  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 35898\n\n                        Modifica para la Comisión Nacional para la Gestión de la Biodiversidad\n(CONAGEBIO), el gasto presupuestario máximo fijado para el año 2010\n\nTexto Completo acta: CFF88\n\nN° 35898-H\n\nEL PRESIDENTE DE LA\nREPÚBLICA\n\nY\nLA MINISTRA DE HACIENDA\n\nCon fundamento en las atribuciones que les confieren\nlos artículos 140 incisos 3) y 18) y 146 de la Constitución Política; los\nartículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley Nº\n6227, Ley General de la Administración Pública de 2 de mayo de 1978 y sus\nreformas; la Ley Nº 8131, Ley de la Administración Financiera de la República y\nPresupuestos Públicos de 18 de setiembre de 2001 y sus reformas; su Reglamento,\nel Decreto Ejecutivo Nº 32988-H-MP-PLAN de 31 de enero de 2006 y sus reformas;\nla Ley Nº 7788, Ley de Biodiversidad de 30 de abril de 1998 y sus reformas; el\nDecreto Ejecutivo Nº 32452-H de 29 de junio de 2005 y sus reformas y el Decreto\nEjecutivo Nº 35111-H de 4 de marzo de 2009 y sus reformas.\n\nConsiderando:\n\nI.-Que mediante\nla Ley Nº 7788, publicada en\nLa Gaceta Nº 101 de\n27 de mayo de 1998 y sus reformas; se creó\nla Comisión Nacional\npara la Gestión\nde la Biodiversidad\n(CONAGEBIO), como un órgano desconcentrado del Ministerio del Ambiente y\nEnergía con personería jurídica instrumental, y funciones referentes a la\nconservación, el uso ecológicamente sostenible y la restauración de la\nbiodiversidad.\n\nII.-Que mediante\noficios OT-09 de 16 de noviembre de 2009, y OT-432-09 de 1 de diciembre de\n2009, la\n Comisión Nacional para\nla Gestión de\nla Biodiversidad,\nsolicita ampliar el gasto máximo presupuestario asignado para el año 2010, por\nun monto de ¢21.700.000,00 (veintiún millones setecientos mil colones sin\ncéntimos), con el objetivo de financiar gastos necesarios para continuar con la\noperativa institucional, permitiéndole a CONAGEBIO continuar con la\npromulgación de políticas nacionales referentes a la conservación, el uso\necológicamente sostenible, la restauración de la biodiversidad, ecosistemas y\nespecies, así como la emisión de permisos y control en acceso a los recursos\ngenéticos y bioquímicas y uso de la biodiversidad.\n\nIII.-Que con recursos\nprovenientes del superávit específico, según lo dispone el artículo 20 de\nla Ley de Biodiversidad, se\nfinanciarán los gastos operativos de la institución, que permitan cumplir con\nlas acciones indicadas en el considerando anterior.\n\nIV.-Que mediante el\nDecreto Ejecutivo Nº 32452-H, publicado en\nLa Gaceta Nº 130 de 6\nde julio de 2005 y sus reformas, se emite el \"Lineamiento para la aplicación\ndel artículo 6º de la Ley Nº\n8131 de la\n Administración Financiera de\nla República y\nPresupuestos Públicos y la regulación de la clase de ingresos del Sector\nPúblico denominada Financiamiento\".\n\nV.-Que en relación\ncon el superávit específico, el numeral 9º del referido Decreto Ejecutivo Nº\n32452-H, posibilita la utilización de éste, para el pago de gastos definidos en\nlos fines establecidos en las disposiciones especiales o legales aplicables a\ntales recursos.\n\nVI.-Que mediante el\nDecreto Ejecutivo Nº 35111-H, publicado en\nLa Gaceta Nº 58 de 24\nde marzo de 2009 y sus reformas, se emitieron las Directrices Generales de\nPolítica Presupuestaria para el 2010, estableciéndose en el artículo 1° del\ncitado decreto, el gasto presupuestario máximo del año 2010, para las\ninstituciones cubiertas por el ámbito de\nla Autoridad Presupuestaria.\n\nVII.-Que con el\noficio STAP-0622-09 de 27 de abril de 2009, se le comunicó a\nla Comisión Nacional\npara la Gestión\nde la Biodiversidad\n(CONAGEBIO) el gasto presupuestario máximo autorizado para el año 2010, por un\nmonto de ¢169.590.000,00 (ciento sesenta y nueve millones quinientos noventa\nmil colones sin céntimos).\n\nVIII.-Que con el\noficio DM-2220-2009 de 4 de diciembre de 2009, el Ministro de Ambiente, Energía\ny Comunicaciones, avala la solicitud planteada por\nla Comisión Nacional\npara la Gestión\nde la Biodiversidad\n(CONAGEBIO).\n\nIX.-Que por lo\nanterior, resulta necesario aumentar el gasto presupuestario máximo fijado para\nla Comisión\n Nacional para\nla Gestión de\nla Biodiversidad\n(CONAGEBIO), incrementándolo en la suma de ¢21.700.000,00 (veintiún millones\nsetecientos mil colones sin céntimos).   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 35898\n\n                        Modifies for the National Commission for Biodiversity Management\n(CONAGEBIO), the maximum budgetary expenditure set for the year 2010\n\nComplete Text of act: CFF88\n\nN° 35898-H\n\nTHE PRESIDENT OF THE\nREPUBLIC\n\nAND\nTHE MINISTER OF FINANCE\n\nBased on the powers conferred upon them by\narticles 140 subsections 3) and 18) and 146 of the Political Constitution; articles 25 subsection 1), 27 subsection 1), and 28 subsection 2) paragraph b) of Law Nº 6227, General Public Administration Law of May 2, 1978, and its amendments; Law Nº 8131, Law of the Financial Administration of the Republic and Public Budgets of September 18, 2001, and its amendments; its Regulations, Decreto Ejecutivo Nº 32988-H-MP-PLAN of January 31, 2006, and its amendments; Law Nº 7788, Biodiversity Law of April 30, 1998, and its amendments; Decreto Ejecutivo Nº 32452-H of June 29, 2005, and its amendments; and Decreto Ejecutivo Nº 35111-H of March 4, 2009, and its amendments.\n\nConsidering:\n\nI.—That through Law Nº 7788, published in La Gaceta Nº 101 of May 27, 1998, and its amendments, the National Commission for Biodiversity Management (Comisión Nacional para la Gestión de la Biodiversidad, CONAGEBIO) was created as a deconcentrated body of the Ministry of Environment and Energy with instrumental legal personality and functions related to the conservation, ecologically sustainable use, and restoration of biodiversity.\n\nII.—That through official letters OT-09 of November 16, 2009, and OT-432-09 of December 1, 2009, the National Commission for Biodiversity Management (CONAGEBIO) requests an increase in the maximum budgetary expenditure assigned for the year 2010, in the amount of ¢21,700,000.00 (twenty-one million seven hundred thousand colones without céntimos), with the objective of financing necessary expenses to continue institutional operations, enabling CONAGEBIO to continue with the promulgation of national policies regarding the conservation, ecologically sustainable use, and restoration of biodiversity, ecosystems, and species, as well as the issuance of permits and control over access to genetic and biochemical resources and use of biodiversity.\n\nIII.—That with resources from the specific surplus, as provided in article 20 of the Biodiversity Law, the operating expenses of the institution will be financed, allowing the actions indicated in the preceding recital (considerando) to be fulfilled.\n\nIV.—That through Decreto Ejecutivo Nº 32452-H, published in La Gaceta Nº 130 of July 6, 2005, and its amendments, the \"Guideline for the application of article 6 of Law Nº 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the Public Sector revenue class called Financing\" is issued.\n\nV.—That in relation to the specific surplus, numeral 9 of the referenced Decreto Ejecutivo Nº 32452-H enables its use for the payment of expenses defined in the purposes established in the special or legal provisions applicable to such resources.\n\nVI.—That through Decreto Ejecutivo Nº 35111-H, published in La Gaceta Nº 58 of March 24, 2009, and its amendments, the General Budgetary Policy Guidelines for 2010 were issued, establishing in article 1 of the cited decree the maximum budgetary expenditure for the year 2010 for the institutions covered by the scope of the Budgetary Authority.\n\nVII.—That with official letter STAP-0622-09 of April 27, 2009, the National Commission for Biodiversity Management (CONAGEBIO) was notified of the maximum budgetary expenditure authorized for the year 2010, in the amount of ¢169,590,000.00 (one hundred sixty-nine million five hundred ninety thousand colones without céntimos).\n\nVIII.—That with official letter DM-2220-2009 of December 4, 2009, the Minister of Environment, Energy, and Communications endorses the request filed by the National Commission for Biodiversity Management (CONAGEBIO).\n\nIX.—That based on the foregoing, it is necessary to increase the maximum budgetary expenditure set for the National Commission for Biodiversity Management (CONAGEBIO), increasing it by the sum of ¢21,700,000.00 (twenty-one million seven hundred thousand colones without céntimos).
