ordinaria Nº\n118-2011, celebrada el lunes 10 de octubre del 2011, aprobó por unanimidad y en\nfirme el siguiente reglamento:\n\n    REGLAMENTO DE TENENCIA Y MANEJO RESPONSABLE\n\n    DE MASCOTAS O ANIMALES DOMÉSTICOS DEL\n\n    CANTÓN DE SAN RAFAEL DE HEREDIA\n\nArtículo 1º-E1 presente Reglamento es de orden social e interés general y\ntiene por objeto regular lo concerniente a la limpieza y tratamiento de los\ndesechos fecales producidos por los animales domésticos en la vía pública.\n\nArtículo 2º-La limpieza y adecuado tratamiento de\nlos desechos fecales producidos por los animales en la vía pública es\nconsiderada de prioridad sanitaria y de responsabilidad exclusiva del\npropietario del animal doméstico.\n\nArtículo 3º-Definiciones: Desechos fecales:\nEl material generado por los animales domésticos en el proceso de evacuación\nnatural de los alimentos.\n\nÁreas comunes o áreas públicas: Son los espacios de\nconvivencia y uso general de los vecinos del cantón de San Rafael de Heredia,\nconocidas como área públicas.\n\nRecipientes o dispositivos de desecho: Son los lugares de\ndepósito colocados y autorizados por la Municipalidad para el desecho de los residuos fecales.Estos\nlugares estarán claramente delimitados por las autoridades municipales en\nsitios estratégicos del cantón.\n\nMateriales necesarios: Se consideran todos\naquellos medios tales como palas, bolsas plásticas, papel periódico, escobas y\ncualquier otro tipo de instrumento que permita recoger de manera correcta los\ndesechos fecales de los animales domésticos.\n\nArtículo 4º-Los propietarios de animales domésticos estarán obligados a\nrecoger y limpiar los desechos fecales que arrojen sus animales en las vías\npúblicas y áreas comunes.\n\nArtículo 5º-Los propietarios o encargados de\nanimales o de cualquier sitio o local que se encargue de animales, están en la\nobligación de cumplir el presente Reglamento, estando obligados a transportar\nlos desechos fecales producidos por sus mascotas a los depósitos señalados\npreviamente para ello.\n\nArtículo 6º-Los propietarios de animales domésticos\nestán en la obligación de que una vez muerta su mascota deberán recogerla y\nsepultarla a una profundidad considerable con el fin de evitar malos olores y\npeligro a la salud pública, bajo ninguna circunstancia las mascotas deberán\ndescomponerse en la vía pública o podrán ser arrojadas por sus dueños a esta\nuna vez fallecidos.\n\nArtículo 7º-Queda terminantemente prohibido:\n\ni.-         Arrojar o abandonar en la vía pública, áreas comunes o\nfacilidades comunales y en general en sitios no autorizados por el presente\nReglamento, animales muertos o en período de descomposición y desechos fecales.\n\nii.-        Permitir\nque las mascotas realicen sus necesidades en sitios en los cuales no existan\ndispositivos o recipientes de desecho.\n\niii.-        Pasear\na la mascota por la vía pública sin contar con los instrumentos necesarios que\nse indican en el presente Reglamento.\n\nArtículo 8º-En caso de transgresión a algún deber por parte de los\npropietarios o cuidadores, la Administración Municipal podrá, a manera de\nprevención y por escrito, amonestar al infractor y apercibirlo de su obligación\ndel cumplimiento de sus obligaciones.\n\nEn el acto se le podrá dar copia del presente\nReglamento.\n\nLos incumplimientos o infracciones al presente\nReglamento darán facultad a cualquier interesado, munícipe del cantón de San\nRafael de Heredia, o empleado municipal para denunciar ante el Ministerio de\nSalud la infracción aducida, la cual, de conformidad con sus competencias podrá\nemitir una orden sanitaria según la gravedad de la falta\n\nSi el propietario del animal doméstico es\nreincidente en la violación al presente Reglamento, por dos o más veces, queda\nexpedita la vía para la denuncia por cualquier interesado ante el Ministerio de\nSalud, conforme el párrafo anterior, el cual además de emitir órdenes\nsanitarias, podrá dentro de sus facultades decomisar el animal.\n\nArtículo 9º-Cuando se proceda al decomiso de\nanimales, los mismos serán entregados a protectoras, veterinarias u otros\nsectores sociales para su respectiva adopción.\n\nArtículo 10.-En cualquier procedimiento de denuncia\no amonestación deberá respetarse el derecho de defensa y debido proceso del\npropietario del animal, teniendo este amplia facultad para ofrecer pruebas,\nrealizar alegaciones y recurrir las actuaciones y/o amonestaciones que se le\nhayan realizado.\n\nDisposición transitoria\n\nÚnica-La   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Regulation 118\n\n                        Regulation for the responsible ownership and management of pets or domestic\nanimals of the canton of San Rafael de Heredia\n\nComplete Text act: DF614\n\nMUNICIPALITY\nOF SAN RAFAEL DE HEREDIA\n\nThe Municipal Council of San Rafael de Heredia, in ordinary session No.\n118-2011, held on Monday, October 10, 2011, unanimously and definitively\napproved the following regulation:\n\n    REGULATION FOR THE RESPONSIBLE OWNERSHIP AND MANAGEMENT\n\n    OF PETS OR DOMESTIC ANIMALS OF THE\n\n    CANTON OF SAN RAFAEL DE HEREDIA\n\nArticle 1.-This Regulation is of social order and general interest and\nhas the purpose of regulating matters concerning the cleaning and treatment of\nfecal waste (desechos fecales) produced by domestic animals on public thoroughfares.\n\nArticle 2.-The cleaning and adequate treatment of\nfecal waste produced by animals on public thoroughfares is considered a sanitary priority and the exclusive responsibility of the\nowner of the domestic animal.\n\nArticle 3.-Definitions: Fecal waste:\nThe material generated by domestic animals in the process of natural\nevacuation of food.\n\nCommon areas or public areas: They are the spaces for\ncoexistence and general use of the residents of the canton of San Rafael de Heredia,\nknown as public areas.\n\nWaste containers or devices: They are the deposit sites\nplaced and authorized by the Municipality for the disposal of fecal waste. These\nsites will be clearly demarcated by the municipal authorities in\nstrategic locations of the canton.\n\nNecessary materials: All\nthose means are considered such as shovels, plastic bags, newspaper, brooms, and\nany other type of instrument that allows for the correct collection of\nfecal waste from domestic animals.\n\nArticle 4.-The owners of domestic animals shall be obligated to\ncollect and clean the fecal waste that their animals deposit on public\nthoroughfares and common areas.\n\nArticle 5.-The owners or caretakers of\nanimals or of any site or premises that looks after animals are\nobligated to comply with this Regulation, being obligated to transport\nthe fecal waste produced by their pets to the deposits previously\ndesignated for that purpose.\n\nArticle 6.-The owners of domestic animals\nare obligated, once their pet has died, to collect it and\nbury it at a considerable depth in order to avoid foul odors and\ndanger to public health; under no circumstances shall pets\ndecompose on public thoroughfares or may they be thrown by their owners onto these\nonce deceased.\n\nArticle 7.-The following is strictly prohibited:\n\ni.-         Throwing or abandoning dead animals or animals in a period of decomposition and fecal waste on public thoroughfares, common areas, or\ncommunity facilities, and in general in sites not authorized by this\nRegulation.\n\nii.-        Allowing\npets to relieve themselves in sites where no\nwaste devices or containers exist.\n\niii.-        Walking\na pet on public thoroughfares without carrying the necessary instruments\nindicated in this Regulation.\n\nArticle 8.-In case of transgression of any duty by the\nowners or caretakers, the Municipal Administration may, as a\npreventative measure and in writing, admonish the offender and warn them of their obligation\nto comply with their duties.\n\nAt that time, they may be given a copy of this\nRegulation.\n\nNon-compliance or infractions of this\nRegulation shall empower any interested party, resident of the canton of San\nRafael de Heredia, or municipal employee to report the alleged infraction before the Ministry of\nHealth, which, in accordance with its powers, may\nissue a sanitary order depending on the severity of the offense.\n\nIf the owner of the domestic animal is a\nrepeat violator of this Regulation, on two or more occasions, the\navenue is left open for a complaint by any interested party before the Ministry of\nHealth, pursuant to the preceding paragraph, which, in addition to issuing sanitary\norders, may, within its powers, confiscate (decomisar) the animal.\n\nArticle 9.-When the confiscation of\nanimals proceeds, they shall be delivered to shelters, veterinary clinics, or other\nsocial sectors for their respective adoption.\n\nArticle 10.-In any reporting or\nadmonishment procedure, the right of defense and due process of the\nowner of the animal must be respected, with the latter having broad power to offer evidence,\nmake allegations, and appeal the actions and/or admonishments that have\nbeen taken against them.\n\nTransitory provision\n\nSingle.-The Municipal\n Administration shall have a non-extendable period of two months\nfor the implementation and start-up of the provisions contained in this\nRegulation.\n\nSan Rafael de Heredia, October 26, 2011.-"
