  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 36481\n\n                        Regula Programa Bandera Azul Ecológica (PBAE)\n\nTexto Completo acta: D947E\n\nNº\n36481-MINAET-S\n\nLA PRESIDENTA DE LA REPÚBLICA,\n\nEL MINISTRO DE AMBIENTE,\nENERGÍA Y TELECOMUNICACIONES\n\nY LA MINISTRA DE SALUD\n\nEn uso de las facultades que les confiere el artículo\n140 incisos 3) y 18) de la Constitución Política, 27 y 28.2.b) de la Ley\nGeneral de la Administración Pública y,\n\nConsiderando:\n\n1º-Que mediante el acuerdo de Junta Directiva del\nInstituto Costarricense de Acueductos y Alcantarillados (A y A) Nº 96-160 del 4\nde junio de 1996, se creó el Programa Bandera Azul Ecológica (PBAE), con la\nparticipación de otras entidades públicas y privadas como: Instituto\nCostarricense de Turismo (ICT), Ministerio de Ambiente, Energía y\nTelecomunicaciones (MINAET), Ministerio de Salud (MINSA), Instituto Costarricense\nde Acueductos y Alcantarillados (AYA), Cámara Nacional de Turismo (CANATUR),\ncon el propósito de incentivar la participación comunitaria en la protección de\nlos recursos hídricos, el ambiente en general y la salud pública del país.\nPosteriormente, la iniciativa recibió el apoyo y se incorporaron otras\ninstituciones a saber: Ministerio de Educación Pública (MEP), Asociación Red\nCostarricense de Reservas Privadas, Instituto Costarricense de Electricidad\n(ICE), Ministerio de Agricultura y Ganadería (MAG)\ny la Caja Costarricense del Seguro Social (CCSS). Estas dos últimas\ninstituciones se integran mediante este Decreto.\n\n2º-Que la Constitución Política de Costa Rica\nestablece en su artículo 50, el deber del Estado, para preservar un ambiente\nsano y ecológicamente equilibrado, siendo su obligación garantizar, difundir y\nsalvaguardar ese derecho.\n\n3º-Que el Plan Nacional de Desarrollo 2011-2014 \"María\nTeresa Obregón Zamora\", contempla el fortalecimiento del PBAE en sus objetivos\ny metas.\n\n4º-Que en sus primeros 15 años de vigencia el PBAE se\nhan creado 7 categorías mediante los Decretos Ejecutivos Nº 25636-MINAE-S\n(1996) -no vigente-, Nº 27010-MINAE-S (1998) -no vigente-, Nº\n31648-MEP-MINAE-S-TUR (2004), Nº 31610-S-MINAE-TUR (2004), Nº\n31978-MEP-MINAE-S-TUR (2004), Nº 33604-MINAE (2007), Nº 34548-MINAE (2008), Nº\n34777-MINAET-S-MEP (2008) y Nº 35162-MINAET(2009).\n\n5º-Que el PBAE se ha convertido en un instrumento\npráctico para incentivar y democratizar la toma de decisiones en la\norganización civil en beneficio del ambiente, la salud y la calidad de vida de\nla población y visitantes de Costa Rica.\n\n6º-Que el éxito y empoderamiento del PBAE ha permitido\nexpandir su filosofía o estilo de vida a otros países de la región\nlatinoamericana.\n\n7º-Que la Comisión Nacional del PBAE realizó el 24 de\nnoviembre del 2006, el segundo Plan Estratégico para el período 2007-2011, en\ndonde se fijaron nuevos objetivos y metas, entre otros la creación de nuevas\ncategorías.\n\n8º-Que el PBAE fue declarado, mediante el\nDecreto Ejecutivo Nº 33604, como \"Programa de Interés Público de Bien Social\".\n\n9º-Que es necesario adecuar algunos parámetros\nobligatorios y complementarios en las diferentes categorías: Playas,\nComunidades, Centros Educativos, Espacios Naturales Protegidos, Microcuencas\nHidrológicas, Acciones para enfrentar el Cambio Climático, Comunidad Clima\nNeutral y la nueva categoría \"Promoción de la Salud Comunitaria\", con el\npropósito de optimizar la administración y operación del Programa. Asimismo, se\nhace necesario integrar en los aspectos normativos más relevantes, los decretos\nejecutivos que regulan el PBAE. Por tanto,\n\nDecretan:\n\nArtículo 1º-Objetivo del PBAE: El objetivo\ngeneral del PBAE es establecer un incentivo para promover la organización de\ncomités locales y la integralidad de los mismos, con el propósito de buscar la\nconservación y desarrollo, en concordancia con la protección de los recursos\nnaturales, la implementación de acciones para enfrentar el cambio climático, la\nbúsqueda de mejores condiciones higiénico-sanitarias y la mejoría de la salud\npública de los habitantes de Costa Rica.\n\nArtículo 2º-Categorías que se integran y finalidad:\nLos decretos que se pretenden integrar mediante la presente regulación son los\nsiguientes Decretos Nº 31648-MEP-MINAE-S-TUR (Categoría: Centros educativos)\ndel 2004, Nº 31610-S-MINAE-TUR del 2004 (Categoría: Comunidades y Categoría:\nPlayas), Nº 31978-MEP-MINAE-S-TUR (Declaratoria de interés público PBAE) del\n2004, Nº 33604-MINAE (Categoría: Espacios Naturales Protegidos) del 2007, Nº\n34548-MINAE (Categoría: Acciones para enfrentar el Cambio Climático) del 2008,\nNº 34777-MINAET-S-MEP (Categoría: Microcuencas hidrológicas) del 2008 y Nº\n35162-MINAET (Categoría: Comunidad Clima Neutral) del 2009; así como la\ncategoría de Promoción de la Salud Comunitaria, creada mediante la presente\nnormativa. La finalidad de este decreto es integrar los alcances de las\ndiferentes categorías del PBAE, creando nuevos parámetros obligatorios y\ncomplementarios de las mismas.\n\nArtículo 3º-Creación de la categoría promoción de\nla salud comunitaria: Se crea la VIII categoría del PBAE, denominada\n\"Promoción de la Salud Comunitaria\", dirigida a la organización comunal, para\nque con el apoyo de las autoridades de salud de la zona, realicen acciones y\nactividades con el propósito de mejorar la calidad de vida de la población\ncorrespondiente.\n\nArtículo 4º-Integrantes de la Comisión Nacional del PBAE: Se crea la Comisión Nacional del PBAE\n(CNPBAE) la cual estará integrada por un funcionario titular y un suplente de cada una de la\ninstituciones integrantes de la misma, que son: Instituto Costarricense de Turismo (ICT), Ministerio\nde Ambiente, Energía y Telecomunicaciones (MINAET), Ministerio de Salud (MINSA), Instituto\nCostarricense de Electricidad (ICE), Ministerio de Educación Pública (MEP), Instituto Costarricense\nde Acueductos y Alcantarillados (AYA), Ministerio de Agricultura y Ganadería (MAG), Caja\nCostarricense del Seguro Social (CCSS) -que se integra para la nueva categoría \"Promoción de la\nSalud Comunitaria\"-, Cámara Nacional de Turismo (CANATUR), Asociación Red Costarricense de Redes\nPrivadas (RED DE RESERVAS). La Comisión Nacional del PBAE podrá invitar otros representantes de\notras entidades públicas y privadas cuando lo considere necesario.\n\nArtículo 5º-Deberes y potestades de la Comisión\nNacional del PBAE: Los deberes y potestades de la Comisión Nacional\ndel PBAE son:\n\na. Preparar el programa de trabajo anual, el cual\ndebe ser aprobado por consenso de la Comisión o en su lugar mayoría simple.\n\nb. Establecer\nel cronograma de reuniones con una frecuencia mensual.\n\nc. Elegir\ncon una frecuencia de cada tres años, en el mes de diciembre su estructura\norgánica, para lo cual se deben seleccionar en su seno los siguientes puestos\nPresidente y Secretario. Asimismo para los aspectos operativos, con el apoyo de\nlas instituciones representadas en la Comisión, podrá seleccionarse un\nCoordinador General. También, a lo interno de la Comisión, y de los miembros\nrepresentantes de la misma, podrá seleccionarse un Coordinador para cada uno de\nlos siguientes aspectos:\n\n-   Finanzas\n\n-           Publicidad\ny Mercadeo\n\n-           Educación\ny Capacitación\n\n-           Actos\nanuales e Izas Locales\n\n-           Otros\nque defina la Comisión\n\nd. Evaluar, auditar, dar seguimiento y seleccionar\nlos comités locales ganadores del Galardón Bandera Azul Ecológica.\n\ne. Realizar\nlos ajustes que sean necesarios y cuando sean requeridos a los parámetros o\nmanuales de procedimiento de las diversas categorías.\n\nf.  Los\ndictámenes o decisiones de la CNPBAE serán inapelables en materia de\notorgamiento de galardones.\n\nArtículo 6º-Conformación de los Comités\nLocales: Los participantes de cada categoría deben conformar Comités\nLocales (CLPBAE), los cuales deben formalizar su inscripción de enero a marzo\nde cada año ante la Comisión Nacional del PBAE, y elaborar los programas de\ntrabajo, el cual deben presentar en Abril de cada año, brindar seguimiento a\nlas acciones para cumplir los parámetros obligatorios y complementarios y\nenviar los informes anuales a la Comisión Nacional del PBAE, en el mes de\ndiciembre del período correspondiente. La conformación de los diferentes\nComités Locales de cada categoría se definirá de acuerdo con el Anexo A.\n\nArtículo 7º-Equipos técnicos de trabajo de la CNPBAE:\nEl CNPBAE integrará Equipos Técnicos con funcionarios de las distintas\ninstituciones representadas en el seno de la CNPBAE, con el propósito de\nrealizar las siguientes funciones: promoción, evaluación, seguimiento, y otras\nactividades de apoyo y monitoreo con los Comités Locales.\n\nArtículo 8º-Funciones de los Comités Locales:\nLas funciones de los Comités Locales de cada categoría son:\n\na) Sesionar al menos una vez al mes, llevando un\nlibro de actas donde se anotarán los principales acuerdos, mejoras y\nactividades educativas realizadas. En el mes de diciembre de cada año, se\npresentará un informe de estas actividades a la CNPBAE.\n\nb) El\nCLPBAE deberá nombrar un coordinador, quien será el contacto directo con la\nCNPBAE y los Equipos Técnicos de Trabajo (ETPBAE).\n\nc) En el\ncaso de los Centros Educativos, el comité local debe contar con el visto bueno\ndel Director de la institución.\n\nd) En la\nprimera sesión del año se debe preparar el programa de trabajo anual y enviarlo\na la CNPBAE.\n\ne) Le\ncorresponde al comité local designar responsables de cada actividad a realizar\ny dar seguimiento a las mismas.\n\nf)  El\ncomité mantendrá informada a la CNPBAE de todas las actividades realizadas\ndurante su periodo de evaluación.\n\ng) El\ncomité velará por el cumplimiento de cada uno de los parámetros de evaluación\ndel programa.\n\nh) El\ncomité deberá preparar un informe final de auto-evaluación en el mes de diciembre\nde cada año, siguiendo el orden del esquema establecido por la comisión para\ncada una de las 8 categorías. Además, en la elaboración del informe final,\nsolamente podrán participar los integrantes del comité local inscrito.\n\ni)  En\naras de una democratización y mayor participación de los habitantes de un lugar\nen el PBAE, no se permitirá que un mismo comité se inscriba para participar en\nmás de cuatro categorías.\n\nj)  No\npodrá tener injerencia o participación un mismo miembro o representante, en más\nde cuatro comités locales de una misma categoría dentro del PBAE.\n\nk) El\ncomité deberá estar dispuesto al auditoraje de la comisión nacional sobre la\nauto-evaluación planteada\n\nl)  Nombrar\ndos representantes que asistan, al acto de premiación organizado por la CNPBAE,\ncuando el comité sea galardonado\n\nm)        En\nel caso de los Centros Educativos, conformar una comisión con docentes y\nestudiantes de hasta 5 personas para asistir al acto de premiación.\n\nn) El\ncomité será el responsable de organizar el acto para izar la Bandera Azul\nEcológica en su localidad inscrita.\n\no) Construir\nel asta donde será colocada la Bandera Azul Ecológica, ubicándola en la zona\npública o privada de mayor concurrencia o relevancia para el sitio ganador y\nvelar porque la misma se mantenga ondeando constantemente.\n\np) El\nComité cubrirá el costo de una nueva bandera, cuando la entregada por la CNPBAE\nsufra deterioro o sea robada.\n\nq) En\ncaso de Centros Educativos, cuando el comité local se hace acreedor de la\nBandera Azul Ecológica, quedará automáticamente inscrito para el próximo año,\ninformando a la CNPBAE si existen cambios dentro de la integración del Comité.\n\nr)  Otras\ndirigidas al fortalecimiento de los comités y el PBAE, que se deriven de la\npresente regulación\n\nArtículo 9º-Logo del galardón: Se mantiene el\nlogo original del galardón, \"Bandera Azul Ecológica\", incluyendo: el logo\noriginal del programa en el centro, en la esquina superior derecha el año de\nevaluación y en el margen inferior derecho, el símbolo de cada categoría. La\nbandera o galardón tendrá un largo de 1.50 metros y un ancho\nde 1 metro.\n\nArtículo 10.-Requisito para participar en las\ncategorías del PBAE: Los establecimientos, entidades, organizaciones\ny otros, que participen en cualquier categoría del PBAE, deben en primera\ninstancia estar legalmente acreditados según su naturaleza jurídica ante las\ninstituciones del Estado, cuando así sea requerido y cumplir las normativas de\nsalud pública vigentes, en lo pertinente.\n\nArtículo 11.-Parámetros, nota mínima y gradación de\nestrellas: Los parámetros obligatorios para cada categoría del PBAE se\ndefinen en el Anexo B. (adjunto). La nota mínima y la gradación de las\nestrellas en el galardón para cada categoría del PBAE, se presenta en el Anexo\nC. (adjunto)\n\nArtículo 12.-Recursos económicos: Cada entidad\npública y privada representada en la Comisión Nacional del PBAE, queda\nfacultada para incluir en su presupuesto, los recursos económicos y humanos\nnecesarios para asegurar la administración y operación de la Comisión Nacional\ny el Equipo de Trabajo del PBAE. Dichos recursos deben ser comunicados a la\nComisión Nacional mediante el representante de cada entidad en el mes de\nsetiembre de cada año. Asimismo las dependencias del sector público y privado,\ndentro del marco legal respectivo, podrán contribuir en la medida de sus\nposibilidades jurídicas y materiales, y sin perjuicio del cumplimiento de sus\npropios objetivos, en todas aquellas actividades que se desarrollen para el\nfortalecimiento y desarrollo del Programa Bandera Azul Ecológica.\n\nArtículo\n  13.-Manuales de procedimientos de cada categoría: Cada categoría\n  cuenta con su respectivo manual de procedimientos, en el cual se detallan\n  aspectos específicos para cada una de ellas. Este manual será revisado al\n  menos cada 4 años por la CNPBAE, para determinar si procede realizar cambios\n  operativos que permitan agilizar y modernizar el programa.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 36481\n\n                        Regulates the Ecological Blue Flag Program (PBAE)\n\nFull Text of acta: D947E\n\nNo.\n36481-MINAET-S\n\nTHE PRESIDENT OF THE REPUBLIC,\n\nTHE MINISTER OF ENVIRONMENT,\nENERGY AND TELECOMMUNICATIONS\n\nAND THE MINISTER OF HEALTH\n\nIn use of the powers conferred by article\n140 subsections 3) and 18) of the Political Constitution, 27 and 28.2.b) of the General\nLaw of Public Administration, and,\n\nConsidering:\n\n1º-That through the Board of Directors agreement of the\nCosta Rican Institute of Aqueducts and Sewers (AyA) No. 96-160 of June 4,\n1996, the Ecological Blue Flag Program (PBAE) was created, with the\nparticipation of other public and private entities such as: Costa Rican Tourism\nInstitute (ICT), Ministry of Environment, Energy and Telecommunications\n(MINAET), Ministry of Health (MINSA), Costa Rican Institute of Aqueducts and\nSewers (AYA), National Chamber of Tourism (CANATUR),\nwith the purpose of encouraging community participation in the protection of\nwater resources, the environment in general, and the country's public health.\nSubsequently, the initiative received support and other institutions joined,\nnamely: Ministry of Public Education (MEP), Costa Rican Network of Private\nReserves Association, Costa Rican Electricity Institute (ICE),\nMinistry of Agriculture and Livestock (MAG)\nand the Costa Rican Social Security Fund (CCSS). These last two\ninstitutions are integrated through this Decree.\n\n2º-That the Political Constitution of Costa Rica\nestablishes in its article 50, the State's duty to preserve a healthy\nand ecologically balanced environment, being its obligation to guarantee, disseminate, and\nsafeguard that right.\n\n3º-That the National Development Plan 2011-2014 \"María\nTeresa Obregón Zamora\", contemplates the strengthening of the PBAE in its objectives\nand goals.\n\n4º-That in its first 15 years of validity, the PBAE has\ncreated 7 categories through Executive Decrees No. 25636-MINAE-S\n(1996) -not in force-, No. 27010-MINAE-S (1998) -not in force-, No.\n31648-MEP-MINAE-S-TUR (2004), No. 31610-S-MINAE-TUR (2004), No.\n31978-MEP-MINAE-S-TUR (2004), No. 33604-MINAE (2007), No. 34548-MINAE (2008), No.\n34777-MINAET-S-MEP (2008) and No. 35162-MINAET(2009).\n\n5º-That the PBAE has become a practical\ninstrument to incentivize and democratize decision-making in\ncivil organization for the benefit of the environment, health, and the quality of life of the\npopulation and visitors of Costa Rica.\n\n6º-That the success and empowerment of the PBAE has allowed\nits philosophy or lifestyle to expand to other countries in the\nLatin American region.\n\n7º-That the National Commission of the PBAE carried out, on November 24,\n2006, the second Strategic Plan for the 2007-2011 period, in\nwhich new objectives and goals were set, among them the creation of new\ncategories.\n\n8º-That the PBAE was declared, through\nExecutive Decree No. 33604, as a \"Program of Public Interest for Social Good\".\n\n9º-That it is necessary to adjust some mandatory\nand complementary parameters in the different categories: Beaches,\nCommunities, Educational Centers, Protected Natural Areas, Hydrological\nMicro-basins, Actions to Confront Climate Change, Climate Neutral\nCommunity, and the new category \"Community Health Promotion\", with the\npurpose of optimizing the administration and operation of the Program. Likewise, it\nis necessary to integrate the most relevant normative aspects, the executive\ndecrees that regulate the PBAE. Therefore,\n\nThey Decree:\n\nArticle 1º-Objective of the PBAE: The general\nobjective of the PBAE is to establish an incentive to promote the organization of\nlocal committees and their integrality, with the purpose of seeking\nconservation and development, in accordance with the protection of natural\nresources, the implementation of actions to confront climate change, the\nsearch for better hygienic-sanitary conditions, and the improvement of public\nhealth of the inhabitants of Costa Rica.\n\nArticle 2º-Categories that are integrated and purpose:\nThe decrees intended to be integrated through this regulation are the\nfollowing Decrees No. 31648-MEP-MINAE-S-TUR (Category: Educational Centers)\nof 2004, No. 31610-S-MINAE-TUR of 2004 (Category: Communities and Category:\nBeaches), No. 31978-MEP-MINAE-S-TUR (Declaration of public interest PBAE) of\n2004, No. 33604-MINAE (Category: Protected Natural Areas) of 2007, No.\n34548-MINAE (Category: Actions to Confront Climate Change) of 2008,\nNo. 34777-MINAET-S-MEP (Category: Hydrological Micro-basins) of 2008 and No.\n35162-MINAET (Category: Climate Neutral Community) of 2009; as well as the\ncategory of Community Health Promotion, created through this\nregulation. The purpose of this decree is to integrate the scopes of the\ndifferent categories of the PBAE, creating new mandatory and\ncomplementary parameters for them.\n\nArticle 3º-Creation of the community health promotion category: The VIII category of the PBAE is created, called\n\"Community Health Promotion\", aimed at community organization, so\nthat, with the support of the health authorities of the area, they carry out actions\nand activities with the purpose of improving the quality of life of the corresponding\npopulation.\n\nArticle 4º-Members of the National Commission of the PBAE: The National Commission of the PBAE\n(CNPBAE) is created, which shall be integrated by one titular official and one alternate from each of the\ninstitutions comprising it, which are: Costa Rican Tourism Institute (ICT), Ministry\nof Environment, Energy and Telecommunications (MINAET), Ministry of Health (MINSA), Costa Rican\nElectricity Institute (ICE), Ministry of Public Education (MEP), Costa Rican Institute\nof Aqueducts and Sewers (AYA), Ministry of Agriculture and Livestock (MAG), Costa\nRican Social Security Fund (CCSS) -which is integrated for the new category \"Community\nHealth Promotion\"-, National Chamber of Tourism (CANATUR), Costa Rican Network of Private\nNetworks Association (RED DE RESERVAS). The National Commission of the PBAE may invite other representatives from\nother public and private entities when it deems necessary.\n\nArticle 5º-Duties and powers of the National Commission of the PBAE: The duties and powers of the National Commission\nof the PBAE are:\n\na. Prepare the annual work program, which\nmust be approved by consensus of the Commission or, failing that, by simple majority.\n\nb. Establish\na schedule of meetings with a monthly frequency.\n\nc. Elect,\nevery three years, in the month of December, its organic structure,\nfor which the following positions must be selected from within its ranks:\nPresident and Secretary. Likewise, for operational aspects, with the support of\nthe institutions represented on the Commission, a\nGeneral Coordinator may be selected. Also, internally within the Commission, and from its\nrepresentative members, a Coordinator may be selected for each of the\nfollowing aspects:\n\n-   Finance\n\n-           Publicity\nand Marketing\n\n-           Education\nand Training\n\n-           Annual\nEvents and Local Flag Raisings\n\n-           Others\nthat the Commission defines\n\nd. Evaluate, audit, follow up, and select\nthe local committees winning the Ecological Blue Flag Award.\n\ne. Make\nthe adjustments that are necessary and when they are required to the parameters or\nprocedure manuals of the various categories.\n\nf.  The\nopinions or decisions of the CNPBAE shall be unappealable in matters of\nawarding accolades.\n\nArticle 6º-Formation of Local Committees: Participants in each category must form Local\nCommittees (CLPBAE), which must formalize their registration from January to March\nof each year before the National Commission of the PBAE, and prepare the work\nprograms, which they must present in April of each year, follow up\non the actions to fulfill the mandatory and complementary parameters, and\nsend the annual reports to the National Commission of the PBAE, in the month of\nDecember of the corresponding period. The formation of the different\nLocal Committees for each category will be defined according to Annex A.\n\nArticle 7º-Technical work teams of the CNPBAE:\nThe CNPBAE will integrate Technical Teams with officials from the different\ninstitutions represented within the CNPBAE, with the purpose of\ncarrying out the following functions: promotion, evaluation, follow-up, and other\nsupport and monitoring activities with the Local Committees.\n\nArticle 8º-Functions of the Local Committees:\nThe functions of the Local Committees for each category are:\n\na) Meet at least once a month, keeping a\nbook of minutes where the main agreements, improvements, and\neducational activities carried out will be recorded. In the month of December of each year, a\nreport of these activities will be presented to the CNPBAE.\n\nb) The\nCLPBAE must appoint a coordinator, who will be the direct contact with the\nCNPBAE and the Technical Work Teams (ETPBAE).\n\nc) In the\ncase of Educational Centers, the local committee must have the approval\nof the Director of the institution.\n\nd) In the\nfirst session of the year, the annual work program must be prepared and sent\nto the CNPBAE.\n\ne) The local committee is responsible for designating those responsible for each activity to be carried out\nand for following up on them.\n\nf)  The\ncommittee will keep the CNPBAE informed of all the activities carried out\nduring its evaluation period.\n\ng) The\ncommittee will ensure compliance with each of the program's evaluation parameters.\n\nh) The\ncommittee must prepare a final self-evaluation report in the month of December\nof each year, following the order of the scheme established by the commission for\neach of the 8 categories. Moreover, in the preparation of the final report,\nonly the members of the registered local committee may participate.\n\ni)  In\nthe interest of democratization and greater participation of the inhabitants of a place\nin the PBAE, the same committee will not be allowed to register to participate in\nmore than four categories.\n\nj)  The same member or representative may not have interference or participation in more\nthan four local committees of the same category within the PBAE.\n\nk) The\ncommittee must be willing to be audited by the national commission on the\nself-evaluation proposed.\n\nl)  Appoint\ntwo representatives to attend the awards ceremony organized by the CNPBAE,\nwhen the committee is awarded.\n\nm)        In\nthe case of Educational Centers, form a commission of teachers and\nstudents of up to 5 people to attend the awards ceremony.\n\nn) The\ncommittee will be responsible for organizing the event to raise the Ecological Blue Flag\nin its registered locality.\n\no) Construct\nthe flagpole where the Ecological Blue Flag will be placed, locating it in the public\nor private area of greatest concurrence or relevance for the winning site and\nensure that it remains constantly flying.\n\np) The\nCommittee will cover the cost of a new flag, when the one delivered by the CNPBAE\nsuffers deterioration or is stolen.\n\nq) In\nthe case of Educational Centers, when the local committee becomes a recipient of the\nEcological Blue Flag, it will be automatically registered for the next year,\ninforming the CNPBAE if there are changes within the integration of the Committee.\n\nr)  Others\naimed at strengthening the committees and the PBAE, derived from the\npresent regulation.\n\nArticle 9º-Award logo: The original logo of the award, \"Ecological Blue Flag\", is maintained,\nincluding: the original logo of the program in the center, the evaluation year in the upper right corner,\nand the symbol of each category on the lower right margin. The\nflag or award will have a length of 1.50 meters and a width\nof 1 meter.\n\nArticle 10.-Requirement to participate in the\ncategories of the PBAE: Establishments, entities, organizations,\nand others that participate in any category of the PBAE must, in the first\ninstance, be legally accredited according to their legal nature before the\ninstitutions of the State, when so required, and comply with the current\npublic health regulations, as pertinent.\n\nArticle 11.-Parameters, minimum score, and star grading: The mandatory parameters for each category of the PBAE are\ndefined in Annex B. (attached). The minimum score and the grading of\nstars on the award for each category of the PBAE are presented in Annex\nC. (attached).\n\nArticle 12.-Economic resources: Each public\nand private entity represented on the National Commission of the PBAE is\nempowered to include in its budget the economic and human\nresources necessary to ensure the administration and operation of the National Commission\nand the Work Team of the PBAE. Said resources must be communicated to the\nNational Commission by the representative of each entity in the month of\nSeptember of each year. Likewise, public and private sector agencies,\nwithin the respective legal framework, may contribute to the extent of their\nlegal and material possibilities, and without prejudice to the fulfillment of their\nown objectives, in all those activities developed for the\nstrengthening and development of the Ecological Blue Flag Program.\n\nArticle\n  13.-Procedure manuals for each category: Each category\n  has its respective procedure manual, which details\n  specific aspects for each of them. This manual will be reviewed at\n  least every 4 years by the CNPBAE, to determine if it is appropriate to make operational\n  changes to streamline and modernize the program.
