General de la Administración Pública.\n\nConsiderando:\n\nI.-Que según la \"Perspectiva\nClimática 2010\",\nelaborada por el Departamento de Climatología e Investigaciones aplicadas del\nInstituto Meteorológico Nacional, como consecuencia del fenómeno de La Niña y\nel calentamiento record en el océano Atlántico, la perspectiva climática para\nel 2010, principalmente durante el segundo semestre, indica que se presentara\nuna temporada lluviosa muy intensa, comparable o quizá mayor a la del 2008.\nAdemás se registrarán intensas tormentas locales y fuertes temporales asociados\na bajas presiones y ciclones tropicales.\n\nII.-Que a la fecha, a raíz de\nesos fenómenos naturales, han resultado perjudicadas cientos de familias con la\npérdida de su vivienda, al tiempo que, de acuerdo con los pronósticos, existe\nel riesgo de que acaezcan nuevas situaciones de la naturaleza durante estos\núltimos meses del año que podrían generar pérdidas similares.\n\nIII.-Que las\ninstituciones estatales responsables de atender estas situaciones, responden\ncon medidas para la atención inmediata de las necesidades de las familias\nafectadas, el resguardo de su vida, el aprovisionamiento de bienes básicos como\nalimentos, enseres domésticos y subsidio para alquiler de vivienda. No\nobstante, el subsidio que se brinda para alquiler de vivienda, no es\npermanente, de manera que las familias, pese a encontrarse en una situación\nexcepcional, deben acudir a los mecanismos convencionales que se ofrecen para\nacceso a vivienda popular.\n\nIV.-Que se requiere impulsar\nmecanismos que brinden soluciones de vivienda permanente para aquellas familias\nque han perdido totalmente su vivienda, producto de un desastre.\n\nV.-Que es responsabilidad de las\ninstituciones del Estado realizar esfuerzos comunes para atender solidariamente\na aquellas familias que han perdido su vivienda. Considerando prioritaria la\natención de los más vulnerables, bajo preceptos de equidad y razonabilidad;\n\nVI.-Que es necesario identificar\nlos recursos financieros que permitan fondear los mecanismos y programas\nexistentes en el BANHVI y el IMAS con el fin de brindar soluciones expeditas de\nvivienda a las familias en situación de pobreza que, con ocasión de un desastre\nnatural, hayan perdido totalmente su vivienda. Por tanto,\n\nemite\nla siguiente directriz:\n\nDIRECTRIZ\nPARA LA DOTACIÓN DE FONDOS\n\nY\nACTIVACIÓN DE MECANISMOS PARA BRINDAR\n\nSOLUCIÓN\nPERMANENTE DE VIVIENDA\n\nA\nLAS FAMILIAS QUE PIERDAN\n\nCOMO\nCONSECUENCIA DE\n\nDESASTRES\nNATURALES\n\nArtículo 1º-Los jerarcas de ministerios e\ninstituciones del sector social, cuyo ámbito de competencia abarque la atención\nde personas o familias en situación de pobreza, deben analizar las metas del\naño 2010, el grado de cumplimiento esperado, así como la pertinencia y urgencia\nde las mismas, con el propósito de identificar recursos remanentes que puedan\ndestinarse a brindar soluciones de vivienda permanente a las familias en\nsituación de pobreza que, con ocasión de un desastre natural, hayan perdido\ntotalmente su vivienda.\n\nAdicionalmente, esta\nidentificación de recursos debe considerar prioritariamente las partidas y\nsubpartidas que no incidan en la prestación del servicio público, .ni afecten\nla ejecución de programas sociales de conformidad con las metas y resultados\nrespectivos.\n\nLa información sobre los recursos\nque se identifiquen deberá ser remitida a la Presidencia de la República a más\ntardar 8 días posteriores a la publicación de esta directriz, indicando todas\nlas condiciones que requiere cada institución para realizar los respectivos\ntraslados presupuestarios. Información a partir de la cual se emitirán nuevas\ndisposiciones para el efectivo traslado presupuestario con base en las\ncondiciones expuestas por las instituciones.\n\nArtículo 2º-La Comisión Nacional\nde Emergencias deberá levantar la lista de familias que requieren soluciones de\nvivienda como consecuencia del reciente desastre natural, la cual deberá poner\na disposición del BANVHI, el IMAS y el MIVAH en un plazo no mayor de 8 días\nposterior a la publicación de esta directriz.\n\nArtículo 3º-El Banco Hipotecario\npara la Vivienda y el Instituto Mixto de Ayuda Social, en coordinación con el\nMinisterio de Vivienda y Asentamientos Humanos, deben definir los mecanismos y\nprogramas que a lo interno de sus instituciones se reactivarán o implementarán\npara servir como receptores y ejecutores de los fondos que lleguen a\nidentificarse para la atención de las necesidades de vivienda de las familias\nafectadas por desastres naturales. Para esto deberán considerar que los\nafectados incluidos en la lista elaborada por la CNE serán\natendidos prioritariamente mediante los mecanismos y programas disponibles por\nel BANVHI, correspondiendo al IMAS la atención de aquellos casos que por\ndiversas razones no califiquen para las opciones ofrecidas por el BANVHI. Para\naquellos casos que no califiquen para ser atendidos por el IMAS o el BANVHI se\ndeberá considerar los mecanismos ofrecidos por el FONAVI para la obtención de\ncrédito bancario en condiciones favorables. In addition, intense local storms and strong storms associated with low-pressure systems and tropical cyclones will be recorded.\n\nII.-That to date, as a result of these natural phenomena, hundreds of families have been harmed by the loss of their home, while, according to the forecasts, there is a risk that new natural situations may occur during these last months of the year that could generate similar losses.\n\nIII.-That the state institutions responsible for addressing these situations respond with measures for the immediate attention of the needs of the affected families, the safeguarding of their lives, the provision of basic goods such as food, household items, and a subsidy for housing rental. However, the subsidy provided for housing rental is not permanent, so that families, despite being in an exceptional situation, must resort to the conventional mechanisms offered for access to low-income housing (vivienda popular).\n\nIV.-That it is necessary to promote mechanisms that provide permanent housing solutions for those families who have lost their home completely as a result of a disaster.\n\nV.-That it is the responsibility of State institutions to make common efforts to assist, in solidarity, those families who have lost their home. Considering the attention to the most vulnerable as a priority, under precepts of equity and reasonableness;\n\nVI.-That it is necessary to identify the financial resources that will allow the funding of the existing mechanisms and programs at BANHVI and IMAS in order to provide expedited housing solutions to families in a situation of poverty who, on the occasion of a natural disaster, have completely lost their home. Therefore,\n\nissues the following directive:\n\nDIRECTIVE FOR THE PROVISION OF FUNDS\n\nAND ACTIVATION OF MECHANISMS TO PROVIDE\n\nA PERMANENT HOUSING SOLUTION\n\nTO FAMILIES WHO LOSE THEIR HOME\n\nAS A CONSEQUENCE OF\n\nNATURAL DISASTERS\n\nArticle 1.-The heads of ministries and institutions of the social sector, whose scope of competence covers the attention of persons or families in a situation of poverty, must analyze the goals for the year 2010, the expected degree of compliance, as well as their relevance and urgency, for the purpose of identifying surplus resources that can be allocated to provide permanent housing solutions to families in a situation of poverty who, on the occasion of a natural disaster, have completely lost their home.\n\nAdditionally, this identification of resources must primarily consider budget lines (partidas) and sub-budget lines (subpartidas) that do not affect the provision of the public service, nor affect the execution of social programs in accordance with the respective goals and results.\n\nThe information on the resources that are identified must be sent to the Presidency of the Republic no later than 8 days after the publication of this directive, indicating all the conditions each institution requires to make the respective budget transfers. Based on this information, new provisions will be issued for the effective budget transfer based on the conditions set forth by the institutions.\n\nArticle 2.-The Comisión Nacional de Emergencias (CNE) must compile the list of families requiring housing solutions as a consequence of the recent natural disaster, which must be made available to BANHVI, IMAS, and MIVAH within a period of no more than 8 days after the publication of this directive.\n\nArticle 3.-The Banco Hipotecario para la Vivienda (BANHVI) and the Instituto Mixto de Ayuda Social (IMAS), in coordination with the Ministerio de Vivienda y Asentamientos Humanos (MIVAH), must define the mechanisms and programs that, internally within their institutions, will be reactivated or implemented to serve as recipients and executors of the funds that may be identified to address the housing needs of families affected by natural disasters. For this purpose, they must consider that the affected parties included on the list prepared by the CNE will be served primarily through the mechanisms and programs available through BANHVI, with IMAS being responsible for the attention of those cases that, for various reasons, do not qualify for the options offered by BANHVI. For those cases that do not qualify to be served by IMAS or BANHVI, the mechanisms offered by FONAVI for obtaining bank credit under favorable conditions must be considered. These institutions must be prepared to serve the affected families in an expedited manner at the time they receive the transfer of funds and the list of cases prepared by the CNE.\n\nArticle 4.-The mechanisms that are defined must consider the principles of simplification of procedures contained in Law 8220 and strict adherence to internal control standards, so that the procedure is effective and can be used without room for inconvenient delays or control failures that facilitate misuse and compromise the program's objectives.\n\nArticle 5.-The institutions affected by this directive must analyze the possibility of establishing permanent mechanisms and programs for the comprehensive care of families who, in the future, are affected by the loss of their home as a consequence of natural disasters.
