Transportes\n\nTexto Completo acta: D9DF4\n\nMINISTERIO DE OBRAS PÚBLICAS Y  TRANSPORTES\n\nRes. 246.-San José, a las ocho horas del catorce de\nabril del dos mil once.\n\nConoce este Despacho,\ncreación del proceso de gestión ambiental y social, el cual será desarrollado\npor la Dirección de Planificación Sectorial del Ministerio de Obras Públicas y\nTransportes.\n\nConsiderando:\n\nI.-Que el Estado costarricense, cuenta con una\ntrayectoria favorable en el tema ambiental, la cual pretende consolidar a\ntravés de una gestión dinámica de los diferentes sectores, que forman parte de\nla actividad estatal y consecuentemente con el desarrollo del país.\n\nII.-Que en aras de\ncoadyuvar con la evolución de este elemento fundamental para el desarrollo\nhumano, se ha considerado necesario incorporar dentro de las políticas\nestatales, propuestas, tendientes a mejorar la gestión ambiental, en áreas como\nsalud, infraestructura, entre otras, de manera que contribuyan al\nposicionamiento del país como potencia ambiental.\n\nIII.-Que tanto a\nnivel nacional como internacional se han establecido lineamientos de orden\nambiental, a seguir en materia de elaboración, ejecución y puesta en operación\nde proyectos de infraestructura vial y tal situación obliga a quienes ejecutan\nproyectos de esa índole, implementar dentro de su estructura organizacional y\nde sus funciones, áreas o procesos que se avoquen a la vigilancia y control del\ncumplimiento de dichos lineamientos.\n\nIV.-Que en razón de\nlo anterior, cualquier actividad o proyecto estatal que se pretenda\ndesarrollar, debe ajustarse a los lineamientos que en materia ambiental se han\nimplementado, agregándose a éste elemento otro fundamental, relacionado con el\nimpacto social que la gestión de dicha actividad, podría eventualmente generar.\n\nV.-Que acorde con lo\nexpuesto, resulta necesario crear dentro del Ministerio de Obras Públicas y\nTransportes, un proceso que tenga como objeto, establecer las acciones a\ndesarrollar por parte de la Institución, tendientes a incorporar las variables\nambientales y sociales en el desarrollo de los proyectos de infraestructura y\nde esta forma consolidar y asegurar la sostenibilidad ambiental y social.\n\nVI.-Que lo anterior\nresulta consecuente con los requerimientos del Banco Interamericano de\nDesarrollo (BID), el cual, a\ntravés del \"Convenio de Cooperación para el Financiamiento de Proyectos de\nInversión (CR-X1007)\" otorgó, un monto de hasta USD 850.000.000,00\n(ochocientos cincuenta millones de dólares moneda de los Estados Unidos de\nAmérica), para financiar proyectos de inversión del Programa de Infraestructura\nde Transportes (PIT), los cuales serán distribuidos en diferentes programas\nindividuales que deberán estar en consonancia con los lineamientos establecidos\nen el Plan Nacional de Desarrollo y los planes de inversión del MOPT para los\ndiferentes subsectores.\n\nVII.-Que como primer\nprograma individual del \"Convenio de Cooperación para el Financiamiento de\nProyectos de Inversión (CR-X1007)\" en fecha 27 de noviembre del 2010, se\nsuscribió el Primer Contrato de Préstamo Nº 2007/OC-CR entre el Banco\nInteramericano de Desarrollo y el Gobierno de Costa Rica, por un monto de hasta\nUSD 300.000.000,00 (trescientos millones de dólares moneda de los Estados\nUnidos de América), constituyéndose el Ministerio de Obras Públicas y\nTransportes (MOPT) en prestatario y Organismo Ejecutor de los recursos y\nactuando a través del Consejo Nacional de Vialidad (CONAVI).\n\nVIII.-Que dentro de\nlos contenidos del contrato descrito en la cláusula anterior, específicamente\nen el establecido en el aparte 5.5 del artículo 5 de dicho acuerdo, se dispone\ncomo obligación del prestatario u órgano ejecutor, la necesidad de evidenciar\nla existencia en el MOPT, de una \"Unidad Ambiental y Social\", que garantice la\nconsolidación de ambos elementos (ambiental y social), dentro de los proyectos\nde infraestructura que ejecute el Ministerio como órgano ejecutor de los\nrecursos. A texto expreso señala el referido numeral:\n\n\"Cláusula 5.05.\nCondición especial de ejecución. El Prestatario, por intermedio del\nOrganismo Ejecutor, se compromete a presentar a satisfacción del Banco, antes\nde la firma del primer contrato de obra financiado con recursos del Programa,\nevidencia de la ceración y puesta en marcha de la Unidad de Gestión Ambiental y\nSocial (UGAS) del MOPT, de conformidad con los términos y las condiciones\npreviamente acordados con el Banco.\n\nIX.-Que en razón de lo anterior, se emite el presente\nacto resolutivo mediante el cual, se incluye dentro de las funciones asignadas\na la Dirección de Planificación Sectorial, el proceso de gestión ambiental y\nsocial, cuyo objetivo general será, garantizar que el componente ambiental y\nsocial se incorpore, tanto dentro de la gestión institucional como en el ciclo\nde los proyectos que se desarrollen en los Consejos adscritos, a fin de\ncontribuir con el desarrollo sostenible.\n\nConsiderandos:\n\nLa doctrina ha definido la gestión ambiental, como \"aquel\nconjunto de procedimientos para proteger o dañar lo menos posible el medio\nambiente y eventualmente, recuperarlo\"[1]].\n\n(1)http:es.wikipedia.org/wiki\n\nPor su parte, la\ngestión social se puede delimitar como aquellas acciones que favorecen el\ndiálogo y la interacción entre la población y los demás actores involucrados en\nel proyecto; orientando esfuerzos al desarrollo sostenible y al bienestar de la\npoblación.\n\nEl elemento ambiental\nha sido perfectamente entendido por el Gobierno y a fin de aplicarlo, fue\nintroducido en el Plan Nacional de Desarrollo 2011-2014, considerándolo como\nuno de los objetivos estratégicos en esta Administración.\n\nTal conciencia, debe\nser considerada por quienes lideran las instituciones que forman parte de la\nAdministración Pública, y dentro de sus planes deben ser incluir, los elementos\nque sean necesarios para que sus decisiones sean coherentes y estén vinculadas\ncon las políticas y estrategias que en materia ambiental se pretenden\nconsolidar a través del Plan Nacional de Desarrollo.\n\nEl planteamiento que\nimpera en el Ministerio de Obras Públicas y Transportes está dirigido a\nconsolidar dentro de su estructura o de sus funciones, una gestión que\ninvolucre el elemento ambiental y el social, de manera que se garantice a la\nsociedad civil, que en la toma de decisiones tendentes al desarrollo de\nproyectos de infraestructura tanto por parte del Ministerio como de sus órganos\nadscritos, se observarán de forma minuciosa el cumplimiento de parámetros\nrelacionados con dichos elementos.\n\nValga indicar en este\nsentido, que si bien en el Ministerio no existe una estructura organizacional o\nfuncional, dirigida al desarrollo de prácticas ambientales y sociales, si se\nhan hecho esfuerzos -quizá insuficientes- de que al menos el concepto\n\"ambiental\" forme parte de los objetivos, funciones o conceptos que se han\nincluido en algunas unidades organizacionales. Sin embargo, necesariamente en\nel Ministerio se debe consolidar un único proceso que centralice y unifique,\nlas funciones que en éste se desarrollarán.\n\nEsta dispersión\nfuncional, fue advertida por la Dirección de Planificación Sectorial y a los\nefectos de consolidar una unidad administrativa que gestione la materia\nambiental y social, propone la conformación de un Departamento de Gestión\nAmbiental y Social, señalando en lo conducente lo siguiente:\n\n\".El\nSector Infraestructura y Transporte y más precisamente el Ministerio de Obras\nPúblicas y Transportes y los Consejos, no cuentan con una dependencia centralizada\ncon funciones para desarrollar acciones en materia ambiental y social. En este\ncontexto la gestión social-ambiental se realiza desagregada y sin coordinación\na nivel institucional.\n\nActualmente,\nla Dirección de Planificación Sectorial, que asume la Secretaría Sectorial\nconforma grupos de trabajo con representantes de diferentes dependencias como\napoyo a las labores encomendadas en materia social y ambiental cuando es\nrequerido para los diferentes proyectos.\n\nEs de\nsuma importancia que el MOPT cuente con una dependencia que asuma esta labor de\ngestión en el campo ambiental y social y que coordine además con las otras\ninstituciones y Consejos que forman el Sector Infraestructura y Transportes.\n\nPor\ntanto, se justifica la creación de una dependencia asesora que se incorpore la\nvariable social- ambiental y que trabaje de manera integral con las diferentes\ndependencias a nivel ministerial y consejos ejecutores (COSEVI- CONAVI- CTP-\nCETAC).\"\n\nConsecuente con lo anterior, mediante la promulgación\nde la Ley Nº 8845 denominada \"Aprobación del primer contrato de préstamo Nº\n2007/OC-CR\", suscrito entre la República de Costa    Rica y el Banco Interamericano de\nDesarrollo, para financiar el primer programa de infraestructura vial (PIV I),\nse define como organismo ejecutor de los recursos (USD 300.000.000) al\nMinisterio de Obras Públicas y Transportes, el cual actuaría a través del\nConsejo Nacional de Vialidad (CONAVI). A los efectos, el artículo 3 de la\nreferida Ley señala en lo que interesa, lo siguiente:\n\n\"3.\nORGANISMO EJECUTOR:\n\nLas\npartes convienen en que la ejecución del Programa y la utilización de los\nrecursos del financiamiento del Banco serán llevadas a cabo por el Prestatario,\npor intermedio del Ministerio de Obras Públicas y Transportes (MOPT), en\nadelante denominado el \"Organismo Ejecutor\", que actuará a través del Consejo\nNacional de Vialidad (CONAVI)\".\n\nEn la misma ley, se dispone la necesidad de poner en\nmarcha una Unidad de Gestión Ambiental y Social, a los efectos de que en todas\nlas actividades que se desarrollen tanto a nivel institucional como de los\nConsejos adscritos, se consideren el elemento social y el ambiental. Al\nrespecto, la cláusula 5.05. de la referida Ley, señala lo siguiente:\n\n\"Cláusula\n5.05. Condición especial de ejecución: El Prestatario, por intermedio\ndel Organismo Ejecutor, se compromete a presentar a la satisfacción del Banco,\nantes de la firma del primer contrato de obra financiado con recursos del\nPrograma, evidencia de la creación y puesta en marcha de la Unidad de Gestión\nAmbiental y Social (UGAS) del MOPT, de conformidad con los términos y\ncondiciones previamente acordados con el Banco.\"\n\nEn consecuencia, es necesario dotar de los recursos\nnecesarios para apoyar y consolidar un sistema moderno y sostenible de gestión\nde la Red Vial Nacional, a los efectos de que en dicho sistema se incluya la\nactividad específica del \"Mejoramiento de la gestión ambiental y sociocultural\ndel MOPT- CONAVI, a través de la capacitación y equipamiento para asegurar un\nadecuado manejo de la temática en los proyectos.\"\n\nBajo este contexto,\nresulta necesario posicionar el proceso de gestión ambiental y social, en un\nnivel estratégico de importancia no sólo para la Institución, sino también para\nsus órganos adscritos; en consecuencia, necesariamente debe consolidar tal\ngestión como un proceso cuya ejecución estaría a cargo del Nivel Superior.\n\nNo obstante el Nivel\nSuperior del MOPT, está conformado por los Despachos de los tres\nviceministerios y ocho unidades asesoras; por lo anterior, las relaciones de\ncoordinación y de dirección por parte del Ministro se ven comprometidas. Esta\nrealidad institucional dificulta que el proceso de gestión ambiental y social,\nsea desarrollado directamente por el Jerarca; en razón de ello, y siendo que en\nlos últimos años, la unidad administrativa que se ha encargado con mayor\nespecialización de los estudios socio-ambientales es la Dirección de\nPlanificación Sectorial, se considera que es en tal dependencia dónde debe\nconsolidarse el referido proceso.\n\nEn aras de tornar\neficiente la gestión, será necesario designar en los órganos adscritos,\nencargados que coordinen con quienes asumirán el proceso de gestión ambiental y\nsocial en el Ministerio, para el desarrollo de la información, instrumentos u\notros requerimientos de las autoridades competentes en materia ambiental, en\nlos diferentes proyectos que se propongan para la ejecución.\n\nA continuación se\nesbozarán algunos aspectos de especial relevancia del proceso de gestión\nambiental y social, la cual como se expuso supra, será un proceso que se\nincorporará dentro de las funciones asignadas a la Dirección de Planificación\nSectorial.\n\na)Funciones:\n\n1) Aplicar los instrumentos de gestión ambiental y\nsocial correspondientes, de conformidad con la normativa ambiental vigente en\nel país y otros requerimientos de organismos internacionales.\n\n2) Coordinar con los encargados de la gestión\nambiental y social de cada uno de los órganos adscritos al MOPT, para el\ndesarrollo de la información, instrumentos u otros requerimientos de las\nautoridades competentes en materia ambiental, en los diferentes proyectos que\nse propongan para la ejecución.\n\n3) Participar como contraparte, en coordinación\ncon los encargados de la gestión ambiental y social de los órganos adscritos al\nMOPT, durante la elaboración de los estudios sociales y ambientales que se\ncontraten.\n\n4) Elaborar o contratar a terceros, los estudios\nambientales y sociales requeridos por organismos multilaterales internacionales\no por la Secretaría Técnica Nacional Ambiental (SETENA), en particular para la\nobtención de la viabilidad ambiental de los proyectos.\n\n5) Preparar y/o coordinar la elaboración de\ntérminos de referencia para la contratación de regencias (responsabilidad\nambiental) y estudios ambientales y sociales requeridos por organismos\nmultilaterales internacionales o por SETENA, en particular para la obtención de\nla viabilidad ambiental de los proyectos.\n\n6) Colaborar en el proceso de regencia ambiental\nrequerido por las autoridades ambientales, en aquellos casos en que el\ndesarrollador del proyecto sea la Institución como tal y no un ente adscrito.\n\n7) Brindar seguimiento, en coordinación con el\nejecutor del proyecto, a las actividades desarrolladas por el responsable\nambiental para el cumplimiento de las medidas establecidas en los respectivos\nestudios socia-ambientales.\n\n8) Desarrollar, actualizar, promover y divulgar el\nMarco de Gestión Ambiental y Social de la Unidad para su aplicación en todos\nlos proyectos que el MOPT promueva a lo largo del ciclo del proyecto,\nconstituyéndose en un instrumento de amplio conocimiento y uso por parte de la\nInstitución.\n\n9) Promover y divulgar el Marco de Gestión Ambiental y Social de organismos multilaterales, como el\nBID, para que se constituya en un instrumento de amplio conocimiento y uso por parte de los\nresponsables de la ejecución de las obras financiadas por éstos.\n\n10) Desarrollar y actualizar los planes de gestión\nambiental y social internos de la Institución, de acuerdo con las necesidades\nrequeridas.\n\n11) Desarrollar y mantener actualizado un sistema\nde información geográfica que incorpore todas las variables ambientales y\nsociales, como herramienta en la toma de decisiones.\n\n12) Coordinar de forma permanente con la SETENA, a\ntravés del Representante del MOPT ante esa Secretaría.\n\n13) Promover y mantener un \"Plan de Capacitación\"\npermanente, en materia de gestión ambiental y social, tanto en el MOPT como en\nsus órganos adscritos, en coordinación con la Dirección de Capacitación y de\nDesarrollo del MOPT; Por tanto,\n\nEL MINISTRO DE OBRAS PÚBLICAS Y TRANSPORTES,\n\nRESUELVE:\n\n1º-Crear el Proceso de Gestión Ambiental y Social\ndentro de la Dirección de Planificación Sectorial del Ministerio de Obras\nPúblicas y Transportes, el cual tendrá como objetivo general, garantizar que el\ncomponente ambiental y social se incorpore tanto dentro de la gestión\ninstitucional, como dentro del ciclo de los proyectos que se ejecuten en los\nConsejos adscritos, a fin de contribuir con el desarrollo sostenible.\n\n2º-Dotar a dicho\nproceso de los insumos necesarios para el desarrollo eficiente del proceso,\ntales como recurso humano, tecnológico y financiero, acordes con la realidad\ninstitucional.\n\n3º-Rige a partir de\nsu publicación.", "body_en_text": "throughout the text\n\n-\n\nFull Text of Norm 246\n\nCreation of the Environmental and Social Management Process of the\nDirectorate of Sectoral Planning of the Ministry of Public Works and Transport\n\nFull Text record: D9DF4\n\nMINISTRY OF PUBLIC WORKS AND TRANSPORT\n\nRes. 246.—San José, at eight o'clock on the fourteenth of\nApril, two thousand eleven.\n\nThis Office is aware of the\ncreation of the environmental and social management process, which will be carried out\nby the Directorate of Sectoral Planning of the Ministry of Public Works and\nTransport.\n\nConsidering:\n\nI.—That the Costa Rican State has a favorable\ntrack record in environmental matters, which it intends to consolidate\nthrough dynamic management by the different sectors that form part of\nstate activity and, consequently, with the country's development.\n\nII.—That in order to\ncontribute to the evolution of this fundamental element for human\ndevelopment, it has been deemed necessary to incorporate, within state\npolicies, proposals aimed at improving environmental management in areas such\nas health, infrastructure, among others, so as to contribute to the\npositioning of the country as an environmental powerhouse.\n\nIII.—That both at the\nnational and international level, environmental guidelines have been established\nto be followed in the preparation, execution, and commissioning\nof road infrastructure projects, and this situation obliges those who execute\nsuch projects to implement, within their organizational structure and\ntheir functions, areas or processes dedicated to monitoring and controlling\ncompliance with said guidelines.\n\nIV.—That by reason of\nthe foregoing, any state activity or project intended to be\ndeveloped must conform to the guidelines that have been implemented in environmental matters,\nadding to this element another fundamental one, related to\nthe social impact that the management of said activity could eventually generate.\n\nV.—That in accordance with the\nabove, it is necessary to create within the Ministry of Public Works and\nTransport, a process whose purpose is to establish the actions to be\ncarried out by the Institution, aimed at incorporating environmental\nand social variables in the development of infrastructure projects and thereby\nconsolidate and ensure environmental and social sustainability.\n\nVI.—That the foregoing\nis consistent with the requirements of the Inter-American Development\nBank (IDB), which,\nthrough the \"Cooperation Agreement for the Financing of Investment\nProjects (CR-X1007)\" granted an amount of up to USD 850,000,000.00\n(eight hundred fifty million dollars, currency of the United States of\nAmerica), to finance investment projects of the Transport Infrastructure\nProgram (PIT), which will be distributed among different individual\nprograms that must be consistent with the guidelines established\nin the National Development Plan and the MOPT's investment plans for the\ndifferent subsectors.\n\nVII.—That as the first\nindividual program of the \"Cooperation Agreement for the Financing of\nInvestment Projects (CR-X1007)\" on November 27, 2010, the\nFirst Loan Contract No. 2007/OC-CR was signed between the Inter-American\nDevelopment Bank and the Government of Costa Rica, for an amount of up to\nUSD 300,000,000.00 (three hundred million dollars, currency of the United\nStates of America), with the Ministry of Public Works and\nTransport (MOPT) acting as borrower and Executing Agency for the resources\nand acting through the National Roadway Council (CONAVI).\n\nVIII.—That within\nthe contents of the contract described in the previous clause, specifically\nthat established in subsection 5.5 of Article 5 of said agreement, it is stipulated\nas an obligation of the borrower or executing agency, the need to demonstrate\nthe existence within the MOPT of an \"Environmental and Social Unit,\" which guarantees the\nconsolidation of both elements (environmental and social), within the\ninfrastructure projects that the Ministry executes as the executing agency for the\nresources. The referred numeral expressly states:\n\n\"Clause 5.05.\nSpecial condition of execution. The Borrower, through the\nExecuting Agency, undertakes to present, to the satisfaction of the Bank,\nbefore the signing of the first works contract financed with Program\nresources, evidence of the creation and start-up of the MOPT's Environmental and Social Management\nUnit (UGAS), in accordance with the terms and conditions\npreviously agreed upon with the Bank.\"\n\nIX.—That by reason of the foregoing, this\nresolutory act is issued whereby the environmental and social management process is included within the functions assigned\nto the Directorate of Sectoral Planning, the general objective of which will be to guarantee that the environmental\nand social component is incorporated, both within institutional management and in the\nproject cycle for projects developed in the attached Councils, in order\nto contribute to sustainable development.\n\nWhereas:\n\nDoctrine has defined environmental management as \"that\nset of procedures to protect or damage the environment as little as possible and, eventually, recover it\"[1]].\n\n(1)http:es.wikipedia.org/wiki\n\nFor its part,\nsocial management can be defined as those actions that favor\ndialogue and interaction between the population and the other actors involved in\nthe project, directing efforts toward sustainable development and the well-being of the\npopulation.\n\nThe environmental element\nhas been perfectly understood by the Government, and in order to apply it, it was\nintroduced into the National Development Plan 2011-2014, considering it as\none of the strategic objectives in this Administration.\n\nSuch awareness must\nbe considered by those who lead the institutions that form part of the\nPublic Administration, and within their plans, they must include the\nelements that are necessary for their decisions to be coherent and linked\nwith the environmental policies and strategies that are intended to be\nconsolidated through the National Development Plan.\n\nThe approach that\nprevails in the Ministry of Public Works and Transport is aimed at\nconsolidating within its structure or its functions, a management that\ninvolves the environmental and the social element, thereby guaranteeing to\ncivil society that in decision-making aimed at the\ndevelopment of infrastructure projects, both by the Ministry and its attached\nbodies, compliance with parameters\nrelated to said elements will be meticulously observed.\n\nIt is worth indicating in this\nregard, that although there is no organizational or functional structure in the Ministry\ndirected at developing environmental and social practices, efforts have\nbeen made—perhaps insufficient—so that at least the\n\"environmental\" concept forms part of the objectives, functions, or concepts that have been\nincluded in some organizational units. However, a single process must necessarily\nbe consolidated in the Ministry that centralizes and unifies\nthe functions that will be developed therein.\n\nThis functional\ndispersion was noted by the Directorate of Sectoral Planning, and for the purposes\nof consolidating an administrative unit that manages environmental\nand social matters, it proposes the formation of a Department of Environmental\nand Social Management, indicating the following in relevant part:\n\n\".The\nInfrastructure and Transport Sector and more precisely the Ministry of Public\nWorks and Transport and the Councils, do not have a centralized\nunit with functions to develop actions in environmental and social matters. In this\ncontext, social-environmental management is carried out disaggregated and without coordination\nat the institutional level.\n\nCurrently,\nthe Directorate of Sectoral Planning, which assumes the Sectoral Secretariat,\nforms working groups with representatives from different departments as\nsupport for the tasks entrusted in social and environmental matters when it is\nrequired for different projects.\n\nIt is of\nutmost importance that the MOPT has a unit that assumes this management\nwork in the environmental and social field and that also coordinates with the other\ninstitutions and Councils that form the Infrastructure and Transport Sector.\n\nTherefore,\nthe creation of an advisory unit is justified that incorporates the\nsocial-environmental variable and works integrally with the different\ndepartments at the ministerial level and executing councils (COSEVI- CONAVI- CTP-\nCETAC).\"\n\nConsistent with the foregoing, through the promulgation\nof Law No. 8845 called \"Approval of the first loan contract No.\n2007/OC-CR,\" signed between the Republic of Costa Rica and the Inter-American Development\nBank, to finance the first road infrastructure program (PIV I),\nthe Ministry of Public Works and Transport is defined as the executing agency for the resources (USD 300,000,000),\nwhich would act through the\nNational Roadway Council (CONAVI). To this effect, Article 3 of the\nreferred Law states, in what is relevant, the following:\n\n\"3.\nEXECUTING AGENCY:\n\nThe\nparties agree that the execution of the Program and the use of the\nBank's financing resources will be carried out by the Borrower,\nthrough the Ministry of Public Works and Transport (MOPT), hereinafter\ncalled the \"Executing Agency,\" which will act through the National\nRoadway Council (CONAVI).\"\n\nIn the same law, the need to start up\nan Environmental and Social Management Unit is stipulated, so that in all\nactivities carried out both at the institutional level and that of the\nattached Councils, the social and environmental elements are considered. In this\nregard, clause 5.05 of the referred Law states the following:\n\n\"Clause\n5.05. Special condition of execution: The Borrower, through\nthe Executing Agency, undertakes to present, to the satisfaction of the Bank,\nbefore the signing of the first works contract financed with Program\nresources, evidence of the creation and start-up of the MOPT's Environmental\nand Social Management Unit (UGAS), in accordance with the terms and\nconditions previously agreed upon with the Bank.\"\n\nConsequently, it is necessary to provide the\nresources needed to support and consolidate a modern and sustainable system for managing\nthe National Road Network, so that in said system, the\nspecific activity of \"Improvement of the environmental and sociocultural management\nof the MOPT-CONAVI, through training and equipment to ensure adequate\nhandling of the theme in projects\" is included.\n\nIn this context,\nit is necessary to position the environmental and social management process at\na strategic level of importance not only for the Institution but also for\nits attached bodies; consequently, such management must necessarily be consolidated\nas a process whose execution would be the responsibility of the Senior Level.\n\nHowever, the Senior\nLevel of the MOPT is composed of the Offices of the three\nvice-ministries and eight advisory units; therefore, the\ncoordination and direction relations on the part of the Minister are compromised. This\ninstitutional reality makes it difficult for the environmental and social management process to\nbe developed directly by the Head of the Institution; for this reason, and since in\nrecent years, the administrative unit that has been tasked with greater\nspecialization in socio-environmental studies is the Directorate of\nSectoral Planning, it is considered that it is in this department where\nthe referred process should be consolidated.\n\nIn the interest of making\nmanagement efficient, it will be necessary to designate, in the attached bodies,\nmanagers who coordinate with those who will assume the environmental and social management process\nin the Ministry, for the development of information, instruments, or\nother requirements of the competent environmental authorities, in\nthe different projects that are proposed for execution.\n\nBelow,\nsome aspects of special relevance to the environmental and social management process\nwill be outlined, which, as stated above, will be a process that\nwill be incorporated into the functions assigned to the Directorate of Sectoral\nPlanning.\n\na)Functions:\n\n1) Apply the corresponding environmental and social management\ninstruments, in accordance with the environmental regulations in force\nin the country and other requirements of international organizations.\n\n2) Coordinate with those responsible for environmental\nand social management in each of the bodies attached to the MOPT, for the\ndevelopment of information, instruments, or other requirements of the\ncompetent environmental authorities, in the different projects that\nare proposed for execution.\n\n3) Participate as a counterpart, in coordination\nwith those responsible for environmental and social management in the bodies attached to the\nMOPT, during the preparation of the social and environmental studies that are\ncontracted.\n\n4) Prepare, or contract third parties for, the environmental\nand social studies required by international multilateral organizations\nor by the National Environmental Technical Secretariat (SETENA), particularly for\nobtaining the environmental feasibility (viabilidad ambiental) of the projects.\n\n5) Prepare and/or coordinate the elaboration of\nterms of reference for contracting environmental supervision (regencias)\nand environmental and social studies required by international\nmultilateral organizations or by SETENA, particularly for obtaining the\nenvironmental feasibility (viabilidad ambiental) of the projects.\n\n6) Collaborate in the environmental supervision (regencia ambiental) process\nrequired by the environmental authorities, in those cases where the\nproject developer is the Institution itself and not an attached entity.\n\n7) Provide follow-up, in coordination with the\nproject executor, on the activities carried out by the environmental supervisor (responsable\nambiental) for compliance with the measures established in the respective\nsocial-environmental studies.\n\n8) Develop, update, promote, and disseminate the Environmental and Social Management\nFramework of the Unit for its application in all\nprojects that the MOPT promotes throughout the project cycle,\nmaking it an instrument of broad knowledge and use by the\nInstitution.\n\n9) Promote and disseminate the Environmental and Social Management Framework of multilateral organizations, such as the\nIDB, so that it becomes an instrument of broad knowledge and use by those\nresponsible for the execution of works financed by them.\n\n10) Develop and update the Institution's internal environmental and social management\nplans, in accordance with the required\nneeds.\n\n11) Develop and keep updated a geographic\ninformation system that incorporates all environmental and\nsocial variables, as a tool for decision-making.\n\n12) Coordinate permanently with SETENA, through\nthe MOPT Representative before that Secretariat.\n\n13) Promote and maintain a permanent \"Training Plan,\"\nin environmental and social management matters, both in the MOPT and in\nits attached bodies, in coordination with the MOPT's Training and\nDevelopment Directorate;
