del 2004\", aprobado por la Junta Directiva en la\nsesión ordinaria N° 5391, artículo 5, inciso III), celebrada el 6 de diciembre\ndel 2005 y comunicado mediante oficio SJD-1165-2005, con el propósito de\naclarar los alcances de las condiciones que se han establecido, para que se lea\nde la siguiente manera: Por tanto,\n\nSe establece el siguiente Procedimiento Institucional sobre\nlos Planes Reguladores Costeros aprobados con fecha anterior al 19 de octubre\ndel 2004:\n\na) Todo Plan Regulador que tenga la Aprobación del\nInstituto Costarricense de Turismo, mediante su acuerdo de Junta Directiva con\nfecha anterior al Pronunciamiento C-297-2004, de fecha 19 de octubre del 2004,\nemitido por la Procuraduría General de La República,  podrá realizar los siguientes trámites ante\nla Dirección de Planeamiento y Desarrollo:\n\na.1.Solicitar\nlos sellos de V° B° a la Dirección de Planeamiento y Desarrollo para proceder a\nla convocatoria para la Audiencia Pública.\n\na.2.Solicitar los sellos de V° B° a la Dirección de\nPlaneamiento y Desarrollo para proceder a la publicación en el Diario Oficial La\nGaceta.\n\nb) En el caso \nde los Planes Reguladores Oficializados mediante la publicación en el\nDiario Oficial La Gaceta, las Municipalidades no podrán otorgar\nConcesiones hasta que se haya realizado la delimitación de las zonas de bosque\ny terrenos de aptitud forestal, por parte del Ministerio del Ambiente y\nEnergía, con el procedimiento \nestablecido  en la Metodología\noficial para tal fin, en la zona marítimo terrestre que abarca el plan\nregulador en cuestión.\n\nc) Las Municipalidades\nquedarán inhibidas de otorgar Anuencias a favor de particulares para la\nelaboración de planes reguladores costeros hasta tanto no se delimiten las\nzonas de bosque y terrenos de aptitud forestal, las anuencias que se han\notorgado con fecha posterior al Pronunciamiento C-297-2004, de fecha 19 de\noctubre del 2004, quedarán bajo la responsabilidad de la Municipalidad que la\nemitió, salvando la responsabilidad el Instituto Costarricense de Turismo.\n\nd) Los\nPlanes Reguladores que sean afectados parcialmente por la delimitación de las\nzonas de bosque y terrenos de aptitud forestal que defina el MINAE (*), con la\nutilización de la Metodología vigente para tal fin, deberán ser actualizados,\nno obstante mantendrán su vigencia en las porciones y áreas que no hayan sido\nafectadas por el Patrimonio Natural del Estado.\n\n(Así\nreformado el punto anterior por acuerdo tomado en sesión N° 5688 del 3 de mayo\ndel 2011)\n\n(*)(Así\nmodificada su denominación por el artículo 11 de la Ley \"Traslado del\nsector Telecomunicaciones del Ministerio de Ambiente, Energía y\nTelecomunicaciones al Ministerio de Ciencia y Tecnología, N° 9046 del 25 de\njunio de 2012)\n\nd.1)\nEn los Planes Reguladores que resultaren afectados parcialmente por la\ndemarcatoria del Patrimonio Natural del Estado, las concesiones se podrán\notorgar por un área menor de la permitida por el Plan Regulador para los\ndiferentes usos de suelo, siempre que el proyecto a desarrollar sea viable técnicamente\nde conformidad con el Ordenamiento Jurídico vigente. Se exceptúa de lo\nanterior, los terrenos ubicados en zona de uso residencial, cuya área mínima\nse encuentra establecida por el artículo 65 del Reglamento de la Ley N° 6043.\n\n(Así\nadicionado el punto d.1) anterior por acuerdo tomado en sesión N° 5688 del 3\nde mayo del 2011)\n\ne) El Instituto\nCostarricense de Turismo deberá dar la aprobación fínal a la nueva versión del\nPlan Regulador, por lo que deberá ser sometido nuevamente a conocimiento de\neste Instituto, entregando los archivos digitales de la documentación en los\nformatos en que originalmente fueron elaborados los documentos y Láminas de\nanálisis, zonificación y vialidad.\n\nf)  Con el aval de las\ninstituciones INVU e ICT, una vez que se hayan realizado las actualizaciones\nseñaladas, la Municipalidad respectiva realizará  la \npublicación en el Diario \nOficial  La  Gaceta \npara  la Oficialización del Plan\nRegulador.\n\ng) En los Planes\nReguladores que la delimitación de las zonas de Bosque y terrenos de aptitud\nforestal los afecte totalmente, el Instituto Costarricense de Turismo, mediante\nacuerdo de su Junta Directiva, procederá a la derogación del Acuerdo de\naprobación inicial, sin perjuicio de los trámites y gestiones que se hayan\nrealizado a la fecha. Request the approval (V° B°) stamps from the Directorate of Planning and Development to proceed with the publication in the Official Gazette La Gaceta.\n\nb) In the case of Regulatory Plans made official via publication in the Official Gazette La Gaceta, the Municipalities may not grant Concessions until the delimitation of forest (bosque) zones and lands suitable for forestry (terrenos de aptitud forestal) has been carried out by the Ministry of Environment and Energy, using the procedure established in the official Methodology for this purpose, within the maritime-terrestrial zone (zona marítimo terrestre) covered by the regulatory plan in question.\n\nc) The Municipalities shall be barred from granting Authorizations (Anuencias) in favor of private parties for the preparation of coastal regulatory plans until such time as the forest (bosque) zones and lands suitable for forestry (terrenos de aptitud forestal) are delimited. Authorizations (Anuencias) that have been granted after the date of Pronouncement C-297-2004, dated October 19, 2004, shall remain under the responsibility of the Municipality that issued them, absolving the Costa Rican Tourism Institute of responsibility.\n\nd) Regulatory Plans that are partially affected by the delimitation of forest (bosque) zones and lands suitable for forestry (terrenos de aptitud forestal) defined by MINAE (*), using the Methodology in force for this purpose, must be updated; however, they shall remain in force for those portions and areas that have not been affected by the Natural Heritage of the State (Patrimonio Natural del Estado).\n\n(Thus amended the preceding point by agreement taken in session No. 5688 of May 3, 2011)\n\n(*)(Thus modified its name by article 11 of Law \"Transfer of the Telecommunications Sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology, No. 9046 of June 25, 2012)\n\nd.1) In Regulatory Plans that are partially affected by the demarcation of the Natural Heritage of the State (Patrimonio Natural del Estado), concessions may be granted for an area smaller than that permitted by the Regulatory Plan for the different land uses, provided that the project to be developed is technically viable in accordance with the current Legal Framework (Ordenamiento Jurídico). Excepted from the foregoing are lands located in a residential use zone, whose minimum area is established by article 65 of the Regulation to Law No. 6043.\n\n(Thus added the preceding point d.1) by agreement taken in session No. 5688 of May 3, 2011)\n\ne) The Costa Rican Tourism Institute must give final approval to the new version of the Regulatory Plan, which must therefore be submitted again for the consideration of this Institute, delivering the digital files of the documentation in the formats in which the documents and the Analysis, Zoning, and Road (vialidad) Maps (Láminas) were originally prepared.\n\nf) With the endorsement of the institutions INVU and ICT, once the indicated updates have been made, the respective Municipality shall carry out the publication in the Official Gazette La Gaceta for the Officialization of the Regulatory Plan.\n\ng) In Regulatory Plans where the delimitation of forest (Bosque) zones and lands suitable for forestry (terrenos de aptitud forestal) affects them entirely, the Costa Rican Tourism Institute, by agreement of its Board of Directors, shall proceed to repeal the initial approval Agreement, without prejudice to the procedures and actions that may have been carried out to date.
