Comisión Técnica.\n\nb. Participar en el seno del Comité MAB.\n\nc. Coordinar al Órgano Consultivo.\n\nd. Representar a\nla Comisión Técnica\ny a la Reserva\nde Biosfera Agua y Paz en actividades oficiales y ante autoridades nacionales y\norganismos internacionales, e.  \nGestionar  recursos logísticos y\nhumanos para el logro de los objetivos y metas de\nla Comisión Técnica\ny del Órgano Consultivo.\n\nf.  Mantener informado al superior jerárquico de\nlas acciones y avances de la\n Reserva de Biosfera Agua y Paz, así como de su divulgación a\nlos diferentes actores que interactúan en su territorio\n\nArticulo 7º-El Director de\n\nla Comisión Técnica dependerá del Ministro Rector\ndel Sector, quien podrá delegar esa función en el Viceministro de Ambiente del\nMINAET.\n\nArticulo 8º-\nLa Comisión Técnica conformará un Órgano Consultivo,\ncon la finalidad de dar respuesta a las responsabilidades que se derivan de los\nprincipios de conservación, desarrollo y conocimiento establecidos por\nla UNESCO.\n\nCAPÍTULO IV\n\nDe las funciones de la Comisión Técnica para la\nGestión\n\nde la Reserva de Biosfera Agua y Paz\nde Costa Rica\n\nArtículo 9º-De sus funciones.\n\na. Impulsar las políticas para la implementación\nde estrategias, planes, programas y proyectos en\nla Reserva de Biosfera Agua y\nPaz, en correspondencia con las políticas nacionales y los lincamientos\nemitidos por la UNESCO\nen esta materia.\n\nb. Coordinar con el Comité MAB de Costa Rica todo\nlo referente a las acciones y acuerdos que ambas instancias impulsen en pro del\ndesarrollo de la Reserva\nde Biosfera Agua y Paz.\n\nc. Formular a través de procesos de planificación\nparticipativa, el Plan de Acción para el Desarrollo Sostenible de\nla Reserva de Biosfera Agua y\nPaz, el cual será ejecutado por los distintos sectores públicos y privados\ninvolucrados.\n\nd. Elaborar el Plan de Trabajo y el Presupuesto\nAnual de la Reserva\nde Biosfera Agua y Paz, los cuales deberán ser aprobados por el Ministro Rector\no su representante.\n\ne. Gestionar recursos financieros ante\ninstituciones públicas, organismos de cooperación internacional o empresas\nprivadas, según corresponda para la puesta en marcha del Plan de Acción para el\nDesarrollo Sostenible de la\n Reserva de Biosfera Agua y Paz.\n\nf.  Coordinar y promover la formulación,\nnegociación e implementación de proyectos orientados al desarrollo del\nconocimiento, la productividad sostenible y la conservación de\nla Reserva de Biosfera Agua y\nPaz.\n\ng. Realizar el seguimiento y la evaluación de la\nejecución de programas y proyectos que se impulsan a través del Plan de Acción\npara el Desarrollo Sostenible de la\n Reserva de Biosfera Agua y Paz.\n\nh. Velar por el cumplimiento de los compromisos\nPaís en el tema de reserva de biosfera.\n\ni.  Participar en iniciativas de desarrollo sostenible\nque solicite el MINAET, en el marco de gestión del territorio de\nla Reserva de Biosfera Agua y\nPaz.\n\nj.  Apoyar y facilitar, cuando se considere\npertinente, a entidades que realicen iniciativas de desarrollo sostenible en el\nmarco de gestión del territorio de\nla Reserva de Biosfera Agua y Paz.\n\nk. Convocar, coordinar y dar seguimiento al Órgano\nConsultivo y otros órganos constituidos por\nla Comisión Técnica.\n\n1. Promover la coordinación Ínter - institucional,\nmunicipal y organizacional, con el propósito de impulsar la formulación y\nejecución de  proyectos que se encuentren\nen el Plan de Acción para el Desarrollo Sostenible de\nla Reserva de Biosfera Agua y\nPaz.\n\nm.Representar\na la Reserva de Biosfera Agua y Paz en actividades oficiales de carácter nacional\ne internacional.\n\nn. Implementar un sistema de monitoreo y\nevaluación de las actividades ejecutadas.\n\nñ. Presentar anualmente al Ministro Rector del\nSector Ambiente, Energía y Telecomunicaciones, un informe de actividades\nejecutadas.\n\nCAPÍTULO V\n\nDe la integración y funciones del Órgano Consultivo\n\nde la Reserva de Biosfera Agua y Paz\n\nArtículo 10.-De su integración.\n\na. El Órgano Consultivo al que se refiere el\nartículo 8° estará conformado por un representante de cada una de los siguientes\nsectores o subsectores, localizados dentro del territorio de\nla Reserva de Biosfera Agua y\nPaz, de la siguiente manera:\n\n- El Director de\nla Comisión Técnica,\nquien lo coordinará.\n\n- Un representante de\nlas municipalidades.\n\n- Un representante de\norganizaciones del sector turismo.\n\n- Un representante de\norganizaciones del sector comunal.\n\n- Un representante de\norganizaciones del subsector\n\nconservacionista.\n\n- Un representante de\norganizaciones del subsector forestal.\n\n- Un representante de\norganizaciones del sector agropecuario.\n\n- Un representante de\norganizaciones del sector energía.\n\n- Un representante de\norganizaciones del subsector agua.\n\n- Un representante de\norganizaciones del sector cultura.\n\n- Un representante de\nentidades del sector académico o científico.\n\nb. De acuerdo a necesidades específicas,\nla Comisión Técnica\ncuando lo considere relevante para el cumplimiento de sus objetivos y metas\npodrá incorporar en el Órgano Consultivo al representante de algún otro sector\no subsector.\n\nc. Con la finalidad de cumplir con lo señalado en\nlos puntos a y b de este mismo artículo,\nla Comisión Técnica\nmediante invitación escrita convocará a los sectores y subsectores\ncorrespondientes a una reunión general para elegir a cada representante.\n\nd. Cuando así se requiera y en calidad de\nasesoría, la\n Comisión Técnica invitará a los representantes de\ninstituciones públicas a las sesiones del Órgano Consultivo, conforme\ncorresponda según los tres principios establecidos por\nla UNESCO para reservas de\nbiosfera, relacionados con desarrollo, conservación y conocimiento.\n\nArtículo 11.-De sus funciones.\n\na. Coadyuvar con los mecanismos de coordinación\npropuestos por\nla Comisión Técnica, de manera que faciliten el uso\nadecuado del territorio de la misma; acorde con los criterios y principios\nestablecidos por la UNESCO\na través de la Red Mundial\nde Reservas de Biosfera.\n\nb. Participar en la elaboración del Plan de Acción\npara el Desarrollo Sostenible de la\n Reserva de Biosfera Agua y Paz.\n\nc. Conocer y apoyar la implementación del Plan de\nTrabajo Anual de la Reserva\nde Biosfera Agua y Paz.\n\nd. Impulsar y proponer proyectos que potencien las\ncapacidades de las organizaciones, gobiernos locales e instituciones y empresas\nque realizan actividades productivas en armonía con la naturaleza.\n\ne. Apoyar y participar en iniciativas que promuevan\notros entes, dentro del marco de gestión de\nla Reserva de Biosfera Agua y\nPaz siempre y cuando estén orientadas a la conservación del ambiente y\npromuevan el desarrollo humano sostenible.\n\nf.  Emprender acciones, en coordinación con\ndiferentes actores, que permitan una mejor aplicación de las técnicas\nagro-conservacionistas para la protección del recurso hídrico en el territorio\nde la Reserva\nde Biosfera Agua y Paz.\n\ng. Promover y participar en procesos de\ncapacitación y actividades relacionadas con la gestión de reservas de biosfera.\n\nh.   "body_en_text": "throughout the text\n\n                    -\n\n                        Complete Text of Regulation 35993\n\n                        Creates the Technical Commission for the Management of the Agua y Paz Biosphere Reserve\nof Costa Rica\n\nComplete Text of act: CFD93\n\nN° 35993-MINAET\n\nTHE PRESIDENT OF\nTHE REPUBLIC\n\nAND THE MINISTER OF\nENVIRONMENT, ENERGY\n\nAND TELECOMMUNICATIONS\n\nIn exercise of the powers conferred upon us by\nsubsections 3) and 18) of Article 140 and Article 146 of the Political Constitution.\n\nConsidering:\n\n1º—That the Man and\nthe Biosphere Programme (MAB), was\ncreated in 1970, as a long-term interdisciplinary programme of the\nUnited Nations Educational,\nScientific and\nCultural Organization (UNESCO).\n\n2º—That the Man and the Biosphere Programme\n(MAB) focuses on research, training, monitoring, and\neducation activities, aimed at seeking compensation and balance through\nhuman responsibility; that guarantees the conservation of biodiversity and\nthe rational use of natural resources for the improvement of social\nand economic well-being of populations.\n\n3º—That to this\nend, it has had, for several years,\nthe World Network of\nBiosphere Reserves which it uses as a vehicle to share knowledge,\npromote research, education and training; and foster participatory\ndecision-making, with the objective of guaranteeing all aspects of\nenvironmental, economic and social sustainability.\n\n4º—That the Man and the Biosphere Programme\n(MAB) through this World Network of Biosphere Reserves, encompasses 531\nsites in more than 105 countries, with diverse types of ecosystems ranging from\nmountainous to marine, as well as rural and urban landscapes.\n\n5º—That the concept of\nBiosphere Reserves was first developed in 1974 and was\nrevised in 1995 when\nthe General Conference of\nUNESCO adopted the Statutory\nFramework and the Seville\nStrategy for Biosphere Reserves.\n\n6º—That Biosphere\nReserves provide opportunities adapted to the context of different\ncountries, which allow combining scientific knowledge with modalities of\ngovernance, in order to reduce biodiversity loss, improve the quality of\nlife of people, and enhance the social, economic and cultural conditions\nnecessary for a sustainable environment.\n\n7º—That Biosphere\nReserves can also serve as demonstration and learning sites with\nrespect to education for sustainable development, within the United\nNations framework.\n\n8º—That Biosphere\nReserves must be given a protagonist role, by virtue of the aforementioned aspects\nand the intersectoral and inter-institutional/organizational role that they\nplay. The foregoing in favor of the application of the principles established\nby UNESCO,\nrelated to development, conservation, and knowledge; all of them\nclosely linked with climate change mitigation and adaptation actions.\n\n9º—That\nthe Agua y\nPaz Biosphere Reserve, designated by UNESCO\nat the end of 2007, (which fully comprises the cantons of Guatuso,\nLos Chiles, San Carlos, Alfaro Ruiz, parts of the cantons of Upala, Tilarán and\nSarapiquí, as well as the entirety of the Monteverde District of the Canton of\nPuntarenas) has been declared a carbon neutral prototype, within the framework of\nthe National Climate Change Strategy of Costa Rica.\n\n10.—That\nthe Agua y\nPaz Biosphere Reserve was selected through an Agreement between\nthe UNESCO Chair\non Natural and Mixed Heritage Sites and\nthe Agua y Paz Biosphere Reserve, as the venue where\nthis Chair will be taught; in the context of a pilot project in which\nwill also participate,\nthe UNESCO Chair on Sustainable Development and\nEnvironmental Education of the Basque Country and\nthe Urdaibai Biosphere Reserve in Spain, as well\nas the\n UNESCO South/South Chair, Cooperation for Sustainable Development and the\nfuture Marajó Biosphere Reserve in Brazil.\n\n11.—That within\nthis context, it is necessary to coordinate and manage in\nthe Agua y\nPaz Biosphere Reserve, the productive activities, conservation of natural resources, and\nknowledge, in a way that facilitates an articulation of the efforts carried\nout by public institutions, municipalities, private companies\nand population organizations; the foregoing with the fundamental objective of\npromoting sustainable development in accordance with the commitment assumed with\nUNESCO.\n\n12.—That to\nimplement and strengthen the model of\nthe Agua y Paz Biosphere Reserve, it requires\n(according to guidelines established by\nUNESCO), an effective operational platform,\nwhich is participatory, functional and permanent, capable of bringing together\nall relevant sectors and actors present in the geographical area of\nthe Reserve.\n\n13º—That the bodies\nthat are constituted for the management of\nthe Agua y Paz Biosphere Reserve will consider for\ntheir actions, the recommendations and guidelines promulgated in\nthe Seville Strategy and\nthe Statutory Framework of the\n World Network of Biosphere Reserves adopted by\nthe General Conference\nof UNESCO\nin 1995; as well as the objectives included in the Madrid Action Plan\nof 2008. Therefore,\n\nDecree:\n\nCREATE\nTHE TECHNICAL COMMISSION FOR THE MANAGEMENT OF THE\n\nAGUA Y PAZ BIOSPHERE RESERVE OF COSTA RICA\n\n \n\nCHAPTER\nI\n\nDefinitions\n\n \n\nArticle 1: In this Decree, the following\nabbreviations shall be used with their respective meaning:\n\nTechnical Commission: Technical Commission\nfor the Management\nof the Agua y Paz Biosphere Reserve of Costa Rica.\n\nConsultative Body: Consultative\nBody of the Agua y Paz Biosphere Reserve.\n\nMAB Committee: National\nCommittee on Man and the\n Biosphere.\n\nMAB Programme:\nProgramme on Man and the\n Biosphere.\n\nRector Minister:\nRector Minister of the Environment, Energy and Telecommunications Sector.\n\nMINAET:\nMinistry of Environment, Energy and Telecommunications.\n\nSAET: Environment,\nEnergy and Telecommunications Sector.\n\nRMRB: World\nNetwork of Biosphere Reserves.\n\nCHAPTER II\n\nOn the constitution and duties of the Technical Commission\nfor\n\nthe Management of the Agua y Paz Biosphere Reserve\nof Costa Rica\n\n \n\nArticle 2—The Technical Commission for\nthe Management of\nthe Agua y\nPaz Biosphere Reserve of Costa Rica is hereby created, hereinafter referred to as\n\nthe Technical Commission, attached to the Environment,\nEnergy and Telecommunications Sector, under\nthe Rectorship of the Rector Minister; an entity that shall be\nresponsible for promoting sustainable development by improving its management\ncapacity, through the establishment and strengthening of\ncommunication and coordination channels between institutions (sectoral, regional,\nmunicipal and population organizations).\n\nArticle 3—\n\nThe Technical Commission shall have the function of promoting\nsustainable development, through the establishment and strengthening of\ncommunication, coordination, and articulation channels of the efforts carried\nout by public institutions, municipalities, private companies and\npopulation organizations. The foregoing with the purpose of improving the\nmanagement of productive activities, conservation of natural\nresources, and knowledge development, in the geographical area of\nthe Agua y\nPaz Biosphere Reserve.\n\nArticle 4—\n\nThe Technical Commission shall continue developing, in its\ngeographical area, the \"Carbon Neutral\" actions, in accordance with the commitment\nagreement established for some cantons of the territory of\nthe Agua y\nPaz Biosphere Reserve, based on what is proposed by\nthe National Climate Change Strategy and the Government's proposal, to make Costa Rica\na \"Carbon Neutral\" country by the year 2021.\n\nCHAPTER III\n\nOn the organization and integration of the Technical\nCommission for the\n\nManagement of the Agua y Paz Biosphere Reserve\nof Costa Rica\n\n \n\nArticle 5—\n\nThe Technical Commission shall be composed of an interdisciplinary\ngroup of persons, who shall be designated via agreement by\none or several of the Institutions that make up the Environment, Energy and\nTelecommunications Sector, other public institutions, municipalities, private\nsector companies or population organizations.\n\nArticle 6—\nThe Technical Commission shall have a Director,\nin accordance with the provisions established by\n UNESCO for Biosphere Reserves. He/she shall be designated by the\nRector Minister of the Environment, Energy and Telecommunications Sector, for a term\nof four years and shall have, in general terms, the following functions:\n\na. Direct the staff of\nthe Technical Commission.\n\nb. Participate within the MAB Committee.\n\nc. Coordinate the Consultative Body.\n\nd. Represent\nthe Technical Commission\nand the Agua y Paz Biosphere Reserve in official activities and before national authorities and\ninternational bodies, e.  \nManage logistical and\nhuman resources for the achievement of the objectives and goals of\nthe Technical Commission\nand the Consultative Body.\n\nf.  Keep the hierarchical superior informed of\nthe actions and progress of the\n Agua y Paz Biosphere Reserve, as well as their dissemination to\nthe different actors that interact in its territory.\n\nArticle 7—The Director of\n\nthe Technical Commission shall report to the Rector Minister\nof the Sector, who may delegate that function to the Vice Minister of the Environment of\nMINAET.\n\nArticle 8—\nThe Technical Commission shall form a Consultative Body,\nwith the purpose of responding to the responsibilities derived from the\nprinciples of conservation, development and knowledge established by\nUNESCO.\n\nCHAPTER IV\n\nOn the functions of the Technical Commission for the Management\n\nof the Agua y Paz Biosphere Reserve\nof Costa Rica\n\nArticle 9—On its functions.\n\na. Promote policies for the implementation\nof strategies, plans, programs and projects in\nthe Agua y\nPaz Biosphere Reserve, in correspondence with national policies and the guidelines\nissued by UNESCO\nin this area.\n\nb. Coordinate with the MAB Committee of Costa Rica everything\nrelated to the actions and agreements that both bodies promote in favor of\nthe development of the Agua y Paz Biosphere Reserve.\n\nc. Formulate, through participatory planning\nprocesses, the Action Plan for the Sustainable Development of\nthe Agua y\nPaz Biosphere Reserve, which shall be executed by the different public and private sectors\ninvolved.\n\nd. Prepare the Work Plan and the Annual Budget of the Agua y Paz Biosphere Reserve, which must be approved by the Rector Minister\nor his/her representative.\n\ne. Manage financial resources from\npublic institutions, international cooperation agencies or\nprivate companies, as appropriate, for the implementation of the Action Plan for the\nSustainable Development of the\n Agua y Paz Biosphere Reserve.\n\nf.  Coordinate and promote the formulation,\nnegotiation and implementation of projects aimed at the development of\nknowledge, sustainable productivity and conservation of\nthe Agua y\nPaz Biosphere Reserve.\n\ng. Monitor and evaluate the\nexecution of programs and projects that are promoted through the Action Plan\nfor the Sustainable Development of the\n Agua y Paz Biosphere Reserve.\n\nh. Ensure compliance with the Country's commitments\nin the area of biosphere reserves.\n\ni.  Participate in sustainable development initiatives\nrequested by MINAET, within the framework of territorial management of\nthe Agua y\nPaz Biosphere Reserve.\n\nj.  Support and facilitate, when deemed\npertinent, entities that carry out sustainable development initiatives within the\nframework of territorial management of\nthe Agua y Paz Biosphere Reserve.\n\nk. Convene, coordinate and follow up on the Consultative\nBody and other bodies constituted by\nthe Technical Commission.\n\n1. Promote inter-institutional,\nmunicipal and organizational coordination, with the purpose of promoting the\nformulation and execution of projects that are contained\nin the Action Plan for the Sustainable Development of\nthe Agua y\nPaz Biosphere Reserve.\n\nm. Represent\nthe Agua y Paz Biosphere Reserve in official activities of a national\nand international nature.\n\nn. Implement a monitoring and\nevaluation system for the activities executed.\n\nñ. Submit annually to the Rector Minister of the\nEnvironment, Energy and Telecommunications Sector, a report on the activities\nexecuted.\n\nCHAPTER V\n\nOn the integration and functions of the Consultative Body\n\nof the Agua y Paz Biosphere Reserve\n\nArticle 10.—On its integration.\n\na. The Consultative Body referred to in\nArticle 8 shall be composed of one representative from each of the following\nsectors or subsectors, located within the territory of\nthe Agua y\nPaz Biosphere Reserve, in the following manner:\n\n- The Director of\nthe Technical Commission,\nwho shall coordinate it.\n\n- A representative of\nthe municipalities.\n\n- A representative of\norganizations from the tourism sector.\n\n- A representative of\norganizations from the communal sector.\n\n- A representative of\norganizations from the conservationist\n\nsubsector.\n\n- A representative of\norganizations from the forestry subsector.\n\n- A representative of\norganizations from the agricultural and livestock sector.\n\n- A representative of\norganizations from the energy sector.\n\n- A representative of\norganizations from the water subsector.\n\n- A representative of\norganizations from the culture sector.\n\n- A representative of\nentities from the academic or scientific sector.\n\nb. According to specific needs,\nthe Technical Commission,\nwhen it considers it relevant for the fulfillment of its objectives and goals,\nmay incorporate into the Consultative Body the representative of some other sector\nor subsector.\n\nc. In order to comply with the provisions of\npoints a and b of this same article,\nthe Technical Commission,\nthrough written invitation, shall convene the corresponding\nsectors and subsectors to a general meeting to elect each representative.\n\nd. When required and in an advisory\ncapacity, the\n Technical Commission shall invite representatives of\npublic institutions to the sessions of the Consultative Body, as\nappropriate according to the three principles established by\nUNESCO for biosphere\nreserves, related to development, conservation and knowledge.\n\nArticle 11.—On its functions.\n\na. Contribute to the coordination mechanisms\nproposed by\nthe Technical Commission, in a way that facilitates the appropriate\nuse of its territory; in accordance with the criteria and principles\nestablished by UNESCO\nthrough the World Network\nof Biosphere Reserves.\n\nb. Participate in the preparation of the Action Plan\nfor the Sustainable Development of the\n Agua y Paz Biosphere Reserve.\n\nc. Be informed of and support the implementation of the\nAnnual Work Plan of the Agua y Paz Biosphere Reserve.\n\nd. Promote and propose projects that enhance the\ncapacities of organizations, local governments, and institutions and companies\nthat carry out productive activities in harmony with nature.\n\ne. Support and participate in initiatives promoted by\nother entities, within the management framework of\nthe Agua y\nPaz Biosphere Reserve, as long as they are oriented towards environmental conservation and\npromote sustainable human development.\n\nf.  Undertake actions, in coordination with\ndifferent actors, that allow for a better application of\nagro-conservationist techniques for the protection of water resources in the territory\nof the Agua y Paz Biosphere Reserve.\n\ng. Promote and participate in training\nprocesses and activities related to the management of biosphere reserves.\n\nh. Support the exchange of experiences and\nknowledge of sustainable production systems, carried out by\ndifferent organizations present in\nthe Agua y Paz Biosphere Reserve of Costa Rica.\n\nCHAPTER VI\n\nOn the budget\n\nArticle 12.—To support and guarantee the management of\nthe Technical Commission, the Ministry of Environment,\nEnergy and Telecommunications shall take the corresponding financial\nprovisions.\n\nArticle 13.—The\nInstitutions that make up the SAET, may, according to their budgetary\npossibilities, financially support\n\nthe Technical Commission in the fulfillment of its purposes.\n\nArticle 14.—This Decree applies as of its publication in\nthe Official Newspaper La Gaceta.\n\nGiven at\nthe Presidency of\nthe Republic.—San\nJosé, at nine o'clock on the twenty-sixth of February of the year two thousand ten.\n\nCHAPTER VII\n\nTransitory Provisions\n\nTransitory Provision I.—Within a period of six months from\nthe publication of this executive decree, the Rector Minister of SAET\nmust prepare a Regulation that will govern everything related to the organization\nand functioning of the Agua y Paz Biosphere Reserve of Costa Rica.\n\nTransitory Provision II.—The\ninter-institutional agreements and letters signed by the Rector Minister of\nSAET for the creation and support of the office of the Action Plan for the\nSustainable Development of\nthe Huetar Norte Region (PADES), shall remain\nin force for the purposes of this decree.\n\nTransitory Provision III.—For\nthe purposes of organizing and coordinating the functioning of the Biosphere Reserves in\nCosta Rica, within the scope of the provisions made by\nUNESCO, the Rector Minister\nof SAET shall regulate, through\nthe Planning Directorate of MINAET within\nits sectoral competence, within a period of no more than 90 calendar days from\nthe date of publication of this executive decree, matters related to the National\nCommittee of the Man and the\n Biosphere Programme (MAB).\n\nTransitory\nProvision IV.—While the provisions of Transitory Provision III are being regulated, the\nrepresentatives of MINAET on the MAB Committee of Costa Rica shall be the Directors\nof the Biosphere Reserves: Agua y Paz,\nLa Amistad and Cordillera Volcánica Central."
