la Ley\nGeneral de la Administración Pública, Nº 6227 del 2 de mayo de 1978; la Ley de\nFomento a la Producción Agropecuaria, que incorpora la Ley Orgánica del\nMinisterio de Agricultura y Ganadería, Nº 7064 del 29 de abril de 1987; la Ley\nGeneral del Servicio Nacional de Salud Animal, Nº 8495 del 6 de abril 2006; la\nLey de Control de Ganado Bovino, prevención y sanción de su robo, hurto y\nreceptación, Nº 8799 del 17 de abril del 2010; la Ley de Presupuesto\nExtraordinario, Nº 7138 del 16 de noviembre de 1989, artículo 46, inciso 22,\nque autoriza la apertura de Cuentas Especiales para recursos provenientes de\nventa de servicios de Mercadeo, Salud y Producción Pecuaria e Investigación\nAgrícola; el Acuerdo de Medidas Sanitarias y Fitosanitarias aprobado mediante\nLey de Ejecución de los Acuerdos de la Ronda Uruguay de Negociaciones\nComerciales Multilaterales, Nº 7473 del 20 de diciembre del 1994; Ley de la\nPromoción de la Competencia y Defensa Efectiva al Consumidor, Nº 7472 del 20 de\ndiciembre de 1994.\n\nConsiderando:\n\n1º-Que es función esencial del Estado proteger la\nsalud de las personas, sistemas de producción primarios, los animales y el\nmedio ambiente, así como garantizar la protección de los cultivos de las plagas\ny enfermedades que puedan poner en riesgo o causar daños a la producción\nagropecuaria.\n\n2º-Que para la\neconomía nacional y la seguridad alimentaria, la protección sanitaria de los\nproductos de origen animal resulta fundamental, en especial en aquellos que son\nesenciales en la dieta de los costarricenses, lo que obliga al Estado a adoptar\ntodas las medidas de prevención, vigilancia y control necesarias para evitar el\ningreso y diseminación de plagas y enfermedades que pongan en peligro o puedan\ncausar daño a las personas o al patrimonio pecuario nacional.\n\n3º-Que igualmente es\nuna función esencial del Estado, establecer los mecanismos y controles\nnecesarios para garantizar la inocuidad de los alimentos de consumo humano y\nanimal, protegiéndose con ello\nla Salud Pública.\n\n4º-Que mediante Ley Nº\n8495 del 6 de abril del 2006, se creó el Servicio Nacional de Salud Animal,\n(SENASA), como un órgano de desconcentración y personería jurídica instrumental\ndel Ministerio de Agricultura y Ganadería, derogándose\nla Ley Nº 6343 del 2 de mayo de\n1978, Ley sobre Salud Animal y sustituyendo por ello para todo efecto legal a\nla Dirección de Salud\nAnimal del Ministerio de Agricultura y Ganadería.\n\n5º-Que a través del\nServicio Nacional de Salud Animal (SENASA) se brindan una serie de servicios a\nlos productores y establecimientos agropecuarios y con cuya venta se generan\nlos recursos necesarios para la sostenibilidad del Servicio, permitiéndose con\nello cubrir gastos relativos a salarios y cargas sociales, la reposición y\ncompra de equipos, materiales, reactivos y otros insumos necesarios para la\nbuena marcha y la atención oportuna de los requerimientos que se le formulan al\nSENASA.\n\n6º-Que conforme al mandato establecido en el artículo 8 bis del Decreto Nº 27763-MAG del 10 de marzo\nde 1999 y sus reformas, se establece que los montos de las tarifas por los servicios estipulados en\nese Decreto están sujetas a un incremento anual que rige a partir del 1º de febrero de cada año, que\nse calculará automáticamente con base en el valor del índice de precios al consumidor del año\nanterior.\n\n7º-Que mediante Decreto Nº 35604-MAG del 28 de octubre del 2009, publicado en La  Gaceta Nº 236 del\n4 de diciembre del 2009, se modificaron los artículos 3, 4 y se insertó un artículo 4 bis al Decreto\nNº 27763-MAG del 10 de marzo de 1999, publicado en el Alcance Nº 26 de La Gaceta  Nº 68 del 9 de\nabril de 1999 y sus reformas a los efectos de introducir algunas nuevas tarifas que se derivan\ndirectamente de la Ley Nº 8495 antes citada y publicitar el precio actual de las tarifas que cobra\neste Servicio.\n\n8º-Que es obligación\nde los diferentes actores estatales vinculados a los sectores de importación y\nexportación de bienes, facilitar los procesos mediante los cuales dichos bienes\nson internalizados o exportados y con ello evitar que se produzcan atrasos o se\nencarezcan por dichos procesos los bienes antes indicados.\n\n9º-Que el Servicio\nNacional de Salud Animal y\nla Dirección General de Aduanas han establecido\nmecanismos de coordinación a efectos de facilitar a los administrados el\ncumplimiento de sus obligaciones de carácter sanitario en relación a los\nprocesos de importación y exportación de bienes, protegiéndose adecuadamente la\nsalud pública en general y permitiendo igualmente que dichos bienes circulen\nrápidamente cumpliéndose con las obligaciones aduaneras establecidas para esos\nbienes y evitando igualmente con ello que las instalaciones aduanales del país\nse saturen con mercancías que no han cumplido o están en proceso de cumplir con\ntrámites sanitarios a cargo de este Servicio y para lo cual el instrumento DUA\nresulta un aliado estratégico en ese propósito.\n\n10.-Que se han\ngenerado cambios en el entorno jurídico del Servicio Nacional de Salud Animal\n(SENASA) con ocasión de la promulgación de\nla Ley Nº 8799 del 16 de abril del 2010, Ley de Control\nde Ganado Bovino, prevención y sanción de su robo, hurto y receptación y para\ncuya implementación es necesario establecer tarifas a servicios ordenados por\nla misma. the Law for the\nPromotion of Competition and Effective Consumer Defense, No. 7472 of December 20,\n1994.\n\nConsidering:\n\n1º-That it is an essential function of the State to protect the\nhealth of people, primary production systems, animals and the\nenvironment, as well as to guarantee the protection of crops from pests\nand diseases that may put at risk or cause damage to agricultural\nproduction.\n\n2º-That for the\nnational economy and food security, the sanitary protection of\nproducts of animal origin is fundamental, especially for those that are\nessential in the diet of Costa Ricans, which obliges the State to adopt\nall necessary prevention, surveillance and control measures to avoid the\nentry and dissemination of pests and diseases that endanger or\nmay cause harm to people or to the national livestock patrimony.\n\n3º-That it is also\nan essential function of the State to establish the necessary mechanisms and\ncontrols to guarantee the safety (inocuidad) of food for human and\nanimal consumption, thereby protecting\nPublic Health.\n\n4º-That by Law No.\n8495 of April 6, 2006, the National Animal Health Service\n(SENASA) was created, as a deconcentrated body with instrumental legal personality\nof the Ministry of Agriculture and Livestock, repealing\nLaw No. 6343 of May 2,\n1978, the Animal Health Law, and substituting for all legal purposes\nthe Directorate of Animal\nHealth of the Ministry of Agriculture and Livestock.\n\n5º-That through the\nNational Animal Health Service (SENASA), a series of services are provided to\nagricultural and livestock producers and establishments, and with their sale the\nnecessary resources are generated for the sustainability of the Service, thereby making it possible\nto cover expenses relative to salaries and social charges, the replacement and\npurchase of equipment, materials, reagents and other supplies necessary for the\nsmooth operation and timely attention of the requirements made to\nSENASA.\n\n6º-That pursuant to the mandate established in article 8 bis of Decree No. 27763-MAG of March 10,\n1999 and its amendments, it is established that the amounts of the tariffs for the services stipulated in\nthat Decree are subject to an annual increase that takes effect as of February 1st of each year, which\nwill be calculated automatically based on the value of the consumer price index of the previous\nyear.\n\n7º-That by Decree No. 35604-MAG of October 28, 2009, published in La Gaceta No. 236 of\nDecember 4, 2009, articles 3 and 4 were modified and an article 4 bis was inserted into Decree\nNo. 27763-MAG of March 10, 1999, published in Supplement No. 26 to La Gaceta No. 68 of April\n9, 1999 and its amendments, for the purpose of introducing some new tariffs that derive\ndirectly from the aforementioned Law No. 8495 and publicizing the current price of the tariffs that\nthis Service charges.\n\n8º-That it is the obligation\nof the different state actors linked to the sectors of import and\nexport of goods, to facilitate the processes through which said goods\nare internalized or exported and thereby prevent delays or the\nincrease in cost of said goods due to these processes.\n\n9º-That the National\nAnimal Health Service and\nthe General Directorate of Customs have established\ncoordination mechanisms in order to facilitate for the administered parties the\nfulfillment of their sanitary obligations regarding the\nprocesses of import and export of goods, adequately protecting\npublic health in general and also allowing said goods to circulate\nquickly while complying with the customs obligations established for those\ngoods and likewise thereby preventing the country's customs facilities\nfrom becoming saturated with merchandise that has not complied or is in the process of complying with\nsanitary procedures under the charge of this Service, and for which the DUA\ninstrument is a strategic ally in that purpose.\n\n10.-That changes\nhave been generated in the legal environment of the National Animal Health Service\n(SENASA) on the occasion of the enactment of\nLaw No. 8799 of April 16, 2010, Law for the Control\nof Bovine Cattle, prevention and sanctioning of its robbery, theft and receiving of stolen goods, and for\nwhose implementation it is necessary to establish tariffs for services ordered by\nthe same law.
