Ley Nº 7475 del 20 de diciembre de 1994, Ley de Ejecución de los\nAcuerdos de la Ronda Uruguay de Negociaciones Comerciales Multilaterales; Ley\n7472 del 20 de diciembre de 1994, Ley de la Promoción de la Competencia y\nDefensa Efectiva del consumidor y Decreto Ejecutivo Nº 26431-MAG del 2\nde octubre de 1997, Reglamento a la Ley Orgánica del Ministerio de Agricultura\ny Ganadería;\n\nConsiderando:\n\n1º-Que es función\nesencial del Estado proteger los vegetales de los perjuicios causados por las\nplagas, así como regular el uso y manejo de sustancias químicas, biológicas y\nafines en aras de proteger la sanidad de los vegetales, de salud humana y del\nambiente.\n\n2º-Que para la\neconomía nacional y la seguridad alimentaria, la protección fitosanitaria de\nlos productos de origen vegetal resulta fundamental, lo que obliga al Estado a\nadoptar todas las medidas de prevención, vigilancia y control necesarias para\nevitar el ingreso y diseminación de plagas que pongan en peligro o puedan\ncausar daño a las personas o al patrimonio agrícola nacional.\n\n3º-Que el Estado con\nbase en el marco del acuerdo para la aplicación de las medidas sanitarias y\nfitosanitarias, debe adoptar aquellas que resulten necesarias para proteger la\nsalud y la vida de las personas, de los animales y vegetales, basando estas\nmedidas en una evaluación adecuada a las circunstancias y a los riesgos\neventuales que ello conlleve, asegurando que estas medidas no constituyan\nobstáculos para el comercio internacional.\n\n4º-Que la evidencia\ntécnica ha demostrado que una de las principales vías de diseminación de plagas\nes mediante el traslado de material de origen vegetal cuyo medio de transporte\nson los equipajes como: valijas, maletines, salveques, entre otros, empleados\npor las personas que ingresan o salen del país. Por lo tanto, en aras de\nproteger el patrimonio agrícola, se establece el escaneo de equipajes para\ndisminuir el riesgo de introducción de nuevas plagas reglamentarias.\n\n5º-Que es requisito\nde la entidad bancaria que realizará la recaudación del dinero, por el pago del\nservicio que se brinda de escaneo, que la normativa sea clara y que se estipule\nen la misma, que se refiere a entradas y salidas del país.\n\n6º-Que es necesario\nla actualización de los costos de operación del sistema de inspección de\nequipaje, con el objetivo de mantener un sistema eficiente y eficaz.\n\n7º-Que ante la poca\nclaridad de la redacción de algunos ítems del artículo 2º del Decreto Ejecutivo\nNº 27763-MAG del 10 de marzo de 1999, publicado en el Alcance Nº 26 a La Gaceta Nº\n68 del 9 de abril de 1999, correspondiente a la Fijación de Tarifas del\nMinisterio de Agricultura, se hace necesario realizar la modificación\npertinente para una adecuada lectura del mismo.
