  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 36173\n\n                        Reforma Reglamento a la Ley Apoyo y Fortalecimiento del Sector Agrícola\n\nTexto Completo acta: D3036\n\nNº 36173-MAG-MEIC\n\nLA\nPRESIDENTA DE LA REPÚBLICA\n\nY LAS\nMINISTRAS DE AGRICULTURA Y GANADERÍA\n\nY\nECONOMÍA, INDUSTRIA Y COMERCIO\n\nEn uso de las facultades establecidas en el artículo\n140, incisos 3), 8), 18) y 20) y en el artículo 146 de la Constitución\nPolítica, los artículos 25, 27.1, 28.2b, de la Ley Nº 6227 del 2 de mayo de\n1978, Ley General de la Administración Pública, la Ley Nº 7064 del 29 de abril\nde 1987, Ley de Fomento a la Producción Agropecuaria,  Ley Nº 8835 del 10 de mayo del 2010, Ley\nApoyo y Fortalecimiento del Sector Agrícola, y el Decreto Ejecutivo Nº 36104\nMAG-MEIC del 14 de julio de 2010, Reglamento a la Ley de Apoyo y Fortalecimiento\ndel Sector Agrícola, Ley Nº 8835.\n\nConsiderando:\n\n1º-Que corresponde al Poder Ejecutivo reglamentar las\nleyes de la República.\n\n2º-Que mediante\nDecreto Ejecutivo N° 36104-MAG-MEIC del 14 de julio del 2010, publicado en La\nGaceta 151 del 5 de agosto del 2010, se reglamento la Ley Apoyo y\nFortalecimiento del Sector Agrícola, Ley Nº 8835.\n\n3º-Que resulta\nnecesario y de interés público a efecto de cumplir con los objetivos de la Ley\nNº 8835 modificar y adicionar algunos artículos del Reglamento de la Ley citada,\nDecreto Ejecutivo Nº 36104 MAG-MEIC.\n\n4º-Que estas\nmodificaciones y adiciones garantizan a los pequeños y medianos productores\nagropecuarios que recibieron el beneficio de los Fideicomisos Fidagro y\nReconversión Productiva, poder solicitar la condonación de sus deudas y\nreadecuación de las deudas, en el tanto cumplan con los requisitos y\ncondiciones establecidos en la Ley Nº 8835. The\nproducer organizations financed by the Productive Reconversion Program (Programa de Reconversión Productiva) shall be subjects of total forgiveness (condonación), in accordance with the amounts\nof the principal (principal), current interest (intereses corrientes), and moratory interest (intereses moratorios), for which\npurpose they must meet the requirements established in Article 7 of Law\nNº 8835 and Article 10 of this Regulation.\"\n\nArticle 4-Article 14 of the Executive Decree\nNº 36104-MAG-MEIC, which is the Regulation to the Law for Support and Strengthening\nof the Agricultural Sector, Law N° 8835, is amended to read as follows:\n\n\"Article\n14-Transfer of Applications: It shall be the responsibility of the\nRegional Directorates (Direcciones Regionales) of the CNP to receive the documentation indicated in\nArticle 10 of this Regulation,\ncomplete the verification sheet (Anexo 12), and carry out the\nCertification according to Forms 7 (Anexo 13). Said information must be\nforwarded in a file duly ordered and numbered to the CTE within a\nmaximum period of 5 business days from receipt of the\napplicant's documentation.\"\n\nArticle 5-Article 18 of Executive Decree\nNº 36104-MAG-MEIC, which is the Regulation to the Law for Support and Strengthening\nof the Agricultural Sector, Law N° 8835, is amended to read as follows:\n\n\"Article 18-In the case of\ndebts originating from Fidagro and the Productive Reconversion Program (Programa de Reconversión Productiva), the\nCTE must:\n\na) Recommend to the CR the forgiveness (condonación), up to ten million colones, for the concept of reimbursable funds (fondos reembolsables), as well as the entirety of the non-reimbursable funds (fondos no reembolsables) component and of the current and moratory interest, both for the reimbursable and non-reimbursable funds.\n\nb) Recommend to the CR, in cases where it exceeds ten million colones, that it be partially forgiven and, if deemed appropriate and necessary, the balance be restructured (readecue), with the purpose of guaranteeing the success of the financed project.\n\nc) Recommend to the CR, in the cases of credit operations that were not subject to forgiveness (condonación), that they be restructured (readecuen) or reorganized with the purpose of guaranteeing the success of the projects developed by the producers and their organizations.\"\n\nArticle 6-Subsection k of Article 21 of\nExecutive Decree Nº 36104-MAG-MEIC, which is the Regulation to the Law for Support and\nStrengthening of the Agricultural Sector, Law N° 8835, is repealed.\n\nArticle 7-It takes effect upon its publication in the\nOfficial Journal La Gaceta.\n\nGiven at the Presidency of the Republic, on the sixth\nday of September, two thousand ten."
