así como, los pronunciamientos contenidos en la Declaración de\nSanto Domingo de Guzmán, resultante de la II Cumbre de Jefes de Estado y/o\nGobierno de los Estados, Países y Territorios de la Asociación de Estados del\nCaribe, celebrada entre los días 16 y 17 de abril de 1999 en República\nDominicana y los principios y objetivos plasmados en el Plan de Acción sobre\nTurismo, Comercio y Transporte;\n\nReconociendo la\nvalidez e importancia de la Declaración para el Establecimiento de la Zona de\nTurismo Sustentable del Caribe, aprobada en la precitada II Cumbre y del Mar\nCaribe como patrimonio común de la región, el papel que el mismo ha desempeñado\nhistóricamente, así como su potencial para actuar como elemento unificador de\nsu desarrollo;\n\nConscientes\nde la necesidad de movilizar las capacidades colectivas de sus pueblos para\ndesarrollar el turismo de manera sostenible, utilizando racionalmente los\nrecursos naturales a fin de mejorar la calidad de vida de las generaciones\npresentes y futuras de los pueblos del Caribe;\n\nRatificando\nnuestra convicción sobre la importancia del concepto de sustentabilidad\ncomo base para proteger la biodiversidad, la cultura y el medio ambiente,\nubicando al ser humano como centro de nuestras acciones en virtud de favorecer\nuna mejor distribución de los beneficios resultantes del desarrollo turístico;\n\nTeniendo\nen cuenta que el Turismo es la principal actividad económica de\nla mayoría de los países de la región denominada Gran Caribe que como tal se\nconstituye en un importante factor de ingreso de divisas, desarrollo económico\ny social;\n\nConvencidos\nde que la Zona de Turismo Sustentable requiere de una perenne voluntad\npolítica que reconozca la necesidad de potenciar su realización, como una vía\npara el mejoramiento de las condiciones de vida de nuestros pueblos;\n\nConsiderando\nlo acordado en el Memorándum de Entendimiento para el Establecimiento de la\nZona de Turismo Sustentable del Caribe y apreciando que la calidad,\ncompetitividad y sustentabilidad de este Sector están relacionados de manera\nintrínseca con la conservación del entorno natural y cultural del Caribe;\n\nCumpliendo\nlo expresado en la Declaración para el Establecimiento de la Zona de Turismo\nSustentable del Caribe, que dispone en su numeral cinco letra b), que la AEC\ndeberá evaluar el marco legal existente y monitorear los avances del Plan de\nAcción Inmediato para, en su caso, negociar un instrumento jurídicamente\nvinculante, que al ser firmado y ratificado, sustituya al Memorándum de\nEntendimiento, aprobado el 17 de abril de 1999 en Santo Domingo de Guzmán,\nRepública Dominicana.\n\nConvienen lo siguiente:\n\nArtículo 1\n\nDel\nobjeto\n\nEl objeto del presente Convenio es el\nestablecimiento de la Zona de Turismo Sustentable del Caribe, en lo adelante la\nZona, como una unidad cultural, socioeconómica y biológicamente rica y diversa,\ngeográficamente determinada, en la que el desarrollo del Turismo estará\ncondicionado a la sustentabilidad y a los principios de integración,\ncooperación y consenso, con el fin de facilitar el desarrollo integral de la\nregión del Gran Caribe.\n\nArtículo\n2\n\nDel\námbito de aplicación\n\n1. El ámbito de aplicación del presente\nConvenio será el área geográfica comprendida en la cuenca del Mar Caribe, sobre\nla que los Estados Miembros y Miembros Asociados de la AEC ejercen soberanía, o\nderechos soberanos o jurisdicción, de conformidad a lo que se establece en el\nartículo 5 de este Convenio.\n\n(Nota de Sinalevi: Mediante ley N° 8879 del 1° de noviembre de 2010 \"Protocolo al Convenio para el\nEstablecimiento de la Zona de Turismo Sustentable del Caribe (ZTSC)\", se indica reformar este\nnumeral de la siguiente manera : \".Numerar la previsión existente del Artículo 2 del Convenio, como\npárrafo 1 e insertar un nuevo párrafo 2 para que lea como sigue: \"2. Para los propósitos de este\nConvenio \"la cuenca del Mar Caribe\" significa \"la Región del Caribe\")\n\nArtículo\n3\n\nObligaciones\nde las Partes\n\n1. Serán obligaciones de las Partes:\n\nA. Adoptar\nindividual y/o conjuntamente las medidas adecuadas para la implementación\ngradual y escalonada de la Zona de Turismo Sustentable del Caribe, como instrumento\npara propiciar el desarrollo del turismo y el de la región del Gran Caribe\nintegralmente.\n\nB. Adoptar,\nindividual y/o conjuntamente las medidas adecuadas para desarrollar, coordinar\ny dar seguimiento por parte de las autoridades pertinentes de los Estados\nMiembros y Miembros Asociados de la AEC a las Estrategias que se relacionan a\ncontinuación:\n\n1.- Cultura e\nIdentidad: Desarrollar los proyectos para investigar, divulgar,\npreservar y difundir la cultura del Caribe, como medio para contribuir a consolidar\nla identidad caribeña y proteger los valores culturales tendientes a fortalecer\nla imagen de la región como destino turístico.\n\n2.- Participación\nComunitaria: Crear mecanismos para promover la participación de las\ncomunidades en la toma de decisiones, la planificación, el desarrollo y los\nbeneficios derivados de la actividad turística, mejorando, al mismo tiempo, la\ninfraestructura y los servicios básicos en los asentamientos receptores de\nturismo.\n\n3.- Medio ambiente: Diseñar\nprogramas y proyectos de investigación y desarrollo para promover la\npreservación, conservación, aprovechamiento y manejo sustentable de los\nespacios naturales con fines de aprovechamiento turístico.\n\n4.- Tecnología para\nla sustentabilidad: Utilización de las mejores tecnologías disponibles\nen el manejo de las aguas servidas, drenaje y desechos sólidos, uso de energías\nalternativas y procesos inhibidores de la contaminación.\n\n5.- Políticas e\ninstrumentos económicos: Impulsar la creación de políticas e\ninstrumentos económicos y financieros que faciliten el desarrollo de las\nempresas turísticas sustentables.\n\n6.- Mercadeo\nTurístico: Impulsar la realización de estrategias y planes\nespecíficos de acción a fin de posibilitar: el desarrollo de productos\nturísticos, el aumento del valor agregado del producto turístico del Caribe, y\nel incremento de la demanda hacia la región.\n\n7.- Educación: Desarrollar\nprogramas de educación, capacitación y concientización sobre el turismo\nsustentable, que contribuyan a elevar la calidad de vida de las comunidades,\nasí como la prestación de los servicios turísticos y el nivel de conciencia\nturística de los prestadores de servicio y los turistas.\n\n8.- Marco Legal: Elaborar,\nadecuar, firmar y ratificar los marcos legales y normativos que permitan la\nconsolidación de la Zona de Turismo Sustentable del Caribe.\n\n9.- Indicadores de\nsustentabilidad: Alentar la creación de indicadores de sustentabilidad,\nasí como, del sistema de categorización, tanto en materia de empresas como\ndestinos turísticos, que permitan que a mediano y largo plazo los consumidores\ncuenten con una garantía de calidad ambiental.\n\n10.- Transporte aéreo\ny marítimo: Promover el desarrollo de sistemas de transportación\naérea y marítima interregionales, que faciliten el desplazamiento de los\nturistas.\n\n11.- Coordinación con\nel sector privado: Promover la realización de acciones de concertación\ncon el sector privado, para la organización y planificación del desarrollo, a\nfin de consolidar el desarrollo turístico sustentable de la región caribeña.\n\n12.- Centro de\ninformación: Promover la formación de un Centro de Información\nsobre el Desarrollo Turístico Sustentable, el cual estará a la disposición de\ntodos los Estados Miembros y Miembros Asociados de la AEC. En este sentido, los\ngobiernos se comprometen a aportar los elementos de información, para integrar\nel banco de datos del Centro.\n\nC. Mantener\nlos criterios y valores mínimos de los indicadores de sustentabilidad de los\ndestinos y a superarlos gradualmente, con la finalidad de lograr un alto nivel\nde calidad de la Zona, como destino turístico.\n\nD. Cooperar\nen la elaboración y adopción de Protocolos u otros Acuerdos para facilitar la\naplicación efectiva del presente Convenio.\n\nE. Cooperar\nen la implementación y armonización de los Programas y Proyectos elaborados por\nOrganismos Regionales e Internacionales en materia de turismo sustentable a fin\nde utilizar las capacidades colectivas de la Región del Gran Caribe.\n\nF. Adoptar\nlas medidas adecuadas, de conformidad con el derecho internacional, para\ncumplir efectivamente las obligaciones previstas en este Convenio y sus\nProtocolos y armonizar sus políticas a este respecto.\n\nG. Suministrar\na la Secretaria de la Asociación de Estados del Caribe la información obtenida\na partir de la aplicación de los Indicadores de Sustentabilidad, aprobados por\nel Comité Especial de Turismo Sustentable. Dicha información y cualquier otra\nque se requiera será suministrada con la periodicidad que establezca el Comité\nEspecial de Turismo Sustentable y deberá estar debidamente avalada por los\nentes competentes en materia de turismo.\n\n(Nota de Sinalevi: Mediante ley N° 8879 del 1° de noviembre de 2010 \"Protocolo al Convenio para el\nEstablecimiento de la Zona de Turismo Sustentable del Caribe (ZTSC)\", se indica reformar este\nnumeral de la siguiente manera : \".Numerar las previsiones existentes del Artículo 3 del Convenio\ncomo párrafo 1 e insertar un nuevo párrafo 2 para que lea como sigue:\"2. Nada en este Artículo puede\nser interpretado como otorgamiento de derecho al Comité Especial de Transporte de la AEC para\nnegociar o determinar derechos de tráfico de ruta de aviación civil internacional en nombre de una\nde las Partes\")\n\nArtículo\n4\n\nDe las\nfunciones del Comité Especial de Turismo Sustentable\n\n(Nota de Sinalevi: Mediante ley N° 8879 del 1° de noviembre de 2010 \"Protocolo al Convenio para el\nEstablecimiento de la Zona de Turismo Sustentable del Caribe (ZTSC)\", se indica reformar este\nnumeral de la siguiente manera: \".(1) Insertar un nuevo párrafo al inicio del Artículo 4 del\nConvenio que diga lo siguiente: \"El Comité de Turismo Sustentable establecido mediante el Acuerdo\n13/96 del Consejo de Ministros, aprobado durante la Segunda Reunión Ordinaria celebrada en la\nHabana, Cuba, en diciembre de 1996 (y renombrado mediante Acuerdo 1/00, como el Comité Especial de\nTurismo Sustentable), será el principal agente para el desarrollo e implementación de este\nConvenio\")\n\n \n\nCorresponderá al Comité Especial de Turismo\nSustentable el desempeño de las funciones siguientes:\n\nA. Evaluar periódicamente\nel estado de la puesta en marcha o desarrollo de la Zona, así como el avance de\nlos destinos que la integran de conformidad con el literal C, del artículo 3.\n\nB. Determinar y\nestablecer criterios y valores mínimos, regionales y uniformes para identificar\ny registrar como Partes integrantes de la Zona, los destinos que sean\npropuestos por los Estados Miembros o Miembros Asociados de la AEC, a esos\nfines.\n\nC. Analizar las\npropuestas que presenten los Estados Miembros o Miembros Asociados de la AEC a\nlos efectos de la integración y categorización de los destinos en la Zona, así\ncomo recomendar al Consejo de Ministros sobre su aprobación.\n\nD. Proponer al\nConsejo de Ministros la recategorización de aquellos destinos que como\nresultado de las evaluaciones periódicas hayan variado en el cumplimiento de\nlos indicadores.\n\nE. Recomendar un\nmecanismo para que las Partes reciban asistencia en la aplicación y ejecución\nde las estrategias tomando en cuenta las iniciativas regionales.\n\n(Nota de Sinalevi: Mediante ley N° 8879 del 1° de noviembre de 2010 \"Protocolo al Convenio para el\nEstablecimiento de la Zona de Turismo Sustentable del Caribe (ZTSC)\", se indica reformar el inciso\ne) anterior de la siguiente manera: \".2) Se modifica el literal E. del Artículo 4 del Convenio de la\nsiguiente forma: \"E. Recomendar un mecanismo para que las Partes reciban asistencia en la aplicación\ny ejecución de las estrategias y otras decisiones del Consejo de Ministros relativas a la Zona\nteniendo en cuenta las iniciativas regionales\")\n\nF. Instar a los\nEstados Miembros y Miembros Asociados de la AEC para desarrollar programas\nnacionales tendientes a alcanzar la sustentabilidad turística regional.\n\nG. Formular\nrecomendaciones ante el Consejo de Ministros sobre la adopción de instrumentos\nadicionales para lograr los objetivos de la Zona de Turismo Sustentable del\nCaribe.\n\nPara el cumplimiento\nde las funciones asignadas el Comité Especial de Turismo Sustentable se\nauxiliará de un panel de técnicos y expertos cuya conformación y atribuciones\nse define en un instrumento adicional denominado \"Normas para la\nIdentificación, Aprobación y Categorización de los destinos que Integran la\nZona de Turismo Sustentable\".\n\n(Nota de Sinalevi: Mediante ley N° 8879 del 1° de\nnoviembre de 2010 \"Protocolo al Convenio para el Establecimiento de la Zona de\nTurismo Sustentable del Caribe (ZTSC)\", se indica reformar el párrafo anterior\nde la siguiente manera:\". (3) Se modifica el último párrafo, del Artículo\n4 del Convenio, de la siguiente forma:\"Para\nllevar a cabo las funciones asignadas, el Comité Especial de Turismo\nSustentable establecerá un panel de técnicos y expertos de las Partes\nContratantes del Convenio, designado sobre la base de una distribución\ngeográfica y lingüística equitativa entre tales Partes, cuya formación y\nobligaciones serán definidas en las \"Normas para la Identificación, Aprobación\ny Categorización de los Destinos que integran la Zona de Turismo Sustentable\ndel Caribe\")\n\nArtículo\n5\n\nDe la\nidentificación, aprobación y categorización de\n\nlos\ndestinos que integran la Zona de Turismo\n\nSustentable\ndel Caribe\n\nA. Corresponderá a\ncada Estado Miembro o Miembro Asociado de la AEC identificar, con arreglo a los\ncriterios y valores mínimos regionales y uniformes, el o los destinos\npropuestos para integrar la Zona.\n\nB. El Comité Especial\nde Turismo Sustentable analizará las propuestas de integración de uno o varios\ndestinos, presentadas por un Estado Miembro o Miembro Asociado de la AEC y en\nlos casos que corresponda, recomendará al Consejo de Ministros su integración\nen la Zona de conformidad con el procedimiento establecido en el instrumento\ndenominado \"Normas para la Identificación, Aprobación y Categorización de los\nDestinos que Integran la Zona de Turismo Sustentable del Caribe\".\n\nC. La Secretaria de la Asociación de Estados del\nCaribe registrará como partes de la Zona, los destinos que apruebe el Consejo\nde Ministros.\n\nArtículo\n6\n\nFirma\n\nEste Convenio estará abierto para la firma desde el\ndía 12 de diciembre de 2001, por cualquier Estado, País o Territorio referido\nen el Artículo IV del Convenio Constitutivo de la Asociación de Estados del\nCaribe, que haya ratificado o adherido al mismo.\n\nArtículo 7\n\nRatificación\n\nEl presente Convenio estará sujeto a ratificación por\nparte de los Estados Signatarios, Países y Territorios a los que se refiere el\nArtículo IV del Convenio Constitutivo de la Asociación de Estados del Caribe,\nde conformidad con sus respectivos procedimientos constitucionales.\n\nArtículo\n8\n\nAdhesión\n\nDespués del depósito del decimoquinto instrumento de\nratificación, este Convenio permanecerá abierto a la adhesión a cualquiera de\nlos Estados, Países y Territorios a que se refiere el Artículo IV del Convenio\nConstitutivo que establece la Asociación de Estados del Caribe.\n\nArtículo\n9\n\nEntrada\nen vigor\n\nEste Convenio entrará en vigor el trigésimo día contado a partir de la\nfecha en que haya sido depositado el decimoquinto instrumento de ratificación.\nPara cualquier Estado, País y Territorio que se adhiera al Convenio después de\nhaber sido depositado el decimoquinto instrumento de ratificación, el Convenio\nentrará en vigor para el referido Estado, País y Territorio a partir del\ntrigésimo día contado desde la fecha en que haya depositado el instrumento\nrespectivo.\n\nArtículo\n10\n\nVigencia\ny denuncia\n\nEl presente Convenio tendrá una vigencia indefinida.\nCualquiera de las Partes podrá denunciarlo en cualquier momento. El retiro se\nhará efectivo un año después de la fecha de recepción por parte del\nDepositario, de la notificación formal de denuncia. La denuncia no anulará los\ncompromisos contraídos por la parte denunciante en virtud del presente Convenio\ndurante el período anterior a la renuncia. El Convenio continuará en vigor para\nlas otras Partes.\n\nArtículo\n11\n\nDepositario\n\nEl instrumento original del presente Convenio, cuyos textos en castellano,\nfrancés e inglés son igualmente idénticos y auténticos, será depositado ante la\nRepública de Colombia, en calidad de Depositario del Convenio Constitutivo de\nla Asociación de Estados del Caribe, del cual enviará copias certificadas de\nsus textos a cada Estado Miembro y Miembro Asociado de la AEC. De igual manera\nles notificará acerca de las firmas, depósitos de instrumentos de ratificación\no adhesión, reservas y denuncias.\n\nArtículo 12\n\nEnmiendas\n\nEl presente Convenio podrá ser enmendado por consenso\nen Reunión de los Jefes de Estado y/o de Gobierno o por Reunión del Consejo de\nMinistros de la Asociación. Ante ello, la AEC dentro del marco\nnormativo de la Zona de Turismo Sustentable del Caribe, está planteando la\ngeneración de modelos propios de refrendación de la sustentabilidad.\n\nDurante la II Cumbre de\nJefes de Estado y/o Gobierno celebrada en la Ciudad de Santo Domingo, República\nDominicana, en abril de 1999, los Ministros de Relaciones Exteriores de los\nPaíses Miembros y Miembros Asociados de la AEC, firmaron el Memorándum de\nEntendimiento, en el cual se definieron los principios, estrategias y acciones\npara el Establecimiento de la Zona de Turismo Sustentable del Caribe. Las\nacciones se encontraban enmarcadas dentro del Plan de Acción Inmediato que\ndebería ser aplicado por las Autoridades Nacionales de Turismo.\n\nDe igual forma, los\nMinistros de Relaciones Exteriores instruyeron al Comité Especial de Turismo,\ntrabajar en la elaboración de un Instrumento Jurídicamente Vinculante que\nreemplazara al Memorándum de Entendimiento, así como un documento en el que se\nexpresaran los criterios y valores mínimos que darían forma a la Zona de\nTurismo Sustentable.\n\nEl Comité Especial de\nTurismo constituyó dos grupos de trabajo para el desarrollo del mandato otorgado,\nuno de Expertos Jurídicos que diera forma al Instrumento Legal y otro de\nExpertos en Indicadores de Sustentabilidad que definieran los criterios y\nvalores a considerar.\n\nEs conveniente aclarar que\nexiste una diferencia entre las metas y objetivos globales plasmados en las 12\nestrategias previstas en el Artículo 3 literal B del Convenio para el\nEstablecimiento de la Zona de Turismo Sustentable del Caribe, cuyo logro\ncorresponde al trabajo individual o integral de los Países Miembros y Miembros\nAsociados de la AEC y su Secretaría, con respecto a las metas y objetivos para\nalcanzar la sustentabilidad de los Destinos Turísticos expresados en\nIndicadores cuyo cumplimiento corresponde a dichos destinos.\n\nEn este sentido, tal y\ncomo lo dispone el Artículo 5 literal B del Convenio para el Establecimiento de\nla Zona de Turismo Sustentable del Caribe, a continuación se presenta el\ninstrumento normativo para la identificación, aprobación y categorización de\nlos destinos que integran la Zona de Turismo Sustentable del Caribe.\n\nObjetivos:\n\n- Contribuir al logro de la sustentabilidad en los destinos turísticos identificados por los Países\nMiembros y Miembros Asociados de la AEC, a través de la categorización[1][1] por medio de los\nindicadores que definen los diferentes grados de avance, y que se conviertan al mismo tiempo en\nmecanismos de enseñanza y estímulo para alcanzar ese propósito.\n\n1 La categorización debe incluir la\nidentificación y los criterios de valoración de los Indicadores de\nSustentabilidad.\n\n- Determinar Indicadores de Turismo capaces de estimular\nla generación de cambios orientados hacia la Sustentabilidad del mismo, como\nvía para la concienciación en el uso racional de los recursos turísticos, de\nlos Países Miembros y Miembros Asociados de la AEC, en los ámbitos social,\ncultural, ambiental y económico.\n\nConsideraciones:\n\n- Existen diferencias en las condiciones de los Países\nMiembros y Miembros Asociados de la AEC. Esas diferencias hacen necesario\nplantear un conjunto de indicadores específicos que permitan armonizar los\ncriterios para la categorización sustentable de los destinos.\n\n- El sector turístico interactúa con elementos\neconómicos, culturales, sociales y ambientales que deben ser tomados en cuenta.\n\n- En los países y en la región existen instituciones\ny organizaciones que poseen y aplican sistemas de medición que pueden\ncontribuir a la categorización de los destinos. Es deseable y conveniente\naprovechar esas experiencias.\n\nPrincipios Básicos que\ndeben cumplir los indicadores:\n\n- Constituir un sistema sencillo, práctico, factible de\naplicar y alcanzar en los países y destinos de la AEC.\n\n- Ser capaces de medir el nivel de la Sustentabilidad\nTurística de los Destinos de los Países Miembros y Miembros Asociados de la\nAEC, mediante instrumentos o modelos enmarcados en las áreas ambiental, social,\ncultural y económica.\n\n- Formar un sistema capaz de evolucionar de lo simple a\nlo complejo, que transite por un avance paulatino y gradual de la manera más\nhomogénea posible entre todos los países del área.\n\n- Conformar un conjunto mínimo de indicadores que sean\nsintéticos, representativos, comparables entre destinos y preferiblemente\ncuantitativos.\n\nProcedimiento a seguir\npara la incorporación y categorización de un destino a la Zona de Turismo\nSustentable del Caribe:\n\n1. La\nsolicitud de incorporación de los destinos serán presentadas por los Estados\nMiembros y Miembros Asociados de la AEC, ante el Comité Especial de Turismo\nSustentable. Los Estados Miembros y Miembros Asociados, deberán suministrar la\ninformación necesaria, con base al esquema de valores de los Indicadores de\nSustentabilidad Turística para considerar la incorporación y correspondiente\ncategorización del destino a la Zona de Turismo Sustentable del Caribe.\n\n2. La información a suministrar y aquella requerida por\nel Comité Especial de Turismo Sustentable deberá estar debidamente avalada por\nla autoridad competente del país respectivo, conforme lo dispone el Artículo 3,\nliteral F, del Convenio para el Establecimiento de la Zona de Turismo\nSustentable del Caribe.\n\n3. El Comité Especial de Turismo Sustentable analizará y\nevaluará la propuesta presentada, y cumplidas las exigencias, con el fin de su\nintegración y categorización en la Zona de Turismo Sustentable del Caribe,\nrecomendará al Consejo de Ministros su aprobación.\n\n4. Si una propuesta presenta inconsistencia en la\ninformación, el Comité Especial de Turismo Sustentable recomendará al Estado\nMiembro o Miembro Asociado de la AEC, efectuar las correcciones pertinentes a los\nfines de iniciar nuevamente el proceso de análisis y evaluación.\n\n5. La Secretaría de la Asociación de Estados del Caribe\nregistrará como partes de la Zona, los destinos que apruebe el Consejo de\nMinistros, y se encargará de la difusión de la Zona y la promoción de estos\ndestinos.\n\nPanel de Expertos:\n\nEl Comité Especial de Turismo Sustentable se auxiliará\nde un panel de expertos que estará conformado por especialistas de alta\ncalificación provenientes de instituciones y organismos de los Estados Miembros\ny Miembros Asociados de la AEC, no pertenecientes al destino evaluado.\n\nEl Comité Especial de\nTurismo Sustentable deberá establecer un mecanismo de verificación sobre los\nindicadores.\n\nEl Panel de Expertos tendrá las siguientes funciones:\n\na. Comprobar el cumplimiento de los indicadores y\nen consecuencia recomendar la inclusión o exclusión de un destino en\ndeterminado grado de sustentabilidad.\n\nb. Precisar los parámetros de medidas de los\nindicadores proponiéndolos y sometiéndolos a la aprobación del Comité Especial\nde Turismo Sustentable.\n\nc. Definir una metodología estandarizada para la\nrecolección de la información para el cálculo de los indicadores.\n\nCómo establecer la\ncategorización de los destinos:\n\nCon la finalidad de categorizar los destinos\nturísticos, se seguirá un proceso de mejoramiento contínuo, sujeto a evaluación\nperiódica, de acuerdo a lo establecido en el Artículo 4, literal A del Convenio\npara el Establecimiento de la Zona de Turismo Sustentable del Caribe, que\npermita situar a los destinos postulados dentro de las siguientes categorías:\n\n- Destino Turístico Comprometido.\n\nDestino aspirante o\ncomprometido a alcanzar la sustentabilidad turística. The scope of application of this\nAgreement shall be the geographical area comprised in the Caribbean Sea basin, over\nwhich the Member States and Associate Members of the ACS exercise sovereignty, or\nsovereign rights or jurisdiction, in accordance with the provisions of\narticle 5 of this Agreement.\n\n(Note from Sinalevi: By means of Law No. 8879 of November 1, 2010, \"Protocol to the Agreement for the\nEstablishment of the Sustainable Tourism Zone of the Caribbean (ZTSC)\", it is indicated that this\nnumeral is reformed as follows: \".Number the existing provision of Article 2 of the Agreement as\nparagraph 1 and insert a new paragraph 2 to read as follows: \"2. For the purposes of this\nAgreement, 'the Caribbean Sea basin' means 'the Caribbean Region'\")\n\nArticle\n3\n\nObligations\nof the Parties\n\n1. The obligations of the Parties shall be:\n\nA. To adopt\nindividually and/or jointly the appropriate measures for the gradual\nand phased implementation of the Sustainable Tourism Zone of the Caribbean, as an instrument\nto foster the development of tourism and that of the Greater Caribbean\nregion integrally.\n\nB. To adopt,\nindividually and/or jointly, the appropriate measures to develop, coordinate\nand follow up, through the relevant authorities of the Member\nStates and Associate Members of the ACS, the Strategies listed\nbelow:\n\n1.- Culture and\nIdentity: To develop projects to research, disseminate,\npreserve and spread Caribbean culture, as a means to contribute to consolidating\nthe Caribbean identity and protecting cultural values aimed at strengthening\nthe image of the region as a tourist destination.\n\n2.- Community\nParticipation: To create mechanisms to promote the participation of\ncommunities in decision-making, planning, development and the\nbenefits derived from tourism activity, while simultaneously improving\ninfrastructure and basic services in the settlements receiving\ntourism.\n\n3.- Environment: To design\nresearch and development programs and projects to promote the\npreservation, conservation, use and sustainable management of\nnatural spaces for tourism use purposes.\n\n4.- Technology for\nsustainability: Use of the best available technologies\nin the management of wastewater, drainage and solid waste, use of alternative\nenergies and pollution-inhibiting processes.\n\n5.- Economic\npolicies and instruments: To promote the creation of economic\nand financial policies and instruments that facilitate the development of\nsustainable tourism enterprises.\n\n6.- Tourism\nMarketing: To promote the implementation of specific action strategies and\nplans to enable: the development of tourism\nproducts, the increase in the added value of the Caribbean tourism product, and\nthe increase in demand for the region.\n\n7.- Education: To develop\neducation, training and awareness programs on sustainable\ntourism, which contribute to raising the quality of life of the communities,\nas well as the provision of tourism services and the level of tourism\nawareness of service providers and tourists.\n\n8.- Legal Framework: To elaborate,\nadapt, sign and ratify the legal and regulatory frameworks that allow the\nconsolidation of the Sustainable Tourism Zone of the Caribbean.\n\n9.- Sustainability\nIndicators: To encourage the creation of sustainability indicators,\nas well as a categorization system, both regarding enterprises and\ntourist destinations, that allows consumers, in the medium and long term,\nto have a guarantee of environmental quality.\n\n10.- Air and sea\ntransport: To promote the development of interregional air\nand sea transportation systems that facilitate the movement of\ntourists.\n\n11.- Coordination with\nthe private sector: To promote concerted actions\nwith the private sector for the organization and planning of development, in\norder to consolidate the sustainable tourism development of the Caribbean region.\n\n12.- Information\nCenter: To promote the formation of an Information Center\non Sustainable Tourism Development, which will be available to\nall Member States and Associate Members of the ACS. In this regard, the\ngovernments undertake to provide the information elements to integrate\nthe Center's data bank.\n\nC. To maintain\nthe minimum criteria and values of the sustainability indicators of the\ndestinations and to gradually exceed them, with the aim of achieving a high level\nof quality in the Zone, as a tourist destination.\n\nD. To cooperate\nin the elaboration and adoption of Protocols or other Agreements to facilitate\nthe effective application of this Agreement.\n\nE. To cooperate\nin the implementation and harmonization of the Programs and Projects elaborated by\nRegional and International Organizations in matters of sustainable tourism in order\nto use the collective capacities of the Greater Caribbean Region.\n\nF. To adopt\nthe appropriate measures, in accordance with international law, to\neffectively fulfill the obligations set forth in this Agreement and its\nProtocols and to harmonize their policies in this regard.\n\nG. To provide\nthe Secretariat of the Association of Caribbean States with the information obtained\nfrom the application of the Sustainability Indicators, approved by\nthe Special Committee on Sustainable Tourism. Such information and any other\nthat may be required shall be provided with the periodicity established by the\nSpecial Committee on Sustainable Tourism and must be duly endorsed by the\ncompetent entities in tourism matters.\n\n(Note from Sinalevi: By means of Law No. 8879 of November 1, 2010, \"Protocol to the Agreement for the\nEstablishment of the Sustainable Tourism Zone of the Caribbean (ZTSC)\", it is indicated that this\nnumeral is reformed as follows: \".Number the existing provisions of Article 3 of the Agreement\nas paragraph 1 and insert a new paragraph 2 to read as follows: \"2. Nothing in this Article shall\nbe interpreted as granting the right to the ACS Special Committee on Transport to\nnegotiate or determine international civil aviation route traffic rights on behalf of any\nof the Parties\")\n\nArticle\n4\n\nFunctions of the Special Committee on Sustainable Tourism\n\n(Note from Sinalevi: By means of Law No. 8879 of November 1, 2010, \"Protocol to the Agreement for the\nEstablishment of the Sustainable Tourism Zone of the Caribbean (ZTSC)\", it is indicated that this\nnumeral is reformed as follows: \".(1) Insert a new paragraph at the beginning of Article 4 of the\nAgreement reading as follows: \"The Committee on Sustainable Tourism established through Agreement\n13/96 of the Council of Ministers, approved during the Second Ordinary Meeting held in\nHavana, Cuba, in December 1996 (and renamed through Agreement 1/00, as the Special Committee on\nSustainable Tourism), shall be the principal agent for the development and implementation of this\nAgreement\")\n\n \n\nThe Special Committee on Sustainable\nTourism shall be responsible for performing the following functions:\n\nA. To periodically evaluate\nthe status of the implementation or development of the Zone, as well as the progress of\nthe destinations that comprise it in accordance with subparagraph C of article 3.\n\nB. To determine and\nestablish regional and uniform minimum criteria and values to identify\nand register as integral parts of the Zone the destinations that are\nproposed for such purposes by the Member States or Associate Members of the ACS.\n\nC. To analyze the\nproposals presented by the Member States or Associate Members of the ACS for\nthe integration and categorization of destinations into the Zone, as well\nas to recommend their approval to the Council of Ministers.\n\nD. To propose to the\nCouncil of Ministers the recategorization of those destinations that, as a\nresult of the periodic evaluations, have varied in their compliance with\nthe indicators.\n\nE. To recommend a\nmechanism so that the Parties receive assistance in the application and execution\nof the strategies, taking into account regional initiatives.\n\n(Note from Sinalevi: By means of Law No. 8879 of November 1, 2010, \"Protocol to the Agreement for the\nEstablishment of the Sustainable Tourism Zone of the Caribbean (ZTSC)\", it is indicated that\nsubsection e) above is reformed as follows: \".2) Subparagraph E. of Article 4 of the Agreement is modified\nas follows: \"E. To recommend a mechanism so that the Parties receive assistance in the application\nand execution of the strategies and other decisions of the Council of Ministers related to the Zone,\ntaking into account regional initiatives\")\n\nF. To urge the\nMember States and Associate Members of the ACS to develop national\nprograms aimed at achieving regional tourism sustainability.\n\nG. To formulate\nrecommendations to the Council of Ministers regarding the adoption of additional\ninstruments to achieve the objectives of the Sustainable Tourism Zone of the\nCaribbean.\n\nTo fulfill\nthe assigned functions, the Special Committee on Sustainable Tourism shall\navail itself of a panel of technicians and experts whose composition and\npowers are defined in an additional instrument called \"Norms for the\nIdentification, Approval and Categorization of the Destinations that comprise\nthe Sustainable Tourism Zone\".\n\n(Note from Sinalevi: By means of Law No. 8879 of November 1, 2010, \"Protocol to the Agreement for the\nEstablishment of the Sustainable Tourism Zone of the Caribbean (ZTSC)\", it is indicated that the\npreceding paragraph is reformed as follows:\". (3) The last paragraph of Article\n4 of the Agreement is modified as follows:\"To\ncarry out the assigned functions, the Special Committee on Sustainable\nTourism shall establish a panel of technicians and experts from the Contracting\nParties to the Agreement, designated on the basis of an equitable geographical\nand linguistic distribution among such Parties, whose formation and\nobligations shall be defined in the 'Norms for the Identification, Approval\nand Categorization of the Destinations that comprise the Sustainable Tourism Zone\nof the Caribbean'\")\n\nArticle\n5\n\nIdentification, Approval and Categorization of\n\nthe\nDestinations that comprise the Sustainable Tourism Zone\n\nof the\nCaribbean\n\nA. It shall be the responsibility of\neach Member State or Associate Member of the ACS to identify, in accordance with\nregional and uniform minimum criteria and values, the destination(s)\nproposed to form part of the Zone.\n\nB. The Special Committee\non Sustainable Tourism shall analyze the proposals for the integration of one or more\ndestinations, presented by a Member State or Associate Member of the ACS, and\nwhere applicable, shall recommend to the Council of Ministers their integration\ninto the Zone in accordance with the procedure established in the instrument\ncalled \"Norms for the Identification, Approval and Categorization of the\nDestinations that comprise the Sustainable Tourism Zone of the Caribbean\".\n\nC. The Secretariat of the Association of Caribbean States\nshall register as parts of the Zone the destinations approved by the Council\nof Ministers.\n\nArticle\n6\n\nSignature\n\nThis Agreement shall be open for signature from the\n12th day of December 2001, by any State, Country or Territory referred to\nin Article IV of the Constitutive Agreement of the Association of Caribbean\nStates, which has ratified or acceded to the same.\n\nArticle 7\n\nRatification\n\nThis Agreement shall be subject to ratification by\nthe Signatory States, Countries and Territories referred to in\nArticle IV of the Constitutive Agreement of the Association of Caribbean States,\nin accordance with their respective constitutional procedures.\n\nArticle\n8\n\nAccession\n\nAfter the deposit of the fifteenth instrument of\nratification, this Agreement shall remain open for accession by any of\nthe States, Countries and Territories referred to in Article IV of the Constitutive\nAgreement establishing the Association of Caribbean States.\n\nArticle\n9\n\nEntry\ninto Force\n\nThis Agreement shall enter into force on the thirtieth day from the\ndate on which the fifteenth instrument of ratification has been deposited.\nFor any State, Country and Territory that accedes to the Agreement after\nthe fifteenth instrument of ratification has been deposited, the Agreement\nshall enter into force for the said State, Country and Territory on the\nthirtieth day from the date on which it has deposited the respective\ninstrument.\n\nArticle\n10\n\nDuration\nand Denunciation\n\nThis Agreement shall have an indefinite duration.\nAny of the Parties may denounce it at any time. The withdrawal shall\nbecome effective one year after the date of receipt by the\nDepositary of the formal notification of denunciation. The denunciation shall not annul the\ncommitments contracted by the denouncing party by virtue of this Agreement\nduring the period prior to the renunciation. The Agreement shall continue in force for\nthe other Parties.\n\nArticle\n11\n\nDepositary\n\nThe original instrument of this Agreement, whose texts in Spanish,\nFrench and English are equally identical and authentic, shall be deposited with the\nRepublic of Colombia, in its capacity as Depositary of the Constitutive Agreement of\nthe Association of Caribbean States, which shall send certified copies of\nits texts to each Member State and Associate Member of the ACS. Likewise,\nit shall notify them regarding signatures, deposits of instruments of ratification\nor accession, reservations and denunciations.\n\nArticle 12\n\nAmendments\n\nThis Agreement may be amended by consensus\nat a Meeting of the Heads of State and/or Government or by a Meeting of the Council of\nMinisters of the Association. The amendments shall enter into force thirty days after\nthe ratification by two-thirds of the subscribers(*) of this Agreement.\n\n(*)(Note from Sinalevi:\nBy means of Law No. 8879 of November 1, 2010, \"Protocol to the Agreement for the\nEstablishment of the Sustainable Tourism Zone of the Caribbean (ZTSC)\", it is indicated\nthat the word \"Subscribers\" shall be replaced by the words \"Contracting\nParties\")\n\nArticle\n13\n\nInterpretation\nand Settlement of Disputes\n\nThe Contracting Parties may resolve any doubts or\ndisputes regarding questions relating to the interpretation or application\nof this Agreement, through amicable means.\n\nWhen the doubts or\ndisputes cannot be resolved by the Parties, they shall be resolved by\nthe Council of Ministers. Faced with this, the ACS, within the normative\nframework of the Sustainable Tourism Zone of the Caribbean, is proposing the\ngeneration of its own models for endorsing sustainability.\n\nDuring the II Summit of\nHeads of State and/or Government held in the City of Santo Domingo, Dominican\nRepublic, in April 1999, the Ministers of Foreign Affairs of the\nMember Countries and Associate Members of the ACS signed the Memorandum\nof Understanding, in which the principles, strategies and actions\nfor the Establishment of the Sustainable Tourism Zone of the Caribbean were defined. The\nactions were framed within the Immediate Action Plan\nwhich was to be applied by the National Tourism Authorities.\n\nLikewise, the\nMinisters of Foreign Affairs instructed the Special Committee on Tourism\nto work on the elaboration of a Legally Binding Instrument that\nwould replace the Memorandum of Understanding, as well as a document expressing\nthe minimum criteria and values that would shape the Sustainable Tourism\nZone.\n\nThe Special Committee on\nTourism formed two working groups for the development of the mandate granted,\none of Legal Experts to shape the Legal Instrument and another of\nExperts in Sustainability Indicators to define the criteria and\nvalues to be considered.\n\nIt is appropriate to clarify that\nthere is a difference between the global goals and objectives embodied in the 12\nstrategies set forth in Article 3, subparagraph B of the Agreement for the\nEstablishment of the Sustainable Tourism Zone of the Caribbean, whose achievement\ncorresponds to the individual or integral work of the Member Countries and Associate\nMembers of the ACS and its Secretariat, with respect to the goals and objectives for\nachieving the sustainability of the Tourist Destinations expressed in\nIndicators whose fulfillment corresponds to said destinations.\n\nIn this sense, as\nprovided in Article 5, subparagraph B of the Agreement for the Establishment of\nthe Sustainable Tourism Zone of the Caribbean, the\nregulatory instrument for the identification, approval and categorization of\nthe destinations that comprise the Sustainable Tourism Zone of the Caribbean is presented below.\n\nObjectives:\n\n- To contribute to the achievement of sustainability in the tourist destinations identified by the Member Countries\nand Associate Members of the ACS, through categorization[1][1] by means of\nindicators that define the different degrees of progress, and which become, at the same time,\nteaching and incentive mechanisms to achieve that purpose.\n\n1 The categorization must include the\nidentification and the valuation criteria of the Sustainability\nIndicators.\n\n- To determine Tourism Indicators capable of stimulating\nthe generation of changes oriented towards its Sustainability, as\na means for raising awareness in the rational use of tourism resources,\nof the Member Countries and Associate Members of the ACS, in the social,\ncultural, environmental and economic spheres.\n\nConsiderations:\n\n- There are differences in the conditions of the Member Countries\nand Associate Members of the ACS. These differences make it necessary to\npropose a set of specific indicators that allow harmonizing the\ncriteria for the sustainable categorization of destinations.\n\n- The tourism sector interacts with economic,\ncultural, social and environmental elements that must be taken into account.\n\n- In the countries and in the region there are institutions\nand organizations that possess and apply measurement systems that can\ncontribute to the categorization of destinations. It is desirable and convenient\nto take advantage of those experiences.\n\nBasic Principles that\nthe indicators must fulfill:\n\n- To constitute a simple, practical, feasible system to\napply and achieve in the countries and destinations of the ACS.\n\n- To be capable of measuring the level of Tourism Sustainability\nof the Destinations of the Member Countries and Associate Members of the\nACS, through instruments or models framed in the environmental, social,\ncultural and economic areas.\n\n- To form a system capable of evolving from simple to\ncomplex, progressing gradually and in the most\nhomogeneous manner possible among all the countries of the area.\n\n- To make up a minimum set of indicators that are\nsynthetic, representative, comparable between destinations and preferably\nquantitative.\n\nProcedure to be followed\nfor the incorporation and categorization of a destination into the Sustainable Tourism\nZone of the Caribbean:\n\n1. The\nrequest for the incorporation of destinations shall be presented by the Member States\nand Associate Members of the ACS to the Special Committee on Sustainable\nTourism. The Member States and Associate Members must provide the\nnecessary information, based on the value scheme of the Tourism\nSustainability Indicators, to consider the incorporation and corresponding\ncategorization of the destination into the Sustainable Tourism Zone of the Caribbean.\n\n2. The information to be provided and that required by\nthe Special Committee on Sustainable Tourism must be duly endorsed by\nthe competent authority of the respective country, as provided in Article 3,\nsubparagraph F, of the Agreement for the Establishment of the Sustainable Tourism\nZone of the Caribbean.\n\n3. The Special Committee on Sustainable Tourism shall analyze and\nevaluate the proposal presented, and once the requirements are met, shall,\nfor the purpose of its integration and categorization into the Sustainable Tourism Zone of the Caribbean,\nrecommend its approval to the Council of Ministers.\n\n4. If a proposal presents inconsistency in the\ninformation, the Special Committee on Sustainable Tourism shall recommend to the Member State\nor Associate Member of the ACS to make the pertinent corrections in\norder to restart the analysis and evaluation process.\n\n5. The Secretariat of the Association of Caribbean States\nshall register as parts of the Zone the destinations approved by the Council of\nMinisters, and shall be responsible for the dissemination of the Zone and the promotion of these\ndestinations.\n\nPanel of Experts:\n\nThe Special Committee on Sustainable Tourism shall avail itself\nof a panel of experts that shall be composed of highly qualified\nspecialists from institutions and organizations of the Member States\nand Associate Members of the ACS, not belonging to the evaluated destination.\n\nThe Special Committee on Sustainable Tourism shall establish a verification mechanism for the indicators.\n\nThe Panel of Experts shall have the following functions:\n\na. Verify compliance with the indicators and consequently recommend the inclusion or exclusion of a destination at a given degree of sustainability (sustentabilidad).\n\nb. Specify the measurement parameters of the indicators, proposing them and submitting them for the approval of the Special Committee on Sustainable Tourism.\n\nc. Define a standardized methodology for collecting the information for the calculation of the indicators.\n\nHow to establish the categorization of destinations:\n\nFor the purpose of categorizing tourist destinations, a continuous improvement process shall be followed, subject to periodic evaluation, in accordance with the provisions of Article 4, subsection A of the Agreement for the Establishment of the Sustainable Tourism Zone of the Caribbean (Convenio para el Establecimiento de la Zona de Turismo Sustentable del Caribe), which allows the applicant destinations to be placed within the following categories:\n\n- Committed Tourist Destination.\n\nAspiring destination or one committed to achieving tourism sustainability.
