Uso, Control y Mantenimiento Vehículo\n\nTexto Completo acta: E1CE3\n\nNº 36564-MINAET\n\n(Este\ndecreto fue derogado por el artículo 1° del decreto ejecutivo N° 36936 del 4\nde octubre del 2011)\n\n LA PRESIDENTA DE LA REPÚBLICA\n\n Y EL MINISTRO DE AMBIENTE, ENERGÍA\n\n Y TELECOMUNICACIONES\n\nEn ejercicio de las facultades que les confieren\nlos incisos 3) y 18) del artículo 140 y 146 de la Constitución Política; el\nartículo 27 y 111 de la Ley General de la Administración Pública, N° 6227 de 2\nde mayo de 1978; la Ley de Creación del Servicio de Parques Nacionales, N°\n6084, publicada en La Gaceta N° 169 del 7 de setiembre de 1977; la Ley\nde Conservación de la Vida Silvestre, N° 7317 publicada en La Gaceta N°\n235 del 7 de diciembre de 1992; la Ley Orgánica del Ambiente, N° 7554,\npublicada en La Gaceta N° 215 del 13 de noviembre de 1995; la Ley\nForestal, N° 7575, publicada en La Gaceta N° 72 del 16 de abril de 1996\ny la Ley de Biodiversidad, N° 7788, publicada en La Gaceta N° 101 del 27\nde mayo de 1998.\n\n Considerando:\n\nI.-Que el artículo 50 de la Constitución Política\nestablece que el Estado debe preservar y garantizar el derecho de los\nhabitantes del país a gozar de un ambiente sano y ecológicamente equilibrado,\nya que la acción que debe llevar adelante el Estado implica velar por la\nexistencia de condiciones que permitan el surgimiento de espacios\nambientalmente puros, obligación que ha sido reiterada por la jurisprudencia de\nla Sala Constitucional.\n\nII.-Que la Ley de Creación del Servicio de Parques\nNacionales, N° 6084, tiene como función el desarrollo y administración de las\nÁreas Silvestres Protegidas para la conservación del Patrimonio Natural del\nEstado.\n\nIII.-Que el artículo 2,\ninciso a) de la Ley Orgánica del Ambiente, N° 7554 establece que el ambiente es\npatrimonio común de todos los habitantes de la Nación, donde el Estado y los\nparticulares deben participar en su conservación y utilización sostenibles, ya\nque son de utilidad pública e interés social.\n\nIV.-Que el artículo 1 de la Ley Forestal, N° 7575,\nestableció como función esencial y prioritaria del Estado, velar por la\nconservación, protección y administración de los recursos naturales.\n\nV.-Que el artículo 22 de la Ley de Biodiversidad\ndispuso que el Sistema Nacional de Áreas de Conservación integraría las\ncompetencias en materia forestal, vida silvestre, áreas protegidas, con el fin\nde dictar políticas, planificar y ejecutar procesos dirigidos a lograr la\nsostenibilidad en el manejo de los recursos naturales de Costa Rica.\n\nVI.-Que el artículo 61 de la Ley de Biodiversidad,\nN° 7788 obliga al Estado a buscar los mecanismos financieros y operativos\nnecesarios para garantizar la operación e integridad de las Áreas Silvestres\nProtegidas así como el personal suficiente y debidamente acreditado para\nejecutar las acciones necesarias.\n\nVII.-Que el artículo 111 de\nla Ley General de la Administración Pública N° 6227 considera servidor público\na toda persona que presta servicios a la administración o a nombre y por cuenta\nde ésta, como parte de su organización en virtud de un acto válido y eficaz de\ninvestidura con entera independencia del carácter imperativo, representativo,\nremunerado, permanente o público de la actividad respectiva.\n\nVIII.-Que el Decreto Ejecutivo N° 26665-MINAE del\n04 de diciembre de 1997 denominado \"Reglamento para el Uso, Control y\nMantenimiento de Vehículos del MINAE\", tiene como finalidad regular el uso,\nmantenimiento y control de los vehículos oficiales pertenecientes a dicho\nMinisterio, además regula los deberes y las obligaciones de los funcionarios\nque los utilicen, para que su uso sea de manera racional y en estricta\nobservancia de las normas afines.\n\nIX.-Que el Estado a través del Ministerio de\nAmbiente, Energía y Telecomunicaciones (MINAET) y el Sistema Nacional de Áreas\nde Conservación (SINAC), ante las limitaciones presupuestarias y de personal\nhan celebrado convenios de cooperación con organizaciones no gubernamentales,\ncon el fin de que estas contraten personal a cargo de las mismas para que\nlaboren para las diferentes áreas de conservación, ejerciendo actividades para\nel manejo y la conservación del ambiente y desempeñando funciones de apoyo a\nlos funcionarios del SINAC. the Organic Environmental Law, No. 7554,\npublished in La Gaceta No. 215 of November 13, 1995; the Forest Law (Ley Forestal), No. 7575, published in La Gaceta No. 72 of April 16, 1996;\nand the Biodiversity Law, No. 7788, published in La Gaceta No. 101 of May 27,\n1998.\n\n Considering (Considerando):\n\nI.-That article 50 of the Political Constitution\nestablishes that the State must preserve and guarantee the right of the country's inhabitants to enjoy a healthy and ecologically balanced environment,\nsince the action that the State must carry out implies ensuring the\nexistence of conditions that allow for the emergence of environmentally pure\nspaces, an obligation that has been reiterated by the jurisprudence of the\nConstitutional Chamber (Sala Constitucional).\n\nII.-That the Law Creating the National Parks Service,\nNo. 6084, has the function of developing and administering the Protected Wilderness Areas (Áreas Silvestres Protegidas) for the conservation of the State's Natural Heritage.\n\nIII.-That article 2,\nsubsection a) of the Organic Environmental Law, No. 7554 establishes that the environment is the\ncommon heritage of all the inhabitants of the Nation, where the State and\nprivate individuals must participate in its conservation and sustainable use, as\nthey are of public utility and social interest.\n\nIV.-That article 1 of the Forest Law (Ley Forestal), No. 7575,\nestablished as an essential and priority function of the State, to ensure the\nconservation, protection, and administration of natural resources.\n\nV.-That article 22 of the Biodiversity Law\nprovided that the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) would integrate the\ncompetencies in forestry (materia forestal), wildlife (vida silvestre), and protected areas (áreas protegidas) matters, in order\nto dictate policies, plan, and execute processes aimed at achieving\nsustainability in the management of Costa Rica's natural resources.\n\nVI.-That article 61 of the Biodiversity Law,\nNo. 7788 obligates the State to seek the financial and operational mechanisms\nnecessary to guarantee the operation and integrity of the Protected Wilderness Areas (Áreas Silvestres Protegidas) as well as sufficient and duly accredited personnel to\nexecute the necessary actions.\n\nVII.-That article 111 of\nthe General Law of Public Administration No. 6227 considers a public servant (servidor público)\nany person who provides services to the administration or on behalf and for the account\nof it, as part of its organization by virtue of a valid and effective act of\ninvestiture, with complete independence from the imperative, representative,\nremunerated, permanent, or public nature of the respective activity.\n\nVIII.-That Executive Decree No. 26665-MINAE of\nDecember 4, 1997, called \"Regulation for the Use, Control, and\nMaintenance of Vehicles of MINAE\", has the purpose of regulating the use,\nmaintenance, and control of the official vehicles belonging to said\nMinistry, and also regulates the duties and obligations of the officials\nwho use them, so that their use is in a rational manner and in strict\nobservance of related norms.\n\nIX.-That the State, through the Ministry of\nEnvironment, Energy and Telecommunications (MINAET) and the National System of Conservation Areas (SINAC), given budgetary and personnel\nlimitations, have entered into cooperation agreements with non-governmental organizations,\nin order for these to hire personnel under their charge to\nwork for the different conservation areas (áreas de conservación), carrying out activities for\nthe management and conservation of the environment and performing support functions for\nthe officials of SINAC. Therefore (Por tanto),\n\n DECREE:\n\n \"TO AUTHORIZE THE NATIONAL SYSTEM OF CONSERVATION\nAREAS\n\n TO BE ABLE TO ACCREDIT SUPPORT PERSONNEL HIRED\n\n BY NON-GOVERNMENTAL ORGANIZATIONS IN ORDER FOR\n\n THESE TO WORK FOR THE DIFFERENT CONSERVATION\n\n AREAS, CARRYING OUT ACTIVITIES FOR THE\n\n MANAGEMENT AND CONSERVATION\n OF THE ENVIRONMENT AND\n\n PERFORMING SUPPORT FUNCTIONS AND\n\n MODIFICATION TO ARTICLE 20\n OF\n\n EXECUTIVE DECREE NO. 26665-MINAE\n\n OF DECEMBER 4, 1997\"\n\nArticle 1.-To authorize the National System of Conservation Areas of the\nMinistry of Environment, Energy and Telecommunications, to be able to accredit\nsupport personnel hired by non-governmental organizations, understood as\nthose organizations that have a cooperation agreement with SINAC for\nthe performance of management and conservation tasks for natural resources, derived\nfrom the applicability of the related and concordant laws in force.\n\nArticle 2.-The hiring of the personnel\nestablished in this decree shall be carried out through the non-governmental\norganizations, and the accreditation of the same shall be carried out before the National System of Conservation Areas (SINAC) at the request of the Directorate of the respective\nConservation Area (Área de Conservación).\n\nThe requirements for the accreditation of personnel shall be\nmade in accordance with the Manual of Specialties and Classes of the Ministry of\nEnvironment, Energy and Telecommunications.\n\nThe accreditation of personnel may be revoked at the\nrequest of the Director of the Conservation Area (Área de Conservación), through the\ncontracting organization, when they do not fulfill the functions assigned by the Administration.\n\nThe hiring and dismissal shall correspond\nonly to the contracting non-governmental organization.\n\nArticle 3.-The support personnel accredited under\nthis decree, regarding the performance of their functions,\nmust comply with the regulations in force and shall have the same obligations that\ngovern the regular officials of the Ministry of Environment, Energy and\nTelecommunications, with the exception of police authority (carácter de policía) which may only\nbe granted by Law.\n\nArticle 4.-Modify article 20 of Executive Decree\nNo. 26665-MINAE of December 4, 1997, so that henceforth it\nreads as follows:\n\n\"Persons authorized to drive vehicles: The following are authorized to\ndrive vehicles for administrative use of the Ministry: the servers who\noccupy a position of Mobile Equipment Operators, those other officials or\nservers authorized by the Oficialía Mayor or Administrative Directorate, the\nsupport personnel who are hired by non-governmental\norganizations, and the ad-honorem officials of MINAET, accredited through\nexecutive agreements; for which they will be provided with an identification card, and therefore\nthere will be an identification card for regular officials and another for those accredited\nas ad-honoren officials and those hired by non-governmental organizations.\nIn the case of discretionary-use vehicles, they may only be driven by\nthe person to whom it is assigned or by the official who is authorized by\nthe latter to do so.\"\n\nArticle 5.-It becomes effective upon its publication in the Official Gazette La\nGaceta.\n\nGiven at the Presidency of the\nRepublic.-San José, March first, two thousand eleven." }
