les confieren los\nartículos 140 incisos 3) y 18) y 146 de la Constitución Política; el Convenio sobre\nDiversidad Biológica y Anexos ratificado por Ley Nº 7416 del 30 de junio de\n1994; los artículos 6 y 7 de la Ley Orgánica del Ambiente Nº 7554 del 4 de\noctubre de 1995; los artículos 23, 24, 25, 27, 29 y 30 de la Ley de\nBiodiversidad Nº 7788 del 30 de abril de 1998; el artículo 38 del Reglamento a\nla Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo del\n2008; los artículos 49 y siguientes de la Ley General de Administración Pública\nN° 6227 del 2 de mayo de 1978.\n\nConsiderando:\n\nI.-Que la Ley Orgánica del Ambiente N° 7554 del 4 de\noctubre de 1995, en sus artículos 6 y 7 incorpora a la legislación nacional el\nprincipio de participación ciudadana, que tiene su origen en la convención de\nRío de Janeiro Brasil de 1992. Principio desarrollado por la Ley de\nBiodiversidad N° 7788 del 30 de abril de 1998, al incorporar al Consejo\nNacional de Áreas de Conservación y a los Consejos Regionales de las Áreas de\nConservación dentro de la Organización Administrativa del Sistema Nacional de\nÁreas de Conservación.\n\nII.-Que el artículo\n27 inciso a) de Ley de Biodiversidad N° 7788 del 30 abril de 1998 establece que\ndentro de la estructura administrativa de las áreas de conservación debe\nexistir como unidad administrativa, el Consejo Regional de Área de Conservación\nconocido como CORAC.\n\nIII.-Que de La Ley de\nBiodiversidad N° 7788 en su artículo 29, faculta a los Consejos Regionales de\nlas Áreas de Conservación para establecer su propio reglamento, en el marco de\nla legislación vigente, el cual será sometido al Consejo Nacional de Áreas de\nConservación para su aprobación final.\n\nIV.-Que el Consejo\nRegional del Área de Conservación Arenal Huetar Norte legalmente constituido,\nel día 25 de setiembre del 2008, en la Sesión Ordinaria Nº 7, mediante el\nAcuerdo N° 5, aprobó el Reglamento Interno para su funcionamiento.\n\nV.-Que de conformidad\ncon el artículo 12 inciso d) del Reglamento a la Ley de Biodiversidad, Decreto\nEjecutivo Nº 34433-MINAE del 11 de marzo del 2008, el Consejo Nacional de Áreas\nde Conservación (CONAC), en Sesión Ordinaria Nº 02-2010 celebrada el día 01 de\nmarzo del 2010, mediante Acuerdo Nº 14 aprobó el Reglamento para el\nfuncionamiento interno del Consejo Regional del Área de Conservación Arenal\nHuetar Norte (CORAC-AHN). Por tanto,\n\nDecretan:\n\nReglamento para el funcionamiento\ninterno\n\ndel Consejo Regional del Área\n\nde Conservación Arenal\n\nHuetar norte\n\n(CORAC-AHN)\n\nCAPÍTULO I\n\nDisposiciones\ngenerales\n\nArtículo 1º-Este reglamento tiene como objetivo\nregular la conformación y funcionamiento del Consejo Regional del Área de\nConservación Arenal Huetar Norte (CORAC-AHN) de acuerdo con los artículos 29 y\n30 de la Ley de la Biodiversidad Nº 7788 del 30 de abril de 1998.\n\nArtículo 2º-En el\npresente reglamento, se utilizarán las siguientes abreviaturas:\n\nACAHN:\nÁrea de Conservación Arenal Huetar Norte.\n\nCONAC:\nConsejo Nacional de Áreas de Conservación.\n\nCORAC-AHN:\nConsejo Regional del Área de Conservación Arenal Huetar Norte\n\nCOLAC-AHN:\nConsejos Locales del Área de Conservación Arenal Huetar Norte.\n\nMINAET:\nMinisterio de Ambiente, Energía y Telecomunicaciones.\n\nSINAC:\nSistema Nacional de Áreas de Conservación.\n\nAsamblea:\nAsamblea General del CORAC-AHN.\n\nCAPÍTULO II\n\nDe la Asamblea\nGeneral\n\nArtículo 3º-La Asamblea General es el máximo órgano\ndel CORAC-AHN, estará integrado por representantes de todas las organizaciones\nno gubernamentales y comunales interesadas, las Municipalidades y las\ninstituciones públicas presentes en el ACAHN y que estén vinculados directa o\nindirectamente con el desarrollo y manejo del ACAHN y la conservación y el\ndesarrollo sostenible de la región.\n\nArtículo 4º-Las\nfunciones de la Asamblea son las siguientes:\n\na) Nombrar a los miembros del CORAC-AHN y a la\nFiscalía.\n\nb) Conocer y aprobar el informe anual del\nCORAC-AHN y el de la Fiscalía.\n\nArtículo 5º-La Asamblea General, será convocada\npúblicamente por el Director del ACAHN en su condición de Secretario Ejecutivo\ndel CORAC-AHN con un mes de anterioridad y se celebrará en el mes de agosto de\ncada año.\n\nEn la Asamblea\nGeneral se dará a conocer un informe anual de labores de la Junta Directiva del\nCORAC-AHN y de la fiscalía y se elegirán, cuando corresponda, de entre los\nrepresentantes de los distintos sectores acreditados ante la Asamblea General,\nlos miembros del CORAC-AHN; debiendo elegir siempre, a un representante\nmunicipal.\n\nLa Asamblea se\nconvocará ordinariamente cada vez que sea necesario elegir alguno de los\nmiembros del CORAC y serán presididas por el Presidente(a) del CORAC-AHN, en su\nausencia, enfermedad y en general, cuando ocurra una causa justa por su\nrepresentante.\n\nArtículo 6º-Previo a\nla celebración de la Asamblea General, las organizaciones no gubernamentales y\ncomunales interesadas, las Municipalidades y las instituciones públicas\npresentes en el ACAHN deberán acreditar ante la Secretaria Ejecutiva del\nCORAC-AHN dos representantes: un titular y un suplente.\n\nLa Asamblea dará\ninicio con los representantes acreditados que se hallen presentes, los cuales\ndeberán ser al menos cinco miembros de distintos sectores.\n\nCada representante\ntitular debidamente acreditado tendrá derecho a voz y voto, así como a\nparticipar en los puestos de elección, los cuales serán elegidos por mayoría\nsimple, nombrando siempre un representante titular de cada organización o\nsector y su respectivo suplente.\n\nArtículo 7º-La\nacreditación de los asambleístas será gestionada por el Director del ACAHN en\nsu carácter de Secretario Ejecutivo del CORAC-AHN, el cual realizará la\nrespectiva convocatoria de conformidad a lo dispuesto en el artículo 5 de este\nreglamento.\n\nCada entidad\nreportará en documento firmado y sellado, los nombres y calidades de sus\nrepresentantes. Los integrantes del CORAC-AHN vigente serán miembros ex oficios\nde la Asamblea General.\n\nArtículo 8º-Para la\nelección del CORAC-AHN la Asamblea se divide en tres sectores a saber:\n\na) Municipalidades: Las Municipalidades elegirán a\nun titular y a un suplente.\n\nb) Instituciones Públicas estatales presentes el\nárea de influencia del ACAHN: Elegirán una terna la cual será llevada a la\nplenaria donde se elegirá por votación un titular y un suplente.\n\nc) Las Organizaciones no gubernamentales y\ncomunales interesadas, presentes en el ACAHN, elegirán seis representantes a la\nplenaria, donde se elegirá por votación cinco titulares y un suplente.\n\nArtículo 9º-Los miembros del CORAC-AHN se elegirán por\nperiodos de dos años, en forma alternada, de manera que al cumplirse los dos\nprimeros años se eligen los tres miembros que se identifican con números pares\ndel 1 al 6 y el año siguiente se eligen lo cuatro miembros que se identifican\ncon números impares del 1 al 7 y así sucesivamente, tal como se visualiza a\ncontinuación:\n\n1) Presidente\n\n2) Vicepresidente\n\n3) Tesorero\n\n4) Secretario\n\n5) Vocal 1\n\n6) Vocal2\n\n7) Fiscal\n\nEn caso de ausencia por muerte, renuncia o alguna otra\ncausa justa, que impida la continuidad de un miembro del CORAC-AHN, será\nsustituido por el suplente o en su defecto, se procederá al nombramiento de un\nsuplente mediante convocatoria ordinaria de la Asamblea General, previo acuerdo\ndel CORAC-AHN. El suplente nombrado durará en su cargo el tiempo que le faltaba\nal titular.\n\nCAPÍTULO III\n\nDel Consejo Regional\n\nArtículo 10.-El CORAC-AHN, electo en Asamblea será el\nórgano encargado de la administración del Área de Conservación Arenal Huetar\nNorte, se integrará por un Presidente, un Vicepresidente, un Tesorero, un Secretario,\ndos vocales y un Fiscal, todos electos de su seno, así como el Director del\nACAHN, quien fungirá como Secretario Ejecutivo y por lo tanto formara parte del\nCORAC-AHN y tendrá voz y voto. El Fiscal tendrá voz pero no voto.\n\nQueda facultado el\nCORAC-AHN para acordar la creación de Consejos Locales y definir en el acuerdo\nde creación la constitución de dichos consejos, que una vez establecidos\nconforme a su acuerdo de creación, pasarán a formar parte de la estructura\nadministrativa del CORAC-AHN.\n\nArtículo 11.-Las\nfunciones de los miembros del CORAC-AHN son:\n\n    Presidente(a):\n\na) Presidir las Asambleas Genérales y las sesiones\ndel CORAC-AHN.\n\nb) Declarar abiertas las sesiones del Consejo, una\nvez confirmado el quórum establecido en este Reglamento.\n\nc) Ejercer la representación del CORAC-AHN ante\nlos demás entes públicos y privados.\n\nd) Resolver cualquier asunto en caso de empate, en\ncuyo caso tendrá doble voto.\n\ne) Dirigir los debates controlando el uso de la\npalabra.\n\nf)  Velar porque el CORAC-AHN cumpla las\npolíticas, Leyes y Reglamentos relativos a su función, según lo establece el\nordenamiento jurídico y técnico vinculante al SINAC.\n\ng) Dar por terminada la sesión.\n\nh) Rendir informes al CORAC-AHN cuando sean\nnecesarios.\n\ni)  Firmar las actas del Consejo.\n\nj)  Proponer la agenda de reunión del Consejo.\n\nk) Fomentar y fortalecer las relaciones entre el\nConsejo y el ACAHN.\n\n1) Firmar los documentos que el Consejo le\nindique.\n\nm)            Cualquier otra función asignada por\nla legislación nacional o por el CORAC-AHN.\n\nn) En su ausencia será representado por el\nVicepresidente.\n\nSecretario(a) Ejecutivo:\n\na) Convocar las\nsesiones ordinarias y extraordinarias.\n\nb) Confeccionar el\norden del día, teniendo en cuenta en su caso, las peticiones de los demás\nmiembros formuladas con al menos tres días de antelación.\n\nc) Levantar las actas\nde las sesiones del CORAC-AHN y llevar actualizado el correspondiente Libro de\nActas.\n\nd) Firmar las actas\ndel CORAC-AHN.\n\ne) Llevar un archivo\nde toda la documentación que emita o se envíe al CORAC-AHN.\n\nf) Convocar las\nAsambleas a las que se refiere el artículo 29 de la Ley de Biodiversidad y\nlevantar las actas de estas Asambleas.\n\ng) Mantener una\npermanente comunicación con los Consejos Locales y demás integrantes del\nCORAC-AHN.\n\nh) Facilitar la\ntransferencia de información entre toda la estructura de ACAHN.\n\ni) Elaborar informes\ntrimestrales del nivel de ejecución de los acuerdos para su presentación al\nCORAC-AHN.\n\nj) Ejecutar los\nacuerdos y resoluciones del CORAC-AHN.\n\nk) Cualquier otra\nfunción asignada por el CORAC-AHN.\n\nSecretario (a):\n\na) Colaborar con el\nSecretario Ejecutivo en la ejecución de los acuerdos que tome el CORAC-AHN.\n\nb) Mantener una\npermanente comunicación con los Consejos Locales y demás integrantes del\nCORAC-AHN.\n\nc) Colaborar en el\nlevantamiento de las actas de la sesiones.\n\nd) Cualquier otra\nfunción que le asigne el CORAC-AHN.\n\nDe los demás miembros:\n\na) Serán las\nestablecidas por la Ley General de la Administración Pública.\n\nb) Cualquier otra\nfunción que le asigne el Consejo.\n\nDe los suplentes:\n\nEn caso de ausencia definitiva de alguno de los\nmiembros CORAC-AHN, se regirá por lo establecido en el artículo 9 párrafo final\nde este Reglamento.\n\nArtículo 12.-Serán funciones del Consejo Regional del\nÁrea de Conservación Arenal Huetar Norte las siguientes:\n\n1) Velar por la\naplicación de vez\nal mes en forma ordinaria, y extraordinariamente cuando el Secretario Ejecutivo\nlo convoque por escrito, a solicitud del presidente o de la mitad más uno de\nlos miembros del Consejo, con una antelación mínima de veinticuatro horas,\nsalvo en casos de urgencia.\n\nEl calendario y hora\nde las sesiones se definirán en la primera sesión no obstante, para celebrar\nuna sesión ordinaria el A principle developed by the Biodiversity Law No. 7788 of April 30, 1998, by incorporating the National Council of Conservation Areas and the Regional Councils of the Conservation Areas within the Administrative Organization of the National System of Conservation Areas.\n\nII.-That article 27 subsection a) of the Biodiversity Law No. 7788 of April 30, 1998, establishes that within the administrative structure of the conservation areas, there must exist as an administrative unit, the Regional Conservation Area Council known as CORAC.\n\nIII.-That the Biodiversity Law No. 7788 in its article 29 empowers the Regional Councils of the Conservation Areas to establish their own regulations, within the framework of current legislation, which will be submitted to the National Council of Conservation Areas for its final approval.\n\nIV.-That the legally constituted Regional Council of the Arenal Huetar Norte Conservation Area, on September 25, 2008, in Ordinary Session No. 7, by means of Agreement No. 5, approved its Internal Regulation for its functioning.\n\nV.-That in accordance with article 12 subsection d) of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE of March 11, 2008, the National Council of Conservation Areas (CONAC), in Ordinary Session No. 02-2010 held on March 1, 2010, by means of Agreement No. 14, approved the Regulation for the internal functioning of the Regional Council of the Arenal Huetar Norte Conservation Area (CORAC-AHN). Therefore,\n\nThey Decree:\n\nRegulation for the internal functioning\n\nof the Regional Council of the\n\nArenal Huetar Norte\n\nConservation Area\n\n(CORAC-AHN)\n\nCHAPTER I\n\nGeneral Provisions\n\nArticle 1.-This regulation aims to regulate the composition and functioning of the Regional Council of the Arenal Huetar Norte Conservation Area (CORAC-AHN) in accordance with articles 29 and 30 of the Biodiversity Law No. 7788 of April 30, 1998.\n\nArticle 2.-In this regulation, the following abbreviations shall be used:\n\nACAHN:\nArenal Huetar Norte Conservation Area.\n\nCONAC:\nNational Council of Conservation Areas.\n\nCORAC-AHN:\nRegional Council of the Arenal Huetar Norte Conservation Area\n\nCOLAC-AHN:\nLocal Councils of the Arenal Huetar Norte Conservation Area.\n\nMINAET:\nMinistry of Environment, Energy, and Telecommunications.\n\nSINAC:\nNational System of Conservation Areas.\n\nAssembly:\nGeneral Assembly of the CORAC-AHN.\n\nCHAPTER II\n\nOf the General Assembly\n\nArticle 3.-The General Assembly is the highest body of the CORAC-AHN; it shall be composed of representatives of all interested non-governmental and community organizations, the Municipalities, and the public institutions present in the ACAHN that are directly or indirectly linked to the development and management of the ACAHN and the conservation and sustainable development of the region.\n\nArticle 4.-The functions of the Assembly are as follows:\n\na) Appoint the members of the CORAC-AHN and the Oversight Office (Fiscalía).\n\nb) Review and approve the annual report of the CORAC-AHN and that of the Oversight Office (Fiscalía).\n\nArticle 5.-The General Assembly shall be publicly convened by the Director of the ACAHN in their capacity as Executive Secretary of the CORAC-AHN one month in advance and shall be held in the month of August of each year.\n\nAt the General Assembly, an annual report on the activities of the Board of Directors of the CORAC-AHN and of the Oversight Office (Fiscalía) shall be presented, and the members of the CORAC-AHN shall be elected, when appropriate, from among the representatives of the different sectors accredited to the General Assembly; always having to elect a municipal representative.\n\nThe Assembly shall be convened ordinarily whenever it is necessary to elect any of the members of the CORAC and shall be chaired by the President of the CORAC-AHN, or in their absence, illness, and in general, when a just cause occurs, by their representative.\n\nArticle 6.-Prior to the holding of the General Assembly, the interested non-governmental and community organizations, the Municipalities, and the public institutions present in the ACAHN must accredit to the Executive Secretariat of the CORAC-AHN two representatives: one principal (titular) and one alternate (suplente).\n\nThe Assembly shall commence with the accredited representatives who are present, who must be at least five members from different sectors.\n\nEach duly accredited principal (titular) representative shall have the right to voice and vote, as well as to participate in elected positions, who shall be elected by simple majority, always naming one principal (titular) representative from each organization or sector and their respective alternate (suplente).\n\nArticle 7.-The accreditation of the assembly members shall be managed by the Director of the ACAHN in their capacity as Executive Secretary of the CORAC-AHN, who shall issue the respective convocation in accordance with the provisions of article 5 of this regulation.\n\nEach entity shall report, in a signed and sealed document, the names and qualifications of its representatives. The current members of the CORAC-AHN shall be ex officio members of the General Assembly.\n\nArticle 8.-For the election of the CORAC-AHN, the Assembly is divided into three sectors, as follows:\n\na) Municipalities: The Municipalities shall elect one principal (titular) and one alternate (suplente).\n\nb) State Public Institutions present in the area of influence of the ACAHN: They shall elect a slate of three (terna) which shall be brought to the plenary where one principal (titular) and one alternate (suplente) shall be elected by vote.\n\nc) Interested Non-governmental and Community Organizations present in the ACAHN shall elect six representatives to the plenary, where five principals (titulares) and one alternate (suplente) shall be elected by vote.\n\nArticle 9.-The members of the CORAC-AHN shall be elected for periods of two years, in an alternating manner, such that upon the completion of the first two years, the three members identified with even numbers 1 through 6 are elected, and the following year, the four members identified with odd numbers 1 through 7 are elected, and so on, as shown below:\n\n1) President\n\n2) Vice President\n\n3) Treasurer\n\n4) Secretary\n\n5) Board Member 1\n\n6) Board Member 2\n\n7) Oversight Officer (Fiscal)\n\nIn the event of absence due to death, resignation, or any other just cause preventing the continuity of a member of the CORAC-AHN, they shall be replaced by the alternate (suplente), or failing that, an alternate (suplente) shall be appointed via an ordinary convocation of the General Assembly, with the prior agreement of the CORAC-AHN. The appointed alternate (suplente) shall serve in their position for the time remaining in the principal's (titular) term.\n\nCHAPTER III\n\nOf the Regional Council\n\nArticle 10.-The CORAC-AHN, elected in Assembly, shall be the body responsible for the administration of the Arenal Huetar Norte Conservation Area. It shall be composed of a President, a Vice President, a Treasurer, a Secretary, two Board Members (vocales), and an Oversight Officer (Fiscal), all elected from among its members, as well as the Director of the ACAHN, who shall serve as Executive Secretary and therefore shall be part of the CORAC-AHN and shall have voice and vote. The Oversight Officer (Fiscal) shall have voice but not vote.\n\nThe CORAC-AHN is empowered to agree to the creation of Local Councils and to define in the creation agreement the constitution of said councils, which, once established in accordance with their creation agreement, shall become part of the administrative structure of the CORAC-AHN.\n\nArticle 11.-The functions of the members of the CORAC-AHN are:\n\n    President:\n\na) Chair the General Assemblies and the sessions of the CORAC-AHN.\n\nb) Declare Council sessions open, once the quorum established in this Regulation is confirmed.\n\nc) Exercise the representation of the CORAC-AHN before other public and private entities.\n\nd) Resolve any matter in the event of a tie, in which case they shall have a double vote.\n\ne) Direct the debates, controlling the floor.\n\nf) Ensure that the CORAC-AHN complies with the policies, Laws, and Regulations related to its function, as established by the legal and technical framework binding on SINAC.\n\ng) Adjourn the session.\n\nh) Render reports to the CORAC-AHN when necessary.\n\ni) Sign the minutes (actas) of the Council.\n\nj) Propose the meeting agenda for the Council.\n\nk) Promote and strengthen relations between the Council and the ACAHN.\n\nl) Sign the documents as instructed by the Council.\n\nm) Any other function assigned by national legislation or by the CORAC-AHN.\n\nn) In their absence, they shall be represented by the Vice President.\n\nExecutive Secretary:\n\na) Convene ordinary and extraordinary sessions.\n\nb) Prepare the agenda (orden del día), taking into account, where applicable, the requests of the other members made at least three days in advance.\n\nc) Record the minutes (actas) of the CORAC-AHN sessions and keep the corresponding Minute Book (Libro de Actas) updated.\n\nd) Sign the minutes (actas) of the CORAC-AHN.\n\ne) Maintain a file of all documentation issued by or sent to the CORAC-AHN.\n\nf) Convene the Assemblies referred to in article 29 of the Biodiversity Law and record the minutes (actas) of these Assemblies.\n\ng) Maintain permanent communication with the Local Councils and other members of the CORAC-AHN.\n\nh) Facilitate the transfer of information throughout the ACAHN structure.\n\ni) Prepare quarterly reports on the level of execution of agreements for presentation to the CORAC-AHN.\n\nj) Execute the agreements and resolutions of the CORAC-AHN.\n\nk) Any other function assigned by the CORAC-AHN.\n\nSecretary:\n\na) Collaborate with the Executive Secretary in the execution of the agreements made by the CORAC-AHN.\n\nb) Maintain permanent communication with the Local Councils and other members of the CORAC-AHN.\n\nc) Collaborate in the recording of the minutes (actas) of the sessions.\n\nd) Any other function assigned by the CORAC-AHN.\n\nOf the other members:\n\na) Those established by the General Law of Public Administration.\n\nb) Any other function assigned by the Council.\n\nOf the alternates (suplentes):\n\nIn the event of the definitive absence of any of the CORAC-AHN members, the provisions established in the final paragraph of article 9 of this Regulation shall apply.\n\nArticle 12.-The functions of the Regional Council of the Arenal Huetar Norte Conservation Area shall be as follows:\n\n1) Ensure the application of policies on the matter.\n\n2) Ensure the integration of community needs into the plans and activities of the Conservation Area.\n\n3) Promote the participation of the different sectors of the Area in the analysis, discussion, and search for solutions to regional problems related to natural resources and the environment.\n\n4) Present to the National Council the proposal for the appointment of the Director of the Area, by means of a slate of three (terna).\n\n5) Approve the strategies, policies, guidelines, directives, plans, and specific budgets of the Conservation Area, upon the proposal of the Director of the Area and the Technical Scientific Committee.\n\n6) Define specific matters for the management of its Protected Areas and present them to the National Council for approval.\n\n7) Recommend to the National Council of Conservation Areas the creation, modification, or change of category of its Protected Areas.\n\n8) Supervise the work of the Director and the established financial administration body.\n\n9) Approve, in the first instance, matters concerning concessions and service contracts established in article 39 of the Biodiversity Law No. 7788.\n\n10) Any other function assigned by national legislation or by the National Council.\n\nArticle 13.-The CORAC-AHN shall meet at least once a month ordinarily, and extraordinarily when the Executive Secretary convenes it in writing, at the request of the President or of one half plus one of the members of the Council, with a minimum of twenty-four hours' notice, except in cases of urgency.\n\nThe schedule and time of the sessions shall be defined in the first session; however, to hold an ordinary session, the Executive Secretary of the CORAC-AHN shall send a convocation via email, fax, or by any other means authorized by the CORAC-AHN, with at least fifteen calendar days' notice.\n\nThe meeting agenda shall be prepared by the President and the Executive Secretary of the CORAC-AHN and shall be delivered in advance to the board members.\n\nThe CORAC-AHN shall meet with one half plus one of its members, and agreements shall be approved by simple majority; in the event of a tie, the President shall exercise a double vote, and at each session, minutes (an acta) shall be recorded, which shall be approved at the following session.\n\nArticle 14.-Attendance at the sessions by all members shall be mandatory, and unjustified absences shall be regulated by article 18 of this Regulation.\n\nCHAPTER IV\n\nOf the Oversight Office (Fiscalía) of the Council\n\nArticle 15.-The Oversight Office (Fiscalía) of the CORAC-AHN shall be appointed for periods of two years and shall have the following functions:\n\na) Monitor the proper functioning of the CORAC-AHN.\n\nb) Monitor the proper use of the budget allocated to the CORAC-AHN.\n\nc) Request such reports as it deems necessary for the normal functioning of the Council.\n\nd) Monitor the implementation of the Annual Work Plan approved by the Council.\n\ne) Present to the Regional Council of the ACAHN all matters that come to its knowledge which affect the administration of the ACAHN.\n\nf) Investigate any irregularity in the exercise of the duties of the members of the CORAC-AHN and report so that the corresponding disciplinary measures may be taken.\n\ng) Deliver an annual report on activities to the General Assembly on the functioning of the CORAC-AHN and on its actions.\n\nh) The other functions assigned to it by the CORAC-AHN.\n\nCHAPTER V\n\nOf the Expenses of the Council and Financing\n\nArticle 16.-The members of the CORAC-AHN shall not earn a salary or payment of per diems (dietas), but the expenses incurred for transportation, food, and other costs arising from their functions shall be recognized, subject to the economic capacity of the ACAHN.\n\nArticle 17.-To finance the expenses of the CORAC-AHN, up to six percent of the total annual budget of the ACAHN shall be allocated, or failing that, the percentage determined by the CORAC-AHN, based on technical reports from the financial administration body and in accordance with the annual activity schedule of the CORAC-AHN and the Local Councils constituted in the Conservation Area.\n\nCHAPTER VI\n\nOf the Obligations and Disciplinary Sanctions\n\nof the members of the CORAC-AHN\n\nArticle 18.-The members of the CORAC-AHN may be removed at any moment, at the request of the organization or sector they represent, for non-compliance with the functions established in this Regulation, those indicated in article 36 of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE, or for conduct contrary to the ends and principles established in the Biodiversity Law and other related norms; by means of a qualified majority agreement taken by the CORAC-AHN.\n\nCHAPTER VII\n\nOf the Legal Recourses (Recursos Legales)\n\nArticle 19.-In the event that any of the members of the CORAC-AHN files a motion for review (recurso de revisión) against an agreement, it shall be resolved upon the review of the minutes (acta) of that session. Simple observations regarding form shall be corrected simply by pointing them out when reviewing the minutes (acta).\n\nArticle 20.-Against the agreements of the CORAC-AHN, a motion for revocation (recurso de revocatoria) may be filed before the same Council, in accordance with the provisions of article 47 of the Regulation to the Biodiversity Law and article 58 of the General Public Administration Law.\n\nArticle 21.-It shall be effective upon its publication in the Official Gazette La Gaceta.\n\nGiven at the Presidency of the Republic, at nine o'clock on March seventeen, two thousand ten." }
