28, subsection b) of Law 6227 of May 2, 1978, which is the General Law on Public Administration, and Law 8488 of November 22, 2006, which is the National Law on Emergencies and Risk Prevention.\n\nConsidering:\n\n1°—That in accordance with the declaration of adherence of the Costa Rican Social and Democratic State under the Rule of Law to the Christian principle of social justice contained in Articles 50 and 74 of the Political Constitution, there is an unavoidable state duty to satisfy the general interest and to recognize and guarantee a series of fundamental rights to individuals whose enjoyment falls within the scope of public interest.\n\n2°—That the Executive Branch, in fulfillment of that duty, through Executive Decree No. 36201-MP published in the Official Gazette La Gaceta No. 194 on October 6, 2010, proceeded to declare a state of national emergency due to the extreme hydrometeorological conditions that affected the country during the months of August and September of 2010.\n\n3°—That these phenomena caused flooding, landslides, and damage to property and persons, affecting the road infrastructure of the National Road Network administered by CONAVI, interrupting the continuity of routes and seriously affecting land communication, agriculture, and public services, in a greater number of cantons than those indicated in Executive Decree No. 36201-MP.\n\n4°—That these populations must be included in the emergency declaration in order to guarantee attention to all the incidents that were generated, thus ensuring the assistance required by the affected populations.\n\n5°—That the life of the population and the continuity of public transportation services are of public interest and protected by the State, which must ensure their protection and the safety of the inhabitants and, in general, the conservation of social order.\n\n6°—That in Executive Decree No. 36201-MP, the completely involuntary error was made of including \"Ciudad Quesada\" as a canton, when in reality it is the head city of the canton of San Carlos.\n\n7°—As indicated, it is necessary to modify the first Article of Executive Decree No. 36201-MP in order to include the cantons of Buenos Aires, Corredores, Garabito, Golfito and Montes de Oro of the province of Puntarenas;
