  "body_en_text": "throughout the entire text\n\n-\n\nFull Text of Regulation 164\n\nWhen compatibility problems arise between the Satellite Tracking and Monitoring System used by INCOPESCA and the system used by vessels wishing to obtain a tuna fishing license, the license may be granted when the shipowner certifies an alternative Satellite System.\n\nFull Text of minutes: DC456\n\nCosta Rican Institute of Fisheries and Aquaculture\n\nA.J.D.I.P./164-2011.-Puntarenas, on the sixth day of\nMay, 2011.\n\nConsidering\n\n1º-That the Executive President reports that, in accordance with Agreement AJDIP 230-2009 on satellite tracking, foreign-flagged tuna purse-seine vessels that require a fishing license to operate in Costa Rican jurisdictional waters are obliged to carry satellite tracking devices that allow the Monitoring Center to visualize and provide proper tracking of the fishing activities carried out in our exclusive economic zone.\n\n2º-That to date, effective tracking of this regulation has been carried out; however, technical compatibility problems have been arising between the satellite tracking system used by INCOPESCA and that of some vessels.\n\n3º-That, for its part, the provider of the satellite tracking system used not only by INCOPESCA but also in Central America has stated its inability to address the compatibility configuration of these other systems within a minimum period of three months.\n\n4º-That the Agreement adopted by INCOPESCA regarding Satellite Monitoring and Tracking establishes the obligation that the systems used by tuna vessels wishing to obtain a fishing license in our country must be compatible with the satellite tracking system used by INCOPESCA.\n\n5º-That the shipowners have indicated their willingness to provide alternative satellite tracking systems in order to comply with current regulations, especially since what is stated in considering clause 3° is not attributable to them.\n\n6º-That having analyzed the arguments presented and considering reasons of convenience, the Board of Directors, Therefore\n\nAGREES:\n\n1º-When compatibility problems arise between the Satellite Tracking and Monitoring System used by INCOPESCA and the system used by those vessels wishing to obtain a tuna fishing license, the license may be granted, provided that the shipowner can certify that they have an alternative Satellite Tracking System, duly verified by INCOPESCA, and that the necessary security codes allowing access to said system are provided to it.\n\n2º-The recognition of this Tracking System shall be granted on a one-time, temporary basis for a maximum period of 3 calendar months, during which time the shipowner or interested party, together with the Satellite Tracking System provider, must make the necessary adjustments to establish the corresponding compatibility with the system used by INCOPESCA.\n\n3º-Final Agreement.\n\n4º-Let it be published."
