  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 36353\n\n                        Modificación del artículo 39 del Reglamento a la Ley Forestal N° 7575,\nDecreto Ejecutivo N° 25721- MINAE del 17 de octubre de 1996 y sus reformas\n\nTexto Completo acta: D6E3D\n\nN° 36353-MINAET\n\nLA\nPRESIDENTA DE LA REPÚBLICA\n\nY EL\nMINISTRO DE AMBIENTE, ENERGÍA\n\nY\nTELECOMUNICACIONES\n\nEn ejercicio de las\nfacultades que les confiere los artículos 140, incisos 3) y 18) y 146 de la\nConstitución Política; la Ley General de la Administración Pública N° 6227 del\n2 de mayo de 1978, la Ley Forestal N° 7575 del 13 de febrero de 1996 y el\nReglamento a la Ley Forestal Nº 7575, Decreto Ejecutivo N° 25721-MINAE del 17\nde octubre de 1996 y sus reformas.\n\nConsiderando:\n\n1º-Que el Programa de Pago de Servicios Ambientales\n(PSA) cuenta con más de doce años de ejecución, con la participación del Fondo Nacional\nde Financiamiento Forestal (FONAFIFO), lo que se hace necesario ajustar algunos\nde sus procedimientos a los cambios y variantes surgidas en el tiempo, de\nmanera tal, que se logre un esquema con procesos más ágiles, claros y dinámicos\nque habrán de constituir el primer paso para un sistema digital, que brinde a\nlos usuarios mayor claridad y simplicidad en los procesos que debe cumplir.\n\n2º-Que para lograr\ntales cambios, se requiere de una modificación al artículo 39 del Reglamento a\nla Ley Forestal Decreto Ejecutivo Número 25721-MINAE del 17 de octubre de 1996,\ncon el fin de procurar mayor seguridad jurídica, tanto a los beneficiarios del\nPrograma PSA como al Estado, por cuanto se pretende implementar un sistema más\nágil y eficiente, el cual consiste en un mecanismo automatizado de solicitud de\ncitas, de forma que se distribuya la atención del usuario mediante una\nprogramación de todas las actividades o acciones requeridas durante todo el\nproceso de incorporación de un inmueble al Programa de Pago de Servicios\nAmbientales.\n\n3º-Que la Defensoría\nde los Habitantes ha recomendado a la Junta Directiva del FONAFIFO un\nprocedimiento más claro de recepción y trámite de solicitudes de ingreso al\nPrograma de Pago de Servicios Ambientales, eliminando con ello algunos procesos\npoco claros y contradictorios. No se recibirán solicitudes remitidas vía fax,\npor correo electrónico, ni por correo certificado o que se pretenda presentar\nsin la respectiva cita, fuera de la fecha y hora asignada en ella, o en otra\nOficina Regional de FONAFIFO que no sea la indicada en la cita.\n\nc) De los requisitos que debe cumplir la\nsolicitud.\n\ni.  Las solicitudes de ingreso al Programa de Pago\nde Servicios Ambientales (PSA) deberán contener, bajo pena de no ser recibidas,\nlos siguientes requisitos de información: a) Nombre, calidades completas y\ndomicilio del o la solicitante, b) Número de cédula o documento oficial de\nidentificación, c) Si se tratara de una persona jurídica deberá indicarse el\nnombre completo, calidades, número de cédula de identidad o documento oficial\nde identificación y domicilio de su representante legal, d) Número de matrícula\nde Folio Real o citas de inscripción del inmueble que se pretende ingresar al\nPrograma PSA. d) Número de Plano Catastrado del inmueble objeto de la\nsolicitud, e) La pretensión de la solicitud, que deberá incluir el área o\nárboles a someter, la modalidad y la indicación de si se trata de un inmueble\nsin inscribir, f) Indicar si se trata de un proyecto de reforestación por\nadelantado, g) Lugar para recibir notificaciones. Si se tratara de un domicilio\nu oficina, éste deberá ubicarse dentro de un radio de dos kilómetros de la\nOficina Regional de FONAFIFO, respectiva.\n\nii.  Las solicitudes deberán presentarse\ndebidamente firmadas por el propietario o propietaria, poseedor o poseedora,\narrendatario o arrendataria (o) sus apoderados.\n\niii. Adicionalmente, a la solicitud deberá adjuntarse\nlos siguientes documentos: a) Fotocopia legible en hoja completa de la cédula\nde identidad vigente del o la solicitante u otro documento oficial de\nidentidad, b) Copia visible en hoja completa por ambos lados del plano  catastrado \ndel  inmueble  que \nse  pretende ingresar con su\nubicación en la hoja cartográfica, escala 1:50 000.\n\niv. Las Oficinas Regionales de FONAFIFO no\nrecibirán solicitudes incompletas o que no cumplan con los requisitos de\nadmisión establecidos en el presente artículo y/o en el Manual de\nProcedimientos para el Pago de Servicios Ambientales.\n\nd) De los trámites y plazos de valoración de las solicitudes.\n\ni.  Recibidas las presolicitudes por parte de las\nOficinas  Regionales de FONAFIFO, se procederá\na la digitalización y ubicación de los planos en el Sistema de Información\nGeográfica. Si se determina la existencia de algún traslape con cualquier otro\nplano, u otro inconveniente, el Jefe Regional por medio de un oficio,\nnotificará a los interesados para que aclaren la información aportada en un\nplazo no mayor a diez días hábiles.\n\nii.  Si vencido el plazo otorgado no se presentan\nlas correcciones y/o aclaraciones, o se presentan nuevamente incorrectas, el\nJefe Regional procederá al archivo de la solicitud.\n\niii. Las Oficinas Regionales de FONAFIFO disponen de\nhasta sesenta días naturales para la valoración de las solicitudes de acuerdo a\nuna matriz de calificación que se establecerá en el Manual de Procedimientos\npara el Pago de Servicios Ambientales, la cual incorpora las prioridades a que\nse refiere el artículo 38 del Reglamento a la Ley Forestal.\n\niv. Terminada la etapa de calificación, indicada en\nel punto anterior, las Oficinas Regionales de FONAFIFO remitirán las\nsolicitudes a la Dirección Jurídica de FONAFIFO, en estricto orden de\ncalificación o puntuación. Solamente en caso de que la calificación de las\nsolicitudes refleje un empate entre dos o más de ellas, se remitirán a la\nDirección Jurídica de acuerdo al principio de primero en tiempo primero en\nderecho.\n\nv.  La Dirección Jurídica de FONAFIFO dispondrá de\nhasta treinta días naturales para la valoración de cada solicitud. Si se\ndetermina que la misma no cumple con los requisitos o condiciones legales\nestablecidas al efecto, la Dirección Jurídica emitirá un documento con los\nrequisitos faltantes y lo remitirá junto con los antecedentes a la Oficina\nRegional de FONAFIFO la cual concederá a el o la solicitante un plazo de hasta\n20 días hábiles para corregir y /o completar los requisitos legales. Si vencido\nel plazo otorgado, el o la solicitante no han cumplido en su totalidad con lo\nprevenido, o se presenta se debe emitir el auto o resolución de archivo\ndebidamente firmada por el Jefe Regional.\n\nvi. Si las solicitudes cumplen con los requisitos y\ncondiciones legales y técnicas se comunicará al solicitante por resolución\nfirmada por el jefe Regional o por el Director Ejecutivo de FONAFIFO que su\nsolicitud fue aprobada y que puede proceder a elaborar el estudio técnico,\nsegún los procedimientos establecidos en el Manual de Procedimientos para el\nPago de Servicios Ambientales.\n\nvii. Concluido todo el proceso de aprobación de\nsolicitudes, las Oficinas Regionales de FONAFIFO, mediante resolución razonada firmada\npor el Jefe Regional, procederán al archivo de todas aquellas solicitudes que\npor falta de recursos económicos, no fueron tramitadas y/o no aprobadas en ese\nperíodo\n\nTransitorio.-Las\nsolicitudes que por falta de fínanciamiento no fueron tramitadas durante el\nperíodo 2010, podrán ser retomadas en el período 2011, siempre y cuando los\ninmuebles se encuentren dentro de la prioridades fijadas por el Estado y la\nsolicitud de reactivación sea presentada dentro del período de recepción de\nsolicitudes, según el procedimiento de cita establecido en el artículo 39\nanterior.\n\nArtículo 2º-Rige a\npartir de su publicación.\n\nDado en la Presidencia de la República.-San José, a\nlos veintidós días del mes de noviembre del dos mil diez.",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 36353\n\n                        Amendment of Article 39 of the Regulations to Forestry Law No. 7575,\nExecutive Decree No. 25721-MINAE of October 17, 1996, and its amendments\n\nComplete Text record: D6E3D\n\nNo. 36353-MINAET\n\nTHE\nPRESIDENT OF THE REPUBLIC\n\nAND THE\nMINISTER OF ENVIRONMENT, ENERGY,\n\nAND\nTELECOMMUNICATIONS\n\nIn exercise of the\npowers conferred by Articles 140, subsections 3) and 18), and 146 of the\nPolitical Constitution; the General Law of Public Administration No. 6227 of\nMay 2, 1978, Forestry Law No. 7575 of February 13, 1996, and the Regulations\nto Forestry Law No. 7575, Executive Decree No. 25721-MINAE of October 17, 1996,\nand its amendments.\n\nConsidering:\n\n1°-That the Payment for Environmental Services Program (Programa de Pago de Servicios Ambientales, PSA) has been in execution for more than twelve years, with the participation of the National Forestry Financing Fund (Fondo Nacional de Financiamiento Forestal, FONAFIFO), making it necessary to adjust some of its procedures to the changes and variants that have arisen over time, in such a way that a scheme with more agile, clear, and dynamic processes is achieved, which will constitute the first step toward a digital system that provides users with greater clarity and simplicity in the processes they must complete.\n\n2°-That to achieve\nsuch changes, an amendment to Article 39 of the Regulations to the Forestry Law, Executive Decree Number 25721-MINAE of October 17, 1996, is required, in order to provide greater legal certainty, both to the beneficiaries of the PSA Program and to the State, as it is intended to implement a more agile and efficient system, which consists of an automated mechanism for requesting appointments, so that user service is distributed through a scheduling of all activities or actions required during the entire process of incorporating a property into the Payment for Environmental Services Program.\n\n3°-That the Office of the Ombudsperson (Defensoría de los Habitantes) has recommended to the Board of Directors of FONAFIFO a clearer procedure for receiving and processing applications for entry into the Payment for Environmental Services Program, thereby eliminating some unclear and contradictory processes. Therefore,\n\nThey Decree:\n\n\"Amendment\nof Article 39 of the Regulations\n\nto Forestry Law No. 7575, Executive Decree\n\nNo. 25721-MINAE of October 17,\n\nof 1996\nand its amendments\"\n\nArticle\n1°-Article 39 of the Regulations to the Forestry Law, Executive Decree Number 25721-MINAE and its amendments, is hereby amended to read as follows:\n\n\"Article 39.\n\nThe National Forestry Financing Fund (FONAFIFO) is authorized to issue the Manuals and/or Procedures necessary for the execution of the Payment for Environmental Services Program (PSA), which must conform, among others, to the following provisions:\n\na) Regarding applications for entry into the Payment for Environmental Services Program (PSA).\n\ni)  The National Forestry Financing Fund shall establish a period for natural and legal persons to submit applications for the entry of their properties into the Payment for Environmental Services Program (PSA).\n\nii)  Exceptionally, and by means of a reasoned agreement issued by the Board of Directors of the National Forestry Financing Fund, an extraordinary period for receiving applications may be opened when the number of applications submitted is less than the area allocated according to the respective budget.\n\niii) The determination of the period for receiving applications shall be published in the Official Gazette La Gaceta and in at least one nationally circulated newspaper.\n\nb) Regarding the Procedure for receiving applications.\n\ni.  Those interested in entering the Payment for Environmental Services Program (PSA) must request an appointment for the submission of their applications.\n\nii.  Appointments shall be requested during the period authorized by FONAFIFO, whether by telephone, through the FONAFIFO website, or by the applicant appearing in person at the Regional Office of FONAFIFO, where they will be assisted in obtaining the appointment through the indicated means.\n\niii. At the date and time of the assigned appointment, the applicant or their representative must appear in person at the respective Regional Office of FONAFIFO to submit their application.\n\niv. The responsible official shall verify that the application meets the requirements established in this article and in the Procedures Manual for the Payment for Environmental Services published in the Official Gazette La Gaceta No. 46 of March 6, 2009, and its amendments, in which case they shall print on the application the number assigned to it, and the date and time of its submission.\n\nv.  The Regional Offices of FONAFIFO shall not receive applications that do not meet the requirements established in this article or in the Procedures Manual for the Payment for Environmental Services.\n\nvi. Applications sent via fax, by electronic mail, or by certified mail, or that are intended to be submitted without the respective appointment, outside the date and time assigned therein, or at a Regional Office of FONAFIFO other than that indicated in the appointment, shall not be received.\n\nc) Regarding the requirements that the application must meet.\n\ni.  Applications for entry into the Payment for Environmental Services Program (PSA) must contain, under penalty of not being received, the following information requirements: a) Name, full identifying details, and domicile of the applicant, b) Identification card number or official identification document, c) If it involves a legal entity, the full name, identifying details, identification card number or official identification document, and domicile of its legal representative must be indicated, d) Folio Real registration number or registration citations of the property intended to be entered into the PSA Program. d) Cadastral Map number of the property subject to the application, e) The purpose of the application, which must include the area or trees to be submitted, the modality, and an indication of whether it involves an unregistered property, f) Indicate if it involves an advance reforestation project, g) Place to receive notifications. If it involves a domicile or office, it must be located within a radius of two kilometers from the respective Regional Office of FONAFIFO.\n\nii.  Applications must be submitted duly signed by the owner, possessor, lessee, or their authorized representatives.\n\niii. Additionally, the following documents must be attached to the application: a) A legible, full-page photocopy of the applicant's valid identification card or other official identification document, b) A visible copy, on a full page, of both sides of the cadastral map of the property intended to be entered, with its location on the cartographic sheet, scale 1:50,000.\n\niv. The Regional Offices of FONAFIFO shall not receive incomplete applications or those that do not meet the admissibility requirements established in this article and/or in the Procedures Manual for the Payment for Environmental Services.\n\nd) Regarding the procedures and deadlines for the evaluation of applications.\n\ni.  Once the pre-applications are received by the Regional Offices of FONAFIFO, the digitization and location of the maps in the Geographic Information System shall proceed. If the existence of any overlap with any other map, or any other drawback, is determined, the Regional Head, by means of an official communication, shall notify the interested parties so that they may clarify the information provided within a period not exceeding ten business days.\n\nii.  If, upon expiration of the granted period, the corrections and/or clarifications are not submitted, or are submitted incorrectly again, the Regional Head shall proceed with the archiving of the application.\n\niii. The Regional Offices of FONAFIFO have up to sixty calendar days for the evaluation of applications according to a scoring matrix to be established in the Procedures Manual for the Payment for Environmental Services, which incorporates the priorities referred to in Article 38 of the Regulations to the Forestry Law.\n\niv. Once the qualification stage, indicated in the preceding point, is completed, the Regional Offices of FONAFIFO shall send the applications to the Legal Directorate of FONAFIFO, in strict order of qualification or score. Only in the event that the qualification of the applications reflects a tie between two or more of them, they shall be sent to the Legal Directorate according to the principle of first in time, first in right.\n\nv.  The Legal Directorate of FONAFIFO shall have up to thirty calendar days for the evaluation of each application. If it is determined that it does not meet the requirements or legal conditions established for that purpose, the Legal Directorate shall issue a document listing the missing requirements and shall send it, along with the background information, to the Regional Office of FONAFIFO, which shall grant the applicant a period of up to 20 business days to correct and/or complete the legal requirements. If, upon expiration of the granted period, the applicant has not fully complied with what was prescribed, or if the response is submitted incomplete, the archiving order or resolution must be issued, duly signed by the Regional Head.\n\nvi. If the applications meet the legal and technical requirements and conditions, the applicant shall be notified by a resolution signed by the Regional Head or by the Executive Director of FONAFIFO that their application was approved and that they may proceed to prepare the technical study, according to the procedures established in the Procedures Manual for the Payment for Environmental Services.\n\nvii. Once the entire application approval process is concluded, the Regional Offices of FONAFIFO, by means of a reasoned resolution signed by the Regional Head, shall proceed with the archiving of all those applications that, due to a lack of economic resources, were not processed and/or not approved in that period.\n\nTransitional Provision.-Applications that, due to a lack of financing, were not processed during the 2010 period, may be reconsidered in the 2011 period, provided that the properties are within the priorities set by the State and the reactivation application is submitted within the application reception period, according to the appointment procedure established in the preceding Article 39.\n\nArticle 2º-This Decree shall be effective upon its publication.\n\nGiven at the Presidency of the Republic.-San José, on the twenty-second day of November of the year two thousand ten."
