En el Litoral Atlántico, serán\ncatalogadas como flota artesanal pequeña escala, las conocidas como botes, es decir,\naquellas construidas de una sola pieza y con motor fuera de borda.\n\n        3. Los carné para pesca deportiva o\nturística de un mes serán vendidos únicamente para uso de los turistas\nnacionales, residentes o extranjeros. Los interesados, las empresas operadoras\nde tours o las asociaciones, podrán adquirir de manera previa y planificada, la\ncantidad de carné que consideren conveniente mantener a disposición de sus\nclientes y en el entendido de que dichos carné INCOPESCA los otorgará con fecha\nde emisión al día en que son adquiridos y con fecha de vencimiento a un mes\ncalendario. Cumplido el plazo de vencimiento sin que hubiesen sido utilizados\npor los usuarios, estos caducarán de pleno derecho sin que puedan ser\nrevalidados, ni procederá reintegro alguno de los montos pagados.\n\n            4. En cuanto a los carné para\ncapitanes y tripulantes nacionales o extranjeros de embarcaciones de pesca\ndeportiva o turística o de observación de cetáceos, estos serán anuales. Para\nsu otorgamiento deberán presentar copia del documento de identificación y una\nfotografía tamaño pasaporte. Los turistas nacionales, residentes o extranjeros,\nque deseen adquirir un carné anual, deberán presentar copia del documento de\nidentificación y una fotografía tamaño pasaporte para su emisión.\n\n            5. Para las inspecciones la tarifa\nordinaria corresponde a las realizadas dentro del horario ordinario de trabajo\ndel Instituto, sea de las 8:00 a. m. a las 4:00 p. m. La tarifa extraordinaria\ncorresponde a las inspecciones realizadas de 4:01 p. m. a 7:59 a. m. así como\nlas efectuadas en días feriados, sábados, domingos o asuetos. \n\n            6. En el caso de las descargas que\nse realicen en el muelle de la Terminal Multiservicios Pesqueros del Barrio El\nCarmen, Puntarenas, la institución no cobrará por la inspección que se efectúe\ndurante la jornada ordinaria, a las embarcaciones de pesca comercial de bandera\nnacional no turística ni deportiva, no así en el caso de las embarcaciones de\npesca comercial de bandera extranjera no turística a las que sí se les deberá\ncobrar la inspección, sea en jornada ordinaria o extraordinaria. Entiéndase por\njornada ordinaria de lunes a viernes, de las 8:00 a. m. a las 4:00 p. m.,\nexcepto días feriados y asuetos.\n\n            7. En relación con la estadía de las\nembarcaciones con fines científicos, de investigación, didácticos y de fomento,\nmediante acuerdo razonado y justificado, la Junta Directiva podrá eximir de\neste cobro, en aquellos casos en que exista un fin de beneficio público al país\no a la institución y se suscriba un Convenio o acuerdo al efecto.\n\n            8. En el caso de la estadía de las\nembarcaciones nacionales o extranjeras para fines distintos a la descarga de\nproductos pesqueros o avituallamiento las embarcaciones, previo a la\nautorización correspondiente, la institución debe valorar la naturaleza propia\ndel tipo de actividades que se requieren realizar, a fin de determinar posibles\nefectos negativos sobre los ecosistemas o sobre la actividad de descarga de\nproductos hidrobiológicos que se realicen o se vayan a realizar en el área\ndestinada para ese propósito, de manera que se asegure la inocuidad y la\nprioridad de descarga para fines pesqueros.\n\n            9. Toda inspección deberá ser\ncancelada previamente o a más tardar el día hábil siguiente a que es realizada\npor los funcionarios del Instituto, sea mediante depósito bancario o\ntransferencia electrónica a una de las cuentas bancarias de INCOPESCA o\nmediante el pago directo en una de las oficinas del instituto. Si el pago se\nrealiza por depósito o transferencia, el usuario deberá entregar copia del\nrespectivo comprobante bancario a la oficina más cercana. La institución no\nestá autorizada para conceder crédito por este servicio, por lo tanto, al\nusuario que no atienda la disposición establecida se le suspenderán todos los\nservicios que brinda el INCOPESCA y deberá pagar intereses diarios a la tasa\nbásica pasiva establecida por el Banco Central.\n\n            10. El usuario del servicio de agua,\nservicio de estadía y muellaje y suministro de electricidad con generador,\ncancelarán los servicios recibidos antes de desatracar la embarcación o a más\ntardar 30 días naturales posteriores a recibir los servicios, siempre y cuando\ncuente con crédito autorizado previamente por el INCOPESCA. En caso de no\ncontar con crédito, deberá pagar los servicios antes de desatracar la embarcación.\n\n            11. Los vehículos que ingresen a\ncargar y descargar productos cancelarán las horas de permanencia antes de salir\ndel área delimitada de muelle.\n\n            12. En aquellos servicios que se\nbrindan en la Terminal Pesquera y que están supeditados a los tiempos de permanencia\nde las embarcaciones o los vehículos, se aplicará el término fracción de la\nsiguiente manera: a) Cuando el tiempo de permanencia de la embarcación o\nvehículo es igual o menor a treinta minutos (30 min o menos), se cobrará el\nequivalente a 30 minutos. b) Si el tiempo de permanencia de la embarcación o\nvehículo es mayor a treinta minutos o igual a 60 minutos (31 min o 60 min), se\ncobrará el equivalente a 1 hora. c) Para permanencias mayores a una hora y\nfracción, se aplicarán los conceptos indicados en los puntos a) y b)\nanteriores.\n\n            13. El dinero recaudado por las\ntarifas cobradas será depositado e ingresado en las cuentas bancarias que el\nINCOPESCA tenga en los bancos del Sistema Bancario Nacional.\n\n            14. On the Atlantic Coast, those known as botes (boats), that is,\nthose built from a single piece and with an outboard motor, shall be classified as small-scale artisanal fleet.\n\n 3. One-month sport or tourist fishing cards will be sold solely for use by national,\nresident, or foreign tourists. Interested parties, tour operator companies,\nor associations may acquire in advance and in a planned manner the\nnumber of cards they deem convenient to keep available for their\nclients, on the understanding that INCOPESCA will issue said cards with the\nissuance date as the day they are acquired and with an expiration date of one calendar\nmonth. Once the expiration period has elapsed without them having been used\nby users, they shall expire as a matter of right without being able to be\nrevalidated, nor shall any refund of the amounts paid be applicable.\n\n 4. Regarding the cards for national or foreign captains and crewmembers of sport\nor tourist fishing vessels or cetacean watching vessels, these shall be annual. For\ntheir issuance, a copy of the identification document and a\npassport-size photograph must be presented. National, resident, or foreign tourists\nwho wish to acquire an annual card must present a copy of the identification\ndocument and a passport-size photograph for its issuance.\n\n 5. For inspections, the ordinary tariff corresponds to those carried out within the ordinary working hours of the Institute,\nthat is, from 8:00 a. m. to 4:00 p. m. The extraordinary tariff\ncorresponds to inspections carried out from 4:01 p. m. to 7:59 a. m., as well as\nthose carried out on public holidays, Saturdays, Sundays, or official days off.\n\n 6. In the case of unloadings carried out at the pier of the Multi-Service Fishing Terminal in Barrio El\nCarmen, Puntarenas, the institution will not charge for the inspection carried out\nduring the ordinary workday for national-flagged commercial fishing vessels that are non-tourist and non-sport, but this is not the case for foreign-flagged commercial fishing vessels that are non-tourist, for which the inspection must be charged, whether during ordinary or extraordinary workday. Ordinary workday is understood as Monday through Friday, from 8:00 a. m. to 4:00 p. m.,\nexcept on public holidays and official days off.\n\n 7. In relation to the berthing of vessels for scientific, research, didactic, and foster purposes,\nthrough a reasoned and justified agreement, the Board of Directors may exempt\nthis charge in those cases where there is a purpose of public benefit to the country\nor to the institution, and an Agreement or accord is signed to that effect.\n\n 8. In the case of the berthing of national or foreign vessels for\npurposes other than the unloading of fishery products or provisioning, the vessels,\nprior to the corresponding authorization, the institution must assess the very nature\nof the type of activities required to be carried out, to determine possible\nnegative effects on ecosystems or on the activity of unloading\nhydrobiological products that are being carried out or are to be carried out in the\narea designated for that purpose, so as to ensure safety and the\npriority of unloading for fishing purposes.\n\n 9. Every inspection must be paid for in advance or at the latest on the\nnext business day after it is carried out by the officials of the Institute, whether by bank deposit or\nelectronic transfer to one of INCOPESCA's bank accounts, or\nby direct payment at one of the institute's offices. If the payment is\nmade by deposit or transfer, the user must deliver a copy of the\nrespective bank receipt to the nearest office. The institution is not\nauthorized to grant credit for this service, therefore, for the\nuser who does not comply with the established provision, all\nservices provided by INCOPESCA shall be suspended, and they must pay daily interest at the basic\npassive rate established by the Central Bank.\n\n 10. The user of the water service,\nberthing and pierage service, and electricity supply via generator,\nshall pay for the services received before the vessel undocks or at the\nlatest 30 calendar days after receiving the services, provided they\nhave credit previously authorized by INCOPESCA. In case of not\nhaving credit, they must pay for the services before the vessel undocks.\n\n 11. Vehicles entering to load and unload products shall pay for the hours of stay before leaving\nthe delimited pier area.\n\n 12. In those services provided at the Fishing Terminal and that are subject to the\nstay times of vessels or vehicles, the term fraction thereof shall be applied as\nfollows: a) When the stay time of the vessel or\nvehicle is equal to or less than thirty minutes (30 min or less), the equivalent of 30 minutes shall be charged. b) If the stay time of the vessel or\nvehicle is greater than thirty minutes or equal to 60 minutes (31 min or 60 min), the equivalent of 1 hour shall be charged. c) For stays greater than one hour and a fraction thereof, the concepts indicated in points a) and b)\nabove shall be applied.\n\n 13. The money collected from the charged tariffs shall be deposited and entered into the bank accounts that\nINCOPESCA has in the banks of the National Banking System.\n\n 14. The established tariffs shall be subject to review and adjustment when applicable, by\nINCOPESCA. Licenses that are not paid in the corresponding period\nmust be paid at the tariff in effect at the time of carrying out the application with the institution.\n\n Article 2º-The indicated tariffs are approved for their publication and, whereas this agreement\nintegrates in a comprehensive manner the tariffs for goods and services provided by\nINCOPESCA and that shall govern for 2011, agreement AJDIP/307-2010 and its modifications are repealed and rendered without effect.\n\n Firm Agreement.\nPublish.
