  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 36121\n\n                        Declara de Utilidad Pública para los intereses del Estado la Asociación\nAdministradora del Acueducto Potable y Alcantarillado Sanitario del Mora de Turrialba\n\nTexto Completo acta: 152BBE\n\nNº 36121-J\n\n(Este decreto ejecutivo se\ndejó sin efecto por el artículo 1° del decreto ejecutivo N° 43662 del 5 de\njulio de 2022)\n\nLA PRESIDENTA DE LA REPÚBLICA\n\nY EL MINISTRO DE JUSTICIA Y PAZ\n\n \n\nCon fundamento en lo dispuesto en los artículos\n140, inciso 18) y 146 de la Constitución Política, en el artículo 32 de la Ley de\nAsociaciones y en los artículos 27 y siguientes de su Reglamento.\n\n \n\nConsiderando:\n\n \n\nI.-Que el artículo 32 de la Ley de Asociaciones\nnúmero 218 del ocho de agosto de mil novecientos treinta y nueve y sus\nreformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad\nPública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y\nactividades sean particularmente útiles para los intereses del Estado, y que\npor ello contribuyan a solventar una necesidad social.\n\nII.-Que la Asociación Administradora del\nAcueducto Potable y Alcantarillado Sanitario del Mora de Turrialba, cédula\njurídica número 3-002-292665 se inscribió en el Registro de Asociaciones del\nRegistro Público desde el día nueve de mayo de dos mil uno, bajo el expediente\nN° 13168, tomo N° 2009, consecutivo uno del sistema mecanizado, Sección\nMercantil del Registro Público.\n\nIII.-Que los fines que persigue la\nAsociación, según el artículo tercero de sus estatutos, y la modificación de\nfecha treinta de setiembre de dos mil seis son: \"... A) Administrar,\noperar, dar mantenimiento, desarrollar y conservar en buenas condiciones el\nacueducto y alcantarillado sanitario, de conformidad con las disposiciones y\nReglamentos que al respecto emita el Instituto Costarricense de Acueductos y\nAlcantarillados, que serán de acatamiento obligatorio. B) Obtener la\nparticipación efectiva de la comunidad en la construcción, operación y\nmantenimiento y desarrollo del acueducto. C) Colaboración en los programas y\ncampañas de índole educativa que se emprendan. D) Ayudar a explicar y divulgar\nen la comunidad las disposiciones y reglamentos de Acueductos y\nAlcantarillados. E) Cooperar con los planes, proyectos y obras que emprenda\nAcueductos y Alcantarillados en la comunidad. F) Participar en asuntos relativos\na la administración, conservación y explotación racional de las aguas, control\nde su contaminación o alteración, definición de las medidas y acciones\nnecesarias para la protección de las cuencas hidrográficas y la estabilidad\necológica. G) Velar porque todos los sistemas sus instalaciones de acueducto o\nalcantarillado sanitario cumplan los principios básicos del servicio público,\ntanto en calidad, cantidad, cobertura, eficiencia, racionalización de gastos,\netc. H) Otorgar los servicios en forma eficiente, igualitaria y oportuna a\ntodos sus usuarios, sin distinciones de ninguna naturaleza..\"'.   "body_en_text": "in the entirety of the text\n\n-\n\nComplete Text of Norm 36121\n\nDeclares of Public Utility for the interests of the State the Administrative Association of the Potable Water and Sanitary Sewer System of Mora de Turrialba\n\nComplete Text record: 152BBE\n\nNo. 36121-J\n\n(This executive decree was\nrendered without effect by Article 1 of executive decree No. 43662 of July 5,\n2022)\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF JUSTICE AND PEACE\n\nBased on the provisions of Articles 140, subsection 18) and 146 of the Political Constitution, Article 32 of the Law of Associations, and Articles 27 and following of its Regulation.\n\nConsidering:\n\nI.-That Article 32 of the Law of Associations number 218 of August 8, nineteen thirty-nine and its amendments, grants the Executive Branch the power to declare of Public Utility simple, federated, or confederated Associations, whose development and activities are particularly useful for the interests of the State, and that thereby contribute to solving a social need.\n\nII.-That the Administrative Association of the Potable Water and Sanitary Sewer System of Mora de Turrialba, legal ID number 3-002-292665, was registered in the Associations Registry of the Public Registry on May 9, two thousand one, under file No. 13168, volume No. 2009, consecutive one of the mechanized system, Mercantile Section of the Public Registry.\n\nIII.-That the purposes pursued by the Association, according to Article Three of its bylaws, and the modification dated September 30, two thousand six, are: \"... A) To administer, operate, maintain, develop, and conserve in good condition the aqueduct and sanitary sewer system, in accordance with the provisions and Regulations issued in this regard by the Costa Rican Institute of Aqueducts and Sewers, which shall be mandatory. B) To obtain the effective participation of the community in the construction, operation, maintenance, and development of the aqueduct. C) Collaboration in educational programs and campaigns that are undertaken. D) To help explain and disseminate in the community the provisions and regulations of Aqueducts and Sewers. E) To cooperate with the plans, projects, and works undertaken by Aqueducts and Sewers in the community. F) To participate in matters relating to the administration, conservation, and rational exploitation of waters, control of their pollution or alteration, definition of the measures and actions necessary for the protection of watersheds (cuencas hidrográficas) and ecological stability. G) To ensure that all systems and their aqueduct or sanitary sewer installations comply with the basic principles of public service, in terms of quality, quantity, coverage, efficiency, rationalization of expenses, etc. H) To provide services in an efficient, equitable, and timely manner to all its users, without distinctions of any nature...\" (Pages 114 and 132 of the administrative file).\n\nIV.-That such purposes solve a social need of the highest order, for which they deserve the support of the Costa Rican State. Therefore,\n\nDECREE:\n\nArticle 1.-The Administrative Association of the Potable Water and Sanitary Sewer System of Mora de Turrialba, legal ID number 3-002-292665, is hereby declared of Public Utility for the interests of the State.\n\nArticle 2.-It is the duty of the Association to submit an annual report to the Ministry of Justice and Peace, in accordance with the provisions of Article 32 of the Regulation to the Law of Associations.\n\nArticle 3.-Once this Decree is published, the interested parties must formalize and submit the respective testimony to the Associations Registry of the National Registry for its respective registration.\n\nArticle 4.-It shall be effective from its publication.\n\nGiven at the Presidency of the Republic.-San José, at nine hours and fifty minutes on June fifteenth, two thousand ten."
