ACUICULTURA\n\n            A.J.D.I.P./193-2011.-Puntarenas,\na los veintisiete días del mes de mayo de 2011.\n\n Considerando:\n\n            1º-Que\nde conformidad con las consideraciones vertidas por la Junta Directiva mediante\nAcuerdo AJDIP/191-2010 del 11 de junio de 2010; respecto a la facultad\ncompetencia, necesidad y oportunidad en cuanto a resguardar el derecho a un\nmayor bienestar de los habitantes de la República, en comunión con un justo y\nadecuado reparto de la riqueza; garantizando con ello además el derecho al\ntrabajo digno, honesto y útil para la sociedad, dentro de un ambiente sano y\necológicamente equilibrado; verbigracia ordinales 50 y 56 de nuestra Carta\nMagna.\n\n            2º-Que bajo esa visión ya la Junta\nDirectiva del INCOPESCA por medio del Acuerdo AJDIP/138-2008 del 04 de abril de\n2008, había establecido el \"Reglamento para el establecimiento de las Áreas\nMarinas para la Pesca Responsable\".\n\n            3º-Que por su parte el Código de Conducta para la Pesca Responsable de la FAO, Decreto\nEjecutivo Nº 27919-MAG reconoce en su artículo 6º, la importante contribución de la pesca artesanal\nen pequeña escala a la generación de empleo, ingresos y seguridad alimentaria. De ahí la necesidad\nde que el Estado garantice apropiadamente el derecho de los pescadores y pescadoras, adoptando\nmedidas de regulación que favorezcan el aprovechamiento de los recursos pesqueros en las aguas de\njurisdicción nacional.\n\n            4º-Que se cuenta con estudios\ncientíficos mediante los cuales se ha logrado demostrar que la regulación de\nlas artes y métodos de pesca, así como el esfuerzo pesquero en determinadas\náreas estratégicas, contribuyen al aumento de la biomasa y de las poblaciones\nde especies.\n\n            5º-Que las medidas señaladas en el\nconsiderando anterior, representan también una alternativa viable que\nposibilite la generación de beneficios económicos, sociales y ambientales para\nlas comunidades pesqueras y para los ecosistemas, de los que los pescadores\ndependen para la pesca.\n\n            6º-Que en ese giro el Poder\nEjecutivo mediante Decreto Ejecutivo Nº 35502-MAG, publicado en el Diario\nOficial La Gaceta N 191, del 1º de octubre del 2009, en su artículo 15,\ndeclara de interés público nacional el establecimiento de las Áreas Marinas\npara la Pesca Responsable.\n\n            7º-Que igualmente y a efecto de\ncontar ante todo con el concurso y asidero en la toma de decisiones de los\npescadores de las comunidades involucradas, la Presidencia Ejecutiva por medio\ndel oficio PESJ-33-1-2009 conforma el Grupo Interinstitucional para la\nelaboración del Plan de Ordenamiento Pesquero que establecerá las\ncaracterísticas y regulaciones particulares para el establecimiento y entrada\nen funcionamiento del Área Marina de Pesca Responsable de Tárcoles\n(AMPR-Tárcoles).\n\n8º-Que de conformidad con lo que establece el artículo 2º del \"Reglamento\npara el establecimiento de las Áreas Marinas Para la Pesca Responsable\", éste\nGrupo Interinstitucional de Trabajo se abocó a formular el Plan de Ordenamiento\nPesquero como requisito previo para aprobar el establecimiento del Área Marina\nPara la Pesca Responsable de Tárcoles.\n\n9º-Que en ese sentido se logró contar con la participación no solo del\nsector de pesca artesanal; sino con las Organizaciones de pescadores\ncamaroneros de arrastre, a fin de establecer de común acuerdo la Propuesta de\nPlan de Ordenamiento Pesquero del Área Marina de Pesca Responsable de Tárcoles.\n\n10.-Que el Grupo de Trabajo habiendo cumplido con las formalidades que\nestablece el Reglamento Nº 138-2008, presentó, en la sesión Nº 30-2011 de Junta\nDirectiva del INCOPESCA, celebrada el 27 de mayo de 2011, la \"Propuesta de Plan\nde Ordenamiento Pesquero para el establecimiento del Área Marina de Pesca\nResponsable de Tárcoles\".\n\n11.-Que asimismo la Dirección General Técnica del INCOPESCA ha avalado y\nrecomendado a la Junta Directiva la aprobación de la propuesta presentada de\nconformidad con el considerando anterior; Hence the need\nfor the State to appropriately guarantee the rights of fishers men and women, adopting\nregulatory measures that favor the utilization of fishery resources in waters under\nnational jurisdiction.\n\n            4º-That scientific studies are available through which it has been demonstrated that the regulation of\nfishing gear and methods, as well as fishing effort in certain\nstrategic areas, contribute to the increase of biomass and species\npopulations.\n\n            5º-That the measures indicated in the\nprevious consideration also represent a viable alternative that\nenables the generation of economic, social, and environmental benefits for\nfishing communities and for the ecosystems on which fishers\ndepend for fishing.\n\n            6º-That in this regard, the Executive\nBranch, through Executive Decree Nº 35502-MAG, published in the Official\nGazette La Gaceta Nº 191, of October 1, 2009, in its Article 15,\ndeclares the establishment of Áreas Marinas para la Pesca Responsable to be of national public interest.\n\n            7º-That likewise, and in order to have above all the participation and support in decision-making of the\nfishers from the communities involved, the Executive Presidency, through\nofficial communication PESJ-33-1-2009, formed the Inter-institutional Group for the\nelaboration of the Fisheries Management Plan (Plan de Ordenamiento Pesquero) that will establish the\nparticular characteristics and regulations for the establishment and start\nof operations of the Tárcoles Responsible Fishing Marine Area\n(AMPR-Tárcoles).\n\n8º-That in accordance with the provisions of Article 2 of the \"Reglamento\npara el establecimiento de las Áreas Marinas Para la Pesca Responsable\", this\nInter-institutional Working Group undertook to formulate the Fisheries Management Plan (Plan de Ordenamiento\nPesquero) as a prerequisite for approving the establishment of the Tárcoles Responsible Fishing Marine Area.\n\n9º-That in this sense, it was possible to secure the participation not only of the\nartisanal fishing sector, but also of the trawling shrimp fishers'\nOrganizations, in order to establish by mutual agreement the Proposed\nFisheries Management Plan (Plan de Ordenamiento Pesquero) for the Tárcoles Responsible Fishing Marine Area.\n\n10.-That the Working Group, having fulfilled the formalities\nestablished by Regulation Nº 138-2008, presented, at Session Nº 30-2011 of the Board\nof Directors of INCOPESCA, held on May 27, 2011, the \"Proposal for a Fisheries Management Plan (Plan de\nOrdenamiento Pesquero) for the establishment of the Tárcoles Responsible Fishing Marine Area.\"\n\n11.-That likewise, the General Technical Directorate of INCOPESCA has endorsed and\nrecommended to the Board of Directors the approval of the proposal presented, in\naccordance with the preceding consideration;
