El\nGobierno de la República de Costa Rica interpreta que, para los efectos del\nartículo 1 del presente Convenio se entiende que, de modificarse el proyecto\nseñalado en el inciso 1) del artículo 1, el Gobierno de Costa Rica deberá\ncumplir los trámites internos de aprobación de los empréstitos, de conformidad\ncon el inciso 15) del artículo 121 de la Constitución Política...\")\n\n(2) El proyecto\nmencionado en el párrafo 1 podrá ser reemplazado por otros proyectos\nrelacionados con los bosques tropicales si el Gobierno de la República Federal\nde Alemania y el Gobierno de la República de Costa Rica así lo conviene, por\nintercambio de notas. En caso de que el proyecto mencionado en el párrafo 1 sea\nsustituido por un proyecto de protección medioambiental o de infraestructura\nsocial o una medida de autoayuda orientada a combatir la pobreza o una medida\norientada a mejorar la posición social de la mujer o un fondo de garantía de\ncrédito para pequeñas y medianas empresas, que reúna las condiciones especiales\nnecesarias para ser fomentado a través de una aportación financiera, podrá\nconcederse una aportación financiera; de no ser así, podrá concederse un\npréstamo.\n\n(3) En caso de que el\nGobierno de la República Federal de Alemania otorgue en un momento posterior al\nGobierno de la República de Costa Rica la posibilidad de obtener de la\nKreditanstalt für Wiederaufbau nuevas aportaciones financieras para la\npreparación del proyecto mencionado en el párrafo 1 o para medidas conexas\nnecesarias destinadas a la realización y atención del proyecto mencionado en el\npárrafo 1, se aplicará el presente Convenio.\n\n(4) Las aportaciones\nfinancieras para medidas preparatorias o conexas conforme al párrafo 3 se\nconvertirán en préstamos si no utilizan para tales medidas. Las condiciones en\nque se otorgarían estos préstamos serán las habituales para este tipo de\npréstamos que otorga a la Kreditanstalt für Wiederaufbau. In the event that the project mentioned in paragraph 1 is\nreplaced by an environmental protection or social infrastructure\nproject or a self-help measure aimed at combating poverty or a measure\naimed at improving the social position of women or a credit guarantee\nfund for small and medium-sized enterprises, which meets the special conditions\nnecessary to be promoted through a financial contribution (aportación financiera), a financial contribution (aportación financiera) may be granted; otherwise, a\nloan may be granted.\n\n(3) In the event that the\nGovernment of the Federal Republic of Germany grants at a later time to the\nGovernment of the Republic of Costa Rica the possibility of obtaining from the\nKreditanstalt für Wiederaufbau new financial contributions (aportaciones financieras) for the\npreparation of the project mentioned in paragraph 1 or for necessary related\nmeasures for the realization and servicing of the project mentioned in\nparagraph 1, the present Agreement shall apply.\n\n(4) The financial contributions (aportaciones financieras)\nfor preparatory or related measures under paragraph 3 shall\nbecome loans if they are not used for such measures. The conditions\nunder which these loans would be granted shall be those customary for this type of\nloan that the Kreditanstalt für Wiederaufbau grants. The granting of these\nloans shall be negotiated by mutual agreement between the Parties, in accordance\nwith their internal legal framework.\n\nArticle 2\n\n(1) The use of the sum mentioned in Article 1, the conditions of its\ngranting, and the procedure for the awarding of contracts shall be set forth in the\nfinancing contracts to be concluded between the Kreditanstalt für\nWiederaufbau and the recipients of the financial contribution (aportación financiera), contracts that\nshall be subject to the legal provisions in force in the Federal Republic of\nGermany.\n\n(2) The Government of the Republic of Costa Rica, if it is not the\nrecipient of the financial contributions (aportaciones financieras), shall guarantee to the Kreditanstalt für\nWiederaufbau any potential claims for reimbursement based on the\nfinancing contracts to be concluded according to paragraph 1.\n\nArticle 3\n\nThe Kreditanstalt für Wiederaufbau is exempt from all taxes and\nother public levies.\n\nArticle 4\n\nRegarding maritime and air transport of persons and goods\nresulting from the granting of the financial contributions (aportaciones financieras), the Government of the\nRepublic of Costa Rica shall permit the passengers and suppliers to choose\nfreely among the transport companies authorized to operate in\nCosta Rica, and shall not adopt measures that exclude or hinder the\nequal participation of transport companies headquartered in the Federal Republic of\nGermany.\n\nArticle 5\n\nThis present Agreement shall enter into force on the day on which the Government of the\nRepublic of Costa Rica notifies the Government of the Federal Republic of\nGermany that the necessary internal requirements on the part of the\nRepublic of Costa Rica have been fulfilled.\n\nDone in Bonn, on October eighteenth, 2002, in two copies, in German and\nSpanish, both texts being equally authentic.\n\nIllegible signatures\n\nFor the Government For the Government of the Federal Republic of Germany of the\nRepublic of Costa Rica\""
