DG-D08-2010\n\nConsiderando:\n\n1º-Que de conformidad con el inciso e) del artículo 6 de la Ley\n8495 del 6 de abril del 2006, Ley del Servicio Nacional de Salud Animal\n(SENASA), es competencia de dicho Servicio \".Dictar las normas técnicas\npertinentes, elaborar los manuales de procedimientos, así como ejecutar y\ncontrolar las medidas de bienestar animal, inspección veterinaria,\ndesplazamiento interno, importación, exportación, tránsito, cordones\nsanitarios, prohibición de desplazamiento a zonas o locales infectados,\nprohibición o uso controlado de medicamentos veterinarios y reactivos de\nlaboratorio veterinario, vigilancia e investigación epidemiológica y medidas\nsanitarias y veterinarias en general, de todo animal doméstico, silvestre,\nacuático u otros, su material genético, sus productos, subproductos, derivados,\nsus desechos, las sustancias peligrosas y los alimentos para animales. Se\nincluye en esta Ley, la competencia para conocer y regular cualquier otra\nmedida o producto que la tecnología desarrolle y afecte la salud o la producción\nanimal...\"\n\n2º-Que igualmente el inciso k) del referido artículo 6 de la Ley\n8495 antes citada, establece que es competencia del Servicio Nacional de Salud\nAnimal (SENASA)\". Establecer el sistema nacional de trazabilidad/rastreabilidad\nde animales, sus productos y subproductos, y de los insumos utilizados en la\nproducción animal.\"\n\n3º-Que in fine el artículo 6 de la Ley 8495 referido establece que\nel SENASA se considerará una autoridad en salud y que por ello, toda persona,\nnatural o jurídica, queda sujeta a los mandatos de esta Ley, sus Reglamentos y\na las órdenes generales y particulares, ordinarias y de emergencia, que esta\nautoridad dicte en el ejercicio de sus competencias.\n\n4º-Que la Ley Nº 8799 del 17 de abril del 2010, Ley de Control de\nGanado Bovino, Prevención y Sanción de su Robo, Hurto y su Receptación tiene\npor objeto definir los procedimientos, los mecanismos y las responsabilidades\npara controlar, regular, prevenir y sancionar el destace, la matanza, el\napoderamiento, la movilización, el transporte, la comercialización, el\ncontrabando y la negociación de ganado bovino, así como de sus productos y\nsubproductos, en el territorio nacional.\n\n5º-Que la actividad ganadera es una de las actividades económicas\nhistóricamente más importantes siendo innegable su incidencia en la nutrición\nde la población, la seguridad alimentaria, la generación de empleo y el ingreso\nde divisas a la economía y por ello resulta clave para el Estado promoverla y\napoyarla.\n\n6º-Que dado que la ley antes indicada establece una serie de\nmedidas y procedimientos que provocan la necesidad de que a partir de su\nvigencia se modifiquen ciertos procesos de comercialización y movilización de\nganado, el SENASA en asocio de Corporación de Fomento Ganadero (CORFOGA), la\nCámara de Ganaderos Unidos del Sur (CGUS), la Cámara de Ganaderos\nIndependientes del Sur y la Subasta Cotobruseña S.A. han desarrollado un plan\npiloto para el control de movilización y rastreabilidad de ganado bovino en la\nRegión Brunca y cuya experiencia será de la mayor importancia a los efectos de\nestandarizar procesos en todo el país con ocasión de la entrada en vigencia de\nla Ley Nº 8799 antes indicada y eventualmente la implementación del Programa de\nTrazabilidad, que ordena la Ley Nº 8495 a cargo del SENASA, por lo que conviene\noficializarlo dentro del marco de la Ley Nº 8495, así como al instrumento guía\noficial de movilización desarrollado dentro del marco de dicho plan piloto. Por\ntanto,\n\nLA DIRECTORA GENERAL DEL\nSERVICIO NACIONAL\n\nDE SALUD ANIMAL DEL\nMINISTERIO DE\n\nAGRICULTURA Y GANADERÍA\n\nEmite la siguiente Directriz Sanitaria:\n\nANEXO 1\n\nPLAN PILOTO DE CONTROL DE MOVILIZACIÓN\n\nY RASTREABILIDAD GRUPAL DE GANADO\n\nBOVINO EN LA REGIÓN BUNCA\n\nObjeto y definiciones\n\nArtículo 1º-Objeto: El presente documento contiene las\ndefiniciones y procedimientos del Plan Piloto de Control de Movilización y\nRastreabilidad Grupal de Bovinos a desarrollarse en la Región Brunca a cargo\ndel Servicio Nacional de Salud Animal del Ministerio de Agricultura y\nGanadería.\n\nArtículo 2º-Definiciones y abreviaciones:\n\nCertificado Veterinario de Operación: Certificado que emite el SENASA, mediante\nel cual se hará constar la autorización, a fin de que el establecimiento se\ndedique a una o varias actividades de las enumeradas en el artículo 56 de la\nLey SENASA, Nº 8495.\n\nCódigo de Identificación Único o Código de Establecimiento: Código de identificación único asignado\npor el SENASA, que identifica al establecimiento en el ámbito nacional.\n\nCVO: Certificado\nVeterinario de Operación.\n\nEmbarque: conjunto\nde bovinos que se movilizan desde un mismo origen a un mismo destino, en el\nmismo momento y por el mismo medio. Puede estar conformado por uno o más\nanimales. Un embarque constituye la unidad de traslado.\n\nEstablecimiento: Cualquier instalación, construcción, vehículo o en el caso de\nestablecimientos al aire libre, cualquier área o terreno situado en una\nubicación determinada, bajo responsabilidad de un titular y dedicado a alguna\nactividad pecuaria que resulte de interés productivo, sanitario y/o\nepidemiológico para el SENASA.\n\nEstablecimiento de Producción Primaria (Finca): Toda extensión de tierra o área dedicada\ntotal o parcialmente a la producción pecuaria de una o más especies,\nindependientemente del título, forma jurídica o tamaño, bajo gerencia y\nresponsabilidad de un titular principal. La unidad productiva puede estar\nconstituida por áreas agregadas o desagregadas en lotes o terrenos propios o\najenos siempre y cuando no se encuentren a una distancia mayor a 1 km del\ncentro administrativo de la finca, se exploten bajo una misma administración y\nse compartan los mismos medios de producción tales como mano de obra,\nmaquinaria y equipo de trabajo.\n\nEstablecimiento de origen: establecimiento donde se origina el movimiento de un animal o\ngrupo de animales, amparados a una guía de movilización.\n\nGuía oficial de movilización: documento público oficial, con carácter de declaración\njurada por parte del responsable o propietario de los animales, sobre la\ninformación ahí consignada, con el que se permite el transporte y movilización\nde animales en calles o caminos públicos desde un establecimiento registrado,\nen la medida en que la información consignada sea completa y en apego a las\nregulaciones de la ley y su Reglamento.\n\nGuía sanitaria: Guía sanitaria de transporte: Documento oficial emitido por la\nautoridad correspondiente (SENASA), cuando se hubiere declarado emergencia\nsanitaria en cuyo caso será obligatorio el uso de la misma para aquellos\nanimales que se transporten y lo cual se hará bajo condiciones controladas y\ncon un destino específico de acuerdo a las directrices de la autoridad\nsanitaria.\n\nMAG: Ministerio de Agricultura y Ganadería.\n\nPropietario: Persona\nfísica o jurídica titular por cualquier medio legal de un inmueble o de\nbovinos.\n\nRastreabilidad/trazabilidad: capacidad de seguir el movimiento de un bovino o lote de\nbovinos y sus partes a través de etapas especificas de producción,\ncomercialización, transformación y distribución.\n\nRepresentante: aquella persona física o jurídica designada por el responsable del\nestablecimiento para tramitar o responder en su nombre, aspectos\nadministrativos vinculados con el establecimiento.\n\nResponsable o Titular: persona física o jurídica, a quien corresponde decidir sobre la\nproducción o demás actividades del establecimiento y se responsabiliza del\nmismo y de los animales que se encuentran en el ante el SENASA.\n\nSENASA: Servicio\nNacional de Salud Animal, creado mediante la Ley Nº 8495 del 6 de abril del\n2006.\n\nTransportista: Persona física o jurídica que se dedica de forma habitual u ocasional\nal transporte de animales vivos o productos y subproductos de origen animal en\nvehículos.\n\nComponentes del sistema\n\nArtículo 3º-El sistema piloto oficial de Control de Movilización y\nRastreabilidad Grupal de Bovinos está integrado por los siguientes elementos\nconstitutivos:\n\n \n\na) Registro e identificación de\nestablecimientos y operadores comerciales\n\nb) Identificación de bovinos\n\nc) Registro de los movimientos\n\nd) Registro de egresos, ingresos y\nexistencias ganaderas\n\nDel registro e identificación de establecimientos\n\ny operadores comerciales\n\nArtículo 4º-Los siguientes establecimientos deberán solicitar el\nCVO y registrarse ante el SENASA, de conformidad con lo establecido en el\nDecreto Ejecutivo Nº 34859-MAG, \"Reglamento General para el Otorgamiento del Certificado\nVeterinario de Operación\" y el procedimiento administrativo que para los fines\nespecíficos de este plan piloto específico se establezcan:\n\na) Los establecimientos de producción\nprimaria (fincas) que pueden ser origen o destino de los traslados de ganado\nbovino en pie.\n\nb) Los establecimientos de\ncomercialización de ganado bovino en pie, sin perjuicio de lo establecido en el\nDecreto Ejecutivo Nº 34976-MAG-MEIC-SP, \"Reglamento para Funcionamiento y Comercialización de\nGanado en Pie en Subasta y Otorgamiento del Certificado Veterinario de\nOperación\" y demás normativa conexa.\n\nc) Los transportistas de bovinos en pie o\nsus derivados. Los vehículos para el transporte de bovinos, incluyendo los\nremolques, deberán de cumplir además de las regulaciones propias del Ministerio\nde Obras Públicas y Transportes, con la aprobación del SENASA una vez que se\nhayan inspeccionado y constatado que cumplen con los requisitos específicos que\naseguren condiciones sanitarias y de bienestar animal adecuadas.\n\nd) Los mataderos autorizados para la\nmatanza y proceso de ganado bovino, sin perjuicio de lo establecido en el\nDecreto Nº 29588-MAG-S, \"Reglamento Sanitario y de Inspección Veterinaria de\nMataderos, Producción y Procesamiento de Carnes\" y demás normativa conexa.\n\nCualquier cambio en la condición de propiedad o titularidad del\nestablecimiento deberá ser reportado al SENASA a la mayor brevedad.\n\nLa información suministrada por el titular se utilizará únicamente\ncon fines sanitarios y para efectos de este sistema.\n\nArtículo 5º-En atención a la solicitud y de acuerdo con el\nprocedimiento específico, la Dirección Regional Brunca del SENASA habilitará el\nregistro oficial para todos los establecimientos contemplados en este plan\npiloto y les asignará un código único de registro que identificará el\nestablecimiento de forma unívoca.\n\nArtículo 6º-El código de identificación le será entregado al\nresponsable en forma impresa y deberá de ser colocado en el centro\nadministrativo del establecimiento de manera visible. La pérdida o deterioro de\nla placa de identificación deberá ser reportada por el titular a la Dirección\nRegional Brunca del SENASA de forma inmediata. El código de identificación\núnico deberá de indicarse en todo documento oficial donde sea necesario\nidentificar el establecimiento y los animales que se encuentren en él y no\npodrá ser utilizado por ningún otro establecimiento que no sea aquel para el\ncual fue expedido.\n\nDe la identificación de los bovinos\n\nArtículo 7º-Cada propietario de bovinos, independientemente de la\ncantidad de animales que posea, estará obligado a tener su marca personal\ndebidamente registrada en el Registro Oficial de Marcas de Ganado.\n\nArtículo 8º-Los bovinos deberán de identificarse con la marca\nregistrada, estampada en la piel del animal con cualquier método físico o\nquímico que garantice una marca indeleble, visible, legible e identificable.\n\nArtículo 9º-La Dirección Regional Brunca del SENASA podrá\nautorizar otros métodos de identificación complementarios previa solicitud del\nresponsable del establecimiento o propietario de los animales.\n\nArtículo 10.-Todo propietario de ganado que tenga una marca\nregistrada deberá de asentarla en el o los establecimientos de producción\nprimaria (fincas) donde permanecerán los animales. Para este trámite deberá de\ncontar con la autorización del responsable del establecimiento cuando no se\ntrate de la misma persona.\n\nArtículo 11.-Todo bovino transportado deberá presentar la marca\nclaramente visible, legible e identificable, guardando concordancia con el\ndiseño declarado en la guía de movilización o en su defecto identificado de\nacuerdo con el establecido en el artículo 9 de este Plan Piloto. Si el animal\npresenta varias marcas se tomará como vigente la marca que se declare en la\nguía de movilización.\n\nDel registro de los movimientos y las guías de movilización\n\nArtículo 12.-Todo bovino que requiera ser trasladado de un\nestablecimiento a otro, dentro del territorio de la Regio Brunca o fuera de\neste, deberá ser movilizado junto con la guía oficial de movilización\nestablecida como tal para los presentes efectos.\n\nArtículo 13.-La guía oficial de movilización tiene carácter de\ndeclaración jurada por parte del propietario de los animales o su\nrepresentante, es válida para un único destino y por un período no mayor de 24\nhoras después de su emisión. En cada guía se deberá de declarar el número de\ntotal de animales a movilizar, la cantidad por categoría (sexo y grupo etario),\nel origen y destino de los animales a movilizar así como los detalles de su\nidentificación.\n\nArtículo 14.-Los talonarios con las guías oficiales de\nmovilización se deberán solicitar en las oficinas que la Dirección Regional\nBrunca del SENASA habilite. Quedan autorizadas para solicitarlas las personas\nque se encuentran registradas como responsables en el registro oficial de\nestablecimientos pecuarios que se establece en el artículo 4 de esta Directriz\no sus representantes. La Dirección Regional Brunca del SENASA llevará un\nregistro de los talonarios asignados a cada responsable asignándole una\nsecuencia de numeración única. El responsable debe mantener la custodia de los\nformularios y velar por su correcto uso, de igual forma deberá reportar de\nforma inmediata a la Dirección Regional Brunca del SENASA sobre la pérdida,\ndeterioro, robo o uso no autorizado del talonario o sus folios, en cuyo caso la\nDirección Regional Brunca del SENASA podrá anular su vigencia.\n\nArtículo 15.-Las Subastas de la Región podrán solicitar a la\nDirección Regional Brunca del SENASA la autorización para emitir la guía de\nmovilización por medio de una aplicación informática específica o en su defecto\nsolicitarán los talonarios con las guías de movilización con el formato\nespecífico para este tipo de establecimiento en las oficinas que la Dirección\nRegional indicada habilite para estos fines.\n\nArtículo 16.-La guía de movilización debe ser emitida por el\npropietario de los animales o su representante desde el establecimiento donde\nse origine el embarque de los animales. La información correspondiente a los\ndatos de origen y destino del embarque así como las características e\nidentificación de los animales a transportar debe de completarse según el\nprocedimiento y la guía de aplicación que para tales fines indique la Dirección\nRegional Brunca del SENASA.\n\nArtículo 17.-El titular del establecimiento de origen será\nresponsable ante la Dirección Regional Brunca del SENASA de la condición\nsanitaria de los animales consignados en las guías de movilización asociadas a\nsu establecimiento. Cuando el movimiento se origine en un centro de\ncomercialización deberá de indicarse además en la guía el nombre y cédula del\ncomprador y vendedor de los animales, quienes serán los responsables sobre la\npropiedad de los mismos.\n\nArtículo 18.-La guía de movilización debe de ser entregada al\ntransportista al momento del embarque de los animales, el responsable del\nestablecimiento de origen del embarque conservará una copia de cada guía\nadherida al talonario el cual formará parte del registro de rastreabilidad de\nsu establecimiento, de acuerdo con los artículos 22, 23 y 24 de este Plan\nPiloto. Los centros de comercialización podrán llevar un registro electrónico\nde las guías emitidas el cual completará el registro físico.\n\nArtículo 19.-Todo transportista o su representante deberá de\nexigir al responsable del o los animales o a su representante, la guía de\nmovilización al momento del embarque y completar en la guía la información\ncorrespondiente al transporte, según el procedimiento y la guía de aplicación\nque para tales fines indique a la Dirección Regional Brunca del SENASA. Asimismo\ndeberá entregar la guía original en el lugar de destino de los animales.\n\nArtículo 20.-Todo transportista registrado, llevará una bitácora\nde movilización en la cual registrará de forma secuencial todo traslado de\nanimales que realice. La Dirección Regional Brunca del SENASA llevará un\nregistro de bitácoras asignadas a cada transportista asignándole una secuencia\nde numeración única. El responsable debe mantener la custodia de la bitácora y\nvelar por su correcto uso, de igual forma deberá reportar de forma inmediata a\nla Dirección Regional Brunca del SENASA sobre la pérdida, deterioro, robo o uso\nno autorizado en cuyo caso el SENASA podrá anular su vigencia.\n\nArtículo 21.-Se consideran parte de un mismo embarque, aquellos\nanimales que tengan un mismo origen y destino. Si en un mismo medio de\ntransporte se moviliza más de un embarque, el transportista debe de portar una\nguía de movilización por cada uno y asegurarse de que los animales de cada\nembarque se encuentren separados dentro del vehículo o en su defecto se\nencuentren identificados de manera que permita asociar los animales con la guía\nque les corresponda.\n\nDel registro de egresos, ingresos y existencias ganaderas\n\nArtículo 22.-Todo establecimiento deberá de habilitar un registro\nfísico o con soporte electrónico donde se registre de forma secuencial la\ninformación de todos los bovinos que ingresen y/o salgan del mismo.\n\nArtículo 23.-Todo bovino que ingrese a un establecimiento de\nproducción primaria (fincas) debe ser identificado de forma permanente con cualquier\nsistema que permita asociar con seguridad el animal con la guía de\nmovilización, sin perjuicio de lo establecido en los artículos 8 y 9 de este\nPlan Piloto.\n\nArtículo 24.-Forman parte del registro de salidas del\nestablecimiento, las copias de cada guía de movilización emitida. De la misma\nforma se deberán conservar las guías de movilización correspondientes a todos\nlos ingresos de animales desde otro establecimiento. Las guías de movilización\ny el registro de movilización podrán ser requeridos en cualquier momento por la\nDirección Regional Brunca del SENASA. Ante la ausencia de estos documentos o de\nlo establecido en el artículo 23 de este Plan Piloto, el titular asumirá la\nresponsabilidad sanitaria y legal sobre los animales que hayan ingresado y/o\nsalido desde o hacia su establecimiento.\n\nArtículo 25.-Cada vez que los establecimientos de producción\nprimaria (fincas) soliciten la renovación de los talonarios de guías de\nmovilización o renueven el registro de su establecimiento, el responsable\ndeberá de reportar al SENASA las existencias ganaderas y entregar las copias de\nlas guías de movilización de todas las salidas e ingresos de animales desde y\nhacia su establecimiento para ese período.\n\nArtículo 26.-Los centros de comercialización de la Región Brunca\ndeberán de contar con un sistema de información físico o con soporte\nelectrónico avalado por la Dirección Regional Brunca del SENASA, que permita\nidentificar el origen y destino de cada animal subastado de acuerdo con la\ninformación declarada en la guía de movilización y el destino declarado por el\ncomprador. Asimismo deberán llevar un registro físico o con soporte electrónico\nde las guías de movilización emitidas, además conservar las guías de\nmovilización correspondientes a todos los ingresos a fin de remitirlas a la\nDirección Regional Brunca del SENASA en un plazo no mayor de ocho días hábiles.\nLos establecimientos de comercialización fuera de la Región Brunca continuarán\ncon sus procedimientos actualmente establecidos.\n\nArtículo 27.-Todo matadero, planta de proceso o faena ubicado en\nla Región Brunca deberá de habilitar un sistema de información físico o con\nsoporte electrónico avalado por la Dirección Regional Brunca del SENASA, donde\nse registren e identifiquen de forma inequívoca los animales que ingresan al\nestablecimiento de manera que sea posible asociarlos con su origen. Deberán de\ncontar además con un programa de rastreabilidad interna o de proceso avalado\npor la Dirección Regional señalada, que permita identificar y relacionar los\nlotes de proceso con el origen de los animales de acuerdo con la información\nconsignada en la guía de movilización con que ingresaron al establecimiento. De\nigual forma deberán de complementar este proceso con la implementación de\nregistros que permitan la rastreabilidad de sus productos hacia sus clientes\n(rastreabilidad hacia adelante).\n\nDel control del transporte de bovinos en carretera\n\nArtículo 28.-Toda guía de movilización podrá ser convalidada en el\npuesto de control de la policía del Ministerio de Seguridad Pública más cercano\nal lugar de embarque de los animales. Les corresponde a las autoridades de\npolicía de los puestos de control revisar y verificar que la información\nrequerida sea completa y que exista correspondencia en cuanto al número de\nanimales del embarque, su identificación y sus características, así como los\ndatos del transportista y el vehículo.\n\nArtículo 29.-Las autoridades del SENASA, Fuerza Pública o Policía\nde Tránsito, quedan facultados para solicitar y revisar en cualquier momento la\ndocumentación requerida para el transporte de animales y retener el cargamento\nde los animales y el vehículo, en caso de detectarse durante la inspección,\nirregularidades o incumplimiento.\n\nArtículo 30.-En caso de que los animales se transporten sin la\nrespectiva guía de movilización o en caso de detectarse durante la inspección,\nomisiones o inconsistencias en cuanto al origen, destino, número,\nidentificación o características de los animales transportados con respecto a\nlos datos consignados en la guía, cuando el documento presente alteraciones que\ndificulten la lectura de la información o hagan dudar sobre la legitimidad del\ndocumento, cuando los animales sean transportados en medios de transporte no\nautorizados o cuando la información del documento sea incompleta, las\nautoridades procederán a retener el embarque y el vehículo y a la mayor\nbrevedad pondrán en conocimiento del hecho a la Dirección Regional Brunca del\nSENASA.\n\nControles en centros de comercialización de bovinos y\nmataderos\n\nArtículo 31.-Ningún centro de concentración y comercialización de\nanimales (Subasta) o matadero de la Región Brunca podrá receptar, subastar o\nrealizar acto de comercio alguno si los animales no han sido movilizados con la\nrespectiva guía de movilización, cuando no estén identificados con una marca\nregistrada, cuando hayan sido trasportados en medios no autorizados o cuando\nlos datos de la guía presenten alteraciones u omisiones que hagan dudar sobre\nel origen de los animales, la legitimidad del transporte o de la condición\nsanitaria de los animales. En estos casos el responsable de recibo de los\nanimales del establecimiento deberá de notificar por medio escrito sobre el\nparticular a la Dirección Regional Brunca del SENASA.\n\nArtículo 32.-Será responsabilidad del médico veterinario regente o\nmédico veterinario oficial y del responsable de recibo de ganado de los\nestablecimientos referidos en el artículo anterior, velar por el cumplimiento\nde los requisitos establecidos en este Plan Piloto y denunciar cualquier\nirregularidad ante a la Dirección Regional Brunca del SENASA o ante la Fuerza\nPública.\n\nObligaciones\n\nArtículo 33.-Son obligaciones de la Dirección Regional Brunca del\nSENASA las siguientes:\n\na) Habilitar y mantener el registro\noficial de establecimientos pecuarios y transportistas.\n\nb) Atender las solicitudes de registro y\nactualización de establecimientos y transportistas.\n\nc) Supervisar los establecimientos para\nverificar la información del registro y el cumplimiento de los requisitos para\nla autorización de las actividades que realiza.\n\nd) Poner a disposición de los usuarios los\nformularios de guías oficiales de movilización y los instructivos para el uso\nde los formularios de guías y uso de bitácoras de movilización.\n\ne) Definir los procedimientos para\nadquisición, exigencias técnicas y uso de los dispositivos de identificación de\nbovinos, cuando corresponda.\n\nf) Informar a los usuarios sobre los\nalcances y regulaciones propias de este programa y los procedimientos para su\naplicación.\n\ng) Mantener y supervisar el registro de\nmovilización de animales y guías de movilización, en el que se administra la\nemisión y seguimiento de los documentos de movilización.\n\nh) Mantener de forma operativa el sistema\noficial de información sobre rastreabilidad sanitaria, en el que se ingresa,\nprocesa y consulta la información de todos los componentes del programa de\nforma integrada.\n\ni) Diseñar y ejecutar los controles\nnecesarios para la buena operatividad del sistema.\n\nj) Realizar los informes necesarios a la\nDirección General del SENASA a efectos de que se impongan las sanciones que\ncorrespondan derivadas del incumplimiento de normas contenidas en la Ley Nº\n8495, relativas a esta materia y este plan piloto cuando así corresponda.\n\nk) Establecer mecanismos de coordinación\ncon la Corporación de Fomento Ganadero (CORFOGA), la Cámara de Ganaderos Unidos\ndel Sur (CGUS); la Cámara de Ganaderos Independientes del Sur y la Subasta\nCotobruseña S.A., entre otros, para facilitar los trámites a los cuales deberán\nsometerse los distintos operadores del sistema de control de movilización y\nrastreabilidad grupal de bovinos a desarrollarse en la Región Brunca a través\ndel presente Plan Piloto.\n\nArtículo 34.-Son obligaciones del responsable del establecimiento\nlas siguientes:\n\na) Solicitar la inscripción de su\nestablecimiento en el registro oficial de establecimientos pecuarios y tramitar\nel CVO para su establecimiento.\n\nb) Facilitar la información requerida por\nla Dirección Regional Brunca del SENASA para el registro del establecimiento.\n\nc) Adquirir los formularios de guías de\nmovilización para su establecimiento.\n\nd) Completar de forma veraz, completa y\ncorrecta el formulario de guía de movilización al momento del embarque de los\nanimales en el establecimiento y firmar el documento, o en su defecto autorizar\na un representante para estos fines.\n\ne) Llevar un registro físico o electrónico\nde todos los ingresos y salidas de bovinos a su establecimiento y permitir a\nlas autoridades de la Dirección Regional Brunca del SENASA el acceso a este\nregistro cuando así sea solicitado.\n\nf) Mantener la placa de identificación de\nfinca en el lugar que le ha sido asignado y reportar su pérdida o deterioro\nante las autoridades regionales del SENASA.\n\ng) Mantener los animales de su propiedad\ndebidamente identificados.\n\nh) Declarar ante la Dirección Regional\nBrunca del SENASA en un plazo no mayor de 30 días hábiles, sobre cualquier\ncambio que modifique la condición declarada originalmente para el\nestablecimiento, tales como segregación, venta, división o finiquito de la\ncondición contractual.\n\ni) Mantener la custodia de las guías y los\nregistros que se establecen en esta Directriz y velar por su correcto uso, de\nigual forma deberá reportar de forma inmediata sobre la pérdida, robo o uso no\nautorizado de cualquiera de los documentos que mantiene bajo su responsabilidad\ny custodia.\n\nj) Respetar los períodos de retiro de\ntodos los medicamentos aplicados a los animales antes de su movilización o\nadvertir de lo contrario en la guía de movilización.\n\nk) Atender todas las demás obligaciones\nque correspondan de acuerdo a la Ley Nº 8495.\n\nArtículo 35.-Son obligaciones del transportista las siguientes:\n\na) Inscribirse como transportista ante la\nDirección Regional Brunca del SENASA.\n\nb) Tramitar el CVO de los vehículos que\nvaya a utilizar para el transporte de los animales, productos o subproductos.\n\nc) Portar durante el transporte y en el\nmedio de transporte la guía de movilización correspondiente a los animales del\nembarque o las facturas comerciales en caso de productos o subproductos.\n\nd) Verificar que las características e identificación\nde los animales que transporta correspondan con los datos consignados en la\nguía de movilización y que el código de establecimiento corresponda con el\nestablecimiento de embarque.\n\ne) Completar en la guía de movilización la\ninformación referente al transportista.\n\nf) Llevar una bitácora de movilización en\nla cual registrará de forma cronológica todo traslado de animales que realice,\nla fecha en que se realice el movimiento, el código del establecimiento de\norigen y de destino del movimiento.\n\ng) Presentar la guía de movilización y la\nbitácora a toda autoridad policial, administrativa o judicial cuando ésta lo\nrequiera.\n\nh) Permitir la inspección del vehículo y\nsu carga y suministrar la información requerida por la autoridad competente\ncuando se le solicite.\n\ni) Velar por el bienestar animal,\ntransportando los animales en condiciones adecuadas, evitando el maltrato o\nsufrimiento y velando por el cumplimiento de las buenas prácticas de\ntransporte.\n\nj) Asegurarse que los animales de\ndiferentes embarques se mantengan separados en el vehículo durante el\ntransporte o en su defecto se encuentren identificados de manera que permita\nasociar los animales con la guía pertinente.\n\nk) Entregar la guía de movilización en el\nlugar de destino del embarque.\n\nl) Atender las órdenes de la autoridad\ncompetente cuando se presenten anomalías que justifiquen la retención del\ncargamento.\n\nm) Informar a la policía, al regente\nveterinario del establecimiento de destino o a la Dirección Regional Brunca del\nSENASA, sobre la muerte, pérdida de animales o cualquier otra situación que\npueda representar un cambio con respecto a la información declarada en la guía\noficial de movilización.\n\nn) Renovar la bitácora de movilización\nante el SENASA cuando ésta se haya completado, o proceder a su devolución\ncuando la Dirección Regional Brunca del SENASA se lo solicite.\n\no) Mantener la custodia de las guías\ndurante el transporte, así como de los demás documentos que se establecen en\nesta Directriz y velar por su correcto uso, de igual forma deberá reportar de\nforma inmediata a la Dirección Regional Brunca del SENASA sobre la pérdida,\nrobo, deterioro o uso no autorizado de cualquiera de los documentos que\nmantiene bajo su responsabilidad y custodia.\n\np) Atender todas las demás obligaciones\nque correspondan de acuerdo con la Ley Nº 8495.\n\nArtículo 36.-Son obligaciones de los regentes de los centros de\ncentros de comercialización de bovinos y mataderos en la Región Brunca a los\npresentes efectos:\n\na) Verificar durante la inspección ocular\nque los animales se encuentren en buenas condiciones sanitarias.\n\nb) En caso de animales provenientes de\nrebaños sometidos a saneamiento por enfermedades infectocontagiosas e\nidentificados como tales en la Región Brunca, el médico veterinario regente\ndeberá de exigir la guía sanitaria emitida por el médico veterinario oficial o\nacreditado y deberá velar por el cumplimiento de las medidas que para estos\ncasos indique la Dirección Regional Brunca del SENASA.\n\nc) Velar por el cumplimiento de las\nregulaciones establecidas en este Plan Piloto e informar inmediatamente a la\nDirección Regional en caso de incumplimiento por parte de los responsables de\nlos establecimientos de comercialización o de los mataderos según corresponda.\n\nd) Atender todas las demás obligaciones\nque correspondan de acuerdo con la Ley Nº 8495.\n\nSobre los incumplimientos, infracciones u omisiones\n\nArtículo 37.-Sanciones Administrativas. Los incumplimientos,\ninfracciones, alteraciones u omisiones a las disposiciones del presente Plan\nPiloto, serán puestos en conocimiento de la Dirección General del SENASA a los\nefectos de que se inicien los procedimientos para imponer las sanciones\nadministrativas según la gravedad de la falta, de conformidad con lo\nestablecido en el Capítulo IX de la Ley N° 8495 del 6 de abril del 2006. Cuando\nen la especie se detecte algún incumplimiento que se considere comisión de\ndelito se realizará la correspondiente denuncia ante la Oficina del Ministerio\nPublico que corresponda.\n\nArtículo 38.-Las especies de animales diferentes a la bovina (Bos Taurus / Bos Indicus) continuarán\nsiendo movilizadas conforme al documento y procedimientos establecidos para esos efectos en el\nDecreto Ejecutivo Nº 28432-MAG-SP del 13 de enero del dos mil.\n\nDisposiciones Transitorias\n\nTransitorio I.-Toda establecimiento pecuario de producción bovina\nque requiera implementar un sistema de rastreabilidad de origen de mayor\nalcance y profundidad que el que se pueda lograr con las disposiciones del\npresente Plan Piloto incluyendo la identificación y rastreabilidad individual de\nlos animales, podrá solicitar al SENASA el reconocimiento del programa y su\ncertificación oficial conforme lo establece el Artículo 72 de la Ley Nº 8495.\nDe igual forma la Dirección Regional Brunca del SENASA podrá establecer\nregulaciones específicas que incluyen la identificación y la rastreabilidad\nindividual para los animales importados, en la zona fronteriza bajo su\njurisdicción, en zonas de saneamiento en hatos sometidos a campañas de control\nde enfermedades o cuando la situación epidemiológica así lo justifique.\n\nTransitorio II.-Cuando se hubiese declarado emergencia sanitaria\npor parte del SENASA mediante Decreto o cuando la condición sanitaria del hato\nimposibilite el transporte de los animales en condiciones regulares, la\nDirección Regional Brunca del SENASA inhabilitará las guías oficiales de\nmovilización para un ámbito geográfico definido o para un establecimiento\nespecífico y en su lugar podrá autorizar el transporte únicamente mediante una\nguía sanitaria para un destino definido y bajo las condiciones que defina la\nDirección Regional Brunca del SENASA.\n\nTransitorio III.-Los\nestablecimientos pecuarios en la Región Brunca que se encuentren en un programa\noficial de prevención, control o erradicación de enfermedades, deberán de\ncumplir además de las obligaciones que impone este Plan Piloto, con las normas\npropias de cada programa en materia de identificación y rastreabilidad.\n\nBarreal de Ulloa,\nHeredia, a las diez horas del trece de setiembre del dos mil diez.", "body_en_text": "in the entirety of the text\n\n -\n\n Full Text of Standard 08\n\n Pilot Plan for the Control of Movement and Group Traceability of Bovine\nCattle in the Brunca Region\n\nFull Text of record: D3CE5\n\nNATIONAL ANIMAL HEALTH SERVICE\n\nGENERAL DIRECTORATE\n\nDIRECTIVE SENASA DG-D08-2010\n\nConsidering:\n\n1º-That in accordance with subsection e) of Article 6 of Law\n8495 of April 6, 2006, the Law of the National Animal Health Service\n(SENASA), it is the competence of said Service \".To issue the pertinent technical\nstandards, prepare procedure manuals, as well as execute and\ncontrol animal welfare measures, veterinary inspection,\ninternal displacement, import, export, transit, sanitary\ncordons, prohibition of displacement to infected zones or premises,\nprohibition or controlled use of veterinary medications and veterinary\nlaboratory reagents, epidemiological surveillance and investigation, and sanitary\nand veterinary measures in general, for all domestic, wild,\naquatic or other animals, their genetic material, their products, by-products, derivatives,\ntheir waste, hazardous substances, and animal feed. This\nLaw includes the competence to know and regulate any other\nmeasure or product that technology develops and that affects animal health or\nproduction...\"\n\n2º-That likewise, subsection k) of the referred Article 6 of the\naforementioned Law 8495 establishes that it is the competence of the National Animal Health\nService (SENASA)\". To establish the national traceability system\nfor animals, their products and by-products, and for the inputs used in\nanimal production.\"\n\n3º-That in fine, Article 6 of the referred Law 8495 establishes that\nSENASA shall be considered a health authority and that, therefore, every person,\nnatural or juridical, is subject to the mandates of this Law, its Regulations, and\nthe general and particular orders, ordinary and emergency, that this\nauthority issues in the exercise of its competences.\n\n4º-That Law Nº 8799 of April 17, 2010, the Law for the Control of\nBovine Cattle, Prevention and Sanction of its Robbery, Theft, and Receiving, has as\nits purpose to define the procedures, mechanisms, and responsibilities\nto control, regulate, prevent, and sanction the slaughter, killing,\nseizure, movement, transport, commercialization,\ncontraband, and negotiation of bovine cattle, as well as their products and\nby-products, within the national territory.\n\n5º-That livestock activity is one of the historically\nmost important economic activities, its impact on the population's nutrition,\nfood security, job creation, and foreign currency income to the economy being undeniable, and therefore it is key for the State to promote and\nsupport it.\n\n6º-That given that the aforementioned law establishes a series of\nmeasures and procedures that create the need for certain cattle commercialization and movement processes\nto be modified from its entry into force,\nSENASA, in partnership with the Livestock Development Corporation (Corporación de Fomento Ganadero, CORFOGA), the\nChamber of United Ranchers of the South (Cámara de Ganaderos Unidos del Sur, CGUS), the Chamber of Independent\nRanchers of the South, and Subasta Cotobruseña S.A., have developed a pilot plan\nfor the control of movement and traceability of bovine cattle in the\nBrunca Region, and this experience will be of the utmost importance for the purposes of\nstandardizing processes throughout the country on the occasion of the entry into force of\nthe aforementioned Law Nº 8799 and eventually the implementation of the Traceability\nProgram, ordered by Law Nº 8495 under the responsibility of SENASA. The productive unit may be\nconstituted by aggregated or disaggregated areas in lots or land owned or not\nas long as they are not located at a distance greater than 1 km from the\nadministrative center of the farm, are exploited under the same administration, and\nshare the same means of production such as labor,\nmachinery, and work equipment.\n\nOrigin establishment (Establecimiento de origen): establishment where the movement of an animal or\ngroup of animals, covered by a movement guide, originates.\n\nOfficial movement guide (Guía oficial de movilización): official public document, with the character of a sworn\nstatement by the person responsible or owner of the animals, regarding the\ninformation contained therein, with which the transport and movement\nof animals on public streets or roads from a registered establishment is permitted,\nto the extent that the information provided is complete and in compliance with the\nregulations of the law and its Regulation.\n\nSanitary guide (Guía sanitaria): Sanitary transport guide: Official document issued by the\ncorresponding authority (SENASA), when a sanitary emergency has been declared,\nin which case its use shall be mandatory for those\nanimals that are transported and which shall be done under controlled conditions\nand with a specific destination according to the directives of the sanitary\nauthority.\n\nMAG: Ministry of Agriculture and Livestock (Ministerio de Agricultura y Ganadería).\n\nOwner (Propietario): Natural\nor juridical person who is the holder, by any legal means, of a property or\nbovines.\n\nTraceability (Rastreabilidad/trazabilidad): the ability to follow the movement of a bovine or batch of\nbovines and their parts through specific stages of production,\ncommercialization, transformation, and distribution.\n\nRepresentative (Representante): that natural or juridical person designated by the person responsible for the\nestablishment to process or respond on their behalf, regarding\nadministrative aspects linked to the establishment.\n\nResponsible Person or Holder (Responsable o Titular): natural or juridical person who is responsible for deciding on the\nproduction or other activities of the establishment and takes responsibility for\nit and for the animals found therein before SENASA.\n\nSENASA: National\nAnimal Health Service (Servicio Nacional de Salud Animal), created by Law Nº 8495 of April 6,\n2006.\n\nTransporter (Transportista): Natural or juridical person who is engaged habitually or occasionally\nin the transport of live animals or products and by-products of animal origin in\nvehicles.\n\nSystem components\n\nArticle 3º-The official pilot system for the Control of Movement and\nGroup Traceability of Bovines is composed of the following constituent\nelements:\n\n \n\na) Registration and identification of\nestablishments and commercial operators\n\nb) Identification of bovines\n\nc) Record of movements\n\nd) Record of livestock departures (egresos), entries (ingresos), and\nstock (existencias ganaderas)\n\nOf the registration and identification of establishments\n\nand commercial operators\n\nArticle 4º-The following establishments must request the\nCVO and register with SENASA, in accordance with the provisions of\nExecutive Decree (Decreto Ejecutivo) Nº 34859-MAG, \"General Regulation for the Granting of the Veterinary\nOperation Certificate (Certificado Veterinario de Operación)\" and the administrative procedure that for the specific\npurposes of this specific pilot plan are established:\n\na) Primary production establishments\n(farms) that can be the origin or destination of transfers of live bovine\ncattle.\n\nb) Commercialization establishments for\nlive bovine cattle, without prejudice to the provisions of\nExecutive Decree (Decreto Ejecutivo) Nº 34976-MAG-MEIC-SP, \"Regulation for the Operation and Commercialization of\nLive Cattle at Auction and the Granting of the Veterinary Operation Certificate (Certificado Veterinario de Operación)\" and other related regulations.\n\nc) Transporters of live bovines or\ntheir derivatives. Vehicles for the transport of bovines, including\ntrailers, must also comply, in addition to the regulations of the Ministry\nof Public Works and Transport, with SENASA's approval once they\nhave been inspected and verified to comply with the specific requirements that\nensure adequate sanitary conditions and animal welfare (bienestar animal).\n\nd) Slaughterhouses (mataderos) authorized for the\nslaughter and processing of bovine cattle, without prejudice to the provisions of\nDecree Nº 29588-MAG-S, \"Sanitary and Veterinary Inspection Regulation for\nSlaughterhouses, Production, and Meat Processing\" and other related regulations.\n\nAny change in the ownership or holder condition of the\nestablishment must be reported to SENASA as soon as possible.\n\nThe information provided by the holder shall be used solely\nfor sanitary purposes and for the purposes of this system.\n\nArticle 5º-In response to the request and according to the\nspecific procedure, the Brunca Regional Directorate of SENASA shall enable the\nofficial registry for all the establishments contemplated in this pilot\nplan and shall assign them a unique registration code that shall identify the\nestablishment univocally.\n\nArticle 6º-The identification code shall be delivered to the\nresponsible person in printed form and must be placed in the administrative\ncenter of the establishment in a visible manner. The loss or deterioration of\nthe identification plate must be reported by the holder to the Brunca Regional\nDirectorate of SENASA immediately. The unique identification\ncode must be indicated on every official document where it is necessary\nto identify the establishment and the animals found therein and may\nnot be used by any other establishment other than the one for\nwhich it was issued.\n\nOf the identification of bovines\n\nArticle 7º-Every owner of bovines, regardless of the\nnumber of animals they own, shall be obliged to have their personal brand\nduly registered in the Official Registry of Cattle Brands (Registro Oficial de Marcas de Ganado).\n\nArticle 8º-Bovines must be identified with the registered\nbrand, stamped on the animal's skin by any physical or\nchemical method that guarantees an indelible, visible, legible, and identifiable brand.\n\nArticle 9º-The Brunca Regional Directorate of SENASA may\nauthorize other complementary identification methods upon request of the\nperson responsible for the establishment or owner of the animals.\n\nArticle 10.-Every cattle owner who has a registered\nbrand must register it at the primary production\nestablishment(s) (farms) where the animals will remain. For this procedure, they must\nhave the authorization of the person responsible for the establishment when it is not\nthe same person.\n\nArticle 11.-Every transported bovine must present the brand\nclearly visible, legible, and identifiable, matching the\ndesign declared on the movement guide or, failing that, identified in\naccordance with the provisions of Article 9 of this Pilot Plan. If the animal\nhas several brands, the brand declared on the\nmovement guide shall be taken as valid.\n\nOf the record of movements and movement guides\n\nArticle 12.-Every bovine that needs to be transferred from one\nestablishment to another, within the territory of the Brunca Region or outside\nof it, must be moved along with the official movement guide\nestablished as such for these purposes.\n\nArticle 13.-The official movement guide has the character of a\nsworn statement by the owner of the animals or their\nrepresentative, is valid for a single destination and for a period not exceeding 24\nhours after its issuance. In each guide, the total number\nof animals to be moved, the quantity per category (sex and age group),\nthe origin and destination of the animals to be moved, as well as the details of their\nidentification, must be declared.\n\nArticle 14.-The receipt books (talonarios) with the official movement\nguides must be requested at the offices that the Brunca Regional\nDirectorate of SENASA enables. The persons\nwho are registered as responsible persons in the official register of\nlivestock establishments established in Article 4 of this Directive, or their representatives, are authorized to request them. The Brunca Regional Directorate of SENASA shall keep a\nrecord of the receipt books assigned to each responsible person, assigning them a\nunique numbering sequence. The responsible person must maintain custody of the\nforms and ensure their correct use, and shall likewise report\nimmediately to the Brunca Regional Directorate of SENASA on the loss,\ndeterioration, theft, or unauthorized use of the receipt book or its sheets, in which case the\nBrunca Regional Directorate of SENASA may annul their validity.\n\nArticle 15.-The Auction Houses (Subastas) of the Region may request from the\nBrunca Regional Directorate of SENASA authorization to issue the\nmovement guide by means of a specific computer application or, failing that,\nthey shall request the receipt books with the movement guides in the specific\nformat for this type of establishment at the offices that the indicated Regional\nDirectorate enables for these purposes.\n\nArticle 16.-The movement guide must be issued by the\nowner of the animals or their representative from the establishment where\nthe shipment (embarque) of the animals originates. The information corresponding to the\norigin and destination data of the shipment as well as the characteristics and\nidentification of the animals to be transported must be completed according to\nthe procedure and the application guide that for such purposes the Brunca Regional\nDirectorate of SENASA indicates.\n\nArticle 17.-The holder of the origin establishment shall be\nresponsible before the Brunca Regional Directorate of SENASA for the sanitary\ncondition of the animals listed on the movement guides associated with\ntheir establishment. When the movement originates in a\ncommercialization center, the guide must also indicate the name and ID number of the\nbuyer and seller of the animals, who shall be those responsible for the\nownership of the same.\n\nArticle 18.-The movement guide must be delivered to the\ntransporter at the time of the shipment of the animals. The person responsible for the\norigin establishment of the shipment shall keep a copy of each guide\nattached to the receipt book, which shall form part of the traceability record of\ntheir establishment, according to Articles 22, 23, and 24 of this Pilot\nPlan. Commercialization centers may keep an electronic record\nof the issued guides, which shall complement the physical record.\n\nArticle 19.-Every transporter or their representative must\ndemand from the person responsible for the animal(s) or their representative, the\nmovement guide at the time of shipment and complete in the guide the information\ncorresponding to the transport, according to the procedure and the application guide\nthat for such purposes the Brunca Regional Directorate of SENASA indicates. Likewise,\nthey must deliver the original guide at the destination location of the animals.\n\nArticle 20.-Every registered transporter shall keep a logbook (bitácora de movilización)\nin which they shall sequentially record every animal\ntransfer they make. The Brunca Regional Directorate of SENASA shall keep a\nrecord of logbooks assigned to each transporter, assigning them a\nunique numbering sequence. The responsible person must maintain custody of the logbook and\nensure its correct use, and shall likewise report immediately\nto the Brunca Regional Directorate of SENASA on its loss, deterioration, theft, or\nunauthorized use, in which case SENASA may annul its validity.\n\nArticle 21.-Those animals that have the same origin and destination are considered part of the same shipment (embarque).\nIf more than one shipment is moved in the same means of\ntransport, the transporter must carry a\nmovement guide for each one and ensure that the animals of each\nshipment are kept separated within the vehicle or, failing that, are\nidentified in a way that allows the animals to be associated with the\ncorresponding guide.\n\nOf the record of departures (egresos), entries (ingresos), and livestock stock (existencias ganaderas)\n\nArticle 22.-Every establishment must enable a physical\nor electronically supported record where the\ninformation of all bovines that enter and/or leave the same is sequentially recorded.\n\nArticle 23.-Every bovine entering a primary\nproduction establishment (farm) must be permanently identified with any\nsystem that allows the animal to be securely associated with the\nmovement guide, without prejudice to the provisions of Articles 8 and 9 of this\nPilot Plan.\n\nArticle 24.-The copies of each issued movement guide form part of the record of departures (salidas) from the\nestablishment. Likewise, the movement guides corresponding to all\nanimal entries (ingresos) from another establishment must be kept. The movement guides\nand the movement record may be required at any time by the\nBrunca Regional Directorate of SENASA. In the absence of these documents or of\nwhat is established in Article 23 of this Pilot Plan, the holder shall assume the\nsanitary and legal responsibility for the animals that have entered\nand/or left from or to their establishment.\n\nArticle 25.-Each time the primary production\nestablishments (farms) request the renewal of the receipt books of\nmovement guides or renew the registration of their establishment, the responsible person\nmust report the livestock stock (existencias ganaderas) to SENASA and deliver the copies of\nthe movement guides for all animal departures and entries from\nand to their establishment for that period.\n\nArticle 26.-The commercialization centers of the Brunca Region\nmust have a physical or electronically supported\ninformation system endorsed by the Brunca Regional Directorate of SENASA, which allows\nidentifying the origin and destination of each auctioned animal according to the\ninformation declared in the movement guide and the destination declared by the\nbuyer. Likewise, they must keep a physical or electronically supported record\nof the issued movement guides, in addition to keeping the\nmovement guides corresponding to all entries (ingresos) in order to send them to the\nBrunca Regional Directorate of SENASA within a period not exceeding eight business days.\nCommercialization establishments outside the Brunca Region shall continue\nwith their currently established procedures.\n\nArticle 27.-Every slaughterhouse (matadero), processing plant, or slaughter facility (faena) located in\nthe Brunca Region must enable a physical or\nelectronically supported information system endorsed by the Brunca Regional Directorate of SENASA, where\nthe animals entering the establishment are unequivocally registered and identified\nso that it is possible to associate them with their origin. They must\nalso have an internal or process traceability program endorsed\nby the indicated Regional Directorate, which allows identifying and relating the\nprocess batches with the origin of the animals according to the information\nrecorded in the movement guide with which they entered the establishment. Similarly,\nthey must complement this process with the implementation of\nrecords that allow the traceability of their products to their clients\n(forward traceability (rastreabilidad hacia adelante)).\n\nOf the control of bovine transport on the road\n\nArticle 28.-Every movement guide may be validated at the\npolice control post of the Ministry of Public Security closest\nto the place of shipment (embarque) of the animals. It corresponds to the\npolice authorities of the control posts to review and verify that the required\ninformation is complete and that there is correspondence regarding the number of\nanimals in the shipment, their identification, and their characteristics, as well as the\ntransporter's data and the vehicle.\n\nArticle 29.-The authorities of SENASA, the Public Police Force (Fuerza Pública), or the Transit\nPolice (Policía de Tránsito) are empowered to request and review at any time the\ndocumentation required for the transport of animals and to detain the cargo\nof animals and the vehicle, in case irregularities or non-compliance are detected during the inspection.\n\nArticle 30.-In the event that the animals are transported without the\nrespective movement guide, or in case omissions or inconsistencies are detected during the inspection\nregarding the origin, destination, number,\nidentification, or characteristics of the transported animals with respect to\nthe data recorded on the guide, when the document presents alterations that\nmake it difficult to read the information or cast doubt on the legitimacy of the\ndocument, when the animals are transported in unauthorized means of transport,\nor when the information on the document is incomplete, the\nauthorities shall proceed to detain the shipment and the vehicle and as soon as\npossible shall bring the fact to the attention of the Brunca Regional Directorate of\nSENASA.\n\nControls in bovine commercialization centers and\nslaughterhouses (mataderos)\n\nArticle 31.-No animal concentration and commercialization center\n(Auction House (Subasta)) or slaughterhouse (matadero) in the Brunca Region may receive, auction, or\ncarry out any commercial act if the animals have not been moved with the\nrespective movement guide, when they are not identified with a registered\nbrand, when they have been transported by unauthorized means, or when\nthe guide data presents alterations or omissions that cast doubt on\nthe origin of the animals, the legitimacy of the transport, or the sanitary\ncondition of the animals. In these cases, the person responsible for receiving\nanimals at the establishment must notify the\nBrunca Regional Directorate of SENASA in writing regarding the matter.\n\nArticle 32.-It shall be the responsibility of the managing veterinarian (médico veterinario regente) or official\nveterinarian (médico veterinario oficial) and the person responsible for receiving cattle at the\nestablishments referred to in the previous article, to ensure compliance\nwith the requirements established in this Pilot Plan and to report any\nirregularity to the Brunca Regional Directorate of SENASA or to the Public Police Force (Fuerza Pública).\n\nObligations\n\nArticle 33.-The obligations of the Brunca Regional Directorate of\nSENASA are the following:\n\na) To enable and maintain the official\nregister of livestock establishments and transporters.\n\nb) To attend to registration and\nupdate requests for establishments and transporters.\n\nc) To supervise establishments to\nverify the registry information and compliance with the requirements for\nthe authorization of the activities they carry out.\n\nd) To make available to users the\nofficial movement guide forms and the instructions for the use\nof the guide forms and use of movement logbooks (bitácoras de movilización).\n\ne) To define the procedures for the\nacquisition, technical requirements, and use of bovine identification\ndevices, when applicable.\n\nf) To inform users about the\nscope and specific regulations of this program and the procedures for its\napplication.\n\ng) To maintain and supervise the\nanimal movement record and movement guides, in which the\nissuance and tracking of movement documents is managed.\n\nh) To operationally maintain the official\ninformation system on sanitary traceability, in which the\ninformation from all program components is entered,\nprocessed, and consulted in an integrated manner.\n\ni) To design and execute the necessary\ncontrols for the proper operation of the system.\n\nj) To make the necessary reports to the\nGeneral Directorate of SENASA for the purpose of imposing the corresponding\nsanctions derived from non-compliance with the standards contained in Law Nº\n8495, related to this matter and this pilot plan when applicable.\n\nk) To establish coordination mechanisms\nwith the Livestock Development Corporation (Corporación de Fomento Ganadero, CORFOGA), the Chamber of United Ranchers of the South (Cámara de Ganaderos Unidos del Sur, CGUS); the Chamber of Independent Ranchers of the South, and Subasta\nCotobruseña S.A., among others, to facilitate the procedures to which\nthe different operators of the movement control and\ngroup traceability system for bovines to be developed in the Brunca Region must submit through\nthis Pilot Plan.\n\nArticle 34.-The obligations of the person responsible for the establishment\nare the following:\n\na) To request the registration of their\nestablishment in the official register of livestock establishments and to process\nthe CVO for their establishment.\n\nb) To provide the information required by\nthe Brunca Regional Directorate of SENASA for the establishment's registration.\n\nc) To acquire the movement guide\nforms for their establishment.\n\nd) To truthfully, completely, and correctly\ncomplete the movement guide form at the time of the shipment (embarque) of the\nanimals at the establishment and to sign the document, or failing that, to authorize\na representative for these purposes.\n\ne) To keep a physical or electronic record\nof all bovine entries (ingresos) and departures (salidas) to their establishment and to allow\nthe authorities of the Brunca Regional Directorate of SENASA access to this\nrecord when so requested.\n\nf) To keep the farm identification plate\nin the place assigned to it and to report its loss or deterioration\nto the regional authorities of SENASA.\n\ng) To keep the animals they own\nduly identified.\n\nh) To declare before the Brunca Regional\nDirectorate of SENASA within a period not exceeding 30 business days, any\nchange that modifies the condition originally declared for the\nestablishment, such as segregation, sale, division, or termination of the\ncontractual condition.\n\ni) To maintain custody of the guides and\nrecords established in this Directive and to ensure their correct use. Similarly,\nthey must immediately report the loss, theft, or\nunauthorized use of any of the documents they hold under their responsibility\nand custody.\n\nj) To respect the withdrawal periods for\nall medications applied to the animals before their movement or\nto warn otherwise on the movement guide.\n\nk) To attend to all other obligations\nthat apply according to Law Nº 8495.\n\nArticle 35.-The obligations of the transporter are the following:\n\na) To register as a transporter with the\nBrunca Regional Directorate of SENASA.\n\nb) To process the CVO for the vehicles\nthey will use for the transport of animals, products, or by-products.\n\nc) To carry, during transport and in the\nmeans of transport, the movement guide corresponding to the animals of the\nshipment or the commercial invoices for products or by-products.\n\nd) To verify that the characteristics and identification\nof the animals they transport correspond to the data recorded on the\nmovement guide and that the establishment code corresponds to the\nshipment establishment.\n\ne) To complete the information regarding the transporter\non the movement guide.\n\nf) To keep a movement logbook (bitácora de movilización) in\nwhich they shall chronologically record every animal transfer they make,\nthe date on which the movement is made, the code of the\norigin establishment and the destination of the movement.\n\ng) To present the movement guide and the\nlogbook to any police, administrative, or judicial authority when\nrequired.\n\nh) To permit the inspection of the vehicle and\nits load and to provide the information required by the competent authority\nwhen requested.\n\ni) To ensure animal welfare (bienestar animal),\ntransporting the animals in adequate conditions, avoiding mistreatment or\nsuffering, and ensuring compliance with good transport\npractices.\n\nj) To ensure that animals from\ndifferent shipments are kept separated in the vehicle during\ntransport, or failing that, are identified in a way that allows\nthe animals to be associated with the pertinent guide.\n\nk) To deliver the movement guide at the\ndestination location of the shipment.\n\nl) To comply with the orders of the\ncompetent authority when anomalies arise that justify the detention of the\ncargo.\n\nm) Inform the police, the veterinary regent of the destination establishment, or the Brunca Regional Directorate of SENASA of the death, loss of animals, or any other situation that may represent a change with respect to the information declared in the official movement guide (guía oficial de movilización).\n\nn) Renew the movement logbook (bitácora de movilización) with SENASA when it has been completed, or proceed to its return when the Brunca Regional Directorate of SENASA so requests.\n\no) Maintain custody of the guides during transport, as well as of the other documents established in this Directive and ensure their correct use; likewise, must immediately report to the Brunca Regional Directorate of SENASA the loss, theft, deterioration, or unauthorized use of any of the documents kept under its responsibility and custody.\n\np) Address all other corresponding obligations in accordance with Law No. 8495.\n\nArticle 36.—For these purposes, the obligations of the regents of bovine marketing centers and slaughterhouses in the Brunca Region are:\n\na) Verify during the visual inspection that the animals are in good sanitary conditions.\n\nb) In the case of animals from herds subjected to sanitation for infectious-contagious diseases and identified as such in the Brunca Region, the regent veterinary doctor must require the sanitary guide issued by the official or accredited veterinary doctor and must ensure compliance with the measures indicated for these cases by the Brunca Regional Directorate of SENASA.\n\nc) Ensure compliance with the regulations established in this Pilot Plan and immediately inform the Regional Directorate in the event of non-compliance by those responsible for the marketing establishments or slaughterhouses, as applicable.\n\nd) Address all other corresponding obligations in accordance with Law No. 8495.\n\nRegarding Non-Compliance, Infringements, or Omissions\n\nArticle 37.—Administrative Sanctions. Non-compliance, infringements, alterations, or omissions with respect to the provisions of this Pilot Plan shall be made known to the General Directorate of SENASA in order to initiate proceedings to impose administrative sanctions according to the seriousness of the fault, in accordance with the provisions of Chapter IX of Law No. 8495 of April 6, 2006. When any non-compliance is detected that is considered to constitute a crime, the corresponding complaint shall be filed with the appropriate Public Prosecutor's Office.\n\nArticle 38.—Animal species other than bovine (Bos Taurus / Bos Indicus) shall continue to be moved in accordance with the document and procedures established for those purposes in Executive Decree No. 28432-MAG-SP of January 13, 2000.\n\nTransitory Provisions\n\nTransitory I.—Any livestock establishment for bovine production that requires implementing a traceability of origin system with a greater scope and depth than that achievable with the provisions of this Pilot Plan, including individual identification and traceability of animals, may request from SENASA the recognition of the program and its official certification as established in Article 72 of Law No. 8495. Likewise, the Brunca Regional Directorate of SENASA may establish specific regulations that include individual identification and traceability for imported animals, in the border zone under its jurisdiction, in sanitation zones in herds subjected to disease control campaigns, or when the epidemiological situation so justifies it.\n\nTransitory II.—When a sanitary emergency has been declared by SENASA through a Decree, or when the sanitary condition of the herd makes it impossible to transport the animals under regular conditions, the Brunca Regional Directorate of SENASA shall disable the official movement guides for a defined geographical area or for a specific establishment and may instead authorize transport solely by means of a sanitary guide for a defined destination and under the conditions defined by the Brunca Regional Directorate of SENASA.\n\nTransitory III.—Livestock establishments in the Brunca Region that are in an official disease prevention, control, or eradication program must comply, in addition to the obligations imposed by this Pilot Plan, with the specific rules of each program regarding identification and traceability.\n\nBarreal de Ulloa, Heredia, at ten o'clock on the thirteenth of September, two thousand ten." }
