  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 36336\n\n                        Regula el horario de navegación de 6:00 a las 18:00 de las embarcaciones en\nlos Ríos y Canales navegables que desemboquen en el Río San Juan\n\nTexto Completo acta: D6B21\n\n    N° 36336-MSP-MOPT\n\nLA PRESIDENTA DE LA\nREPÚBLICA\n\nY LOS MINISTROS DE\nSEGURIDAD PÚBLICA\n\nY DE OBRAS PÚBLICAS Y\nTRANSPORTES\n\nEn uso de las facultades que les confieren los\nartículos 140, incisos 3), 6) y 18), 146 de la Constitución Política, 27, 28\ninciso 2b), de la Ley N° 6227, Ley General de la Administración Pública.\n\nConsiderando:\n\nI.-Que como consecuencia\nde la amenaza latente contra la integridad territorial, suscitada reciente en\nla zona norte de nuestro país, es necesario determinar un conjunto de acciones y\nmedidas preventivas con la finalidad de garantizar la seguridad ciudadana en\ndicha zona y la defensa del territorio nacional.\n\nII.-Que la seguridad de la\nnavegación en aguas de jurisdicción nacional es responsabilidad del Estado, que\na tal efecto tiene la obligación de dictar la regulación que corresponda para\nsatisfacer tal fin, pudiendo limitar o restringir, por razones de seguridad\npública, el tránsito o la permanencia de embarcaciones en determinadas zonas,\npuertos y canales de acceso o salida.\n\nIII.-Que la navegación de\nlas embarcaciones debe ajustarse a criterios esenciales de segundad con el fin\nde garantizar la salvaguarda de bienes jurídicos fundamentales como es el caso\nde la vida, integridad de las personas, así como su patrimonio.\n\nIV.-Que de conformidad con\nla Ley N° 4786, \"Reforma a la Ley de Creación del Ministerio de Transportes\",\nes responsabilidad del Ministerio de Obras Públicas y Transportes regular y\ncontrolar el transporte marítimo internacional, de cabotaje y por vías de\nnavegación interior. Asimismo, de conformidad con Ley N° 8000, \"Ley de Creación\ndel Servicio Nacional de Guardacostas\", es responsabilidad del Servicio\nNacional de Guardacostas vigilar y resguardar las aguas interiores navegables\ndel Estado, así como velar por la seguridad del tráfico portuario y marítimo\ntanto de naves nacionales como extranjeras en las aguas jurisdiccionales del\nEstado.\n\nV.-Que las medidas\nordenadoras de la navegación de embarcaciones que por este acto se establecen\nno infringen la libertad de tránsito ni la libertad de comercio, por cuanto no\nimpiden el uso generalizado de las rutas fluviales y lacustres por parte de las\nembarcaciones, sino que regulan la navegación en determinadas zonas, mediante\nun sistema de horarios, para los fines señalados en el considerando primero.\n\nVI.-Que los Ministerios de\nSeguridad Pública y de Obras Públicas y Transportes en uso de las potestades\nconferidas legalmente, consideran que la aplicación de las disposiciones\nrelacionadas con la restricción de la navegación en horarios nocturnos\nconstituye una medida justificada, proporcional y razonable. Likewise, in accordance with Law No. 8000, \"Ley de Creación del Servicio Nacional de Guardacostas\", it is the responsibility of the Servicio Nacional de Guardacostas to monitor and guard the navigable inland waters of the State, as well as to ensure the safety of port and maritime traffic for both national and foreign vessels in the jurisdictional waters of the State.\n\nV.-That the measures ordering the navigation of vessels established by this act do not infringe upon freedom of transit or freedom of commerce, since they do not impede the generalized use of fluvial and lacustrine routes by vessels, but rather regulate navigation in determined zones, by means of a system of schedules, for the purposes indicated in the first considerando.\n\nVI.-That the Ministries of Public Security and of Public Works and Transport, in use of the powers legally conferred, consider that the application of the provisions related to the restriction of navigation during nighttime hours constitutes a justified, proportional, and reasonable measure. The navigation of all types of vessels shall be only between 6:00 and 18:00 hours in the mouths of the rivers and navigable canals that flow into the Río San Juan, among them, the Sarapiquí, San Carlos, and the Infiernito, and in the Río Colorado.\n\nArticle 2°-Exceptions. The regulation shall not apply to the vessels of the institutions and dependencies of the State, those belonging to the Fire Department, nor the Red Cross, nor to vessels transporting persons with a medical emergency.\n\nArticle 3°-Sanciones.
