reformas.\n\nConsiderando:\n\n1º.-Que mediante\nla Ley Nº 7788 de 30 de abril\nde 1998, Ley de Biodiversidad, se crea el Sistema Nacional de Áreas de\nConservación como un sistema de gestión y coordinación institucional,\ndesconcentrado y participativo, que integrará las competencias en materia\nforestal, vida silvestre, áreas protegidas y el Ministerio del Ambiente y\nEnergía, con el fin de dictar políticas, planificar y ejecutar procesos\ndirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de\nCosta Rica.\n\n2º.-Que mediante los\noficios SINAC-DE-1646-2010 y SINAC-SE-262, el SINAC solicita ampliar el gasto\npresupuestario máximo para el 2010 por la suma de ¢1.600.460.477,00 (mil\nseiscientos millones cuatrocientos sesenta mil cuatrocientos setenta y siete\ncolones sin céntimos) y adicionalmente por oficio SINAC-SE-536 solicita un\nlevantamiento del gasto presupuestario máximo por un monto de ¢\n2.434.606.607,00 (dos mil cuatrocientos treinta y cuatro millones seiscientos\nseis mil seiscientos siete colones sin céntimos), montos que se financiarán con\nsuperávit libre y con transferencias corrientes por su orden.\n\n3º.-Que con el superávit\nlibre se financiará lo siguiente: el pago de servicios de energía eléctrica,\ntelecomunicaciones, mantenimiento de edificios y locales, de cómputo y sistemas\nde información, así como la sustitución de equipo de oficina, actualización de\nequipo informático, desarrollar obras de infraestructura, construcción de\nsenderos en áreas silvestres protegidas y cancelar terrenos adeudados por el\nEstado que fueron declarados Áreas de Protección, el alquiler de edificios,\nlocales y terrenos, elaboración de planos constructivos, diagnóstico sobre\nradio comunicación, plataforma tecnológica de cadena de custodia para\nproducción forestal, transportes, seguros, herramientas, mantenimiento y reparación\npreventiva de las instalaciones de áreas silvestres protegidas, compra de\nmateriales diversos, compra de tractores para las áreas de conservación de\nla Isla del Coco y Guanacaste,\ncompra de busetas para el traslado de funcionarios y voluntarios, compra de\nequipo de radio de comunicación, equipo de oficina, de combate de incendios\nforestales y armas de fuego para los guarda parques, construcción de edificio\nde la Dirección\n Regional de ACOSA, caseta y servicios sanitarios en Guayabo,\nbodegas y la construcción de la primera etapa del edificio de\nla Dirección Regional\nde ACTO.\n\n4.-Que con transferencias\ncorrientes se financiará: la atención de resoluciones judiciales para la\nreconstrucción de un canal del Refugio de Vida Caño Negro, la demolición de una\ncabaña en el Área de Conservación Huetar Norte, pago de diferencias de\nalquileres del Área de Conservación Osa y el traslado de ¢43.271.250,00\n(cuarenta y tres millones doscientos setenta y un mil doscientos cincuenta\ncolones exactos) a la\n Asociación del Acueductos de Golfito por infringir\nla Ley Forestal con fin\nde que se construya una planta de tratamiento de aguas servidas.\n\n5º.-Que mediante el\nDecreto Ejecutivo Nº 32452-H, publicado en\nLa Gaceta No. 130 de 6 de\njulio de 2005 y sus reformas, se emite el \"Lineamiento para la aplicación del\nartículo 6 de la Ley Nº\n8131 de la\n Administración Financiera de\nla República y Presupuestos\nPúblicos y la regulación de la clase de ingresos del Sector Público denominada\nFinanciamiento\".\n\n6º.-Que el artículo 7º del\ndecreto citado en el considerando anterior, dispone que los recursos de\nfinanciamiento que provienen de vigencias anteriores -superávit libre- son\nparte del patrimonio de los órganos y las entidades y pueden utilizarlos en\nperíodos subsiguientes para financiar gastos que se refieran a la actividad\nordinaria de éstas, con los cuales se atienda el interés de la colectividad, el\nservicio público y los fines institucionales, siempre que -como en el presente\ncaso- no tengan el carácter permanente o generen una obligación que requiera\nfinanciarse a través del tiempo, como la creación de plazas para cargos fijos,\no cualquier otro compromiso de la misma naturaleza.\n\n7º.-Que mediante el\nDecreto Ejecutivo Nº 35111-H, publicado en\nLa Gaceta Nº 58 de 24\nde marzo de 2009 y sus reformas, se emitieron las Directrices Generales de\nPolítica Presupuestaria para el año 2010, estableciéndose en el artículo 1º del\ncitado decreto, el gasto presupuestario máximo del año 2010, para las entidades\ncubiertas por el ámbito de\nla Autoridad Presupuestaria.\n\n8º.-Que con el oficio STAP\n2026-09 de 29 de abril de 2009, se comunicó al SINAC, el gasto presupuestario\nmáximo fijado para el año 2010, por la suma de ¢17.427.000.000,00 (diecisiete\nmil cuatrocientos veintisiete millones de colones sin céntimos), el cual no\ncontempla los gastos adicionales señalados en los considerandos segundo,\ntercero y cuarto de este decreto.\n\n9º.-Que del monto total\nsolicitado se excluyen las sumas parciales de ¢640.221.663,00 (seiscientos\ncuarenta millones doscientos veintiún mil seiscientos sesenta y tres colones\nsin céntimos), correspondientes por encontrarse la suma de ¢313.093.348,00\n(trescientos trece millones noventa y tres mil trescientos cuarenta y ocho\ncolones sin céntimos) incorporados en el Presupuesto Nº\n32452-H of June 29, 2005 and its amendments and Executive Decree Nº 35111-H\nof March 4, 2009 and its amendments.\n\nConsidering:\n\n1º.—That through\nLaw Nº 7788 of April 30,\n1998, Biodiversity Law, the National System of Conservation Areas is created as a decentralized and participatory institutional management and coordination system, which will integrate competencies in forestry, wildlife, protected areas, and the Ministry of Environment and Energy, for the purpose of issuing policies, planning, and executing processes aimed at achieving sustainability in the management of Costa Rica's natural resources.\n\n2º.—That through official communications SINAC-DE-1646-2010 and SINAC-SE-262, SINAC requests to increase the maximum budgetary expenditure for 2010 by the sum of ¢1,600,460,477.00 (one billion six hundred million four hundred sixty thousand four hundred seventy-seven colones without céntimos) and additionally through official communication SINAC-SE-536 requests a lifting of the maximum budgetary expenditure for an amount of ¢\n2,434,606,607.00 (two billion four hundred thirty-four million six hundred six thousand six hundred seven colones without céntimos), amounts that will be financed with free surplus (superávit libre) and with current transfers, respectively.\n\n3º.—That the free surplus (superávit libre) will finance the following: payment for electric power services, telecommunications, maintenance of buildings and premises, computer and information systems, as well as replacement of office equipment, updating of computer equipment, developing infrastructure works, construction of trails in protected wilderness areas and paying off lands owed by the State that were declared Protection Areas, rental of buildings, premises, and lands, preparation of construction plans, diagnosis of radio communication, technological platform for chain of custody for forestry production (producción forestal), transportation, insurance, tools, preventive maintenance and repair of the facilities of protected wilderness areas, purchase of various materials, purchase of tractors for the conservation areas of Isla del Coco and Guanacaste, purchase of minibuses for the transfer of officials and volunteers, purchase of radio communication equipment, office equipment, forest firefighting equipment, and firearms for park rangers, construction of the Regional Directorate building of ACOSA, guardhouse and sanitary services in Guayabo, warehouses, and the construction of the first stage of the Regional Directorate building of ACTO.\n\n4.—That current transfers will finance: addressing judicial rulings for the reconstruction of a channel of the Caño Negro Wildlife Refuge, the demolition of a cabin in the Huetar Norte Conservation Area, payment of rental differentials of the Osa Conservation Area, and the transfer of ¢43,271,250.00 (forty-three million two hundred seventy-one thousand two hundred fifty exact colones) to the Asociación del Acueductos de Golfito for violating the Forestry Law (Ley Forestal) in order to build a wastewater treatment plant.\n\n5.—That through Executive Decree Nº 32452-H, published in La Gaceta No. 130 of July 6, 2005 and its amendments, the \"Guideline for the application of Article 6 of Law Nº 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the public sector revenue class called Financing\" is issued.\n\n6.—That Article 7 of the decree cited in the preceding considering paragraph provides that financing resources coming from prior periods—free surplus (superávit libre)—are part of the equity of the bodies and entities and may be used by them in subsequent periods to finance expenses related to their ordinary activity, which serve the community interest, public service, and institutional purposes, provided that—as in the present case—they do not have a permanent character or generate an obligation that requires financing over time, such as the creation of permanent positions for fixed posts, or any other commitment of the same nature.\n\n7.—That through Executive Decree Nº 35111-H, published in La Gaceta Nº 58 of March 24, 2009 and its amendments, the General Budgetary Policy Guidelines for the year 2010 were issued, establishing in Article 1 of the cited decree the maximum budgetary expenditure for the year 2010 for the entities covered by the scope of the Budgetary Authority.\n\n8.—That through official communication STAP 2026-09 of April 29, 2009, the maximum budgetary expenditure set for the year 2010 was communicated to SINAC, for the sum of ¢17,427,000,000.00 (seventeen billion four hundred twenty-seven million colones without céntimos), which does not include the additional expenses indicated in the second, third, and fourth considering paragraphs of this decree.\n\n9.—That from the total amount requested, the partial sums of ¢640,221,663.00 (six hundred forty million two hundred twenty-one thousand six hundred sixty-three colones without céntimos) are excluded, corresponding because the sum of ¢313,093,348.00 (three hundred thirteen million ninety-three thousand three hundred forty-eight colones without céntimos) is incorporated in the 2010 Ordinary Budget, ¢317,128,315.00 (three hundred seventeen million one hundred twenty-eight to modify the maximum budgetary expenditure set for the National System of Conservation Areas for the year 2010, increasing it by the sum of ¢3,394,845,421.00 (three billion three hundred ninety-four million eight hundred forty-five thousand four hundred twenty-one colones without céntimos). Therefore:\n\nDECREE:\n\nArticle 1º—The maximum budgetary expenditure set for the National System of Conservation Areas (SINAC) for the year 2010, established in Executive Decree Nº 35111-H, published in La Gaceta Nº 58 of March 24, 2009 and its amendments, is modified, resulting in the maximum budgetary expenditure being the sum of ¢20,821,845,421.00 (twenty billion eight hundred twenty-one million eight hundred forty-five thousand four hundred twenty-one colones without céntimos) for that period.\n\nArticle 2º—The active administration of the National System of Conservation Areas (SINAC) is responsible for complying with the provisions of Article 6 of Law Nº 8131, Law of Financial Administration of the Republic and Public Budgets, published in La Gaceta Nº 198 of October 16, 2001 and its amendments, as well as in Executive Decree Nº 32452-H, published in La Gaceta Nº 130 of July 6, 2005 and its amendments.\n\nArticle 3º—It takes effect upon its publication.\n\nGiven at the Presidency of the Republic, on July twenty-ninth, two thousand ten." }
