General de la Administración\nPública, y la Ley N° 8488 del 11 de enero del 2006, que es la Ley Nacional de\nEmergencias y Prevención del Riesgo, la Ley N° 7064 del 29 de abril de 1987,\nLey de Fomento a la Producción Agropecuaria (FODEA) y Orgánica del MAG;\n\nConsiderando:\n\nI.-Que desde el mes de agosto del\naño en curso el país se ha visto afectado por diversos eventos de carácter\nextraordinario generados por condiciones meteorológicas adversas que han\ngenerado abundantes lluvias en todo el territorio nacional y han provocado\ninundaciones en poblaciones y cultivos.\n\nII.-Que adicionalmente, desde el\ndía 20 de setiembre del año en curso, se han presentado condiciones lluviosas\nmuy fuertes y extraordinarias ocasionadas por el temporal que afecta el\nPacífico Central, Norte y Sur, y el Valle Central, con afectación general en\ntodo el territorio nacional al asociarse con la tormenta Nicole en el Mar\nCaribe, caracterizadas por lluvias de variable intensidad relacionadas a\nsistemas de baja presión sobre Centroamérica y al posicionamiento de la zona de\nconvergencia intertropical (confluencia de vientos del suroeste u noroeste).\n\nIII.-Que todas\nestas condiciones adversas de carácter climatológico han provocado serios y\ncuantiosos daños en todo el sector agropecuario, principalmente en las zonas\nagrícolas y pecuarias, por el exceso de lluvias constantes, según consta en los\nreportes planteados ante el Ministerio de Agricultura y Ganadería, lo que ha\nocasionado una situación de calamidad pública provocada por hechos de la\nnaturaleza que están fuera del control de las instituciones y los administrados\nafectados, ya que excede su capacidad ordinaria de reacción, por tratarse de\nsituaciones imprevisibles o previsible pero inevitables, que no pueden ser\ncontroladas por las potestades ordinarias de que dispone el Gobierno.\n\nIV.-Que el Instituto\nMeteorológico Nacional ha advertido que durante los meses de octubre y\nnoviembre del presente año las condiciones adversas del clima se pueden\nincrementar afectando aún más a las poblaciones, ganado y áreas de cultivos que\nya están muy afectados, dado que los suelos están saturados y por ello aumenta\nla escorrentía superficial y se incrementa la amenaza de inundaciones y\ndeslizamientos.\n\nV.-Que la Comisión Nacional de\nPrevención del Riesgo y Atención de Emergencias mantiene desde el 30 de agosto\ndel presente año un estado de alerta verde permanente en el Valle Central,\nPacífico y Zona Norte del país y alerta amarilla en diferentes zonas del\nterritorio ante eventos puntuales que se han presentado en forma constante,\nactivando los sistemas de atención y prevención existentes.\n\nVI.-Que la vida y salud de la\npoblación, así como sus bienes, deben ser protegidos o tutelados por el Estado,\nquien debe velar por su protección y por la seguridad de los habitantes y en\ngeneral por la conservación del orden social.\n\nVII.-Que la Ley\nNacional de Emergencias y Prevención del Riesgo dispone que en caso de\ncalamidad pública ocasionada por hechos de la naturaleza o del hombre que son\nimprevisibles o previsibles pero inevitables y no puedan ser controlados,\nmanejados ni dominados con las potestades ordinarias de que dispone el\nGobierno, el Poder Ejecutivo podrá declarar emergencia nacional a fin de\nintegrar y definir las responsabilidades y funciones de todos los organismos,\nentidades públicas, privadas y poder brindar una solución acorde a la magnitud\ndel desastre.\n\nVIII.-Que en razón de lo expuesto\nse hace necesaria la promulgación de un marco jurídico para tomar las medidas\nde excepción que señala la Constitución Política y la Ley Nacional de\nEmergencias y Prevención del Riesgo, para hacerle frente a los efectos\nocasionados por estos fenómenos hidrometeorológico y mitigar las consecuencias\nque ocasionó su impacto en las diferentes zonas del país. Por tanto,\n\nDECRETAN:\n\nArtículo 1°-Se declara estado de\nemergencia nacional la situación provocada por las condiciones\nhidrometereológicas extremas que han afectado el territorio nacional, en los\nsectores agrícola y pecuario\n\nArtículo 2°-Para los efectos\ncorrespondientes, se tienen comprendidas dentro de la presente declaratoria de\nemergencia las tres fases que establece la Ley Nacional de Atención de\nEmergencias y Prevención del Riesgo, a saber:\n\na) Fase de respuesta.\n\nb) Fase de rehabilitación.\n\nc) Fase de reconstrucción.\n\nArtículo 3°-Se tienen comprendidas dentro la\nComisión Nacional de Prevención de Riesgos y Atención de Emergencias, para\npoder ser objeto de atención conforme al concepto de emergencia, quedando\nautorizada esta Comisión para la atención previa de las obras de primer\nimpacto, sin que esté aprobado este Plan General.\n\nArtículo 4°-La Comisión Nacional\nde Prevención de Riesgos y Atención de Emergencias será el órgano encargado del\nplaneamiento, dirección, control y coordinación de los programas y actividades\nde protección, salvamento, atención, rehabilitación y reconstrucción de las\nzonas declaradas en estado de emergencia, para lo cual designará como unidad\nejecutora a la Institución que corresponda por su competencia.\n\nArtículo 5°-De conformidad con lo\ndispuesto por la Ley Nacional de Emergencias y Prevención del Riesgo, el Poder\nEjecutivo, en especial el Ministerio de Hacienda, las instituciones públicas,\nentidades autónomas y semiautónomas, y empresas del Estado, dar aportes,\ndonaciones, transferencias y prestar la ayuda y colaboración necesaria a la\nComisión Nacional de Prevención de Riesgos y Atención de Emergencias.\n\nArtículo 6°-Para la atención de\nla presente declaratoria de emergencia la Comisión Nacional de Prevención de\nRiesgos y Atención de Emergencias, de conformidad con la Ley Nacional de\nEmergencias y Prevención del Riesgo, podrá destinar fondos y aceptar donaciones\nde entes públicos y privados.\n\nArtículo 7º-La Comisión Nacional\nde Prevención de Riesgos y Atención de Emergencias, para la atención de esta\nemergencia podrá utilizar fondos remanentes no comprometidos de otras\nemergencias finiquitadas o vigentes, según disponga la Junta Directiva de este\nÓrgano.\n\nArtículo 8°-Los predios de\npropiedad privada ubicados en el área geográfica REPUBLIC\n\nAND THE MINISTER OF THE PRESIDENCY\n\nIn exercise of the powers conferred by\narticles 140, subsections 3) and 18), 146 and 180 of the Political Constitution,\narticle 25 subsection 1), Emergency Response and Risk Prevention of\nLaw No. 6227 of May 2, 1978, which is the General Law of Public\nAdministration, and Law No. 8488 of January 11, 2006, which is the National Law of\nEmergencies and Risk Prevention, Law No. 7064 of April 29, 1987,\nLaw for the Promotion of Agricultural and Livestock Production (FODEA) and Organic Law of the MAG;\n\nConsidering:\n\nI.-That since the month of August of the\ncurrent year, the country has been affected by various extraordinary events\ngenerated by adverse meteorological conditions that have\ngenerated abundant rains throughout the national territory and have caused\nflooding in populations and crops.\n\nII.-That additionally, since the\n20th of September of the current year, very strong and extraordinary rainy conditions\nhave occurred caused by the storm affecting the\nCentral, North, and South Pacific, and the Central Valley, with generalized effects throughout\nthe entire national territory when associated with storm Nicole in the Caribbean\nSea, characterized by rains of variable intensity related to\nlow-pressure systems over Central America and the positioning of the\nIntertropical Convergence Zone (confluence of southwest and northwest winds).\n\nIII.-That all\nthese adverse climatological conditions have caused serious and\nsubstantial damage throughout the agricultural and livestock sector, mainly in the\nagricultural and livestock zones, due to the excess of constant rains, as recorded in the\nreports submitted to the Ministry of Agriculture and Livestock, which has\ncaused a situation of public calamity caused by acts of\nnature that are beyond the control of the institutions and the affected\ncitizens, since it exceeds their ordinary capacity for reaction, as these are\nsituations that are unforeseeable or foreseeable but inevitable, which cannot be\ncontrolled by the ordinary powers available to the Government.\n\nIV.-That the National\nMeteorological Institute has warned that during the months of October and\nNovember of this year, the adverse weather conditions may\nincrease, further affecting the populations, livestock, and crop areas that\nare already heavily affected, given that the soils are saturated and therefore\nsurface runoff increases and the threat of floods and\nlandslides grows.\n\nV.-That the National Commission for\nRisk Prevention and Emergency Response has maintained since August 30 of\nthis year a permanent green alert state in the Central Valley,\nPacific, and Northern Zone of the country and a yellow alert in different zones of the\nterritory in response to specific events that have occurred constantly,\nactivating the existing response and prevention systems.\n\nVI.-That the life and health of the\npopulation, as well as their property, must be protected or safeguarded by the State,\nwhich must ensure their protection and the security of the inhabitants and, in\ngeneral, the conservation of social order.\n\nVII.-That the National Law\nof Emergencies and Risk Prevention provides that in the event of\npublic calamity caused by acts of nature or of man that are\nunforeseeable or foreseeable but inevitable and cannot be controlled,\nmanaged, or dominated with the ordinary powers available to the\nGovernment, the Executive Branch may declare a national emergency in order\nto integrate and define the responsibilities and functions of all\norganizations, public and private entities, and to be able to provide a solution commensurate with the magnitude\nof the disaster.\n\nVIII.-That by reason of the foregoing,\nthe enactment of a legal framework is necessary to take the\nexceptional measures indicated by the Political Constitution and the National Law of\nEmergencies and Risk Prevention, to confront the\neffects caused by these hydrometeorological phenomena and mitigate the\nconsequences caused by their impact on the different zones of the country. Therefore,\n\nTHEY DECREE:\n\nArticle 1.-A state of national\nemergency is declared for the situation caused by the extreme\nhydrometeorological conditions that have affected the national territory, in the\nagricultural and livestock sectors.\n\nArticle 2.-For the corresponding\npurposes, the three phases established by the National Law of Emergency Response\nand Risk Prevention are included within this emergency declaration, namely:\n\na) Response phase.\n\nb) Rehabilitation phase.\n\nc) Reconstruction phase.\n\nArticle 3.-All actions and works necessary for the\nresponse, rehabilitation, reconstruction, and replacement of the damages caused\nin the agricultural and livestock sector in the national territory are included within this\nemergency declaration according to the official\nreports of the Ministry of Agriculture and Livestock, all of which must be recorded\nin the General Emergency Plan approved by the Board of Directors of the\nNational Commission for Risk Prevention and Emergency Response, in order\nto be subject to response under the concept of emergency, with this Commission being authorized\nfor the prior response of first-impact\nworks, without this General Plan having been approved.\n\nArticle 4.-The National Commission\nfor Risk Prevention and Emergency Response shall be the body responsible for the\nplanning, direction, control, and coordination of the programs and activities\nfor protection, rescue, response, rehabilitation, and reconstruction of the\nzones declared in a state of emergency, for which it shall designate as the\nexecuting unit the Institution that corresponds due to its competence.\n\nArticle 5.-In accordance with\nthe provisions of the National Law of Emergencies and Risk Prevention, the Executive\nBranch, especially the Ministry of Finance, public institutions,\nautonomous and semi-autonomous entities, and state enterprises, shall provide\ncontributions, donations, transfers, and render the necessary help and collaboration to the\nNational Commission for Risk Prevention and Emergency Response.\n\nArticle 6.-For the response to\nthis emergency declaration, the National Commission for Risk Prevention\nand Emergency Response, in accordance with the National Law of\nEmergencies and Risk Prevention, may allocate funds and accept donations\nfrom public and private entities.\n\nArticle 7.-The National Commission\nfor Risk Prevention and Emergency Response, for the response to this\nemergency, may use uncommitted remaining funds from other\nconcluded or current emergencies, as determined by the Board of Directors of this\nBody.\n\nArticle 8.-Privately owned\nproperties located in the geographic area established in this\nemergency declaration must bear all legal easements (servidumbres)\nnecessary to execute the actions, processes, and works\ncarried out by public entities in the response to the emergency, provided\nthis is absolutely indispensable for the timely response to\nit, in accordance with the provisions of the first phase of the emergency.\n\nArticle 9.-This emergency\ndeclaration shall remain in force for the period that the Executive\nBranch determines, according to the reports issued by the National\nCommission for Risk Prevention and Emergency Response.\n\nArticle 10.-It shall take effect as of October 5,\n2010.\n\nIssued at the Presidency of the Republic.-San José,\nOctober fifth, two thousand ten." }
