Juan\nCarlos Borbón Marks\" gerente general del ICT y trasladado a esta Comisión por\nla Secretaría del Concejo\nmediante el oficio SM-1585-ORD.50-2009, hemos acordado recomendarle a este\nHonorable Concejo Municipal, en base a la recomendación que nos ha hecho llegar\nel Asesor Legal, el cual nos ha dado una explicación satisfactoria que dice lo\nsiguiente:\n\n\"c) Para el caso del otorgamiento de las\nconcesiones, la Municipalidad respectiva deberá utilizar la Certificación de\nPatrimonio Natural del Estado vigente, para comprobar que la parcela solicitada\nno se contrapone con el Patrimonio Natural del Estado. Sólo se dará trámite a\nsolicitudes de concesión cuando el respectivo plano de catastro no esté\nafectado de ninguna forma por el Patrimonio Natural del Estado certificado a la\nfecha.\"\n\nDe esta manera, recomiendo emitir, por parte del\nConcejo Municipal, una directriz dirigida al señor Alcalde Municipal, para que\nse le ordene al Departamento de Zona Marítimo Terrestre que incorpore a los\nrequisitos de solicitudes de Concesiones en la Zona Marítimo Terrestre lo\nsiguiente:\n\n\"Previo a la publicación del Edicto en La Gaceta,\nel solicitante deberá presentar una Certificación que indique que, el plano en\nel cual se describe el área que se pretende concesionar no se encuentra dentro\nde un área Patrimonio Natural del Estado. Que este requisito es para todas\naquellas solicitudes de concesión que se encuentren en trámite y futuras, así\ncomo de las solicitudes de prórrogas de concesión actuales y futuras.\nAdvirtiendo que en caso de omisión, se archivará el expediente y se declarará\ninadmisible la solicitud de concesión o prórroga.\"\n\nPor ser la anterior una directriz vinculante para\nterceros, ordénese a la Proveeduría Municipal publicarlo por una sola vez en el\nDiario Oficial La Gaceta, dicha directriz regirá a partir del día\nsiguiente de su publicación.\n\nPor lo tanto recomendamos Aprobar el presente\nDictamen, asimismo que se le solicita a la Secretaría del Concejo Municipal se\nnotifique a ICT, al Departamento de Z.M.T, y Alcaldía Municipal.\n\nSe acuerda por unanimidad: acoger en todos sus\nextremos el dictamen de la Comisión de Zona Marítimo Terrestre.\n\n2.- Se autoriza al señor Alcalde Municipal, se\nsirva girar la siguiente directriz al Departamento de Zona Marítimo Terrestre,\nque dice: \"Previo a la publicación del Edicto en\nLa Gaceta, el\nsolicitante deberá presentar una Certificación que indique que, el plano en el\ncual se describe el área que se pretende concesionar no se encuentra dentro de\nun área Patrimonio Natural del Estado.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 0\n\n                        For the granting of concession permits in the Maritime-Terrestrial Zone, it is necessary to present a current State Natural Heritage Certification to verify that the requested parcel does not conflict with the State Natural Heritage.\n\nComplete Text of Record: D3A17\n\nMUNICIPALITY OF SANTA CRUZ\n\nThe agreement reached by the Municipal Council is transcribed, in extraordinary session No. 18-2010, article 03, item 09, dated July 1, 2010, where the following was agreed:\n\nItem 09: the Maritime-Terrestrial Zone Commission Opinion signed by councilmembers Róger Sánchez Fonseca, Celia Pastrana Gutiérrez, and Francisco Zúñiga Barrantes is heard; which states:\n\nCommission Opinion:\n\nWe, members of the Maritime-Terrestrial Zone Commission, have studied and analyzed the document presented by \"Lic. Juan Carlos Borbón Marks,\" general manager of ICT, and forwarded to this Commission by the Council Secretariat via official letter SM-1585-ORD.50-2009. We have agreed to recommend to this Honorable Municipal Council, based on the recommendation sent to us by the Legal Advisor, who has given us a satisfactory explanation that states the following:\n\n\"c) For the case of granting concessions, the respective Municipality must use the current State Natural Heritage Certification to verify that the requested parcel does not conflict with the State Natural Heritage. Concession applications will only be processed when the respective cadastral map is not affected in any way by the State Natural Heritage certified at the date.\"\n\nIn this manner, I recommend that the Municipal Council issue a directive addressed to the Municipal Mayor, so that the Maritime-Terrestrial Zone Department is ordered to incorporate the following into the requirements for Concession applications in the Maritime-Terrestrial Zone:\n\n\"Prior to the publication of the Edict in La Gaceta, the applicant must present a Certification indicating that the map on which the area intended for concession is described is not located within a State Natural Heritage area. This requirement applies to all concession applications that are in process and future ones, as well as to current and future concession renewal applications. Warning that in case of omission, the case file will be archived and the concession or renewal application will be declared inadmissible.\"\n\nSince the foregoing is a directive binding on third parties, the Municipal Procurement Office is ordered to publish it once in the Official Gazette La Gaceta; said directive will take effect the day following its publication.\n\nTherefore, we recommend Approving this Opinion, and likewise that the Secretariat of the Municipal Council be requested to notify ICT, the Z.M.T. Department, and the Municipal Mayor's Office.\n\nIt is unanimously agreed: to accept the opinion of the Maritime-Terrestrial Zone Commission in its entirety.\n\n2.- The Municipal Mayor is authorized to issue the following directive to the Maritime-Terrestrial Zone Department, which states: \"Prior to the publication of the Edict in La Gaceta, the applicant must present a Certification indicating that the map on which the area intended for concession is described is not located within a State Natural Heritage area.
