Por lo que el Estado mantendrá un papel\npreponderante y dictará las medidas generales y particulares, relacionadas con\nla investigación, la exploración, la explotación y el desarrollo de esos\nrecursos, con base en lo dispuesto en el Plan Nacional de Desarrollo.\n\n6º-Que una de las metas del Plan Nacional de\nDesarrollo 2011-2014 \"María Teresa Obregón Zamora\" es el impulso del aprovechamiento\nde las fuentes renovables de energía de que dispone, para alcanzar que el 95%\nde la energía nacional se sustente en fuentes renovables.\n\n7º-Que el Proyecto Hidroeléctrico El Diquís, es un\nproyecto de desarrollo requerido por el país, el cual forma parte del Plan de\nExpansión de Generación Eléctrica, por lo que su implementación oportuna es de\ninterés público, a fin de suplir la demanda energética, y reducir la\ndependencia de combustibles importados, así como aprovechar mejor las fuentes\nde energía renovables.\n\n8º-Que el Proyecto Hidroeléctrico El Diquís\naumentaría el porcentaje de la producción de electricidad de fuentes\nrenovables, lo cual contribuye a las acciones de país para mitigar el cambio\nclimático y para el cumplimiento de la meta de carbono neutralidad a futuro.\n\n9º-Que el Ministerio de Ambiente, Energía y\nTelecomunicaciones es el ente rector del Sector Energía y como tal tiene como\nmisión la coordinación de los distintos entes del Sector Eléctrico, incluyendo\ninstituciones autónomas, entes privados, organizaciones y grupos de poder de la\nsociedad civil y a la Presidencia de la Republica. La\nautoridad máxima de cada Ministerio e Institución participante deberá acreditar\nante el Presidente de la Comisión Diquís, a su representante oficial y su\nsuplente, a más tardar un mes después de publicado el presente Decreto\nEjecutivo. Los funcionarios nombrados deberán ser personal con dominio técnico\nen la materia propia de la institución que representa y ostentar las facultades\ninstitucionales suficientes para la toma de decisiones.\n\nArtículo 4º-Funciones de la Comisión. La\nComisión Diquís tendrá las siguientes funciones:\n\n1) Elaborar y dar seguimiento a un Plan de Trabajo de Coordinación\nInterinstitucional que incluirá proyectos, programas y actividades para el\ndesarrollo de la zona Sur en el marco del Proyecto Hidroeléctrico El Diquís.\nDicho Plan incluirá una referencia sobre los recursos que cada institución destinará\npara el cumplimiento de sus actividades.\n\n2) Establecer los mecanismos de coordinación interinstitucional y toma\nde decisiones, para la ejecución efectiva de los planes elaborados por la\nComisión Diquis para el desarrollo del Proyecto Hidroeléctrico El Diquís.\n\n3) Dar seguimiento al cumplimiento de las responsabilidades y\ncompromisos de cada Ministerio o Institución en los proyectos, programas y\nactividades a que se refiere el inciso primero.\n\n4) Coordinar y ejecutar la realización de un proceso de divulgación con\nlos sectores políticos, económicos y sociales del país, en torno a los planes\nelaborados por la Comisión Diquís.\n\n5) Cada uno de los miembros, en el ejercicio de la representación de\nlos Ministerios e Instituciones, brindará el apoyo necesario en temas\nestratégicos como servicios básicos de salud, educación, vivienda, y otros como\ncultura, deporte, esparcimiento, seguridad ciudadana, sin perjuicio de\ncualquier otro tema a valorarse en el seno de la Comisión Diquís, que deberán\nincluirse dentro del Plan de Trabajo para su análisis.\n\n6) Las demás funciones que la Comisión Diquís establezca según los\nrequerimientos de su ámbito de coordinación.\n\nArtículo 5º-De la Secretaría de la Comisión. El representante del\nInstituto Costarricense de Electricidad , titular de la Secretaría de la\nComisión Diquís, será el responsable de llevar un registro de las\nacreditaciones de los representantes; realizar las convocatorias; preparar en\ncoordinación con el Presidente de la Comisión, el orden del día para cada sesión;\nconfirmar la asistencia en cada sesión; levantar el acta de la sesión;\ncoordinar la recolección de firmas; circular las actas entre los miembros de la\nComisión; llevar un registro actualizado de los acuerdos tomados; realizar el\nseguimiento continuo de la ejecución de los acuerdos y emitir cualquier\ncomunicación de interés para el giro de trabajo de la Comisión.\n\nArtículo 6º-Reuniones y calendario de sesiones.\nLa Comisión Diquís se reunirá ordinariamente una vez al mes, y\nextraordinariamente cuando sea convocada por su Presidente con por lo menos dos\ndías hábiles de anticipación.\n\nSe establecerá un calendario de reuniones anual.\n\nEl orden del día y el acta de la sesión anterior se\nenviarán a cada integrante con ocho días naturales de antelación a la realización\nde cada sesión. La asistencia a las sesiones será obligatoria.\n\nArtículo 7º-De las Sesiones de la Comisión.\nEn las sesiones de la Comisión Diquís participarán únicamente sus\nrepresentantes debidamente autorizados. La Comisión queda facultada para convocar\na las personas interesadas en la discusión de un determinado asunto, con el fin\nde exponer sus puntos de vista.\n\nDe cada sesión se levantará un acta, que contendrá,\nentre otros aspectos, la indicación de los miembros asistentes o participantes\na las sesiones, las circunstancias de lugar y tiempo en que se ha celebrado,\nlos puntos principales de revisión y seguimiento, así como el contenido de los\nacuerdos que se adopten.\n\nArtículo 8º-Plazo para la elaboración del Plan\nde Trabajo. Una vez transcurrido el plazo establecido en el artículo tres,\ny debidamente integrada la Comisión Diquís, ésta dispondrá de un término de dos\nmeses para la elaboración del Plan de Trabajo y el calendario anual de\nreuniones.\n\nArtículo 9º-Organización interna de la Comisión.  La Comisión podrá constituir grupos para\ntemas específicos y ejecutivos, con participación de miembros de la propia\nComisión y de otros participantes que se considere conveniente. Therefore,\n\nThey decree:\n\nCREATION OF THE INTERINSTITUTIONAL COORDINATION\n\nCOMMISSION FOR THE EL DIQUÍS HYDROELECTRIC\n\nPROJECT\n\nArticle 1—Creation. The Interinstitutional Coordination Commission for the El Diquís\nHydroelectric Project is hereby created, hereinafter referred to as the \"Diquís Commission,\" with\nthe purpose of collaborating and coordinating the development of the southern zone within the\nframework of the El Diquís Hydroelectric Project.\n\nArticle 2—Composition. The Diquís Commission shall be composed of regular and alternate\nofficials from the following Ministries and Institutions:\n\n1) The Minister of Environment, Energy and Telecommunications, who shall preside over it.\n\n2) An official of the Costa Rican Electricity Institute, who shall serve as secretary of\nthe Commission.\n\n3) An official of the Ministry of National Planning and Economic Policy.\n\n4) An official of the Ministry of Public Education.\n\n5) An official of the Ministry of Public Works and Transport.\n\n6) An official of the Ministry of Agriculture and Livestock.\n\n7) An official of the Ministry of Social Welfare and Family.\n\n8) An official of the Ministry of Housing and Human Settlements.\n\n9) An official of the Ministry of Culture and Youth.\n\n10) An official of the Ministry of Health.\n\n11) An official of the Institute of Agrarian Development.\n\n12) An official of the Costa Rican Social Security Fund.\n\n13) An official of the Costa Rican Institute of Aqueducts and Sewers.\n\n14) An official of the National Learning Institute.\n\n15) A representative of the Technical Commission for the Integrated Management and\nDevelopment of the Térraba River Basin.\n\nThe Diquís Commission shall have its headquarters in the Presidential House and every three\nmonths the Presidential Environment Council shall receive it to jointly evaluate the progress of\nthe Commission's work.\n\nArticle 3—Powers of its members. The highest authority of each participating Ministry and\nInstitution must accredit its official representative and its alternate to the President of the\nDiquís Commission, no later than one month after the publication of this Executive Decree. The\nappointed officials must be personnel with technical mastery in the specific area of the\ninstitution they represent and possess sufficient institutional faculties for decision-making.\n\nArticle 4—Functions of the Commission. The Diquís Commission shall have the following\nfunctions:\n\n1) Prepare and monitor an Interinstitutional Coordination Work Plan that will include\nprojects, programs, and activities for the development of the southern zone within the framework\nof the El Diquís Hydroelectric Project. Said Plan shall include a reference to the resources\nthat each institution will allocate for the fulfillment of its activities.\n\n2) Establish the mechanisms for interinstitutional coordination and decision-making, for\nthe effective execution of the plans prepared by the Diquís Commission for the development of the\nEl Diquís Hydroelectric Project.\n\n3) Monitor compliance with the responsibilities and commitments of each Ministry or\nInstitution in the projects, programs, and activities referred to in subsection one.\n\n4) Coordinate and execute the realization of a dissemination process with the country's\npolitical, economic, and social sectors, regarding the plans prepared by the Diquís Commission.\n\n5) Each member, in the exercise of representing the Ministries and Institutions, shall\nprovide the necessary support on strategic issues such as basic health, education, and housing\nservices, and others such as culture, sports, recreation, and citizen security, without prejudice\nto any other topic to be assessed within the Diquís Commission, which must be included within the\nWork Plan for its analysis.\n\n6) Other functions that the Diquís Commission establishes according to the requirements of\nits coordination scope.\n\nArticle 5—The Secretariat of the Commission. The representative of the Costa Rican\nElectricity Institute , head of the Secretariat of the Diquís Commission, shall be responsible\nfor keeping a registry of the representatives' accreditations; issuing the calls for meetings;\npreparing, in coordination with the President of the Commission, the agenda for each session;\nconfirming attendance at each session; drafting the minutes of the session; coordinating the\ncollection of signatures; circulating the minutes among the members of the Commission; keeping an\nupdated record of the agreements made; carrying out continuous follow-up on the execution of the\nagreements; and issuing any communication of interest for the Commission's scope of work.\n\nArticle 6—Meetings and session schedule.\nThe Diquís Commission shall meet ordinarily once a month, and extraordinarily when convened by\nits President with at least two business days' notice.\n\nAn annual meeting schedule shall be established.\n\nThe agenda and the minutes of the previous session shall\nbe sent to each member eight calendar days in advance of each session. Attendance at the\nsessions shall be mandatory.\n\nArticle 7—The Sessions of the Commission. Only its duly authorized representatives shall\nparticipate in the sessions of the Diquís Commission. The Commission is empowered to convene the\npersons interested in the discussion of a particular matter, for the purpose of presenting their\npoints of view.\n\nMinutes shall be drafted for each session, which shall contain, among other aspects, the\nindication of the members attending or participating in the sessions, the circumstances of place\nand time in which it was held, the main points of review and follow-up, as well as the content of\nthe agreements adopted.\n\nArticle 8—Deadline for the preparation of the Work Plan. Once the period established in\nArticle three has elapsed, and the Diquís Commission is duly integrated, it shall have a term of\ntwo months for the preparation of the Work Plan and the annual meeting schedule.\n\nArticle 9—Internal organization of the Commission. The Commission may form groups for\nspecific and executive topics, with the participation of members of the Commission itself and\nother participants deemed appropriate. This organization must ensure the participation of the\ninhabitants of the region where the El Diquís Hydroelectric Project will be developed.\n\nArticle 10.—It shall become effective upon its publication.\n\nGiven at the Presidency of the Republic.—San José, on the seventeenth day of the month of\nMarch of two thousand eleven." }
