La oficialización de este Reglamento Técnico, conlleva la\naprobación por el Consejo de Ministros de Integración Económica (COMIECO).\n\nMIEMBROS\nPARTICIPANTES DEL SUBGRUPO\n\nPor Guatemala\n\nÁrea Fitozoogénetica de la\nUnidad de Normas y Regulaciones\n\nPor El Salvador\n\nÁrea de Certificación de\nSemillas\n\nPor Nicaragua\n\nDepartamento de Semillas\n\nPor Honduras\n\nDepartamento de Certificación de Semillas\n\nPor Costa Rica\n\nOficina Nacional de Semillas\n\n1.  OBJETO\n\nEstablecer los requisitos\nque deben cumplirse a efectos de inscribir una variedad vegetal en el\nregistro de variedades comerciales, de modo que se faculte la\ncomercialización de su semilla.El registro comercial de una variedad no otorga\nninguna exclusividad en la explotación de la misma al registrante.\n\n2.  ÁMBITO DE\nAPLICACIÓN\n\nAplica a las variedades\nvegetales de todos los cultivos que se destinen a la comercialización en\nestos países.\n\nLos estados partes podrán\nestablecer excepciones para especies vegetales, según sus\nparticularidades, siempre que la excepción implique una disminución de\nrequisitos, ya sea en cuanto a validación, descripción varietal, o ambos.\n\n3.  DEFINICIONES\n\n3.1  Descripción\nvarietal: detalle de las características fenotípicas y genotípicas que\nidentifican a una variedad vegetal y que permiten su distinción de otras\nvariedades.\n\n3.2  Ensayo de validación: prueba que se\nrealiza de una variedad, mediante su siembra en campo o invernadero, en el\ncual se evalúan sus características y comportamiento bajo determinadas\ncondiciones de ambiente y manejo agronómico.\n\n3.3  Variedad: conjunto de plantas o\nindividuos cultivados que se distinguen por uno o más Caracteres\nmorfológicos, fisiológicos, citológicos, químicos u otros de carácter\nagrícola o industrial y que al ser reproducidos mantienen sus\ncaracterísticas distintivas de uniformidad y estabilidad.\n\n3.4  Registro: proceso técnico administrativo\nmediante el cual toda solicitud de registro de una variedad comercial es\nevaluada por la autoridad nacional competente.\n\n3.5  Registro de variedades comerciales: son\nlos expedientes de las variedades inscritas que cumplen con los requisitos\ngenerales de este RTCA para su comercialización.\n\n4.  ENTE NACIONAL\nCOMPETENTE Corresponde la vigilancia y verificación de la aplicación\ny cumplimiento del presente Reglamento Técnico Centroamericano a Área\nFitozoogénetica de la Unidad de Normas y Regulaciones del Ministerio de\nAgricultura, Ganadería y Alimentación de Guatemala; Área de Certificación\nde Semillas de la Dirección General de Sanidad Vegetal y Animal, del\nMinisterio de Agricultura y Ganadería de El Salvador; Departamento de\nCertificación de Semillas del Servicio Nacional de Sanidad Agropecuaria,\nMinisterio de Agricultura y Ganadería de Honduras; a Departamento de\nSemillas de la Dirección General de Protección y Sanidad Agropecuaria, del\nMinisterio Agropecuario y Forestal de Nicaragua y, a la Oficina Nacional\nde Semillas de Costa Rica, o sus sucesores o entidades que en el\nfuturo se les asigne específicamente estas funciones.\n\n5.  REQUISITOS\nGENERALES Los requisitos para la inscripción en el registro de\nvariedades comerciales son:\n\n5.1  Presentación de\nla descripción varietal,\n\n5.2  Denominación de\nla variedad.\n\n5.3  Resultados de al menos un ciclo de\nensayos de validación, que podrán ser realizados tanto por programas\nregionales de investigación reconocidos, por entes públicos o empresa\nprivada autorizada por el ente nacional competente.\n\n5.4  Los ensayos de validación deberán ser\nrealizados en tres localidades como mínimo, en las zonas y épocas de mayor\nproducción comercial del cultivo. La nueva variedad deberá demostrar ser\nigual o superior al testigo nacional en rendimiento, o bien en\ncualquier otro atributo de tipo agronómico, industrial, nutricional u otra característica\nde interés particular.\n\n5.5  Las variedades deberán inscribirse\ninicialmente en el país donde fueron desarrolladas.\n\n6.  DISPOSICIONES GENERALES\n\n6.1  La descripción varietal se realizará de\nacuerdo a los formatos aprobados (en aquellas especies en que existan\nformatos consensuados). Para otras especies se procederá según se defina\nen los procedimientos correspondientes en los países centroamericanos.\n\n6.2  Para la inscripción en el registro de\nvariedades comerciales, se utilizarán los formatos aprobados en los países\ncentroamericanos, los que se anexan para este efecto.La vigencia para el\nRegistro de Variedades Comerciales será de cinco (5) años para cultivos\nanuales y semiperennes y diez (10) años para cultivos perennes los cuales\nserán contados a partir de la fecha de aprobación de la solicitud. The officialization of this Technical Regulation entails its approval by the Council of Ministers of Economic Integration (COMIECO).\n\nPARTICIPATING MEMBERS OF THE SUBGROUP\n\nFor Guatemala\nPhytozoogenetic Area of the Standards and Regulations Unit\n\nFor El Salvador\nSeed Certification Area\n\nFor Nicaragua\nSeed Department\n\nFor Honduras\nSeed Certification Department\n\nFor Costa Rica\nNational Seed Office\n\n1. OBJECTIVE\n\nTo establish the requirements that must be met in order to register a plant variety in the commercial varieties register, thereby authorizing the marketing of its seed. The commercial registration of a variety does not grant any exclusivity in its exploitation to the registrant.\n\n2. SCOPE OF APPLICATION\n\nApplies to plant varieties of all crops intended for marketing in these countries.\n\nThe State Parties may establish exceptions for plant species, according to their particularities, provided that the exception implies a reduction of requirements, whether in terms of validation (validación), varietal description (descripción varietal), or both.\n\n3. DEFINITIONS\n\n3.1 Varietal description (descripción varietal): detail of the phenotypic and genotypic characteristics that identify a plant variety and allow its distinction from other varieties.\n\n3.2 Validation trial (ensayo de validación): test carried out on a variety, by planting it in the field or greenhouse, in which its characteristics and performance are evaluated under certain environmental conditions and agronomic management.\n\n3.3 Variety (variedad): a set of cultivated plants or individuals that are distinguished by one or more morphological, physiological, cytological, chemical, or other characters of agricultural or industrial significance, and which, when reproduced, maintain their distinctive characteristics of uniformity and stability.\n\n3.4 Registration (registro): administrative technical process through which every application for registration of a commercial variety is evaluated by the competent national authority.\n\n3.5 Commercial varieties register (registro de variedades comerciales): the files of the registered varieties that meet the general requirements of this RTCA for their marketing.\n\n4. COMPETENT NATIONAL ENTITY\n\nThe surveillance and verification of the application and compliance with this Central American Technical Regulation corresponds to the Phytozoogenetic Area of the Standards and Regulations Unit of the Ministry of Agriculture, Livestock and Food of Guatemala; the Seed Certification Area of the General Directorate of Plant and Animal Health, of the Ministry of Agriculture and Livestock of El Salvador; the Seed Certification Department of the National Agricultural Health Service, Ministry of Agriculture and Livestock of Honduras; the Seed Department of the General Directorate of Agricultural Protection and Health, of the Ministry of Agriculture and Forestry of Nicaragua; and the National Seed Office of Costa Rica, or their successors or entities that in the future are specifically assigned these functions.\n\n5. GENERAL REQUIREMENTS\n\nThe requirements for registration in the commercial varieties register are:\n\n5.1 Submission of the varietal description (descripción varietal),\n5.2 Denomination of the variety.\n5.3 Results of at least one cycle of validation trials (ensayos de validación), which may be conducted by recognized regional research programs, by public entities, or private companies authorized by the competent national entity.\n5.4 The validation trials (ensayos de validación) must be conducted in at least three locations, in the zones and seasons of greatest commercial production for the crop. The new variety must demonstrate being equal to or superior to the national check in yield, or in any other attribute of agronomic, industrial, nutritional type, or other characteristic of particular interest.\n5.5 Varieties must initially be registered in the country where they were developed.\n\n6. GENERAL PROVISIONS\n\n6.1 The varietal description (descripción varietal) will be carried out according to the approved formats (for those species where consensus-based formats exist). For other species, the procedure will be as defined in the corresponding procedures in the Central American countries.\n\n6.2 For registration in the commercial varieties register (registro de variedades comerciales), the formats approved in the Central American countries will be used, which are annexed for this purpose. The validity of the Commercial Variety Registration will be five (5) years for annual and semi-perennial crops and ten (10) years for perennial crops, counted from the date of approval of the application. Once this period has expired, at the request of the interested party, the registration may be renewed for an additional period. Countries will have the authority to remove a variety from the register (registro), in highly qualified cases due to adaptability problems or severe susceptibility to pests of economic importance, for which the corresponding technical support must be presented.\n\n6.3 The application for registration in the register of national commercial varieties or those from third countries may be processed by the owner of the cultivar and/or the breeder, their legal representative in the country where the application is processed, the rights holder, the authorized national distributor, or a public or private research institution.\n\n6.4 Regarding varietal descriptors (descriptores varietales) not included for other species in the annexes, each country will develop the corresponding varietal descriptor, which may be adopted by the other State Parties, after prior consultation.\n\n6.5 The genealogical information related to the progenitors may be of a private nature provided that the company demonstrates the reason why it must be confidential.\n\n7. UPDATING AND REVISION OF THE REGULATION\n\nThis Technical Regulation will be reviewed and updated upon a duly justified request from any State Party.\n\n8.
