  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 36773\n\n                        Declara de Utilidad Pública para los intereses del Estado la Asociación\nAdministradora del Acueducto y Alcantarillado Sanitario de Matapalo\n\nTexto Completo acta: 177059\n\nNº 36773-JP\n\n(Este\ndecreto ejecutivo fue dejado sin efecto por el artículo 1° del decreto\nejecutivo N° 45030 del 26 de febrero de 2025)\n\nLA PRESIDENTA DE LA\nREPÚBLICA\n\nY EL MINISTRO DE\nJUSTICIA Y PAZ\n\nCon fundamento en lo dispuesto en los artículos\n140, inciso 18) y 146 de la Constitución Política, en el artículo 32 de la Ley\nde Asociaciones y en los artículos 27 y siguientes de su Reglamento.\n\nConsiderando\n\nI.-Que el artículo 32 de la Ley de Asociaciones\nnúmero 218 del ocho de agosto de mil novecientos treinta y nueve y sus\nreformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad\nPública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y\nactividades sean particularmente útiles para los intereses del Estado, y que\npor ello contribuyan a solventar una necesidad social.\n\nII.-Que la Asociación\nAdministradora del Acueducto y Alcantarillado Sanitario de Matapalo, Distrito\nSavegre, Cantón de Aguirre, Provincia de Puntarenas, cédula de Persona Jurídica\nnúmero: 3-002-357597, se inscribió en el Registro de Asociaciones del Registro\nPúblico desde el día trece de enero del dos mil seis, bajo el expediente número\n15891, asiento 32.\n\nIII.-Que los fines que\npersigue la Asociación, según su acta constitutiva son los que se transcriben:\n\".Artículo Tercero \"los fines de la Asociación son los siguientes:\n\". A) Administrar, operar, dar mantenimiento, desarrollo y conservar en\nbuenas condiciones el acueducto, de conformidad con las disposiciones y\nreglamentos que al respecto emite el Instituto Costarricense de Acueductos y\nAlcantarillados que serán de acatamiento obligatorio. B) Obtener la\nparticipación efectiva de la comunidad, en la construcción, operación,\nmantenimiento y desarrollo del acueducto. C) Obtener la participación efectiva\nde la comunidad en la construcción y mantenimiento del acueducto. D)\nColaboración en los programas y campañas de índole educativo que se emprendan.\nE) Ayudar a explicar y divulgar las disposiciones y reglamentos del Instituto\nCostarricense de Acueductos y Alcantarillados. F) Cooperar con los planes,\nproyectos y obras que emprenda el Instituto Costarricense de Acueductos y\nAlcantarillados. G) Participar en asuntos relativos a la administración,\nconservación y explotación racional de las aguas; control de su contaminación o\nalteración, definición de medidas y acciones necesarias para la protección de\nlas cuencas hidrográficas y estabilidad ecológica. H) Velar porque todos los\nsistemas, sus instalaciones acueductos o alcantarillados sanitario, cumplan los\nprincipios básicos del servicio público, tanto en calidad, cantidad, cobertura,\neficiencia, racionalización de gastos, etc. I) Otorgar los servicios públicos,\nen forma eficiente, igualitaria y oportuna a todos sus usuarios, sin\ndistinciones de ninguna naturaleza\".\n\nIV.-Que tales fines\nsolventan una necesidad social de primer orden, por lo cual merecen el apoyo\ndel Estado Costarricense. Por tanto,\n\nDECRETAN:\n\nArtículo 1º-Declárese de Utilidad Pública para los\nintereses del Estado la Asociación Administradora del Acueducto y\nAlcantarillado Sanitario de Matapalo, Distrito Savegre, Cantón de Aguirre, Provincia\nde Puntarenas, cédula de Persona Jurídica número: 3-002-357597.\n\nArtículo 2º-Es deber de la\nAsociación rendir anualmente un informe ante el Ministerio de Justicia y Paz,\nde conformidad con lo indicado en el artículo 32 del Reglamento a la Ley de\nAsociaciones.\n\nArtículo 3º-Una vez\npublicado este Decreto los interesados deberán protocolizar y presentar el\nrespectivo testimonio ante el Registro de Asociaciones del Registro Nacional,\npara su respectiva inscripción.\n\nArtículo 4º-Rige a partir\nde su publicación.\n\nDado en la Presidencia de la República.-San José, a\nlas once horas cincuenta minutos del cuatro de agosto del dos mil once.",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 36773\n\n                        Declares of Public Utility for the interests of the State the Administrative\nAssociation of the Matapalo Aqueduct and Sanitary Sewer System\n\nFull Text of record: 177059\n\nNo. 36773-JP\n\n(This\nexecutive decree was rendered without effect by article 1 of executive\ndecree No. 45030 of February 26, 2025)\n\nTHE PRESIDENT OF THE\nREPUBLIC\n\nAND THE MINISTER OF\nJUSTICE AND PEACE\n\nBased on the provisions of articles\n140, subsection 18) and 146 of the Political Constitution, on article 32 of the Law\nof Associations and on articles 27 and following of its Regulation.\n\nConsidering\n\nI.-That article 32 of the Law of Associations\nnumber 218 of August eight, nineteen hundred thirty-nine and its\namendments, confers upon the Executive Branch the power to declare of Public\nUtility simple, federated or confederated Associations, whose development and\nactivities are particularly useful for the interests of the State, and which\nthereby contribute to addressing a social need.\n\nII.-That the Administrative\nAssociation of the Matapalo Aqueduct and Sanitary Sewer System, Savegre\nDistrict, Aguirre Canton, Puntarenas Province, legal entity identification\nnumber: 3-002-357597, was registered in the Associations Registry of the Public\nRegistry since January thirteen, two thousand six, under case file number\n15891, entry 32.\n\nIII.-That the purposes pursued\nby the Association, according to its articles of incorporation, are transcribed as follows:\n\".Article Three \"the purposes of the Association are the following:\n\". A) Manage, operate, maintain, develop and keep in\ngood condition the aqueduct, in accordance with the provisions and\nregulations issued in this regard by the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados), which shall be of mandatory compliance. B) Secure the\neffective participation of the community in the construction, operation,\nmaintenance and development of the aqueduct. C) Secure the effective participation\nof the community in the construction and maintenance of the aqueduct. D)\nCollaboration in educational programs and campaigns that are undertaken.\nE) Help to explain and disseminate the provisions and regulations of the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados). F) Cooperate with the plans,\nprojects and works undertaken by the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados). G) Participate in matters relating to the management,\nconservation and rational exploitation of waters; control of their contamination or\nalteration, definition of measures and actions necessary for the protection of\nhydrographic basins and ecological stability. H) Ensure that all\nsystems, their aqueduct or sanitary sewer installations, comply with the\nbasic principles of public service, in terms of quality, quantity, coverage,\nefficiency, cost rationalization, etc. I) Provide public services,\nin an efficient, equal and timely manner to all its users, without\ndistinctions of any nature\".\n\nIV.-That such purposes\naddress a social need of the highest order, for which they deserve the support\nof the Costa Rican State. Therefore,\n\nTHEY DECREE:\n\nArticle 1º-Declare of Public Utility for the\ninterests of the State the Administrative Association of the Matapalo Aqueduct and\nSanitary Sewer System, Savegre District, Aguirre Canton, Puntarenas\nProvince, legal entity identification number: 3-002-357597.\n\nArticle 2º-It is the duty of the\nAssociation to annually render a report before the Ministry of Justice and Peace,\nin accordance with the provisions of article 32 of the Regulation to the Law of\nAssociations.\n\nArticle 3º-Once\nthis Decree is published, the interested parties must formalize and present the\nrespective certified copy before the Associations Registry of the National Registry,\nfor its respective registration.\n\nArticle 4º-It shall take effect as of\nits publication.\n\nDone at the Presidency of the Republic.-San José, at\neleven hours fifty minutes on August fourth, two thousand eleven."
