Sistema Nacional para la Calidad, Ley Nº 8279 del 2 de mayo del 2002; y la\nLey del Servicio Nacional de Salud Animal, Ley Nº 8495 del 6 de abril del 2006.\n\nConsiderando:\n\nI.-Que es función del Estado velar por la salud de los\nhabitantes de la República y garantizar su bienestar; asimismo, debe procurar\nque dichas medidas no se constituyan en un obstáculo para el establecimiento de\ncondiciones de competitividad, que contribuyan en el desarrollo de la actividad\neconómica del país.\n\nII.-Que las normas\nelaboradas por el Codex Alimentarius son consideradas de referencia\ninternacional por parte de la Organización Mundial de Comercio.\n\nIII.-Que\ndicho organismo de referencia internacional ha recomendado mediante la norma\nCODEX STAN 234-1999 y sus enmiendas, una serie de métodos de análisis y\nmuestreo para comprobar la calidad e inocuidad de los alimentos.\n\nIV.-Que dentro de la\nlegislación costarricense, existen reglamentos técnicos para productos\nalimenticios que establecen límites máximos o mínimos de tolerancia para\nciertas sustancias, cuyo incumplimiento afecta la calidad o inocuidad del\nproducto definido en el reglamento técnico respectivo y ponen en riesgo la\nsalud y la vida de los consumidores.\n\nV.-Que algunos de\nesos reglamentos técnicos no indican los métodos de análisis requeridos, para\nverificar los parámetros de calidad e inocuidad contenidos en los mismos.
