José Luis Hernández Vega, Gerente de la Cooperativa de Insumos\nPesqueros Artesanales de Puntarenas R.L., solicita a la Junta Directiva del\nINCOPESCA la revisión del costo administrativo (costo operativo) que cobra la\ninstitución en la Terminal Pesquera, principalmente en el caso de las\nembarcaciones de pesca comercial que utilizan la pantalla para abastecerse de\nhielo y diesel.\n\n2º-Que mediante\noficio CT-008-2010, la Comisión de Tarifas presenta a Junta Directiva una\npropuesta de tarifa para los usuarios de Coopeinpesa R.L., con el fin de poner\na su disposición las instalaciones de la Terminal Pesquera con todas las\nmejoras exigidas por SENASA en materia de inocuidad y trazabilidad de los\nproductos hidrobiológicos.\n\n3º-Que en el acuerdo\nAJDIP/293-2009 referente a las tarifas del periodo 2010, se omitió establecer\nuna tarifa específica por concepto de \"utilización de muelle para embarcaciones\nde pesca comercial de bandera extranjera\". \n\n4º-Que en el acuerdo\nmencionado, no se consideró una tarifa por concepto de utilización del muelle\npara embarcaciones que eventualmente puedan llegar a nuestro país para realizar\nactividades científicas, de fomento, de investigación o con fines didácticos.\nDe igual manera, no se contempló una tarifa por concepto de utilización del\nmuelle para embarcaciones que eventualmente requieran utilizar la pantalla de\nla Terminal Pesquera para poder realizar otras actividades diferentes a la\ndescarga de productos pesqueros o avituallamiento.\n\n5º-Que es necesario que las personas que ejecutan pesca deportiva, puedan adquirir el respectivo\ncarne y siendo que algunas organizaciones deportivas han manifestado la dificultad de cancelar la\nsuma que como monto único anual a la fecha esta establecida, han solicitado a la Junta Directiva del\nINCOPESCA, la posibilidad de que el cobro del carne sea diferenciado por su tiempo de vigencia.  Que\nsobre este tema mediante Oficio CT-009-2010 la Comision de Tarifas presentó la propuesta a la Junta\nDirectiva.\n\n6º-Que debido a la\nnecesidad de incluir algunas tarifas adicionales así como modificar otras, por\nservicios que brinda la institución, se considera necesario contemplarlas para\nel periodo 2010. Por tanto,  \n\nACUERDAN:\n\n1º-Aprobar las\nsiguientes tarifas y su incorporación y vigencia al acuerdo AJDIP/293-2009,\nreferente a las tarifas del período 2010:\n\nEstadía de\nembarcaciones de pesca comercial nacional, no turística ni deportiva para\navituallamiento (hielo y diesel en Coopeinpesa R. L.) (¢30.00 * metro eslora *\nhora o fracción) + ¢2550,00. Coopeinpesa R. Entiéndase por jornada ordinaria de lunes a viernes, de las\n8:00 a.m. a las 4:00 p.m., excepto días feriados y asuetos.\n\n4º-En relación con la\nestadía de las embarcaciones con fines científicos, de investigación,\ndidácticos y de fomento, mediante acuerdo razonado y justificado, la Junta\nDirectiva podrá eximir de este cobro, en aquellos casos en que exista un fin de\nbeneficio público al país o a la institución y se suscriba un Convenio o\nacuerdo al efecto.\n\n5º-En el caso de la\nestadía de las embarcaciones nacionales o extranjeras para fines distintos a la\ndescarga de productos pesqueros o avituallamiento las embarcaciones, previo a\nla autorización correspondiente, la institución debe valorar la naturaleza propia\ndel tipo de actividades que se requieren realizar, a fin de determinar posibles\nefectos negativos sobre los ecosistemas o sobre la actividad de descarga de\nproductos hidrobiológicos que se realicen o se vayan a realizar en el área\ndestinada para ese propósito, de manera que se asegure la inocuidad y la\nprioridad de descarga para fines pesqueros.\n\n6º-Los carné para\npesca deportiva o turística de un mes serán vendidos únicamente para uso de los\nturistas nacionales, residentes o extranjeros. José Luis Hernández Vega, Manager of the Cooperative of Artisanal Fisheries\nSupplies of Puntarenas R.L., he requests the Board of Directors of\nINCOPESCA to review the administrative cost (operating cost) that the\ninstitution charges at the Fishing Terminal, mainly in the case of\ncommercial fishing vessels that use the screened area to stock up on\nice and diesel.\n\n2º-That by means of\nofficial letter CT-008-2010, the Tariff Commission presents to the Board of Directors a\nproposed tariff for the users of Coopeinpesa R.L., with the purpose of making\nthe Fishing Terminal facilities available to them with all the\nimprovements required by SENASA regarding the safety and traceability of\nhydrobiological products.\n\n3º-That in agreement\nAJDIP/293-2009 concerning the tariffs for the 2010 period, a specific tariff was omitted for the concept\nof \"wharf usage for foreign-flag commercial fishing vessels.\"\n\n4º-That in the mentioned\nagreement, a tariff was not considered for the concept of wharf usage\nfor vessels that may eventually arrive in our country to carry out\nscientific, stock enhancement, research, or educational activities.\nSimilarly, a tariff was not contemplated for the concept of wharf\nusage for vessels that may eventually need to use the screened area of\nthe Fishing Terminal to carry out activities other than the\nunloading of fishery products or victualling.\n\n5º-That it is necessary that persons who engage in sport fishing be able to obtain the respective\nlicense, and given that some sport organizations have expressed difficulty in paying the\ntotal amount established as a single annual fee to date, they have requested the Board of Directors\nof INCOPESCA the possibility that the license fee be differentiated by its term of validity. That\non this matter, by means of Official Letter CT-009-2010, the Tariff Commission presented the proposal to the Board\nof Directors.\n\n6º-That due to the\nneed to include some additional tariffs as well as modify others, for\nservices provided by the institution, it is deemed necessary to contemplate them for\nthe 2010 period. L.) (¢30.00 * meter of length overall *\nhour or fraction thereof) + ¢2,550.00. Coopeinpesa R. L.)\n\nStay and unloading of\nforeign commercial fishing vessels ($0.30 * meter of length overall * foreign\nhour or fraction thereof) + ¢5,100.00.\n\nStay of a vessel\nfor scientific, research, educational, and stock enhancement purposes ¢180.00.\n\nStay of a national\nor foreign vessel for purposes other than the unloading of fishery products\nor victualling ¢180.00\n\nNational, Resident,\nor Foreign License for those practicing inland or marine fishing from a\nvessel (one calendar month) $11.50\n\n2º-For those services provided at the Fishing\nTerminal that are subject to the length of stay of\nvessels or vehicles, the term fraction will be applied as follows: a) In those cases where the\nlength of stay of the vessel or vehicle is less than or equal to thirty\nminutes (30 min or less), the equivalent of 30 minutes will be charged. b) In\nthose cases where the length of stay of the vessel or vehicle is\ngreater than thirty minutes or equal to 60 minutes (31 min or 60 min), the\nequivalent of 1 hour will be charged. c) For stays greater than one hour and a fraction, the\nconcepts indicated in points a) and b) above will be applied.\n\n3º-In the case of\nunloading carried out at the wharf of the Multiservice Fishing Terminal\nin Barrio El Carmen, Puntarenas, the institution will not charge for the inspection\ncarried out during ordinary working hours to national-flag commercial fishing vessels\nthat are neither tourism nor sport vessels; however, this does not apply to the case of\nforeign-flag commercial fishing vessels that are not tourism vessels, from which\nthe inspection must be charged, whether during ordinary or extraordinary working hours. Ordinary working hours are understood to be\nMonday through Friday, from 8:00 a.m. to 4:00 p.m., except on public holidays and days off.\n\n4º-In relation to the\nstay of vessels for scientific, research,\neducational, and stock enhancement purposes, by means of a reasoned and justified resolution, the Board\nof Directors may exempt such\nvessels from this charge, in those cases where the purpose involves a public benefit\nto the country or the institution and a Cooperation Agreement or accord is signed for that purpose.\n\n5º-In the case of the\nstay of national or foreign vessels for purposes other than the\nunloading of fishery products or victualling, prior\nto the corresponding authorization, the institution must assess the specific nature\nof the type of activities required to be carried out, in order to determine possible\nnegative effects on the ecosystems or on the activity of unloading\nhydrobiological products that is being or will be carried out in the area\ndesignated for that purpose, so as to ensure the safety and the\npriority of unloading for fishery purposes.\n\n6º-One-month sport or\ntourism fishing licenses will be sold solely for the use of\nnational, resident, or foreign tourists. Interested parties, tour\noperating companies, or associations may acquire, in a planned manner in advance,\nthe quantity of licenses they deem appropriate to keep available for their\nclients, and on the understanding that INCOPESCA will issue such licenses with an issue\ndate on the day they are acquired and an expiration date one calendar month later.\nOnce the expiration period has elapsed without the licenses having been used\nby the users, they will expire automatically without the possibility of being\nrevalidated, nor will any reimbursement of the amounts paid proceed.\n\nFirm agreement.
