Asimismo, incorpora el derecho de toda persona a un\nambiente sano y ecológicamente equilibrado.\n\n2º-Que\nel Artículo 56 de la Constitución Política establece que el Estado debe\ngarantizar el trabajo digno, honesto y útil para la sociedad.\n\n3º-Que\nla Ley de Creación del Instituto Costarricense de Pesca y Acuicultura\n(INCOPESCA), Ley N° 7384, establece como función de este ente público estatal,\nnormar el aprovechamiento racional de los recursos pesqueros para lograr\nmayores rendimientos económicos, la protección y conservación de las especies\nmarinas y acuícolas.\n\n4º-Que\ncorresponde al INCOPESCA como Institución Rectora del sector pesquero y\nacuícola de nuestro país, establecer medidas de ordenamiento para el\naprovechamiento sostenible de los recursos hidrobiológicos que permitan\nproteger áreas de reproducción, reclutamiento y de alimentación; que favorezcan\nel incremento de las especies y el aumento de su biomasa, de manera que se\ngarantice su sostenibilidad en provecho de los ecosistemas y de los pescadores.\n\n5º-Que\nel Código de Conducta para la Pesca Responsable de la FAO, Decreto Ejecutivo N°\n27919-MAG reconoce en su Artículo 6, la importante contribución de la pesca\nartesanal en pequeña escala a la generación de empleo, ingresos y seguridad\nalimentaria. De ahí la necesidad de que el Estado garantice apropiadamente el\nderecho de los pescadores y pescadoras, adoptando medidas de regulación que\nfavorezcan el aprovechamiento de los recursos pesqueros en las aguas de\njurisdicción nacional.\n\n6º-Que\nse cuenta con estudios científicos mediante los cuales se ha logrado demostrar\nque la regulación de las artes y métodos de pesca, así como el esfuerzo\npesquero en determinadas áreas estratégicas, contribuyen al aumento de la\nbiomasa y de las poblaciones de especies.\n\n7º-Que\nlas medidas señaladas en el considerando anterior, representan también una\nalternativa viable que posibilite la generación de beneficios económicos,\nsociales y ambientales para las comunidades pesqueras y para los ecosistemas,\nde los que los pescadores dependen para la pesca.\n\n8º-Que\nla Junta Directiva del INCOPESCA aprobó mediante Acuerdo N° 138-2008 A.J.D.I.P., de fecha 04\nde abril del 2008, el \"Reglamento para el establecimiento de las Áreas Marinas\npara la Pesca Responsable\".\n\n9º-Que\nla Presidencia Ejecutiva del INCOPESCA mediante Oficio Nª PESJ-315-08-2009, de\nfecha 10 de agosto del 2009, informó a las seis organizaciones de pesca\nartesanal y la Asociación Costarricense de Pesca Turística que desarrollan su\nactividad en el Golfo Dulce, que la Junta Directiva del INCOPESCA mediante\nacuerdo unánime y firme, en su sesión del viernes 07 de agosto del 2009, aprobó\nel proceso que permita en definitiva la declaratoria oficial que establezca el\nÁrea Marina de Pesca Responsable del Golfo Dulce.\n\n10.-Que\nde conformidad con lo que establece el Artículo 2 del \"Reglamento para el\nestablecimiento de las Áreas Marinas Para la Pesca Responsable\", mediante\nResolución de fecha 30 de Julio del 2009, la Presidencia Ejecutiva del\nINCOPESCA creó un Grupo de Trabajo, con el\nfin de formular y presentar ante la Junta Directiva el Plan de Ordenamiento Pesquero\ncomo requisito previo para aprobar el establecimiento del Área Marina para la\nPesca Responsable del Golfo Dulce.\n\n11.-Que\nel Grupo de Trabajo ha cumplido con las\nformalidades que establece el Reglamento N° 138-2008 y en la Sesión de Junta\nDirectiva, del 11 de junio del 2010, presentó la \"Propuesta de Plan de\nOrdenamiento Pesquero para el establecimiento del Área Marina para la Pesca\nResponsable del Golfo Dulce\".\n\n12.-Que\nel Poder Ejecutivo mediante Decreto Ejecutivo Nº 35502-MAG, publicado en el\nDiario Oficial \"La Gaceta\", Nº 191, del 01 de octubre del 2009, en su\nartículo 15, declara de interés público nacional el establecimiento de las\nÁreas Marinas para la Pesca Responsable.\n\nLA JUNTA\nDIRECTIVA DEL INCOPESCA, ACUERDA:\n\nDeclarar\nel Golfo Dulce como Área Marina\n\npara la\nPesca Responsable\n\nArtículo 1º-Aprobar el establecimiento del\nÁrea Marina para la Pesca Responsable del Golfo Dulce, conforme a lo\nestablecido en el Reglamento A.J.D.I.P 138-2008 y el Decreto Ejecutivo Nº\n35502-MAG, publicado en el Diario Oficial La Gaceta, Nº 191 del 01 de\noctubre del 2009.\n\nArtículo\n2º-Aprobar de conformidad con lo que establece el Reglamento 138-2008 A.J.D.I.P.,\nde fecha 04 de abril del 2008, la propuesta del \"Plan de Ordenamiento Pesquero\npara el establecimiento del Área Marina para la Pesca Responsable del Golfo\nDulce\".\n\nArtículo 3º-Como\nmedida de ordenamiento y regulación para el Área Marina para la Pesca\nResponsable del Golfo Dulce, con fundamento en los resultados derivados de las\ninvestigaciones pesqueras realizadas, sus características geomorfológicas,\necológicas y considerando la información brindada por los pescadores sobre sus\nhábitos pesqueros, se decide dividir el Golfo Dulce en tres\náreas de pesca: Golfo Dulce Externo (Zona A), Interno (Zona B) y la zona de\nGolfito, las cuales estarán delimitadas\npor las siguientes coordenadas geográficas:\n\n| Zona | Tipo de pesca | Pesca objetivo | Arte y couta | Recomendación | | | --- | --- | --- | ---\n| --- | --- | | | | | Actual | Propuesta | | | A (Golfo Externo) | Artesanal Pequeña Escala |\nEscama | Cuerda de mano y una línea plañera con long. Likewise, it incorporates the right of every person to a\nhealthy and ecologically balanced environment.\n\n2º-That\nArticle 56 of the Political Constitution establishes that the State must\nguarantee dignified, honest, and socially useful work.\n\n3º-That\nthe Law Creating the Costa Rican Institute of Fisheries and Aquaculture\n(INCOPESCA), Law No. 7384, establishes as a function of this state public entity,\nto regulate the rational exploitation of fishery resources to achieve\ngreater economic returns, and the protection and conservation of marine\nand aquaculture species.\n\n4º-That\nit corresponds to INCOPESCA, as the Governing Institution of the fisheries and\naquaculture sector of our country, to establish management measures for the\nsustainable exploitation of hydrobiological resources that allow for\nprotecting areas of reproduction, recruitment, and feeding; that favor\nthe increase of species and the growth of their biomass, so as to\nguarantee their sustainability for the benefit of ecosystems and fishers.\n\n5º-That\nthe FAO Code of Conduct for Responsible Fisheries, Executive Decree No.\n27919-MAG, recognizes in its Article 6, the important contribution of artisanal\nsmall-scale fisheries to employment generation, income, and food\nsecurity.
